Defense claims marks were eczema

A Livingston man was found guilty Wednesday of aggravated battery to a child for repeatedly burning a 3-year-old with cigarettes.

During the two-day trial, prosecutor Crystal Uhe made the case that 32-year-old Eric D. Hurley burned the child with cigarettes as a method of disciplining it.

Its hard to believe something like this happened, Uhe told jurors in her opening statements.

Uhe showed them photographs of the child that had been taken shortly after the alleged incident, on Oct. 23, 2010. The childs grandmother testified that she took some of the photos herself after she noticed a mark on the child's face that she suspected was a cigarette burn.

The photos showed circular marks on the childs right cheek, lower abdomen and little finger.

When the child's biological father saw the marks he drove the child to the emergency room where workers notified the Department of Children and Family Services.
