Human rights and making amends

The Human Rights Victims Reparation and Recognition Act of 2013 (RA 10368) has been in limbo for nearly a year until President Aquino appointed early this month the nine members of the Human Rights Victims Claims Board the independent body that the law created to process and approve claims against a P10-billion fund earmarked for distribution to martial law victims of human rights violations.

The Board has 30 days to organize itself and another 30 days to come out with approved implementing rules and regulations. Barring any hitches, this should start the process of reparation.

Not all human rights victims under martial law welcomed the idea of filing a class action lawsuit against Ferdinand Marcos when it was raised in 1986 or thereabout. Some resented the implication of assigning money value to a fight that they put up in pursuit of a principle. Money, they thought, debased it. Particularly repelling to them was the vision of the victims negotiating with the Marcoses for settlement on the issue of wealth that was plundered from the people. It was blood money: would they lend a hand and their names in cleaning it?

More than 9,500 victims joined the class suit anyway, most of them reportedly coming from the rural poor, apparently too poor to invoke a non-pecuniary principle, without necessarily disdaining it.

Going by its word origin, reparation includes repairing, setting right, making amends, and also restoring to good condition. It appeals to me because it intrinsically acknowledges that a harm (damage) is done or a wrong (crime) is committed, which entitles the victim to any or all forms of reparation provided by law, including monetary compensation.

Our first collective encounter with the concept (as reparations, plural) was after the Second World War when Japan, as loser, made amends to the Filipino people for bringing war into their homeland, with all its inherent evil. The victim of the internationally wrongful acts was the state, subsuming the people. Our word in this sense stood the same as war indemnities which in fact was the currency until the end of World War I.

In the sense that RA 10368 uses it, the focus shifts to individuals rights as a subject in international law to pursue violations of human rights. Our term in this manner has evolved only recently from a series of international instruments on human rights, beginning post-World War II with the Universal Declaration of Human Rights.

The evolution started with a broad and sweeping call for states to ensure that any person whose rights are violated shall have an effective remedy.

A more detailed mention of a remedy appeared only recently in the Rome Statute of the International Court of Justice (entered into force on 1 July 2002), as contained in one exclusive Article providing for reparations to victims, including restitution, compensation, and rehabilitation.

Three years later, the UN General Assembly would adopt (in 16 December 2005) Resolution 60/147, titled, Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law. The Resolution now stands as the key document in defining rights, remedies and reparation in international human rights.

The Canadian Museum for Human Rights is weathering a censorship allegation after deleting a blog post it commissioned from a Tyrell medal-winning Canadian historian.

To coincide with International Womens Day, the Winnipeg-based museum asked Veronica Strong-Boag, a historian specializing in the history of women and children in Canada, to pen a blog post in her area of expertise.

The post appeared on March 4, but was removed hours later after museum staff deemed a passage criticizing the federal Conservative government unacceptable.

The passage in question described the Conservatives as having an "anti-woman record." She said museum staff first asked her to back up that claim, but ultimately rejected a footnoted posting as a partisan statement.

Faunda named St.?C. post commander

ST. CLAIRSVILLE - Lt. James Faunda, who grew up in Eastern Ohio, has been named as commander of the St. Clairsville Post of the Ohio State Highway Patrol. The position opened after Lt. Jeff LaRoche retired in February.

Recently promoted from sergeant to lieutenant, Faunda has been with the state patrol since 1993 and was transferred to the St. Clairsville Post in 2011. Despite being on the promotion list for several years, he indicated that he was surprised by his recent promotion.

"The thing I like about this promotion, I graduated from River High School (in Hannibal) in 1989 and I grew up in Monroe County," said Faunda. "I am familiar with the area. Basically, I am back home. So the fact that I was able to get promoted to the St. Clairsville Post is actually a blessing."

Becoming a law enforcement officer is something that Faunda always wanted to do. He went into the State Patrol Academy after attending the University of Alabama and Belmont Technical College.

"The Ohio State Highway Patrol had one of the best reputations in law enforcement for professionalism," said Faunda. "It's been a very fulfilling career. Just like anything else, it has its up and downs. We don't like going to people's homes and telling them that their family member has been killed in a crash, but we do get a feeling of satisfaction when we remove an impaired driver from the roadway, when we arrest people that are dealing drugs and even beyond that one of our big focal points is service to the public."

In 21 years as a trooper, Faunda has been transferred to several different posts throughout the state of Ohio. He was first assigned to the Milan Post and it was there, he was selected as "Post Trooper of the Year" in 1997. He then was transferred to the Norwalk Post in 1999, where he was selected as "Post Trooper of the Year" in 2001.

Faunda was promoted to sergeant in 2002 and was transferred to the Bowling Green Post. At the Bowling Green Post, he served as assistant post commander. As a sergeant, he served at the Norwalk Post, Bucyrus District Criminal Patrol, Mansfield Dispatch Center and the Steubenville Post.

Faunda said one of the things that impressed him most about the St. Clairsville Post is the working relationships and communications with local law enforcement agencies, and he plans for this to continue. "The thing that impressed me when I came back home is how well the post and all the agencies in Belmont County worked together," Faunda said. "We have a great working relationship with the sheriff's office and all the police departments in Belmont County, and we also have a great relationship with the Monroe County Sheriff's Office in Woodsfield and the Woodsfield Police Department."

He thinks that this is an important because all of these agencies have the same job, which is to remove criminals from our highways, cities and towns.

"If all the agencies don't work together, then that just makes that job that much harder," Faunda said. "We are very fortunate in this area."

Brenda Picard welcomes Human Rights post

Brenda Picard has tallied an impressive volunteer record over the years working with many provincial and national organizations relating to family violence prevention, restorative justice and conflict resolution.

Brenda Picard decided way back in Grade 8 she wanted to go to law school one day.

The appeal of the profession, concedes the relatively new executive director of the P.E.I. Human Rights Commission and former long-time legal aid lawyer, was nothing terribly noble at the time.

Looking back, the 51-year-old Mount Stewart resident believes her interest in becoming a lawyer was simply sparked by all the crime shows she had been watching on television at the time while growing up in Kensington.

She went on to enter law school with no specific area of the field in mind in which she might like to pursue. She would. though, eventually get a good diverse taste of the legal profession after receiving her bachelor of laws degree in 1985 from Dalhousie University.

Picard first worked in public legal education, updating and revising material during a short-term contract.

The education component would be a consistent one in her career while her jobs would vary in interesting fashion over the ensuing years.

I always had an interest in being able to share the knowledge and communicate and teach people...to be able to help people in understanding what their options were, says Picard.

Racial Fantastic Four Backlash: Michael B. Jordan Comments [VIDEO]

The Human Torch is a young, cocky, and charismatic superhero who can turn his whole body into flames. Actor Michael B. Jordan is young and can play cocky and charismatic with the best of them. So why are some people so mad director Josh Trankcast him in the 2015 reboot of Fantastic Four? Simply put, in the comics the Human Torch is white and Michael B. Jordan is black. Some fans dont want a black Human Torch.

Since the rumors of Jordans casting began, his race has been a major topic of discussion. While the actor has commented briefly in the past, that was before hed officially been announcedfor the role.That announcement has now taken place and, below, you can watch and listen to him talking about the controversy.

It was expected. You kinda know going into it that people are used to seeing something one way, its a continuity thing more than anything. People dont like change too much. But annoyed? Im going to do my job the best I can and the way Ive been doing it my entire life, my entire career. I grew up a comic book guy, I read comic books as a kid growing up, and the Fantastic Four/Human Torch is one of my favorite characters so Im going to give it my everything. I cant wait. I dont really let it bother me at all. I just want to go into it and do the best job I can. Well see what happens.

Good for Jordan that hes taking the high road here. He shouldnt have to defend who he is or why he was chosen. Whats more important? That an actor is perfect for the part of looks perfect in the part? A black Human Torch is going to be awesome.

Human rights commissioner defends House Speaker Laura Boldrini

(ANSA) - Strasbourg, March 6 - The Council of Europe's Human Rights Commissioner Nils Muiznieks on Thursday defined as "clearly mosogynistic" an online post by 5-Star Movement (M5S) head Beppe Grillo criticising the Speaker of Italy's lower chamber of parliament, recalling how Laura Boldrini has been the target of repeated hate speech since being sworn in. "In Italy, the House Speaker, Laura Boldrini, has been the target of repeated hate speech since she was sworn in, including recently when the leader of the 5-Star Movement, a political group which obtained a quarter of the votes in last year's legislative elections, published a clearly misogynistic post on his blog, which was picked up by his social media account and those used by his MPs, and which generated violent, insulting comments against her," wrote Muiznieks in a message ahead of International Women's Day on March 8. The post in question, containing a video with the title "What would you do alone in a car with Boldrini?", which showed a man driving and talking to a cut-out of her, came after the House Speaker took the unprecedented decision to stop a filibuster by members of the M5S to prevent a controversial government decree from being converted into law by using the so-called "guillotine" power to interrupt parliamentary discussions in order to speed up voting. Boldrini has also been the target of threats and insults from the anti-immigration Northern League since taking office in March 2013. The former spokeswoman for the UN refugee agency has made no secret of wanting to use her position to promote women's issues and gender equality. However in a recent interview to the weekly Observer newspaper she admitted that the criticism was "unbelievable" and "hard".
