Grim Sleeper defense says DNA in some cases points to another suspect

Since Los Angeles police first announced that they had made an arrest in the hunt for the so-called Grim Sleeper serial killer, the case involving the slayings of more than 10 women has centered around DNA.

Genetic evidence at the crime scenes helped investigators conclude they had a single killer. Authorities say tests matched the DNA profile to one man: Lonnie Franklin Jr.

But now Franklin's attorneys are also making use of DNA, alleging that genetic material from another man was found on items collected at the crime scenes of three of the victims linked to their client.

"What role that person plays, we don't know," said defense lawyer Seymour Amster, who filed a 16-page motion last week detailing a defense expert's finding about the new DNA profile. "But we believe he stands in the same equal status as Lonnie."

Authorities say Franklin preyed on poor and vulnerable girls and women whose deaths spanned more than two decades beginning in 1985. He faces 10 counts of murder and one of attempted murder, but investigators believe he is responsible for more killings. Many of the victims were found along a South L.A. corridor straddling Western Avenue, and prosecutors contend that a combination of DNA and ballistics evidence links him to the crimes.

In the motion filed Wednesday, the defense attorneys also argued that the case against Franklin, now 62, is flawed because some of the evidence collected from decades-old crime scenes has since been destroyed.

The motion lists dozens of now-gone items: a dark-red carpet draped over one victim's body, another victim's brown leather jacket and white bra, and a sexual assault kit in another case.

Citing the missing evidence and the other DNA profile found at some of the crime scenes, the attorneys asked a judge to bar the prosecution from seeking the death penalty against Franklin.

"A man is being asked to defend his life without all the evidence to determine what the truth is," Amster said. "That's a problem."

One of the prosecutors on the case, Deputy Dist. Atty. Beth Silverman, dismissed the defense's claims, saying that destruction of evidence is far from unheard of in old cases. Silverman said she thinks the defense expert may be misinterpreting the DNA evidence in concluding that the genetic material links another person to three of the killings.

Ancient Horse DNA Reveals What Makes a Champion

Using genomic analysis, scientists have identified DNA changes that helped turn ancient horses such as those in prehistoric cave art into today's Secretariats. Understanding the genetic changes involved in equine domestication, which earlier research traced to the wind-swept steppes of Eurasia 5,500 years ago, has long been high on the wish list of evolutionary geneticists because of the important role that taming wild horses played in the development of civilization.

It was all made possible by 125 genes, according to a study in Proceedings of the National Academy of Sciences. Related to skeletal muscles, balance, coordination and cardiac strength, those genes produced traits so desirable that ancient breeders selected horses for them, said geneticist Ludovic Orlando of the Natural History Museum of Denmark, who led the study. The result was generations of horses adapted for chariotry, pulling plows and racing. Genes active in the brain also underwent selection. Variants linked to social behavior, learning, fear response and agreeableness are all more abundant in domesticated horses.

Orlando's team examined DNA from 29 horse bones discovered in the Siberian permafrost and dating from 16,000 and 43,000 years ago, and compared it with DNA from five modern domesticated breeds. Some genes in today's horses were absent altogether from the ancient ones, showing they arose from recent mutations. Among them: a short-distance "speed gene."

DNA evidence recently established Richard III as brother of Anne of York. Both were great-great-grandchildren of King Edward III. But the data also show that the Y chromosome passed to Richard III from Edward was not the same Y chromosome that males on the Lancaster/Tudor side of the family inherited from Edward. Illegitimacy is inferred.

Geneticists don't often dig into 530-year-old graves, which makes the DNA obtained from Richard III's bones a unique treasure. With much of it sequenced, the paternity issues described above may soon be resolved. But does this constitute an ethical violation, a breach of royal family privacy?

Will these high-profile paternity cases be tested? Most likely. They will require finding additional direct descendants of Edward. Alternatively, more graves could be exhumed. Newly obtained DNA would then be compared with Richard III's and with DNA already obtained from male-lineage descendants of John of Gaunt.

Is bringing to light ancient and otherwise lost-forever personal or family secrets ethical? Societies often take decades to figure out how new and transformative technologies should be used, and ethical mistakes are made. Perhaps mistakes are being made today in identifying ethical DNA technologies versus those that aren't.

Prosecutor files charge against DNA in Baby April case

A single count of first-degree murder has been filed in the 22-year-old death of an infant girl dubbed Baby April in Moline.

Her killer's identity, however, remains a mystery.

Rock Island County States Attorney John McGehee announced Monday that the charge has been filed against the DNA profile of an unknown female. The DNA was found at the crime scene.

On April 11, 1992, a man walking his dog at 17th Street and the Mississippi River found a trash bag with what he believed to be fish remains left by a fisherman.

Inside the bag was a full-term baby girl who police believe had been born in the 24-hour period before the body was found. The girl is buried at Riverside Cemetery in Moline.

McGehee told reporters Monday this is the first time a charge has been filed against a DNA profile in Rock Island County. McGehee said similar filings have been made by prosecutors across Illinois.

Although a suspect has not yet been identified, he said a DNA profile is specific enough to file a criminal charge under Illinois law.

DNA, McGehee said, is the fingerprints of the 21st century.

I think were going to see more of this as time moves forward in terms of crime scene analysis, he added.

McGehee said the charge also is meant to let the community know the case still is being investigated.
