DNA twist frees rape suspect — for now

Posted: at 9:45 am

A suspect in two heinous rapes crimes that had Hub college women frightened to walk alone in the fall of 2004 left court yesterday a free man because of a rare technicality where DNA tests could not differentiate him from his identical twin.

Dwayne McNair, 33, of Jamaica Plain and Dedham, was released from an eight-count indictment that charged him with raping two young women with an accomplice, Anwar Thomas. Prosecutors attempted to use a newly developed, state-of-the-art DNA test they said could determine whether Dwayne McNair was the rapist. The test is said to be precise enough to distinguish his DNA from that of his identical twin, Dwight McNair.

Dwayne McNair already had been in jail for nearly two years, and Superior Court Judge Christine McEvoy said the test which could take months to complete would deprive him of a fair and speedy trial.

My concern is the delay in the case based on the request being made so late in the case, McEvoy said, referring to the fact that prosecutors asked for the new DNA test two weeks before yesterdays trial date. Those concerns are very much on my mind, and they have been on my mind.

McNair was indicted in 2012 after Thomas took a plea deal, admitted guilt in the two rapes and said McNair was involved in the vicious crimes. McNairs bail had been set at $3.3 million.

Thomas is due to be sentenced next month. He will get no more than 16 years if he cooperates with authorities, according to Jake Wark, spokesman for Suffolk District Attorney Daniel F. Conley.

However, prosecutors said in a court filing they will proceed with the $120,000 DNA test, which was recently developed by a German firm, Eurofins, with an eye toward bringing Dwayne McNair back before a jury.

Im happy hes out, McNairs mother told the Herald last night. Goodbye, she added when asked about the landmark case.

David Yennetti, a criminal defense attorney not involved in the case, noted the quandary for prosecutors.

On one hand, if they dont have enough evidence to prosecute, he could walk away after trial for good, Yennetti said. Now hes free, and if he does something while hes out there, prosecutors will have to think about it.

Newport News man seeks DNA testing in 1994 murder conviction | With Video

Posted: at 9:45 am

Daily Press Reporter Ashley Speed Visits Deerfield Correction.

NEWPORT NEWS A Newport News man is asking a judge to order DNA testing in a murder he was convicted of nearly 20 years ago. The man says the results will prove he wasn't the killer.

Nathaniel Pierce, 44, filed a motion this month asking Newport News Circuit Judge David F. Pugh to order DNA testing for 23 shell casings and six items of clothing gathered as evidence in the shooting death of Steven Anthony Smith. Smith, 19, was gunned down on July 12, 1994.

Pierce, his brother Darryl Hunter and Reginald Fletcher were all convicted in the fatal shooting. Hunter and Fletcher also say they are innocent. Since the shooting, four witnesses have recanted their statements in affidavits, saying they lied about Pierce's involvement in the crime.

"They didn't have no evidence to prove I was even at the scene of the crime," Pierce said during a recent interview at Deerfield Correctional Facility in Southampton County. "All the guys' testimony was different. Nothing linked me to the crime. The only thing that linked me to the crime was a guy lying."

Smith was shot to death while sitting on a porch with friends at Newsome Park Apartments. Two other men were wounded during the shooting.

Pierce has been convicted in the crime by two separate juries.

"We're hoping it will show someone else's DNA is present on the evidence and that it's neither Mr. Pierce nor the victims," said Charles Haden, Pierce's appellate attorney. "It's not a sure thing. I asked for a number of items to be tested. They rarely grant that everything to be tested, but maybe just maybe he will go ahead and test some of these things."

Recantations

Pierce has maintained his innocence since being charged.

DNA Solves 2012 Murder, Suspect in Custody

Craig Taylor, 21, was arrested around 2:30 p.m.on Tuesday on the 2100 block of N. Highland Avenue by the U.S. Marshals Task Force and transported to the Madison County Jail.

The task force is compromised of deputy U.S. Marshals and investigators from the Jackson Police Department's Gang Unit and Metro Narcotics Unit.

Taylor is scheduled to be formally arraigned via video link at 8 a.m. Wednesday in Jackson City Court on charges of first-degree murder of Staten in perpetration of attempted aggravated robbery and attempted aggravated robbery of Staten's girlfriend.

Around 5 p.m. on Nov. 15, 2012, Staten's girlfriend had just arrived at the home she shared with Staten at 173 Lealand Lane. While the woman was outside, a masked man came from the side of her duplex and approached her with a gun. The man then ordered the woman to go inside her home.

The woman began to scream causing Staten to come to from inside the home with a gun. Staten and the robber exchanged gunfire, and Staten was struck. He was transported to Jackson-Madison County General Hospital where he died from a gunshot wound.

Officers canvassed the area in which the robber had run and found a camouflage mask. Staten's girlfriend identified the mask as the one the robber had worn.

Investigators sent the mask to the Tennessee Bureau of Investigation Crime Lab for DNA analysis. The crime lab developed a DNA profile from the mask.

During the course of the investigation, Craig Taylor was developed as a suspect. In January, investigators obtained a sample of Taylor's DNA and submitted it to the crime lab for comparison.

Mother's diet at time of conception may alter baby's DNA

Posted: at 9:45 am

A woman's diet at the time of conception might cause lasting changes in the DNA of her children, potentially influencing their development, researchers say.

In a new study, researchers analyzed the diets of women in rural parts of The Gambia, in western Africa, who experience major changes in their diets over the course of each year as the area goes through rainy seasons and dry seasons.

"The rainy season is often referred to as 'the hungry season,' and the dry season 'the harvest season,'"said study author Robert Waterland, a nutritional epigeneticist at Baylor College of Medicine in Houston. "During the rainy season, villagers have a lot more farming labor to do, and they gradually run out of food collected from the previous harvest."

Yearlong staples of the women's diet include rice, a grain called millet, peanuts and cassava. But during the rainy season, they eat more leafy green vegetables similar to spinach, which are very high in folate, a nutrient that is especially important during pregnancy.

The scientists investigated the concentration of nutrients in the blood of 84 pregnant women who conceived at the peak of the rainy season and 83 women who conceived at the peak of the dry season. In addition, they analyzed the DNA of six specific genes in the women's infants when they were 2 to 8 months old. [7 WaysPregnantWomen Affect Babies]

The researchers found that in all six genes, the infants who were conceived during the rainy season had consistently higher rates of "methylation" in their DNA. A methylation is a change made to DNA it's the addition of methyl groups to the DNA strand, a so-called epigenetic modification to DNA and is a process that can silence the expression of a gene.

Methylation generally depends on nutrients such as folate, choline, methionine, and vitamins B2 and B6, the researchers said. In the study, methylation in the infants' genes was linked to various nutrient levels in the mother's blood.

"Our results represent the first demonstration in humans that a mother's nutritional well-being at the time of conception can change how her child's genes will be interpreted, with a lifelong impact," senior study author Branwen Hennig, of the London School of Hygiene & Tropical Medicine, said in a statement.

Prior studies in animals had suggested that environmental influences before conception might lead to epigenetic changes in the offspring. For instance, a 2003 study revealed a female mouse's diet can alter the color of her offspring's coat by permanently modifying DNA methylation.

"These specific epigenetic marks on DNA are very stable essentially permanent, as far as we know,"Waterland said.
