Supreme Court to weigh criminal DNA law

Washington (CNN) -- The U.S. Supreme Court will decide whether police can take DNA samples from criminal suspects following their arrest, a case based on Maryland law with potentially national implications for the use of a popular investigative tool.

Justices will weigh a challenge to the state's law by Alonzo King, who was convicted of a 2003 rape on Maryland's Eastern Shore with the assistance of genetic material obtained following his arrest three years ago on an unrelated assault charge.

King moved to suppress the use of the DNA on Fourth Amendment grounds, but was ultimately convicted of the rape offense.

Federal law in 1994 created a national database in which local, state, and federal law enforcement agencies could compare and share information on DNA matches from convicted felons. But courts have been at odds on just when such samples can be collected and the information distributed.

A divided Maryland Court of Appeals agreed with King, saying suspects under arrest enjoy a higher level of privacy than a convicted felon. This, the court said, outweighed the state's law enforcement interests.

The appeals court also said that obtaining King's DNA immediately after arrest was not necessary in identifying him and that the process was more personally invasive than standard fingerprinting.

State officials asked the Supreme Court to intervene, saying the state court ruling "resulted in the loss of a valuable crime-fighting tool." They said that from a law enforcement and forensic perspective, there is no difference between fingerprinting and collecting "biometric information."

‘The Double Helix’ Review – Twists in the Tale of the Great DNA Discovery

Anyone seeking to understand modern biology and genomics could do much worse than start with the discovery of the structure of DNA, on which almost everything else is based. The classic account of the discovery, The Double Helix, by James D. Watson, was first published in 1968 and has now been reissued in an annotated and illustrated edition.

Strangely for the account of a great discovery, Dr. Watsons book contains not a solemn or pompous word. It breezes along, full of gossipy vignettes, many of them at the expense of Francis Crick, his partner in pursuit of DNA. (For 35 years he had not stopped talking and almost nothing of fundamental value had emerged.) Reviewers noted, not with the intent to praise, that the book read more like a novel than history.

The book is not a history of the discovery of DNA, as you claim in the preface. Instead it is a fragment of your autobiography, Crick wrote to him in a furious attempt to suppress its publication. Anything which concerns you and your reactions, apparently, is historically relevant, and anything else is thought not to matter. ... If you publish your book now, in the teeth of my opposition, history will condemn you.

Whether history or autobiography, the annotated version of The Double Helix embeds the book firmly in a historical context and lets the reader appreciate how much substance lies deftly hidden beneath the filigree surface. As Crick later admitted, after he had gotten over his fury, his colleague had unobtrusively packed a lot of science into the book, which faithfully recounts the logic of each step forward and backward.

A feature that makes The Double Helix so unusual, as well as readable, is that Dr. Watson does not describe the discovery from the usual retrospective view taken by historians. Rather, his aim was to record his state of mind at the time the discovery was made. Since he was then just 24, the narrative presents a young mans view of the world, hence the preoccupation with girls and parties, the dismissive attitude toward Rosalind Franklin, his critic and rival in the race, and youthfully astringent observations like this one: One could not be a successful scientist without realizing that, in contrast to the popular conception supported by newspapers and mothers of scientists, a goodly number of scientists are not only narrow-minded and dull, but also just stupid.

Dr. Watson was no doubt well aware of the risks in describing what he really felt at the time. In an era of relentless self-promotion, few could understand that an author might choose to set down the exact truth even if it was unflattering. One set of critics felt the public image of science had been grievously damaged by this unvarnished portrayal of competitive instincts. Another group used his narrative to charge that Franklin had been unfairly robbed of the Nobel Prize.

The annotated edition of The Double Helix, prepared by two of Dr. Watsons colleagues at the Cold Spring Harbor Laboratory, Alexander Gann and Jan Witkowski, provides several documents that bear on Franklins role in the discovery. One is the devious and destructive letter sent to her by John Randall, chairman of the physics department at Kings College, London.

Randalls colleague Maurice H. F. Wilkins, the only English researcher officially working on the structure of DNA, had asked him for an assistant. Franklin was duly hired, but Randall, for reasons best known to him, implied in his letter that DNA would be her project alone. This naturally set up a poisonous state of affairs between Franklin and Wilkins. They barely communicated, and Franklin by herself made slow progress, opening up the strong possibility that the American chemist Linus Pauling would solve the problem first.

Because of his own work and an early X-ray photo of DNA taken by W. T. Astbury, Wilkins strongly believed that the molecule had a helical structure. For a long while Franklin doubted this. The annotated edition reproduces the black-bordered postcard in which she mockingly announced the death of the DNA helix. It is hoped that Dr. M. H. F. Wilkins will speak in memory of the late helix, she wrote.

The young Dr. Watson had no monopoly on contempt for his fellow scientists. Franklin, for example, wrote of her colleagues in a letter excerpted here, The other middle and senior people are positively repulsive and its they who set the general tone.

Dr Jamals nephew, Ahmed had been arrested with two of his friends on the 6th September 2011 by Gaddafi militia in Sirte and had not been heard from since. Ahmeds father spoke to leading doctors and pathologists in Libya to find the best way for positive identification. Each path he tried came to a dead end with a lack of equipment, skilled forensic analysis or corruption putting up barriers.

On the recommendation of a family doctor a sample of DNA was carefully collected from the body and securely brought to the UK. Dr Jamal immediately met with Health Staff of the Libyan Embassy Health Office in London to find an appropriate specialist they trusted.

Verizon Teases HTC Droid DNA, More Handset Images Leak

A brand-new HTC smartphone is making its way to Verizon and, at this point, the company might as well announce the details of the entire thing given how much it's spoiled about the Droid DNA thus far.

Verizon's official "Droid Does" webpage currently features a link under its "News & Offers" section that speaks directly about a "Droid DNA Unboxing" that's scheduled to occur within a Google+ Hangout on November 19. It's interesting that Verizon appears to otherwise be attempting to keep the rest of the device's details including its name hidden among its promotional text, save for the aforementioned headline that directly calls out the new smartphone by name.

An image that appears to be a leaked press shot of the Droid DNA is also making its way around the Web right now. First spotted and posted by the Twitter account @evleaks, the front-and-back shot of the Droid DNA shows off its expected appearance a black body with modest red accents that give it a look similar to that of HTC's J Butterfly smartphone, a device introduced in Japan in October.

In fact, reports PhoneDog's Alex Wagner, the Droid DNA is basically expected to be a Verizon-filled version of that exact device. The smartphone's current rumored spec sheet includes a 1920-by-1080, five-inch display; a 1.5-GHz quad-core Snapdragon processor; around two gigabytes of RAM, 16 gigabytes of internal storage, and a microSD card slot for expandable storage.

The Droid DNA will likely run Android 4.1 (Jelly Bean), support 4G LTE connectivity (naturally) and, as illustrated in the leaked pictures, sport touch-sensitive buttons slapped directly on the front of the device instead of resorting to software-based buttons for navigating around Android.

However, the full details will all be revealed in Verizon's official launch event for the device different than the Nov. 19 unboxing previously mentioned, we note. Verizon and HTC are holding a joint press event on Tuesday, and it's wildly expected that the Droid DNA and its huge, 1080p screen with a full 440 pixels per inch will make an appearance there.

New Droid DNA accidentally confirmed by Verizon

Verizon momentarily uncovers Droid DNA as its newest Android superphone.

Over the weekend Verizon briefly called out the Droid DNA as its next Droid handset. The revelation was fleeting, though; the carrier promptly scrubbed all mention of DNA from its Web site.

Verizon is likely kicking itself, and likely the people responsible, for the slip-up since it came days ahead of the new phone's expected launch tomorrow in New York. I and many others anticipate the Droid DNA to be built by HTC and based on the rumored HTC DLX.

If you recall, the Droid DNA is said to feature a phablet-size 5-inch screen, Android 4.1 Jelly Bean, all buttressed by 2GB of RAM and 16GB of onboard storage. The phone may even boast a quad-core 1.5GHz Snapdragon S4 processor.

Android Central first noticed Verizon's gaffe and also posted images of the gadget reportedly obtained by Twitterer @evleaks. If all this pans out, we're in store for a real smartphone treat tomorrow. Verizon also says it will publish an official unboxing of its freshest Droid on November 19, but you don't have to wait around that long.
