Filing sealed by court is unlawful censorship, newspaper attorneys argue

An appellate court order sealing a previously public court filing that disclosed parts of a report on an officer-involved shooting was an unconstitutional censorship of the press, attorneys for the Los AngelesTimes and other news organizations wrote in papers filed Thursday.

The 2nd District Court of Appeal on Wednesday ordered sealed a document filed nine days earlier by the Pasadena Police Officers Assn., which included about a dozen excerpts from an independent consultants report on the 2012 fatal shooting of an unarmed teenager by two Pasadena police officers.

An attorney for the union asked for the order, saying the union's filing had "inadvertently, and mistakenly, included verbatim excerpts" of the report it had previously argued was the officers confidential personnel information and should remain secret. The union was challenging a Los Angeles County Superior Court judge's ruling in October that portions of the report could be released.

In an opposition filed Thursday, attorneys for The Times argued that because the information had already been handed over to members of the public and the newspaper, sealing it after the fact would in effect be prior restraint, or censoring information before publication.

The result of the Courts Order has been the immediate and absolute chilling of the [newspapers] speech, attorneys wrote, calling the unions request for the order more than a week after its papers were madepublicly available an attempt to put the genie back in the bottle.

Noting that the U.S. Supreme Court has said only information such as the movement of troops at wartime or information that would set in motion a nuclear holocaust would justify prior restraint, the newspapers attorneys wrote that the unions situation does not come close to presenting such extraordinary circumstances.

Police union attorney Richard Shinee did not respond to a request for comment Thursday afternoon.

A coalition of several media and 1st Amendment organizations, including the Associated Press, the New York Times and the Reporters Committee for Freedom of the Press, separately asked to be heard in the case and urged the court to reverse its sealing order, calling it unconstitutional.

Permitting the March 25 order to stand would set a dangerous precedent of restricting publication of lawfully obtained information, attorneys for the press and free speech organizations wrote. The order removes information of public concern from the hands of the media, preventing the press everywhere from reporting on issues of intense public interest.

The case arose out of the death of Kendrec McDade, a 19-year-old who was shot and killed by Officers Matthew Griffin and Jeffrey Newlen as they responded to a report of armed robbery. The shooting was determined to be justified by the Los Angeles County district attorney'soffice and by the police departments internal review.

Ron Paul supporters bolt Rand camp

As he pulls together his expected presidential campaign in Iowa and New Hampshire, Sen. Rand Paul is confronted by defections from an unexpected quarter: the die-hard idealists whose energy powered his fathers campaigns.

That network of committed supporters was expected to convey to Paul, the natural successor to Ron Pauls libertarian movement, providing him with a plug-and-play ground organization in the make-or-break early voting states. But instead of embracing the Kentucky senator, many of those grass-roots activists are turning their backs on him, disillusioned by the younger Pauls concessions to mainstream politics.

One of the most prominent defectors is Drew Ivers, chairman of Ron Pauls 2012 Iowa campaign, who says he will not endorse Rand Paul for president. On Tuesday, three members of Iowas Ron Paul-aligned Liberty movement state Sen. Jason Shultz and former Iowa Republican Party central committee members Chad Steenhoek and Joel Kurtinitis announced the same, adding that they will support Texas Sen. Ted Cruz. Ivers said he does not plan to endorse any candidate.

Sen. Rand Paul continues to have tremendous support from the vast majority of the liberty movement, said Sergio Gor, communications director for the Paul campaign.

Shultz had endorsed Ron Paul in 2012 and Kurtinitis served as his Iowa regional director. Steenhoek worked for Newt Gingrichs Iowa campaign but was sympathetic to Ron Paul, who endorsed Steenhoeks subsequent bid to serve on the state central committee.

Ivers, who had dinner with Rand Paul in August, said the Kentucky senator has abandoned many of the stances that made Ivers loyal to his father.

Hes moderating on most of them, not taking a real clear stance on a number of them, said Ivers. The strategy of sending a blended message is one that has risk.

That was never an issue for Ron Paul, whose uncompromising ways and willingness to operate on the margins relegated him to the sidelines of national politics. Even at the height of his national influence and popularity in 2012, the Texas congressman proved unable to win the popular vote in a single state and never seriously contended for the GOP nomination in several tries.

Rand Paul, by contrast, won statewide office in his first try and has established himself as a viable presidential candidate with a talent for taking the movements liberty message to a broader audience.

WASHINGTON (MarketWatch) Rand Paul is facing defections from an unexpected quarter: the idealists who powered his father Rons presidential campaigns.

Instead of embracing the younger Paul as he pulls together his expected presidential campaign in Iowa and New Hampshire, many of the grass-roots activists who backed Ron Paul are turning their backs on his son. The problem, writes Politico, is their disillusionment with Rand Pauls concession to mainstream politics. The chairman of Ron Pauls 2012 Iowa campaign, for example, says the younger Paul is moderating on many key stances.

Hillary comes down to earth: Also in Politico on Friday: what Hillary Clinton will do immediately after she kicks off her own presidential campaign. According to several people familiar with the planning process, the former first lady will embark on a short tour that will almost certainly include Iowa and perhaps other states to interact with voters in a series of events. Most of them will be in what Politico called low-key settings.

Ryan open to budget deal: Rep. Paul Ryan, the chairman of the House Ways and Means Committee, said Thursday hes open to another bipartisan budget deal to alleviate sequestration before it returns in October. Ryan, writes the Huffington Post, cautioned his ability to bring along other House Republicans is more limited now that he no longer leads the House Budget Committee. But he said he was willing to support a deal that raises spending caps, as in the deal he brokered two years ago with Sen. Patty Murray, a Democrat from Washington.

Budget clears Senate: The Senate adopted a Republican budget for fiscal year 2016 just before 3:30 a.m. Friday, with no Democratic support. As The Wall Street Journal writes, it marked the first GOP budget to clear the Senate in almost a decade and brought Republicans closer to passing a budget through both congressional chambers. Republican Sens. Ted Cruz of Texas and Rand Paul of Kentucky voted against it. Cruz has announced his presidential bid, and Paul is expected to do the same soon.

Guess whos coming to dinner: If its Iowa, it must be campaign season. The Des Moines Register reports nine Republican presidential contenders have told Iowa GOP officials they intend to speak at this years Lincoln Dinner fundraiser, scheduled in May. Confirmed guests are Jeb Bush, Ben Carson, Carly Fiorina, Lindsey Graham, Bobby Jindal, Rick Perry, Rick Santorum, Donald Trump and Scott Walker. None have announced their candidacy yet.
