Missouri Second Amendment Protection Act Concerns

CARTHAGE, MO.--- A proposed bill bans the publishing of the names of Missouri gun owners. The Missouri Press Association claims the "Second Amendment Protection Act" could threaten first amendment rights.
"You just don't mess with the first amendment of the constitution and the same amendment to the Missouri constitution. That old cliche about a slippery slope comes into play here, you just don't want to mess with that stuff," said John Hacker, Editor, Carthage Press.
That's why the MPA is asking the governor to veto the bill, something State Representative Charlie Davis thinks might not stand.
"If he does veto it, I do believe we have the numbers in the Missouri House and the Senate to override the veto. If there is something that is objectionable by the Missouri Press Association, then we can always come back and address that," said Charlie Davis, Missouri Representative, District 162.
"There are gonna need to be some fixes if the governor vetoes this bill and the legislators override it. They're going to need to come back and look at this thing and fix it," said Hacker.
The MPA says if signed, journalists could be at risk for misdemeanor charges when covering stories related to guns.
"It leaves reporters and news organizations possibly open, I can see where it could be open to civil lawsuits," said Hacker.
"I believe that you can report that guns were stolen but because that becomes a matter of public record, because a police report is generated at that point, it's just the CCW, the acknowledgment that someone does have guns in their house," said Davis.
Representative Davis says this is just a small part of the bill, and he supports any changes that would ensure first amendment rights.
"We'll absolutely look at it and see if that's something we could do or should do," said Davis.

Huntsville Stars Cancel Controversial Gun Certificate Raffle Promotion on ‘Second Amendment Night’

It appears the Hunstville Stars organization gave into the pressure.
The Brewers minor league affiliate has canceled its Second Amendment Night promotion, according to AL.com. The team had planned to raffle off gift certificates for guns, but apparently that idea didnt sit well with Minor League Baseball.
Its in the best interest of baseball, general manager Buck Rogers told AL.com. He said the team was pressured into canceling the promo.
Were part of a larger organization and we have to uphold the game of baseball. It comes before everything we do, Rogers said. Some teams do crazy promotions and fund-raising and we do that too. Were still going to continue to have promotions and things to bring family entertainment to Huntsville.
The Second Amendment Night was slated to feature a raffle from Larrys Pistol and Pawn, a local gun shop. Winners of the raffle would have received gift certificates at the park for Larrys Pistol and Pawn, pending background checks.
Rogers maintained that the raffle was a great idea.

Huntsville Stars Cancel Gun Raffle at Second Amendment Night

HUNTSVILLE, Ala. (WHNT) The Huntsville Stars have decided to cancel the raffle for a chance to win one of three guns at their upcoming Second Amendment Night promotion at the July 3rd game.
Billed as a chance to educate their fans about the Second Amendment, the Stars Second Amendment Night went viral as several sports blogs picked up the story.
Fan reaction to the development Monday evening at the game was mixed.
Decatur resident Jackie Handley said he brought his family out to the game Monday after finding out about the original promotion.
There is a place for guns and there is a place for good family fun entertainment, so we are happy they decided to not do that, Handley said.
But Mark Woods who is a member of the National Rifle Association said he was looking forward to the evening and the chance to win a new gun.
its disappointing but I cant say I am surprised given everything that has been going on lately they have a public relations situation to deal with, Woods told WHNT News 19.
In a press release, the Stars spokeswoman, Nicole Collins, said:
In the best interest of baseball, the Huntsville Stars will not include the gift certificates from Larrys Pistol & Pawn in thein-game raffle on Wednesday, July 3rd. We appreciate the support and understanding of Stars fans and inviteeverybody out for our 2nd Amendment Night/Independence Night celebration game with post-game fireworks show onWednesday night. Gates will open early at 5:00 pm, game time is scheduled for 6:43 pm.
