DNA sampling should include guidelines for appropriate use
Posted: at 3:46 pm
One of the most powerful tools for prosecuting criminals is DNA evidence. And now, a U.S. Supreme Court ruling has moved the concept back into the national spotlight.
A divided court ruled last week that taking DNA samples from arrestees is a reasonable police action in step with the Fourth Amendment.
The Fourth Amendment guards against unreasonable searches and seizures, requiring probable cause before warrants are issued.
The question is, what is reasonable when it comes to DNA samples, and what is an invasion of privacy?
Thanks to scientific advancements, we have the ability to link suspects to crime scenes through biological material left behind be it a drop of blood, sweat, saliva or a piece of hair.
Any biological material contains that persons unique genetic blueprint, tightly wrapped up in the double helix of a DNA molecule, according to HowStuffWorks.com.
The only other way someone can have DNA just like yours is if you have an identical twin otherwise, that blueprint is unique to you.
But DNA is not an absolute indicator of someones guilt. What if the person was at the scene earlier, but left before the crime actually occurred? There have also been cases of DNA fraud, where criminals have planted fake DNA samples at the scene to throw detectives off.
As it currently stands, all 50 states and the federal government take DNA samples from convicted criminals to check against federal and state databases. Justices were divided, however, over whether DNA collection could come before a suspect is convicted and without a judge issuing a warrant, according to The Associated Press.
Justice Anthony Kennedy, who wrote the courts majority opinion for last weeks ruling, argued, "Taking and analyzing a cheek swab of the arrestee DNA is, like fingerprinting and photographing, a legitimate police booking procedure that is reasonable under the Fourth Amendment."

DNA from cigarette helps crack 2006 double murder
Posted: at 3:46 pm
DNA from a cigarette butt helped detectives in Central Florida crack a 2006 double-murder cold case.
The Marion County Sheriff's Office on Wednesday said an Alabama murder suspect has confessed to fatally shooting Javier Huerta, 20, and Gustavo Olivares-Rivas, 28, in the Ocala-area nearly seven years ago.
Identified from DNA on the cigarette, murder suspect Jose Martinez, 50, is being held in Alabama on charges from an unrelated homicide, the Marion County Sheriff's Office said.
The bodies of the two Volusia County men were found near the Marion-Lake County Line on State Road 19 just north of State Road 40 after they were killed on Nov. 8, 2006.
The victims, both of Pierson in northwest Volusia County, were found inside a black 2006 Nissan Titan 4 door pickup.
The Marion County Sheriff's Office said tests were performed Feb. 27 on a cigarette butt found in the truck and the DNA was linked to Martinez of Moulton, Ala.
Martinez was picked up in Yuma County, Arizona and extradited to Alabama for a first-degree murder charge in that state.
"Major Crimes Detective T. Watts traveled to Alabama to interview Martinez, where he gave a full confession of the killings and intimate details that only the killer would have known," the Marion County Sheriff's Office said in a statement. "The State Attorney's Office issued a warrant for two counts of First Degree Murder for Martinez."
The Sheriff's Office "placed a hold on Martinez pending the outcome of the charges in Alabama," the agency said.
The slain men were close friends.

DNA code sheds light on world-ranging alga
Posted: at 3:46 pm
It's just a tiny thing -- a single-celled organism visible only under a microscope -- yet it is one of the most successful life forms on the planet.
So say scientists who on Wednesday published the DNA code of an ocean alga called Emiliania huxleyi, whose astonishing adaptability enables it to thrive in waters from the equator to the sub-Arctic.
Known under the more useful moniker of "Ehux," the alga has a thin, hard, chalky shell of calcium carbonate.
Condensed piles of billions of long-dead Ehuxes comprise, for instance, the White Cliffs of Dover.
In the ocean, "blooms" of Ehux algae can cover thousands of square kilometres (square miles), and their milky reflected light can be seen from space.
Less visibly, the micro-alga also has an essential place in the ecosystem and the complex equation of climate change, which explains the bid to sequence its genome.
As a phytoplankton, Ehux is a basic link in the ocean's food chain. It also absorbs lots of carbon dioxide (CO2) at the ocean surface, helping to attenuate the greenhouse-gas problem.
Unveiled in Nature, the genome project turned out to be something of a nightmare, the researchers admit.
The Ehux genome was originally thought be only about 30 million bases, or "rungs" in the DNA ladder.
In the end, it turned out to be a whopping 141 million bases, with at least 30,000 genes -- a third more than the gene tally among humans, although our overall genome is many times bigger.
