Austin Sigg attorneys question DNA evidence in Jessica Ridgeway case

GOLDEN Lawyers for the teenager accused of kidnapping, killing and dismembering 10-year-old Jessica Ridgeway raised questions Friday about possible DNA contamination in the case.

Austin Sigg, who turned 18 in jail, is charged with 18 counts related to Jessica's death, as well as an attack on a jogger at Ketner Lake last Memorial Day weekend.

Four of the counts carry mandatory life sentences.

Sigg pleaded not guilty last month, over objections of his attorneys, who said they needed more time to consider a plea. At that same hearing last month, Judge Stephen Munsinger set a Sept. 20 start date for Sigg's trial, which is expected to last three weeks.

He and his attorneys appeared in a Jefferson County courtroom Friday for a hearing on several pre-trial motions, most filed by Sigg's defense team.

The hearing revealed that the Colorado Bureau of Investigation issued three "contamination memos" regarding DNA testing in the Ridgeway and jogger cases, and signaled what may be a defense strategy: challenging the reliability of DNA evidence in the case.

Mitch Ahnstedt, one of Sigg's attorneys, said in court that the contamination memos "call into question the reliability of the work that's been done" on the case.

Prosecutors put a CBI lab director on the witness stand to explain the process of DNA testing and analysis.

Kathleen Fetherston described the process, and brought with her some of the equipment used in DNA analysis.

Female DNA on Bomb Not Suspect's Wife: Sources

The female DNA discovered on the remains of one of the bombs that ripped through the Boston Marathon crowd earlier this month does not appear to match that of the wife of one of the bombing suspects, sources told ABC News today.

Earlier this week sources revealed that the DNA had been discovered on bomb fragments, but investigators did not know if it came from a victim in the attack, from someone who handled the bomb components before it was constructed or from a possible co-conspirator. The same day as that revelation, agents were seen leaving the home of Katherine Russell, wife of bombing suspect Tamerlan Tsarnaev, with a set of evidence bags.

Though Russell's DNA does not appear to match what was left on the bomb parts, the sources said today that the FBI still wants to know what Tamerlan may have said in a phone call to Russell days after the explosion. The sources also said residue of explosive material was discovered in the couple's apartment.

An attorney for Russell released a statement Tuesday saying she was providing "as much assistance to the investigation as she can," and later said she had no prior knowledge of the plot.

Tamerlan Tsarnaev, and his younger brother Dzhokhar, stand accused of detonating a pair of bombs near the finish line of the Boston Marathon April 15, killing three people, including an 8-year-old boy, and injuring more than 260 others. Days later Tamerlan was killed in a shootout with police, but Dzhokhar was injured and later captured.

Sources told ABC News Thursday that at least for some time after his arrest, Dzhokhar was speaking with investigators and had told them the original plan for the bombing was to target a Boston Fourth of July celebration. But the young men built the explosives sooner than they expected and wanted to put them to use earlier, Dzhokhar allegedly said.

Dzhokhar also allegedly described his brother as the leader in the plan -- saying he was only brought in days before -- and reportedly told the FBI the pair constructed the bombs in the apartment Tamerlan shared with Russell.

Also this week, three 19-year-old friends of Dzhokhar's were arrested, two for allegedly trying to get rid of a laptop and a bag full of fireworks with the powder missing that belonged to Dzhokhar, and another for allegedly lying to federal investigators. The bag was found after a massive search of a landfill and an attorney for one of those young men told ABC News Thursday his client had turned over the laptop to the FBI.

Today authorities searched four locations near University of Massachusetts-Dartmouth where they believed the brothers may have practiced with explosives, but the search came up empty, the FBI said.

DNA questioned in Jessica Ridgeway case

JEFFERSON COUNTY, Colo. - DNA results are being questioned in the Jessica Ridgeway kidnapping and murder case.

In court Friday, the lead defense attorney for suspect Austin Sigg called into question the quality of work done on the DNA evidence in the Ridgeway case and the attempted abduction of a jogger at Ketner Lake.

The defense team said it has received three memos from authorities that show three DNA samples may have been contaminated -- two in the Ridgeway case, one in the Ketner Lake case.

The Colorado Bureau of Investigation report on the Ketner Lake case said the Ketner Lake sample was in a tray of other samples. CBI officials said some of the other samples were contaminated but the jogger sample wasn't.

Contamination can occur when a DNA sample is heated. Sometimes gas or liquid from one sample may contaminate another sample.

In the Ridgeway case, no details were released about the possible contamination, but officials said those samples were tested individually.

Sigg pleaded not guilty last month to 18 counts in the Ridgeway and Ketner Lake cases, despite confessing to both crimes to 911 dispatchers.

A two-and-a-half week jury trial for the case is scheduled to begin Sept. 20.

While Sigg entered a plea of not guilty, his attorneys mentioned Sigg's mental health, indicating a plea of not guilty by reason of insanity was still on the table.

If convicted, Sigg faces life in prison with the possibility of parole after 40 years. Sigg, who is 18, cannot face the death penalty because he was 17 at the time of the slaying.

DNA found on a fragment of one of the Boston Marathon bombs does not match DNA taken earlier this week from Katherine Russell, the widow of the dead suspect in the attack, but she remains under scrutiny, investigators told NBC News.

Investigators said they still have many questions for Russell because they believe the bombs were assembled at the home she shared with her husband, Tamerlan Tsarnaev, who was killed in a firefight with suburban Boston police April 19.

Russell converted to Islam in 2009, after meeting Tsarnaev in a nightclub, and married him in 2010. She said through her lawyer that his alleged involvement in the attack came as an absolute shock.

Investigators said earlier this week that a piece of one of the pressure-cooker bombs set off by the brothers had a womans DNA on it, and that they wanted to determine who else might have handled the bombs.
