Psychiatrist Convicted of Billing Medicare and Private Insurance … – Department of Justice

BOSTON A Natick psychiatrist was convicted by a federal jury yesterday of billing Medicare and private insurance companies for over $11 million in treatments he did not provide and obstructing justice in an attempt to conceal his crimes.

Gustavo Kinrys, 52, of Wellesley, was convicted of seven counts of wire fraud, six counts of false statements relating to health care matters and one count of obstructing a criminal health care investigation. U.S. District Court Judge Denise J. Casper scheduled sentencing for Jan. 31, 2023. Kinrys was arrested and charged in December 2020.

Dr. Kinrys shamelessly billed for over $11 million in treatment from Medicare and private insurers treatments he never provided. He exploited our healthcare system and showed callous disregard for patient well-being, said Acting United States Attorney Joshua S. Levy. This conviction should send a stern message: healthcare fraud will not go unpunished, and those who exploit our vital healthcare system for personal gain will face the full extent of the law.

Through his scheme to defraud the Medicare program, the defendant stole taxpayer funds and violated the publics trust in his position as a physician, said Roberto Coviello, Special Agent in Charge of the U.S. Department of Health and Human Services, Office of Inspector General. This conviction sends a clear message that we will hold accountable those who exploit our federal health care system for personal gain, and we will not tolerate attempts to obstruct our pursuit of justice.

This conviction is a big win for taxpayers who were cheated when Dr. Kinrys fraudulently billed Medicare and private insurance companies for more than $11 million for medical treatments he never provided and then obstructed our investigation in an attempt to conceal his crimes, said Jodi Cohen, Special Agent in Charge of the FBI Boston Division. Healthcare fraud is not a victimless crime. It can raise health insurance premiums, expose patients to unnecessary medical procedures, and increase taxes. Anyone involved in, or entertaining similar activity, should know the FBI and our partners will not hesitate to pursue those trying to steal from our countrys vital health care system.

This matter illustrates the commitment of all agencies to combat medical billing fraud which affects all citizens. The Insurance Fraud Bureau of Massachusetts places a high priority on fighting this type of insurance fraud. Our continuing collaboration with our partners is critical to successfully fight insurance fraud, said Anthony M. DiPaolo, Executive Director of the Massachusetts Insurance Fraud Bureau.

Kinrys was a licensed psychiatrist who owned and operated Advanced TMS Associates, located in Natick, Mass. Among other services, Kinrys offered transcranial magnetic stimulation (TMS) therapy and psychotherapy to patients suffering from depression. TMS therapy is a noninvasive method of brain stimulation that uses rapidly alternating or pulsed magnetic fields to induce electrical currents directed at a patients cerebral cortex.

Between January 2015 and December 2018, Kinrys engaged in a variety of fraudulent billing schemes in which he sought and received reimbursement for services he did not render. For example, Kinrys billed Medicare and private insurers $10.6 million for thousands of TMS sessions he never provided, including over 8,000 sessions he claimed were provided to 74 patients who, in fact, never received a single session of the therapy. Kinrys billed Medicare and private insurers for hundreds of thousands of dollars worth of psychotherapy sessions he never provided, including over 900 face-to-face sessions he falsely claimed he provided while he was on vacation in locations like the Bahamas, Punta Cana, Dominican Republic, and the Czech Republic. On 382 occasions, Kinrys billed Medicare and private insurers for having provided more than 24 hours worth of psychotherapy services in a single day, including one day in July 2017 when he claimed he had provided hour-long psychotherapy sessions to 70 different patients all while outside the United States on vacation.

To further his fraudulent billing scheme, Kinrys made numerous false statements to his patients, the billing company with which he worked and the insurers to whom he submitted claims seeking reimbursement. When Medicare, private insurers and the Department of Health and Human Services (HHS) sought records from Kinrys pertaining to certain of his claims, he took steps to conceal his fraudulent conduct by making false representations and creating false documentation purporting to show that he had provided thousands of treatments he had billed for, but never rendered. For example, in response to a July 2018 subpoena from the HHSs Office of Inspector General seeking medical records for 10 of his patients, Kinrys created documents and ordered his office workers to create documents falsely stating that those patients had received dozens of treatments they had never been provided and falsely representing that the condition of those patients was improving. The wire fraud charges provide for a sentence of up to 20 years in prison, three years of supervised release and a fine of $250,000 or twice the gross gain or loss, whichever is greater. The charges of false statements relating to health care matters and obstruction of a criminal investigation of a health care offense each provide for a sentence of up to five years in prison, three years of supervised release and a fine of $250,000 or twice the gross gain or loss, whichever is greater. Sentences are imposed by a federal district court judge based upon the U.S. Sentencing Guidelines and statutes which govern the determination of a sentence in a criminal case.

Acting U.S. Attorney Levy, HHS-OIG SAC Coviello, FBI Boston SAC Cohen and MA IFB Director DiPaolo made the announcement today. Assistant U.S. Attorneys Patrick M. Callahan and Christopher R. Looney of the Health Care Fraud Unit are prosecuting the case.

At 25, Sierra Johnson feels good about working a full-time job, setting goals for herself, and looking forward to the future.

However, this wasnt always the case.

Just a few months ago, Sierra wouldnt leave her bedroom, let alone her house. She loved working with children but couldnt keep her job at a day care center.

Since she was a young teenager, Sierras anxiety and depression symptoms interfered with school, work, relationships, and life in general. So much so, she shut out the world and hid behind room-darkening curtains in her bedroom.

I was going down this path from fifth grade until now that I was just never happy, Sierra said. I gave up on everything. I became angry and paranoid, and did not get along with my family.

I blamed everyone else, she said. I was stuck.

TMS therapy a game changer

Sierra heard about a treatment called transcranial magnetic stimulation, better known as TMS.

TMS is an outpatient therapy that uses a device to give very short pulses of magnetic energy to stimulate nerve cells in certain parts of the brain, explained Dr. Lindsay Campbell, WellSpan psychiatrist and behavioral health site director.

The magnetic device stimulates the underactive parts of the brain in patients diagnosed with depression.

Its quite effective for those patients experiencing major depressive disorder and anxious depression, Dr. Campbell said.

Once patients are referred for TMS, Tanya Seprinski, WellSpan TMS coordinator, works to arrange their treatment plan and sessions. She also works with insurance companies to get patients approved for the program.

The therapy is quick, with sessions lasting just 18 to 20 minutes. Its also safe, with minimal side effects, and patients can drive afterward. Typically, after a few weeks, patients notice a difference, Seprinski explained.

More than 500 patients have turned to WellSpan for TMS therapy. The program, which is available in York and Mt. Gretna, has the lowest drop-out rate in the country.

Our program has changed in that we have implemented several new devices and protocols which translate into less time in the TMS chair for patients and improved accuracy, Dr. Campbell said.

A new outlook on life

For Sierra, once she committed to TMS, there was no turning back. She completed all her treatments over a few months.

At first, the changes in Sierra were subtle.

After treatment 10, my attitude had really changed, she said. And that brought on other, larger changes. I was able to get out of bed and leave my room. I had more energy.

Sierra started noticing physical and emotional changes in herself. Next, family relationships began to heal, and she was back to taking her medication daily without skipping.

I was so happy, I cried, she said. The cloud hanging over me was gone and I could face the day with positivity.

Since completing TMS, Sierra is back to working full-time at her day care job and has the confidence to shop alone and mingle at large events, no longer feeling the need to hide in her bedroom.

She is sharing her story on social media and has been interviewed by reporters from local TV stations - all with the goal of promoting hope for others with depression and anxiety.

I will always have a diagnosis of anxiety and depression, but now I am able to deal with it, she said.

Results of TMS therapy

Studies have shown TMS can improve depression symptoms in up to 83% of patients undergoing treatment, and 62% of them achieve symptoms of relief or remission from their depression.

In addition to depression, the FDA has also approved TMS for obsessive-compulsive disorder, migraines, and smoking cessation, although these are separate protocols than the ones used for depression.

Depression Relief: Brain Signal Reversal by Magnetic Pulses – Neuroscience News

Powerful magnetic pulses applied to the scalp to stimulate the brain can bring fast relief to many severely depressed patients for whom standard treatments have failed. Yet its been a mystery exactly how transcranial magnetic stimulation, as the treatment is known, changes the brain to dissipate depression.

Now, research led by Stanford Medicine scientists has found that the treatment works by reversing the direction of abnormal brain signals.

The findings also suggest that backward streams of neural activity between key areas of the brain could be used as a biomarker to help diagnosedepression.

The leading hypothesis has been that TMS could change the flow of neural activity in the brain, said Anish Mitra, MD, Ph.D., a postdoctoral fellow in psychiatry andbehavioral sciences. But to be honest, I was pretty skeptical. I wanted to test it.

Mitra had just the tool to do it. As a graduate student at Washington University in Saint Louis, in the lab of Mark Raichle, MD, he developed a mathematical tool to analyzefunctional magnetic resonance imaging, or fMRIcommonly used to locate active areas in the brain. The new analysis used minute differences in timing between the activation of different areas to also reveal the direction of that activity.

In the new study, published May 15 in theProceedings of the National Academy of Sciences, Mitra and Raichle teamed up with Nolan Williams, MD, associate professor of psychiatry and behavioral sciences, whose team has advanced the use of magnetic stimulation, personalized to each patients brain anatomy, to treat profound depression.

The FDA-cleared treatment, known as Stanford neuromodulation therapy, incorporates advanced imaging technologies to guide stimulation with high-dose patterns of magnetic pulses that can modify brain activity related tomajor depression.

Compared with traditional TMS, which requires daily sessions over several weeks or months, SNT works on an accelerated timeline of 10 sessions each day for just five days.

This was the perfect test to see if TMS has the ability to change the way that signals flow through the brain, said Mitra, who is lead author of the study. If this doesnt do it, nothing will.

The researchers recruited 33 patients who had been diagnosed with treatment-resistant major depressive disorder. Twenty-three received SNT treatment, and 10 received a sham treatment that mimicked SNT but without magnetic stimulation. They compared data from these patients with that of 85 healthy controls without depression.

When they analyzed fMRI data across the whole brain, one connection stood out. In the normal brain, the anterior insula, a region that integrates bodily sensations, sends signals to a region that governs emotions, the anterior cingulate cortex.

You could think of it as the anterior cingulate cortex receiving this information about the bodylike heart rate or temperatureand then deciding how to feel on the basis of all these signals, Mitra said.

In three-quarters of the participants with depression, however, the typical flow of activity was reversed: Theanterior cingulate cortexsent signals to the anterior insula. The more severe the depression, the higher the proportion of signals that traveled the wrong way.

What we saw is that whos the sender and whos the receiver in the relationship seems to really matter in terms of whether someone is depressed, Mitra said.

Its almost as if youd already decided how you were going to feel, and then everything you were sensing was filtered through that, he said. The mood has become primary.

Thats consistent with how a lot of psychiatrists see depression, he added. Even things that are quite joyful to a patient normally are suddenly not bringing them any pleasure.

When depressed patients were treated with SNT, the flow of neural activity shifted to the normal direction within a week, coinciding with a lifting of their depression.

Those with the most severe depressionand the most misdirected brain signalswere the most likely to benefit from the treatment.

Were able to undo the spatio-temporal abnormality so that peoples brains look like those of normal, healthy controls, Williams said.

A challenge of treating depression has been the lack of insight into its biological mechanisms. If a patient has a fever, there are various testsfor a bacterial or viral infection, for examplethat could determine the appropriate treatment. But for a patient with depression, there are no analogous tests.

This is the first time in psychiatry where this particular change in a biologythe flow of signals between these two brain regionspredicts the change in clinical symptoms, Williams said.

Not everyone with depression has this abnormal flow of neural activity, and it may be rare in less severe cases of depression, Williams said, but it could serve as an important biomarker for triaging treatment for the disorder.

The fMRI data that allows precision treatment with SNT can be used both as a biomarker for depression and a method of personalized targeting to treat its underlying cause, he said.

When we get a person with severe depression, we can look for this biomarker to decide how likely they are to respond well to SNT treatment, Mitra said.

Behavioral conditions like depression have been difficult to capture with imaging because, unlike an obvious brain lesion, they deal with the subtlety of relationships between various parts of the brain, said Raichle, who has studied brain imaging for more than four decades.

Its incredibly promising that the technology now is approaching the complexity of the problems were trying to understand.

The researchers plan to replicate the study in a larger group of patients. They also hope others will adopt their analytic technique to uncover more clues about the direction ofbrain activityhidden in fMRI data. As long as you have good clean fMRI data, you can study this property of the signals, Mitra said.

Major depressive disorder (MDD) is widely hypothesized to result from disordered communication across brain-wide networks. Yet, prior resting-state-functional MRI (rs-fMRI) studies of MDD have studied zero-lag temporal synchrony (functional connectivity) in brain activity absent directional information.

We utilize the recent discovery of stereotyped brain-wide directed signaling patterns in humans to investigate the relationship between directed rs-fMRI activity, MDD, and treatment response to FDA-approved neurostimulation paradigm termed Stanford neuromodulation therapy (SNT).

We find that SNT over the left dorsolateral prefrontal cortex (DLPFC) induces directed signaling shifts in the left DLPFC and bilateral anterior cingulate cortex (ACC).

Directional signaling shifts in the ACC, but not the DLPFC, predict improvement in depression symptoms, and moreover, pretreatment ACC signaling predicts both depression severity and the likelihood of SNT treatment response.

Taken together, our findings suggest that ACC-based directed signaling patterns in rs-fMRI are a potential biomarker of MDD.

Incoming TMS students take tours of site – Yahoo News

May 15Future Tahlequah Middle School students roamed the halls of the sixth- through eighth-grade site last Tuesday, May 9.

During the morning of May 9, fifth-grade students with Tahlequah Public Schools toured the building by themselves, while later that night, the soon-to-be sixth-graders guided their parents through the halls.

TMS Principal Abby Keys said the morning and night tours offer incoming students a way to get acclimated to the building. By having the kids walk the halls a few hours before the night tours, Keys said, students gets a sense of pride and ownership as they take their parents on the same walk.

"We want our kids to come first and then they can bring their families," said Keys. "It's a big change from being in elementary. It's a lot bigger, and all of them are coming in together, so it gives them their first little taste of all being together here."

The morning event, which only featured the incoming students, had the kids walking the halls and receiving information on classes they will be taking, while a more in-depth version was given during the evening tour.

Keisha Murray, an event attendee, brought her home-schooled daughter, Emersyn Murray, as she did not get participate in the morning tours. Emersyn said the tour helped take away some of the scariness surrounding the upcoming year.

Shayna Rodriguez, a parent at the evening tour, said she already knew the layout of the school from subbing at TMS. Since Shayna already knew the lay of the land, she had her son, Liam Rodriguez, show her where he will be going each day. She said the fact that her son already knew how to make his way to his locker and classes was reassuring.

"His summer school is going to be done here, so that alone made my anxiety go out the window, because I knew he has all month of June to prepare [as well]," said Shayna.

Keisha said the event also answered her family's main questions regarding electives and how they work.

"We knew there were some, but we didn't know how they get chosen or anything like that," said Keisha.

Keys said she hopes the tours allowed parents and students to feel less anxious about that big step from elementary to middle school. The event offered guardians and their children a chance to ask questions.

"I think it just answers a lot of questions for them," said Keys. "If they have questions about electives, or they have questions here within the school, we're all here tonight to be able to help them."

TMS music director Amy Wright said she's noticed the tours have reassured not only the incoming sixth-graders but the parents, as well.

"I think it is comforting for the kids to be able to see the teachers' faces before they get here, and that it's good for the parents to know we are here to help their children succeed, because all we remember is what we went through in middle school and how horrible it was," said Wright. "It just [helps them to] know there's going to be those times, but we're here for their kids."

Passion Drives TMS Titanium’s Todd Harrison – Drag Illustrated

Almost 17 years ago in a garage in Southern California, Todd Harrison started one of the most widely recognized and respected titanium supply businesses in the country, TMS Titanium. Like so many racing dreams it began with a young man reading issues of Hot Rod magazine and having a goal.

I had read an article in Hot Rod magazine about titanium connecting rods, said Harrison. I worked for a guy who was a racer and I started asking him titanium questions. The next thing I knew I had a job offer. I worked for them and grew that company. I moved from there to another titanium processing company as their general manager. I decided to go out on my own in 2006 in my parents garage.

The early years were not easy as titanium costs were sky high, but Harrison had passion and knew how he would set his company apart. He focused on customer service and finding loyal customers. That combination along with hard work has set Harrison on a path that has seen TMS Titanium grow every year and provide high-quality titanium to customers in just about every racing series as well as aerospace, tactical operations, the chemical and medical industries, and marine services. The biggest growth area for the company has been racing and especially drag racing.

Our sales staff is really plugged in to the racing world professionally and personally, Harrison said. They are fans and they want to do a good job. They know this is a performance business and they like to see the teams we work with win races and championships. We were fortunate to work with Elite Motorsports and Ron Capps Motorsports, who won NHRA Pro Stock and Funny Car championships in 2023. We were involved in supplying the titanium for some of the performance enhancement they made. It is a great feeling to see your friends win and dominate. It was special to be a part of Ron Capps first championship as a new team owner. I spent a lot of time talking with (Capps crew chief) Dean Antonelli talking about parts and uses of titanium.

Harrison isnt just interested in the bold type names in drag racing. He and TMS Titanium are great supporters of up-and-coming teams. He remembers how hard it was to get his company started and it took a lot of support and encouragement from friends and associates. He considers every client a friend and no matter what level they are racing, they should get the best customer service and attention possible.

We are working with Jason Rupert, who is a six-time champion in [nostalgia] Funny Car. He is stepping up to the NHRA Nitro Funny Car class and he just needs some help. We offer material, guidance, and marketing partnerships. We figured out a way to jump in and help some of these smaller teams. We want them to succeed, be competitive, and be safe. Jason is a very interesting relationship. Not only is he a six-time champion but he is also a welder and fabricator. He really understands the metal and I have learned things about titanium from our conversations about his applications and what he has seen and experienced over the years.

One of the benefits TMS Titanium brings to the racing industry is their relationships outside of the sport. Harrison and his partner, James Hostetler, develop contacts with companies and industries around the world. The cross-over from the aerospace, medical, and tactical fields has been a game changer for the company over the years.

These industries are really one and the same. They speak the same language, and they speak a completely different language at the same time. We have people that have no interest in racing, but they are having the exact same problem a race team is having. I can use my knowledge of seeing broken parts and machining applications in the racing world and take that information to the aerospace or chemical processing or medical world and we are able to provide answers and solve problems for them. Everyone struggles at times, whether its racing or machining, and we try and do our little bit to help teams and organizations use our products and our knowledge base. I have always said customer service is No. 1. You must be able to be there for the customer. If you dont know the answer right then let them know you will find out and get right back to them as soon as you can.

Over the years Harrison has met and worked with many legends in the sport. Most importantly, he has developed long-term relationships with some of the biggest names in drag racing. He has leaned on them for advice both in the business and racing worlds.

I have been trained by Roland Leong, who is a great mentor of mine. He has always said it is not what you know, it is who you know. Through our relationships across different racing series from SRX to NASCAR to IndyCar to NHRA, we have created relationships with this knowledge base. If we dont have the answer, I can go to a contact at another organization and get input from them.

Like any business, there have been good years and lean years. Most recently, the past two to three years have been especially trying with a pandemic and global conflict upending supply chains and logistical networks. This is where the long-standing mindset of customer service first has served Harrison and TMS Titanium well to manage a shifting global economy.

We have had a good supply chain for 16 years now, Harrison said. The biggest impact we have seen besides just the world economy and Covid has been the Russian-Ukraine war. A lot of material came from that part of the world. Fifty percent of Boeings aerospace material came out of Russian mills for commercial aerospace, and that has changed with the impact of the war. There is also metal that was melted in Ukraine and shipped to the US to be manufactured, and all those situations have changed. We have had to be very creative in our relationships and luckily, we have some very loyal mills that we work with and suppliers that understand our business. We have found some workarounds and we have been able to continue to work because they know we have great customer service and we do a good job.

Working in the racing industry has been a dream come true for Harrison. While he is not hands on day-to-day with a team or car, he is as involved as he can be. His customers in every industry know he is a phone call or text away. In racing, that can mean contact at any hour of the day. These are the moments and situations Harrison and TMS Titanium thrive in and are eager to step up to help.

We get emails and calls non-stop around the clock, Harrison said. Racers work in the middle of the night. They are in the garage and we get those calls or texts. We just try and be available and fulfill as many of them as possible. It is neat to get a text at 9:30 p.m. and you can give someone an answer and you get into the office at 6:00 a.m. and it gets shipped right out. That is a great relationship to have with these guys.

I cant tell you how many times we get a call two or three days before a race where a racer needs something, Harrison continued. A great example is Ryan Martin blew up his transmission and threw the driveshaft out. They called us at 3:40 p.m. and we stopped production. I put six guys on an eight line item order and we got it out UPS red so he got it the next day, put the car together, and was able to continue filming his racing.

With racing growing and getting faster every season, TMS Titanium and Harrison have kept up their end of the bargain. They are always available and will put in the work to support any race team at any level. They work round the clock to source materials and solve problems whether a team needs to fix a Funny Car body support or a medical fabricator needs raw materials to design a new titanium rod for a patient. The goal is getting the win and keeping the customer happy.
