Hernandez trial features testimony on DNA, shell casing, bubble gum

FALL RIVER, Mass. Aaron Hernandezs attorneys launched a multi-pronged attack Friday on the competence of police investigators, showing that they never bothered to obtain a DNA sample from an alleged accomplice and never tested a piece of chewed bubble gum that was stuck to a shell casing linked to the death of Odin Lloyd.

The gum, a forensic scientist acknowledged under cross-examination by one of Hernandezs attorneys, had likely contaminated the shell casing by transferring Hernandezs DNA to it.

The scientist, Diane Fife Biagiotti, was called to testify in the 21st day of Hernandezs murder trial about her work to compare genetic samples from key pieces of evidence in the case to several of those allegedly involved. But defense attorney James Sultan took advantage of his turn to question her to push the central theme of the defenses case -- that police were sloppy and rushed to pin Lloyds murder on Hernandez.

First, she acknowledged that nobody ever obtained a DNA sample from Ernest Wallace Jr., one of two men alleged to have been with Hernandez when Lloyd was killed.

And she acknowledged that when she tested a shell casing and found DNA on it from the former New England Patriots star she did not know that a piece of chewed bubble gum had previously been stuck to it.

Sultan first got Biagiotti, a DNA technician for the Massachusetts State Police crime lab, to acknowledge that chewing gum can contain DNA. Then he asked her to assume that the shell casing and the gum were once touching each other -- while at the same time displaying a photograph of them stuck together.

Would you agree with me, Miss Biagiotti, that there is a high likelihood that the DNA contained in the saliva on the chewed blue chewing gum would be transferred to that shell casing that is attached to it? Sultan asked.

Prosecutor William McCauley rose and objected to the question, but Judge E. Susan Garsh quickly overruled him.

Yes, Biaggioti said, I would agree with that.

Prosecutors have asserted that shell casing, which was recovered from a car rented to Hernandez, was fired by the same .45-caliber pistol that killed the 27-year-old semi-pro football player. An Enterprise Rent-A-Car employee removed the shell casing -- along with a wad of chewed gum, a piece of paper and a Vitamin Water bottle -- from the Nissan Altima when she cleaned it out after Hernandez returned it.

Witness: Hernandez DNA matched cigarette butt at crime scene

FALL RIVER, Mass. Former New England Patriots player Aaron Hernandez's DNA was found on a cigarette butt at the scene of a murder near his home, a crime lab scientist testified Friday.

Hernandez is on trial for murder in the June 2013 killing of Odin Lloyd, who was dating the sister of Hernandez's fiancee. Lloyd's body was found in an industrial park, and prosecutors have said previously a marijuana cigarette was found near his bullet-riddled body.

Diane Fife Biagiotti of the state police crime lab told jurors that she received rolling paper from a 2-inch-long cigarette butt to test for DNA. She said she found it had the DNA of at least two people on it.

She said she first compared it with Lloyd's DNA and discovered he could have been one of the people whose DNA appeared on the butt. She said she then was able to use Lloyd's DNA to deduce the second DNA contributor.

"I did a comparison between the profile I deduced and the profile of Aaron Hernandez," she said. "I found that the profile from Aaron Hernandez matched the deduced DNA profile."

She then ran a statistical analysis and determined the likelihood it was someone else is one in more than a quadrillion.

"How many zeros does a quadrillion have?" prosecutor William McCauley asked her?

"One with 15 zeros after it," she replied.

He then asked her the world's population: 7 billion and pointed out a quadrillion is one million times a quadrillion.

But Hernandez lawyer James Sultan went after other DNA evidence in the case, including some collected from a spent shell casing found inside a car Hernandez rented. Police found the casing in a trash bin at an Enterprise rental car, stuck to some blue bubble gum. An Enterprise employee said she found both items under the driver's seat of the car and threw them away.

Wider DNA collection passes in House panel

Lawmakers on Thursday moved forward an effort to expand the types of suspects who must submit DNA samples to law enforcement. They also pushed to expand rights for gun owners at polling places.

The House Judiciary Committee passed House Bill 1573, which would require law enforcement officials to take a DNA swab of any offender arrested on a felony charge.

Current Arkansas law requires DNA samples to be taken for anyone convicted of a felony or a misdemeanor that counts as a sex crime. It also requires law enforcement officials to take DNA for people suspected of committing murder, rape, kidnapping and sexual assaults.

Expansion of the statute to include all felonies, ranging from burglaries to cashing hot checks, will cast a wider net to ensnare at-large murderers and rapists and will prevent crime, proponents say.

A day after she appeared in the Senate Judiciary Committee, Jayann Sepich testified about the murder of her daughter and how instrumental DNA was in the arrest and conviction of the killer.

Sepich is an advocate for the expansion of DNA collection, and after pushing for the passage of a law in her home state of New Mexico to include the DNA documentation of all felony arrests, including burglary, that state's DNA database has matched 845 crimes.

"[DNA evidence] solves crimes sooner, prevents crimes and saves lives," she said. "We've seen it exonerate the innocent."

Twenty-eight states take DNA for some felony arrests while 14 states take DNA for all felony arrests.

Jeff Rosenzweig, an attorney representing other criminal defense attorneys, said he was concerned that the bill, if enacted, would allow law enforcement officials to take people's DNA samples on "bogus" arrests that don't get prosecuted.

He suggested that the lawmakers require law enforcement officials have the DNA swab signed off on by a judge who has reviewed an arrest affidavit to ensure that the arrest, and thus the cause for taking the DNA, was legitimate.
