Spilka says she ‘would have voted yes’ had sports betting bill gone to roll call – GBH News

At the end of April, the Massachusetts Senate passed a sports betting bill via a voice vote. Having faced criticism around the lack of transparency in voice votes, which dont show the public how individual lawmakers would vote, Senate President Karen Spilka told Boston Public Radio Friday that she would have voted yes had the vote been a roll call.
Spilka committed Friday that the final vote will be a roll call.
It's no secret, I am not a fan of gambling, Spilka said, referencing her vote against a casino law in 2010. I would have voted yes on this particular bill based on [these] very strong pieces of consumer protection.
Spilka pointed to parts of the bill that would require 9% of revenue going to addiction treatment resources, prohibitions on credit card use for betting and limits on advertising as conditions that led to her support.
The House also approved a version of the sports betting bill in April. Next, the House and Senate will reconcile any differences before a final vote differences that perhaps most notably include whether college sports betting will be legalized.
The Senate President also discussed the Senates $50 million budget plan released Tuesday, which includes funding for early education, childcare, opioid addiction treatment, mental health care, higher education scholarships and more. The budget also allocates $2 million towards reproductive health care and rights.
She hinted that there is more to come on protecting abortions in the commonwealth, following the leaked Supreme Court draft decision that would overturn Roe v. Wade that was first reported by POLITICO.
We are looking at language, working with reproduction advocates, working with the attorney general as to what more we need to do, she said. We're looking at other legislative options. Again, this is all very early, but I anticipate that we will do more as well.
The Senate will start debating the budget on May 24.

Missouri bills from sports betting to redistricting still on the table – News-Leader

JEFFERSON CITY The General Assembly enters the final week of its annual session with a laundry list of legislative wishes, but it remains to be seen how many will get across the finish line.
Last week, lawmakers passed a $49 billion annual budget, fulfilling their constitutional obligation mere hours before the deadline to get the bills to Gov. Mike Parson's desk. There aren't constitutional requirements to pass any other legislation, but the Republican majorities are aiming to regardless after an election-year session that has been dominated by inter-party disagreements.
With the clock ticking down, the number of bills sent to Parson this year could be smaller but those that do pass are more likely to contain key priorities.
"This has been a painful path on certain days and weeks," said Senate Majority Leader Caleb Rowden, a Columbia Republican, last week. "We will presumably pass fewer actual bills this year.I would assume those bills will be larger and we'll get more of these smaller things done."
If the GOP can avoid halting progress and keep members satisfied, the lead Senate Democrat said, there's still the potential for significant legislative movement.
"It's very much like playing against Michael Jordan in the fourth quarter," said Minority Leader John Rizzo of Independence. "You know what's coming, you just got to hope he misses it. We'll see how it goes."
Here are a few issues that could see debate and possible action in the final five days of the 2022 regular session.
Redrawing Missouri's congressional map is in part what spurred so much disagreement and a lack of action early on in the session. But state lawmakers seem determined to make one last run at redistricting, under the threat of several lawsuits seeking court intervention and with the knowledge that the Show-Me State is the last in the U.S. to pass a map.
A new proposal passed out of a House committee last week would likely retain the current partisan alignment in Congress six Republican-favored districts and two Democrat-favored districts. Its most drastic changes come in the 2nd district in suburban St. Louis, where regional lawmakers have pushed hard for certain communities and counties to be included or excluded. It also splits each of the city of Columbia in mid-Missouri and Webster County in southwest Missouri between two districts.
Republicans are also seeking to pass a litany of changes to how elections are run, ahead of voters heading to the polls this fall.
The proposal with the most momentum is House Bill 1878, which requires photo ID to vote and allows for two weeks of early voting, among other measures. It was debated and finalized by the Senate last week; it needs a final vote in the chamber, after which the House can request a conference to negotiate a compromise or accept the Senate's version of the 82-page bill.
Several proposals to make it more difficult for voters to put a measure on the ballot through the initiative petition reform process have made it through the House but have seen little action in the Senate. Rowden told reporters last week it still wasn't off the table.
Legalized sports betting could also see a last minute compromise and push after previous attempts to pass bills on the subject ran into resistance.
The latest proposal came in the Senate at almost 1 a.m. last week, as Republican Sen. Denny Hoskins of Warrensburg proposed new language legalizing sports betting but excluding language on video lottery terminals, which have proved to be controversial among other Republicans. It imposed a 15 percent tax on wagers, allowed for parlay bets and included $5 million for measures relating to gambling addiction.

Hoskins said that latest language had been discussed with professional sports teams in the state as well as lobbyists with the casino and gaming industries, but eventually withdrew the language. But as a priority for some of the state's biggest teams and a potential generator of big revenue, its proponents will aim to pass some form of sports betting legalization if possible.
Republicans have also indicated that two bills targeting social safety net programs could be priorities in the final days.
House Bill 1860 would allow Missouri to reduce how long unemployment benefits would be available depending on the current statewide unemployment rate, going as low as eight weeks.
House Joint Resolution 117 would ask voters whether or not MO HealthNet, Missouri's Medicaid program, could be subject to appropriation by state lawmakers. The measure could potentially lead to the General Assembly stripping out funding for parts of the expansion population, which is funded in this year's budget but was not in last year's budget due to many Republicans' opposition to expansion.
Both bills still needto make it through Senate debate and potential amendments before being voted on by the chamber and seeking final approval from the House.

Analysis: Has ESPN Missed The US Sports Betting Boat? – Legal Sports Report

Phase one of US sports betting is over without ESPN deeply involved.
Earnings calls no longer focus on growth-at-all-costs and market share. Instead, execs talk of cutting marketing spend and the path to profitability.
In other words, the initial land grab is subsiding. But what does that mean for those who never participated in it?
Industry investor David VanEgmond asked on social media.Has ESPN missed the party? Indeed, ESPN did not cash in massively as a media outlet or as an operator.
The company may have inked advertising deals with DraftKings and Caesars Sportsbook but it did not secure the big exclusive ad deal like NBC or CBS, VanEgmond said.
The company did try. It was looking for at least $3 billion over several years to license the ESPN brand to a sportsbook partner, according to a WSJ report last year.
Partners balked at that price tag. And now market leaders have established their brand and share.
As VanEgmond put it:
FanDuel, DraftKings, BetMGM and Caesars own ~80% national market share and dont need to do a deal with ESPN at all costs for brand awareness. Plus DKNG and CZR did small deals with ESPN already. Why break the bank now?
It feels like the big payday was missed even if the market is still early days, VanEgmond added.
Parent company Disney held its Q2 earnings call on Wednesday, and for the first time in several quarters there was no talk of sports betting.
The marketing opportunity is perhaps gone, given now-falling ad spend from the industry. But that closing door opens up another, specifically the chance to run a sportsbook under the ESPN brand.
ESPN has said multiple times it is willing to go down that road,as long as it has a partner with industry expertise.From that perspective, ESPN might have benefited from waiting rather than missing out.
For one, the competitive environment is now much less intense. Some operators have dropped out of the sector entirely. WynnBet and Caesars cut marketing dramatically, while other companies are turning their focus to profitability rather than growth at all costs.
This is an opportunity, said industry consultant Alun Bowden. The space is less crowded. People made mistakes but you dont have to repeat their mistakes.
It is also shortsighted to assume the US sports betting market is settled in perpetuity with FanDuel and DraftKings atop the pile.
As Bowden put it in his recent newsletter:
The way things are is just the way things are. It is no more a guide to the future than the run out of red and black on the roulette table.
The growth of BetMGM over the last year is just one example of how quickly things can change. Further afield,Sky Bet rose to prominence in the UK well after the market matured.
Sky Bet didnt really become a serious player until something like 2010, said FanDuel founder Nigel Eccles. And ESPN is much more dominant than Sky Sports was in the UK.
The comparison is helpful because ESPN has many of the attributes that made Sky Bet a success, starting with a massive customer acquisition funnel via TV and digital assets.
An ESPN Super 6-style game would be very successful, Im sure, Bowden said.
Some 5.5 million people have played the free-to-play game at Fox Sports for instance.
Perhaps the bigger question then is ESPNs partner. Who is going to bring the technology and operational expertise to pair with the ESPN brand and customer base?
Bet365 is one tantalizing option, given the quality of the product and relative lack of brand awareness in the US.
Thats the only one that makes sense to me, Eccles said. They would need to figure out market access but I suspect that gets easier as a lot of the tier-two operators start to bail sooner or later.
PointsBet is another interesting potential technology partner, with the companys betting app ranking third in Eilers & Krecjicks recent app review, behind only FanDuel and DraftKings.
Alternatively, Bowden suggests one of the current market leaders could opt for a dual-brand strategy with ESPNBet alongside BetMGM, for example.
The exact details remain to be seen, but the opportunity is clear. ESPN is still evaluating various options in the space, LSR understands.
As for missing the boat? Well, as Bowden put it: The boat has barely left the dock.

The NHLs "concealing approach to injury disclosure has made it an outlier" among sports leagues "full-throated efforts to profit from legalized sports betting," according to Adam Kilgore of the WASHINGTON POST. The obfuscation of player injuries during the Stanley Cup Playoffs has "hardened over the years into a quaint and often comical tradition." While other leagues maintain "strict rules about disclosing injuries and punish noncompliant teams," NHL coaches still "discuss injuries in only the vaguest terms, and the league has no mechanism that compels teams to reveal specifics." Even in an "age of widespread gambling, from which it reaps financial benefits," the NHL has "stuck with its approach." But the "dearth of transparency" means the fans whom the NHL has "tacitly or explicitly encouraged to gamble on its games often operate without the most fundamental knowledge: Whos playing?" Kilgore: "More disquieting, it allows for the possibility that some bettors or bookmakers could gain access to information the public does not have, skewing the market in the favor of insiders." The NHL has "ventured into new territory with betting," as the league and its franchises have "formed partnerships with a passel of online sportsbooks." However, the league has "no plans to adjust how it permits teams to withhold injuries from the public." The NFLs "comprehensive injury-disclosure policy" was adopted with the aim of "creating a level playing field for bettors, although some NFL coaches remain deliberately vague." In a "rapidly evolving climate," though, some sportsbook operators "expect that to change" (WASHINGTON POST, 5/10).

Sports betting in New Hampshire may offer clues for Maine – Kennebec Journal and Morning Sentinel

Matt Siegel of Topsham doesnt make the trip very often, maybe once or twice every few months. Sometimes its to a parking lot in Portsmouth, or a diner there. Just as long as hes far enough south of the Piscataqua River that the geolocation on his phone realizes he is in New Hampshire.
Once over the border, Siegel can fire up the DraftKings Sportbook app on his phone and start placing bets on sporting events, which has been legal in New Hampshire since late 2019. Typically, he wagers on professional soccer or UFC fights. The app will not allow Siegel, or anybody, to place a bet from inside Maines borders.
When Im visiting my buddy in the Portland area, sometimes well drive to New Hampshire. I enjoy sports. Ive been playing daily sports fantasy for a while, said Siegel, 34.
A bill working through the Maine Legislature could keep bettors like Siegel close to home. Last month, the Judiciary Committee voted 8-6 to advance a bill that would allow Maines indigenous tribes to operate mobile sports betting businesses, and authorize Oxford Casino and the states harness racing tracks and off-track betting facilities to conduct in-person sports betting.
As Maine considers sports betting, it can look to New Hampshire for clues. Fueled predominately by mobile wagering, sports betting has been a fast-growing revenue boost for New Hampshire. But the ease of placing sports bets via a computer or phone app has raised concerns about the potential for gambling addictions.
Sports betting in New Hampshire is run by the states lottery commission, which has an exclusive contract with DraftKings Sportbook to post betting odds, collect wagers and pay off the winners. The New Hampshire Lottery receives 50 percent of the gaming revenue from sports betting sales at the three retail locations in Dover, Seabrook and Manchester, as well as 51 percent of revenue from sports bets placed using the DraftKings Sportsbook mobile app. DraftKings gets the rest of the revenue.
Through the first eight months of the 2021-22 fiscal year, more than $579 million had been wagered on sports in New Hampshire, with the state receiving slightly more than $15 million in revenue. Charlie McIntyre, executive director of the New Hampshire Lottery, estimated the states cut by the end of the fiscal year on June 30 will be just over $22 million an increase of nearly one-third from 2020-21 ($16.7 million) and a huge increase from the first year that sports betting was introduced in the state ($2.2 million in 2019-20).
Its been tremendously successful, even more so than we anticipated, McIntyre said of sports betting. I think we have absolutely crushed the illegal market.
All of New Hampshires sports gambling revenue goes to the states Education Trust Fund; it will account for about 2 percent of the estimated $1 billion revenue for the Education Trust Fund in this fiscal year.
THE MOBILE SIDE IS WHAT DRIVES GROWTH
New Hampshire is bordered by three states Maine, Massachusetts, and Vermont where sports betting is prohibited. McIntyre estimated 30 percent of the money wagered in New Hampshires three retail sports-betting sites is placed by out-of-staters. Nonresidents account for an estimated 15 percent of mobile users, McIntyre said.
Players can bet on a myriad of professional and collegiate sporting events in North America and overseas. Wagers on teams based in the state, such as those at the University of New Hampshire, are prohibited. Winnings are subject to federal income tax, and payouts greater than $5,000 are subject to Internal Revenue Service reporting.
The DraftKings Sportsbook app is simple to use. To start, bettors must deposit a minimum of $5 from a credit card (DraftKings gives bonus funds in the form of site credit to first-time users). Someone, for example, looking to place a bet on The Masters golf tournament this weekend can select a golfer and an outcome a victory or top-5 finish, to name two possibilities then choose an amount to wager. The app offers quick-click buttons to bet either $1, $5 or $20, or you can enter a different amount. In a few clicks, the bet is placed.
John Paglio of Portland said hes gone to New Hampshire to wager on sports, most recently in February for the Super Bowl.
I went to The Brook (a retail sports-betting site in Seabrook) for the experience. However, I used the DraftKings Sportsbook app to place my bets, Paglio said. It is so much easier and Id rather have full control of my money. Whereas if I were to go to the window and place a bet, Id have to drive back down to New Hampshire to collect my money.
DraftKings spokesperson Suzanne Trainor declined to give an amount for the average wager placed by mobile app users. Paglio said his typical wagers range between $25 and $50. Siegel said his typical bet is $10.
Seeing that money spent out of state is what prompted Maine Rep. Tim Roche, a Republican from Wells, to sponsor a bill seeking legalized sports betting, though his bill was ultimately set aside in favor of the one that came out of the Judiciary Committee. Roche was motivated by what he saw across the border.
I just saw a ton of money heading south. I have people I know who go over (to New Hampshire) and place bets, Roche said. They bet, and then they turn around and come back, and New Hampshires getting that. We have scratch tickets. We have bingo. Whats the difference if somebody wants to put a little on the Patriots?
The mobile app makes it easy to do just what Roche described, For Mainers in York or Oxford County, its a short drive to New Hampshire, where they can sit in their car and place bets from their phones. Bets placed with the DraftKings Sportsbook app account for 77 percent of all wagers placed in New Hampshire so far this fiscal year. In the year from July 2020 through June 2021, they accounted for 84 percent of all money bet on sports in New Hampshire.
The mobile side is what drives growth. Its where most of the revenue comes from, McIntyre said.
CONCERNS OVER PROBLEM GAMBLING
Since sports betting was introduced in December 2019, Ed Talbot, executive director of the New Hampshire Council on Problem Gambling, has seen what he described as a slight increase in calls to his organization from people looking for help with a sports betting problem.
Talbot said 45 percent of calls from gamblers seeking help to the New Hampshire Council on Problem Gambling in 2021 were for sports betting. In the first quarter of 2022, approximately 43 percent of the calls were for sports betting, Talbot said.
Once sports betting was legalized, it became almost a horse race between lottery and sports gambling, Talbot said of the reason for calls to his agency. Before it was legal, sports gambling was going on. We all know that. But since its been more accessible, theres been a small uptick (in calls).
If sports betting becomes legal in Maine, gambling addiction treatment options in the state have to be improved, said Lori Manson of the Maine Council on Problem Gambling, a private nonprofit agency. Manson also serves as Maines liaison with the National Council on Problem Gambling.
That would all have to be scaled up, and there would be a lag in time in funding, Manson said. There needs to be an understanding that its an addiction. Many people think (gambling) is more of a character flaw.
The Maine bill includes safeguards Manson supports. Bettors will need to be at least 21, as opposed to 18 in New Hampshire.One percent of the profits from sports betting will go to gambling addiction treatment funds, and professional and college teams based in Maine will be off limits for wagers.
Our goal isnt to prevent sports gambling, said Manson. Our goal is to ensure there are safeguards.
Manson cited a sharp increase in calls to Connecticuts gambling helpline shortly after sports gambling was legalized there last October. A number of calls came from younger people who lost large amounts of money quickly, instead of over time, Manson said.
Maine 211 is a phone service designed to help Mainers find help for a number of issues, including problem gambling. Maine 211 program manager Nikki Williams said they received 56 calls in the last fiscal year related to problem gambling, but did not know how many of those were specifically related to sports betting.
The legislation that allowed for sports betting in New Hampshire earmarked $100,000 per year go to problem gambling resources. If Maine were to generate similar revenue from sports betting as New Hampshire $16.7 million in the last fiscal year then approximately $167,000 would go to gambling treatment programs in the state.
30 STATES HAVE LEGALIZED SPORTS BETTING
In May 2018, a U.S. Supreme Court ruling struck down a federal ban preventing states from offering sports betting. Since then, the floodgates have opened across the country. DraftKings Sportsbook launched in New Jersey within months of the Supreme Court ruling, becoming the first company to offer online sports betting.
Thirty states and the District of Columbia have legalized sports betting, according to the American Gaming Association. Florida, Nebraska and Ohio have passed legislation legalizing sports betting, but it has yet to go live in those states.
Each state has its own laws to govern the industry, said Michael McCann, the founding director of the Sports and Entertainment Law Institute at the University of New Hampshire and one of the nations leading sports law experts.
What makes New Hampshires law different from the proposal before the Maine legislature is that one entity, the New Hampshire Lottery, oversees everything related to sports betting in the state. In Maine, the plan is to let the tribes oversee the mobile app piece of the business. Many states have a partnership with their tribes, McCann said.
When theres one entity (in charge), that creates a level of organization, McCann said. Im sure (Maine) can make it work because the state and tribes have incentive to make it work. Its a wrinkle, but not an insurmountable one.
Bets placed on mobile apps accounted for 87 percent of all sports bets nationwide in 2021, according to the American Gaming Association. Slightly more than $50 billion was wagered using a mobile app last year, with revenue from mobile apps amounting to $3.59 billion.
Still, New Hampshire and many other states have retail betting centers where patrons can place sports bets in person. New Hampshire has three: The Brook Casino in Seabrook, and the Filotimo Restaurants and Casinos in Dover and Manchester. McIntyre, of the New Hampshire State Lottery, said the state hopes to open a fourth retail betting center soon.
It was quiet at the Filotimos in Dover on a weekday afternoon in March, but owners Jamie and Dante Timbas expected good crowds for the NCAA mens basketball tournament games Thursday and Friday night and over the weekend.
A good amount of players come from Maine. Usually from just over the border, Berwick, or Lebanon, Dante Timbas said.
McIntyre, however, said legalized betting in Maine would have a negligible impact on New Hampshires gambling revenue. He said more of New Hampshires out-of-state bettors come from Massachusetts, simply because of the larger population to the south.
Maines not a big concern of ours, because theres not a major population center on the border, McIntyre said. I dont think many people from Portland are driving to New Hampshire to place bets on the mobile side.

Maine Voices: Sports betting bill is a win for the tribes in Maine – Press Herald

Maine is ready to pass a sports wagering bill that is inclusive of the tribes, helps to eliminate the illegal offshore market and generates revenue for the state. That bill is L.D. 1352.
Three years ago, the Veterans and Legal Affairs Committee passed a sports wagering bill that would have allowed the tribes, casinos, tracks, off-track betting facilities and experienced mobile sports betting operators to offer sports wagering in Maine. The bill was supported by nearly every stakeholder including the tribes but was ultimately vetoed by Gov. Mills. The governor raised concerns about Maine not being ready for the novel industry as well as the absence of advertising restrictions and strong penalties for illegal activities in the bill. The Legislature failed to override the veto because many lawmakers also felt that the bill did not go far enough to prioritize our in-state gaming stakeholders, including the tribes.
Last year, members of the Veterans and Legal Affairs Committee worked through numerous work sessions and put together a framework that addresses the governors important public policy concerns, and presented the tribes and local gaming interests with greater economic opportunity in the emerging industry than the bill that was passed the previous year. This was a tremendous win for Maine because it included the tribes, who have historically been shut out of the gaming industry. It also meant that consumers would have more legal and regulated sports wagering options to choose from in competition with the thriving illicit offshore market.
This year, the governor has put forward a tribal-state collaboration proposal L.D. 585 that includes sports wagering. We commend the governor for her backing of legalizing sports wagering in Maine. As drafted, however, the bill would create a limited number of safe and regulated sports wagering choices for Mainers; only the tribes would be able to offer mobile sports wagering, while casinos and off-track-betting operators would be able to accept sports wagers only at their facilities. The proposal is also expected to generate less revenue for the state than L.D. 1352. Finally, unlike L.D. 1352, the governors proposal also eliminates the opportunity for the tribes to offer retail sports wagering, a business prospect that will create jobs for the tribes and Maine.
Perhaps the most problematic aspect of the governors proposal is not the underlying framework but the process itself. Although the Veterans and Legal Affairs Committee is responsible for reviewing gaming bills, this proposal was sent to the Judiciary Committee because of the laudable non-gaming aspects of the legislation. Normally, our legislative process requires that a bill with multiple subject matters be sent to all of the appropriate committees. However, that is not the case here. And all lawmakers, including our counterparts on the Judiciary Committee, should be concerned about that. This will set a precedent that allows lawmakers to venue shop and send legislation where it will go unchallenged and receive what is believed to be a more receptive audience. That is not how our government works.
Maine has a chance to correct history for our tribes and simultaneously get sports wagering right this year. The Veterans and Legal Affairs Committee has put forth a comprehensive framework with bipartisan support that will provide the tribes with greater economic opportunity, generate more revenue for the state and offer Mainers a more competitive regulated sports wagering industry that presents a viable alternative to the illegal market. For these reasons, we will be asking our colleagues to support L.D. 1352, and we hope that you will do the same.

Gaming Society, a gamification and content company committed to making sports betting easy, has announced the closing of its $3.5 million seed funding round. The financing was co-led by Acies Investments, a venture fund dedicated to the sports wagering and esports industries, and TLI Bedrock, a multi-strategy investment fund active in media, technology, sports and entertainment.
Founded by sports executive and entrepreneur Jaymee Messler, co-founder of The Players Tribune, and NBA hall of famer Kevin Garnett, Gaming Society is expanding its approach to sports betting. The duo created Gaming Society to be the vehicle for introducing the majority of sports fans to now-legal sports betting. The company offers betting education, and through various verticals allows fans to support their favorite teams, leagues, players, shows and events with the incentives of rewards, prizes and bragging rights.
Betting is the ultimate form of gamification in sports, but the industry is still largely intimidating and difficult to understand for the majority of fans, said Messler in an interview with Sportico.
Namely womens sports fans. They share so many of the same behavioral traits as sports bettors because theyre tech savvy, Messler said. Sports betting is a proven driver for more engagement and viewership in sports, we just think that the category presents an exciting opportunity to increase visibility for who these athletes are.
Gaming Society is building verticals that combine editorial, original programming and gamification products. One of these verticals, the Dollar Bet Club, encourages fans to rally behind one bet together every day through storytelling, betting analysis and prizes. Their second vertical, Bet on Women, stems from a partnership with the WNBA Player Association (WNBPA) and aims to propel womens sports forward through the growth of the betting industry. Another vertical, The Betting Academy, is an interactive masterclass giving fans the tools needed to learn how to bet safely and intelligently.
There is a huge swath of the population who are ardent sports fans, yet uninitiated or undereducated on the opportunities around the gamification of sports including sports betting, said Dan Fetters of Acies Investments, in an interview.
Acies invested in a handful of niche betting companies in the past, including Jefebet, Underdog Fantasy and Simplebet. We are not focused on backing a company that has aspirations of replacing DraftKings or FanDuel or Caesars interactive or a bet MGM, said Fetters, who is also a Gaming Society board member. Its a crowded space in the B to C.
Financing from this round will accelerate Gaming Societys investment in gamification products and media content. Other noteworthy investors in Gaming Society includeJohn Patrick Mullen and Will Corkin of Soma Finance.
