The Supreme Court should invalidate the patent on human DNA

Jeffrey Rosenfeld is an assistant professor of medicine at the New Jersey Medical School and a member of the High Performance and Research Computing Group. Christopher E. Mason is an assistant professor of computational genomics at Weill Cornell Medical College and affiliate fellow of the information society project of Yale Law School.
Asked in 1955 whether his polio vaccine was patented, Jonas Salk replied, There is no patent. Could you patent the sun? With that, Salk debunked the misguided notion of patenting objects found in nature. His polio vaccine was not a new invention but an inactive form of the natural polio virus.
Today, Salk would be shocked to find that your DNA belongs not to you but rather to many companies and institutions that have patents on the DNA from your cells.Forty-one percent of the genes in your genome are not legally yours, according to a long list of gene patents that have been granted since the 1980s. These patents cover thousands of human genes and restrict a doctors ability to look at your DNA and plan your medical treatment.These patent claims contradict an intuitive sense that your DNA is no less yours than your lungs or kidneys.
Fortunately, the Supreme Court has a chance to rectify this genetic injustice. The justices will hear oral argument April 15 over a lower federal courts decision that human genes can be patented. The case involves Myriad Genetics, which received patents in the 1990s for the exclusive right to examine any isolated DNA that contains the BRCA1 and BRCA2 genes.Most people have normal versions of these genes, but those who carry mutations of BRCA usually have an 85 to 90percent risk of developing breast or ovarian cancer. Doctors cannot independently look at the genetic code in a persons BRCA genes, because as soon as blood is drawn and DNA is isolated to examine those genes, it is immediately the legal property of Myriad Genetics.
Like many scientists, we believe that these patents never should have been granted and that the genes ofthe human genome, like other natural body parts, belong to their owners, not to companies seeking to exploit monopolies.If the court allows these types of patents to stand, it will put the endeavors of openly researching, preventing and treating lethal diseases on a lower level of importance than a set of ill-conceived property rights.
Because of Myriads patents, any American who wants to have his or her DNA tested for the potentially life-threatening BRCA mutations has to use the services of Myriad Genetics. There is no possibility of an independent test. Myriad charges about $3,000 for the testing, but hundreds of clinical laboratories nationwide could do it for less than $200.
Worse, the restrictions of Myriads patents are not limited to breast cancer genes. The company claims any piece of DNA having at least 15 nucleotides of the BRCA1 gene. In work we recently published in the journal Genome Medicine, we found that these short sequences in BRCA1 also appear in 689 other genes that have a wide variety of functions, including brain development and proper cardiac functioning.
Myriads claim is outrageous but must be understood in context. All of the genes in the human genome share 15 nucleotide sequences with numerous other genes. So the broad reach of a patent on a single gene is not unique to Myriads claims on BRCA1. If patents allow claims for 15 nucleotide sequences, then a patent that was issued for bovine improvement to Cargill, an agricultural company that provides advice on cattle breeding, covers 84 percent of human genes, even though Cargill is interested only in cows. This lack of specificity underscores why patents on short, indiscriminate DNA sequences never should have been issued.
Patenting such a fundamental piece of the human genome has been opposed by thousands of scientists and clinicians, hundreds of medical organizations, and many Nobel laureates. Some have likened it to patenting elements of the periodic table. Such patents grant an exclusive claim that covers an entire landscape of rights in non-related fields.In the case of BRCA1, data from large-scale cancer projects such as the Cancer Genome Atlas have shown that BRCA1 is mutated in not only breast and ovarian cancer but also at least 21 other types of cancer that afflict both men and women.Myriads patent means it owns the monopoly on testing DNA from any patient for any of those cancers, even though the company does not do work on the majority of those diseases. So Myriads control extends far beyond just breast cancer testing, inhibiting the creation of optimal tests for many other cancers.
Some argue that patents to genes are essential to encourage pharmaceutical companies to invest the resources required to produce new therapies and to identify unknown genes. But the sequencing of genetic variants is a very small part of drug design.Of course, once a pharmaceutical company hasdeveloped a novel therapeutic agent to target a specific disease, that treatment can be patented and should be rewarded for its innovation. Others argue that the testing company must be compensated to encourage it to develop new tests.But companies such as Quest Diagnostics and LabCorp are extremely profitable while performingroutine tests that are not covered by exclusive patents.

Scientists hope turtle DNA could lead to treatment for hypothermia, stroke

VANCOUVER - Scientists have decoded the DNA of the Western painted turtle, and hope that unravelling the mystery of the reptiles may lead to medical breakthroughs for humans.
They are the most abundant turtle in North America, with a northernmost range from Ontario west to British Columbia, where they are listed as endangered on the Pacific Coast and of special concern in the rest of the province.
The shelled reptile, named for the bright yellow stripes that adorn its body, is a fresh water species that can freeze solid and return to life when thawed.
It can also hold its breath for up to four days at room temperature without suffering oxygen deprivation and up to four months when hibernating, said Brad Shaffer of UCLA's Institute of the Environment and Sustainability and one of the lead authors of the study published in the latest edition of the journal Genome Biology.
"Those are fascinating ecological, physiological features that have evolved in turtles ... so as a biologist those are fascinating things to learn more about, more about the genes that allow them to do that," Shaffer said.
Shaffer and his colleagues hope solving the DNA puzzle may one day lead to innovations in treating hypothermia, frostbite, heart attacks or strokes.
The DNA confirmed for scientists that the turtles have evolved at a ... turtle's pace, and have in fact changed little in design over the past 210 million years.
"Turtles are nothing short of an enigma," Richard K. Wilson, director of Washington University's Genome Institute and one of the authors, said in a statement. "We could learn a lot from them."
In addition to their ability to freeze and thaw without suffering organ or tissue damage, they have longevity and continue to reproduce at advanced ages, he said.
Western painted turtles can live for more than 40 years, while other species of turtle live well over a century. Females can grow up to 25 centimetres long, while males grow up to 17 centimetres.

Sequester Pain Hits Genome Research, Cancer Clinics

Pains wrought by the sequestration of the US federal budget have already begun to put the hurt on biomedical and genomics research communities, as had been predicted, but also it is directly affecting cancer clinics and patients, which was not expected.
It was expected, predicted, and widely announced that the 5 percent hunk that has been hewn from the National Institutes of Health budget would have a swift impact on biomedical research, and that appears to be happening now, according to the Huffington Post's Howard Fineman.
It is particularly ironic that the budget cuts are hitting human genomics research, a rapidly growing field that was largely launched with the NIH's Human Genome Project, Fineman writes.
Academic research centers that are some of the biggest drivers of genome science may lose "a big chunk" of their funding, including Harvard University, Johns Hopkins University, the University of Pennsylvania, and Washington University in St. Louis, he notes.
According to Fineman, Washington University, which houses the Genome Institute at Washington University, could lose about $40 million in funding over the next eight months.
"Our genomics progress will be substantially slowed," Larry Shapiro, dean of the medical school there, tells the Huffington Post.
"Shapiro and others worry about any pause in their drive to attract top scientists, researchers and entrepreneurs to one of the most advanced programs of its kind in the world," Fineman writes.
According to Washington Post Wonkblog reporter Sarah Kliff, US cancer clinics have been forced to turn away thousands of Medicare patients, because the sequester has triggered a two percent slash in the amount the program provides to doctors . Although relatively small, that cut has hit private cancer clinics uniquely hard, because of the way Medicare pays oncologists for cancer drugs.
While most meds for seniors generally fall under the optional Medicare Part D, which was excluded from the sequester cut, cancer drugs must be administered by doctors and therefore are under Part B, which covers doctor visits and was subject to the cut, Kliff notes.
This 2 percent slice is magnified because it is being cut from the 6 percent reimbursement oncologists receive for storing and administering medications, she writes.

Walk to Cure Psoriasis

On Sunday, April 7, the National Psoriasis Foundation is hosting its annual Walk to Cure Psoriasis at the Aventura Mall (19501 Biscayne Blvd.). The event aims to raise funds for the Foundations research, education and advocacy programs.
Nationwide, as many as 7.5 million people are affected by the disease. Psoriasis, a noncontagious, chronic disease of the immune system, appears on the skin causing red, scaly patches. These patches, often painful and itchy, can appear on any part of the body. Additionally, up to 30 percent of people with psoriasis develop psoriatic arthritis. People with psoriasis are at risk of developing other serious conditions such as heart disease, diabetes and depression.

With over 500 million YouTube views, TED Talks have attracted guest speakers such as Bill Gates, Richard Dawkins and Julian Assange and in the process, made conferences cool again.
But in recent weeks TED Talks with their mantra - ideas worth sharing - have been accused of censorship after two British speakers had their talks removed from TEDs official website.
The row involves two British speakers, the journalist and author Graham Hancock and Cambridge and Harvard University lecturer Rupert Sheldrake. Both speakers have been deemed as provocative amid accusations of pseudoscience at lectures they gave at a TEDx talk a franchised spin-off of the main TED Talk brand. Hancock describes a war on consciousness that prevents the world from gaining a higher state of awareness through shamanic principles and psychoactives like the South American potion, ayahuasca.
Rupert Sheldrake, a biochemist gave a speech which was loosely based on his book, The Science Delusion in which he refutes enduring dogmas which he claims are holding back legitimate scientific enquiry.
Both speakers who spoke at the TEDx conference in east London last month had their speeches pulled from its YouTube channel. After complaints from Sheldrake and Hancock and many TED viewers, their videos were reinstalled, but not on the main website in the naughty corner as Mr Hancock described it.
Hancock and Sheldrake have also called for the anonymous science board which advises TED on the legitimacy of speakers, to be revealed something which TED is refusing to do, citing they are unpaid volunteers.
At the talks, speakers are given 18 minutes to present their ideas, which range from a mixture of science and culture through to storytelling.
But in recent months, a series of controversies dogged the not-for-profit organisation and whose acronym stands for Technology, Entertainment and Design, leading many to question the integrity of the organisation which charges audiences several thousands of pounds to watch a speech, yet pays its speakers nothing. In 2009, TED decided to license its brand allowing anyone, around the world to stage TEDx events.
Last week in California, officials withdrew the license awarded to organisers of TEDx West Hollywood. Organisers said the conference theme who were talking about the reality of ESP, was pseudoscience.
Graham Hancock, said: I think it comes down to the management of popular culture, rather than leaving people to make up their own minds.
