French Polices Plan To DNA Test 500 High Schoolers Wouldnt Fly In U.S.

French police are demanding DNA samples from 527 male students and staff members in its search for the perpetrator of a high school rape case. The teenage victim says that she cant identify her assailant since he attacked her from behind in a dark bathroom at the school on Sept. 30. After running out of leads the police tested DNA recovered from the girls clothes but found no match in the countrys database authorities have decided to simply take DNA samples from every male who was on the closed campus at the time of the alleged rape. The testing began Monday.

Authorities have warned students and staff that if anyone opted not to give a DNA sample he would be considered a suspect and taken into custody.Its clearly a situation where people do not have a choice, Catherine Bourgain, a genetic researcher and author of DNA, Superstar or Supercop, told the Associated Press. Once you have a DNA file its very difficult to get that information erased. So far, nobody has refused to give over a sample, prosecutor Isabelle Paganelle told the Associated Press.

The choice is simple for me, Paganelle said. Either I file it away and wait for a match in what could be several years, or I go looking for the match myself. Authorities promised to trash the samples of the children under investigation once each student was eliminated as a suspect.

The head of the school agreed that asking for DNA samples from every man at the school was the right decision. This happened during the school day in a confined space, Chantal Devaux, the private Roman Catholic schools director, told French media. The decision to take such a large sample was made because it was the only way to advance the investigation.

Though the mass DNA sampling may seem like the logical conclusion for the French police, its unlikely that U.S. authorities would take similar steps to catch a rapist. The cost alone a reported $6,900 would likely be a deterrent.

But the more pressing issue is one of privacy. The Fourth Amendment to the United States Constitution prohibits unreasonable search and seizure without a warrant backed by probable cause. This includes seizure of DNA. The American Civil Liberties Union called it a serious blow to genetic privacy when the Supreme Court ruled 5-4 in June of 2013 that police may take DNA samples from people after they are arrested in connection with a serious crime: The ruling allows the police to seize the DNA of innocent Americans who have never been convicted of any sort of crime, without a search warrant. Imagine what the ACLU would have to say about police taking DNA samples before they obtained a warrant.

American authorities would have a hard time arguing that 500 people attending school would constitute probable cause for search and seizure of the students DNA. And it would certainly cause an uproar if police in the U.S. were able to take someone into custody for refusing to voluntarily provide a DNA sample. Though the technology is relatively new, the principle is as old as the Fourth Amendment itself.

So we probably wont be seeing such tactics employed by American police any time soon. But there are also larger questions about an emerging concern for rape culture at play. My colleague Charlotte Alter argued last week that rape culture and sexual assault awareness can unfairly place good guys under suspicion for acts they would never commit: this incident seems to be the prime example since the police are arguing that every male in the school is a suspect merely because of their location and chromosomal makeup.

Then again, however problematic the tactic may be, its heartening to see the French police force take such a proactive stance on identifying a rapist when there is a backlog of 400,000 rape kits still waiting to be tested in the U.S.

DNA on cigarettes leads to Marietta man's robbery conviction

A Marietta man convicted of robbing an ATM customer after his DNA was found on cigarettes at the crime scene was sentenced Monday to 40 years in prison.

On Friday, a Cobb County Superior Court jury convicted Derrius Shamar McKinney for the Sept. 13, 2012 armed robbery and aggravated assault of a 59-year-old man who had just used the ATM at the Bank of America branch in the 2400 block of South Cobb Drive.

The victim was hit in the head with a gun and robbed of $160, according to Kim Isaza, spokewoman for the Cobb district attorney's office.

Isaza said DNA found on cigarettes near where the victim said the perpetrator's car was parked matched that of McKinney.

Cobb Superior Court Judge Mary Staley Monday morning sentenced McKinney, 23, to the state's recommendation of 40 years.

Co-defendant Shawn Thomas pleaded guilty in the case and was sentenced to 15 years, with 10 years to serve, Isaza said.

Hundreds of French students and teachers DNA tested to find rapist

Students received their summonses last week.

Permission to take DNA samples requires the double consent of pupils and their parents, however refusal to agree to provide samples would be viewed as suspect and could be held for questioning, police said.

Most pupils were apparently happy to take part in the exercise but some said they regretted not being informed of the rape until several months after the attack.

Isabelle Pagenelle, the local prosecutor, said: Forty samples will be taken per hour, under the watch of teachers when it comes to pupils, as photos and identity cards are not always trustworthy for minors.

On the delay in conducting the tests and informing pupils, she said: We first needed to be sure about the girls credibility, then look for DNA traces on clothes, check these didnt belong to relations and compare them with the national genetic print database.

Only when this produced no leads did they decide to proceed with the mass test. It was chosen to avoid any repeat offence and to safeguard the school, she said, conceding that investigators could not totally rule out the possibility that the assault was carried out by an unknown intruder with no links to the school.

However, given its quasi-compulsory nature, the genetic testing of teenagers has come in for criticism.

"I understand the argument that those who have done nothing wrong have no reason to refuse. But why should refusal be considered an admission of guilt?" said Pierre Tartakowsky, president of the French human rights league. The exercise was "disproportionate, threatening and traumatising", he told Le Parisien.

However Cathy Richert, a legal expert, said: Its obviously less traumatic to say that everyone is taking a DNA test than singling out certain people who risk being stigmatised.

The school has set up a counselling unit to provide psychological help if needed.

527 DNA tests in high school rape in France: 'Choice is simple'

Paris Male students and staff at a high school in western France 527 people in total were asked to give DNA samples beginning Monday as police search for the assailant who raped a teenage girl.

The La Rochelle prosecutors office said tests were expected to last from Monday through Wednesday at Fenelon-Notre Dame high school, where the 16-year-old was sexually assaulted Sept. 30 in a dark bathroom. Police recovered genetic material from the girls clothing, but it had no matches in the national DNA database.

The prosecutor said it was an easy decision to order the DNA tests. The DNA dragnet started Monday in La Rochelle, and prosecutor Isabelle Pagenelle says so far no one has refused.

Pagenelle said investigators exhausted all other leads in the rape last fall.

Pagenelle had said anyone who refuses the test could be considered a suspect and taken into custody.

Summonses went out last week to 475 students, 31 teachers and 21 others either staff or males who were on campus at the time. The cost to analyze the samples is estimated to total 5,000 euros ($6,900)

Devaux acknowledged that all the results could come back negative, sending investigators back to the drawing board.

France has an extensive DNA database, with a total of 2 million profiles kept on file as of 2012, and refusing a test can be used against suspects in court.
