DNA Frees Two US Men Jailed for 1983 Rape and Murder

New DNA evidence has freed a death-row inmate after he spent three decades in prison for rape and murder. (Representational pic)
Henry McCollum, 50, walked out of Central Prison in Raleigh, hugged his mother and father and thanked God for his release.
His half-brother, 46-year-old Leon Brown, also had his conviction in a 1983 rape and murder overturned on Tuesday.
McCollum spoke briefly to reporters before getting into the passenger seat of his father's car, where a reporter had to show him how to buckle the seat belt. He had never used a seat belt of that design.
McCollum said he hoped to go home and take a bath. There will be changes to which he'll need to adjust - particularly the Internet and cellphones, he said.
A judge overturned their convictions after another man's DNA was discovered on a cigarette butt left near the girl's body. Tuesday's ruling is the latest twist in a notorious legal case that began with what defense attorneys said were coerced confessions from two scared teenagers with low IQs. McCollum was 19 at the time and Brown was 15.
Superior Court Judge Douglas Sasser said the new DNA results contradicted the case prosecutors put forward.
He said he was vacating their convictions and ordering their release "based on significant new evidence that they are, in fact, innocent."
The DNA from the cigarette butts doesn't match Brown or McCollum, and fingerprints taken from a beer can at the scene aren't theirs either, attorneys say. No physical evidence connects them to the crime.
Both were initially given death sentences, which were overturned. At a second trial, McCollum was again sent to death row, while Brown was convicted of rape and sentenced to life.

DNA Evidence Key to Both Freedom and Prison in Decades-Old Murder Cases

The power of DNA evidence was on display this week in courtrooms on opposite sides of the country, where the fates of three defendants tied to grisly crimes committed decades ago took remarkable turns.
A Los Angeles County jury on Tuesday found a 74-year-old, wheelchair-bound drifter and suspected serial killer guilty of strangling three women to death in the 1980s after DNA evidence led to a break in the cold-case murders.

A Los Angeles County Superior Court jury deliberated just two hours before finding Samuel Little, 74, guilty of first-degree murder in the deaths of all three women, who prosecutors described as having been made easy targets by their involvement in drugs and prostitution.
Prosecutors said Little was tied by DNA matches to the July 1987 murder of Carol Alford, 41, as well as to the August and September 1989 slayings of Audrey Nelson, 35, and Guadalupe Apodaca, 46.
All three were beaten and then strangled to death, and Deputy District Attorney Beth Silverman said Little was a suspect in several similar murders in Florida and elsewhere during the same period of time.
Mr. Little, who was acquitted by a jury of a Florida slaying three decades ago, was connected to the L.A. killings after DNA evidence found at the crime scenes was matched with his DNA profile, obtained from an unrelated drug arrest in Kentucky in 2012, according to Reuters.
A prosecutor at the trial said Mr. Little could be responsible for at least 40 killings since 1980, according to AP, which reported that authorities in California, Florida, Kentucky, Missouri, Louisiana, Texas, Georgia, Mississippi and Ohio are investigating possible links.
DNA evidence, meanwhile, proved to be the key to freedom for two prison inmates In North Carolina.
On Tuesday, a North Carolina judge threw out the convictions of half-brothers Henry McCollum and Leon Brown, who had spent more than 30 years behind bars for the gang-rape and murder of an 11-year-old girl.

(CNN) -- A pair of siblings who served decades behind bars in the rape and murder of a North Carolina child will walk out of prison free men Wednesday after DNA evidence implicated someone else.
Henry McCollum and Leon Brown were just teenagers when they were arrested in 1983 and charged with the rape and murder of 11-year-old Sabrina Buie in Red Springs, about 30 miles southeast of Fayetteville in rural Robeson County.
Buie's body was found in an area of Red Springs known as something of a "lovers' lane," according to Joe Freeman Britt, the district attorney who prosecuted them in the '80s. The ground was littered with "beer cans, condoms and cigarettes," Britt said.
It was one of those cigarette butts that ultimately set them free.
DNA found on a cigarette "matched another individual named Roscoe Artis, a convicted rapist and murderer who lived less than 100 yards from where the victim's body was found," said a statement from McCollum's and Brown's attorneys.
Artis is serving a life sentence in a North Carolina prison on a separate conviction. It was not immediately clear Tuesday whether prosecutors would bring charges against him for Buie's murder.

LUMBERTON, N.C., Sept. 3 (UPI) -- Two North Carolina half brothers who have spent their entire adult lives in prison are innocent of the gruesome 1983 rape and murder of an 11-year-old girl, a judge said.
Henry McCollum and Leon Brown were ordered released at a hearing Tuesday. Prison officials kept them behind bars for one more night, saying they needed to be processed.
Supporters in the courtroom cheered and wept when Superior Court Judge Doug Sasser issued the order for release.
The brothers, both with mental disabilities, were convicted and sentenced to death after confessing to the murder of Sabrina Buie, whose body was found in a soybean field near Red Springs, her underpants stuffed down her throat. After new trials in the early 1990s, McCollum, 19 at the time of the killing, was sentenced to death again, while his brother, who was 15 in 1983, was sentenced to life in prison for rape.
Johnson Britt, the current district attorney in Robeson County, said the DNA of another man, found on a cigarette near Sabrina's body, effectively destroyed the case.
"Time and time again, confessions have proven to be insufficient and at times inaccurate," Britt said.
The case was reinvestigated by the North Carolina Innocence Inquiry Commission, which linked the killing to Roscoe Artis. Artis was convicted of a similar crime in Red Springs a few weeks after Sabrina was killed.
Former District Attorney Joe Freeman Britt -- no relation to the current district attorney -- insisted the original verdict was correct. Britt was once cited by the Guinness Book of World Records as the world's "deadliest prosecutor."
"It's a tragic day for justice in Robeson County," Britt said. "That case was fought with powerful arguments, but apparently the district attorney just threw up his hands and capitulated."

Defence lawyers petitioned for their release after a recent analysis from the butt pointed to another man who lived near the soybean field where Sabrina Buies body was found in Robeson County. That man is already serving a life sentence for a similar rape and murder that happened less than a month later.
