Supreme Court was right on Second Amendment
Posted: at 12:40 am
Re "Read the Second Amendment" (Letters, Sept. 8): Letter writer Marc Grossman writes that the Supreme Court's recent ruling on the Second Amendment is all wrong and that the Second Amendment only allows the National Guard to have guns. If the reader would like to know how wrong that is, I have a hardbound copy of the Federalist Papers that can enlighten him.
Grossman says the court had it right in denying that the Second Amendment was an individual right. Did the court also have it right when it allowed slavery, or discrimination? In a time when we need unity, why promote this divisive and polarizing fight?

Second Amendment debate in Appleton
APPLETON, Wis. (AP) Two men who openly carried assault-style rifles and handguns near a downtown Appleton farmers market have sparked a debate on Second Amendment rights.
Some gun rights advocates are angry that police held the two men at gunpoint and handcuffed them last weekend. Others are expressing frustration over what they say was a foolish and dangerous stunt.
Wisconsin Carry president Nik Clark says police acted outside of their legal authority when they pointed guns at the men and detained them. Appleton police say they got calls about the men from concerned citizens, briefly detained them and released them after determining they intended no harm and were in legal possession of the guns.
The Journal Sentinel (http://bit.ly/186NkYv ) says an officer questioning the men, ages 22 and 27, told them they were taking the Second Amendment a little too far.

Work on New Second Amendment Bill Begins

FROM THE OFFICE OF THE MISSOURI SENATE
Work on New Second Amendment Bill Begins
Joint Announcement Released by Representative Funderburk and Senator Leaders Dempsey and Richard
ST. CHARLES, MO Sponsor of House Bill 436 Rep. Doug Funderburk, R-St. Charles, committed today to work with Senator Leader Tom Dempsey, R-St. Charles, Majority Floor Leader Ron Richard, R-Joplin, and Senator Brian Nieves, R-Washington, on a new bill defending Missourians Second Amendment rights.
I agree with the Senates efforts to improve what was contained in my House Bill 436, relieve concerns over possible errors, and put a bill defending Missourians Second Amendment rights on the governors desk at the beginning of next session, said Funderburk. This issue is important to all of us, and I appreciate Sen. Dempsey, Sen. Richard and Sen. Nievess commitment to the constitution and good public policy. Because we have a Democratic Governor and Attorney General, we have to get this bill right from the start. With that in mind, I welcome the continued input from our law enforcement and prosecutors to ensure that this bill supports their efforts to fight crime while also protecting our citizens right to lawfully bear arms.
Dempsey responded, I appreciate Rep. Funderburks willingness to continue to champion this important issue and his desire to work with Sen. Richard, Sen. Nieves and myself next session on a robust gun bill that clearly protects the Second Amendment rights of the citizens of the Show-Me State, but does so in a manner that does not tie the hands of Missouris law enforcement community, including our locally elected sheriffs. Sen. Richard, Sen. Nieves and I both have a deep respect for the constitution and the oath we have taken to defend it. The continued threat to our essential liberties from a hostile administration in Washington demands a response. The Missouri General Assembly will rise to the occasion.
Bill handler, Senator Brian Nieves, R-Washington, said hes disappointed with the outcome of the bill, but he looks forward to working with Rep. Funderburk and Sen. Demspey and Sen. Richard in the coming months.
It is frustrating to watch the continued violation of our right to keep and bear arms, said Nieves. While I echo many of the sentiments of Rep. Funderburk, we must move quickly on a new, improved bill also making sure we dont sacrifice any of the cornerstone Second Amendment liberties. I want to ensure all Missourians continue to have those fundamental rights.
Richard commended the efforts of both law enforcement and Second Amendment advocates saying, Our men and women in law enforcement deserve our respect and gratitude for their service. I know they will continue working with us to correct some possible conflicts in the original bill. Perhaps as much as any other group of professionals, these men and women in uniform are passionate about defending us from those who wish to restrict our Second Amendment rights. I also invite our constitutional experts and concerned citizens alike to provide input as to how we can best inoculate ourselves from out-of-touch bureaucrats and defend our states sovereignty under the 10th Amendment.
When Republicans work and stand together, we get results for the people of Missouri, said Funderburk. Three gun bills were passed this year, including one to reform the CCW process after the governor and Department of Revenue were caught breaking the peoples trust and illegally transferring information to the federal government. The beginning of the new legislative session is right around the corner, and I look forward to joining my colleagues in the Missouri Senate on starting immediately to draft a new bill that we can all be proud to sign.

Great news for Second Amendment supporters

Tyler, Texas (KETK) If you are a supporter of the Second Amendment, this is great news.
Two Colorado State Senators, who lead the charge for tighter gun laws in the last election, have been recalled.
We're talking about democrats John Morse and Angela Giron.
By the way Morse is President of the Senate.
The motion to recall came after many "Coloradans" were fed up with the more "urban politicians telling those in rural counties to shut up and sit down and follow the new liberal ideology which has been brought in by "out-of staters" who were newly elected.
Then the recall campaign started. It was a "David VS Goliath deal." Many democrats howled it was a waste of taxpayer money, but, it's legal.
"Nanny Bloomberg" and his "Mayors Against Guns Crew," showed up with millions of dollars from other liberal states. The NRA showed up with more than $350.000. The recallers finally raise about $550,000 to go up against the liberals $3,000,000.
Now "left-wind do-gooder," Debbie Wasserman Shultz. is hollering voter suppression. Many on the far left do this when they lose.

Second Amendment doesn't endorse coups d'état
Posted: September 4, 2013 at 12:40 pm
To the Editor:
In his letter today, Mr. Michael Dow made the common false assertion about the Second Amendment that we hear all the time from people who almost never vote Democratic and almost always vote Republican. (Whether they call themselves Republican or not, they're Republicans by default.)
The Second Amendment is not, as Mr. Dow writes, "all about American citizens being able to defend themselves against an overreaching and tyrannical government." Nowhere does the Second Amendment mention overreach, tyranny or government. It's about a "well-regulated militia," which it does mention. Notice the word, "regulated." Who would do this regulation? The government, of course.
The proof that the Second Amendment is not about being able to make war on our own government and that the government has regulatory authority over the militia lies in Article I, Section 8, Clauses 15 and 16. There, the U.S. Constitution grants the U.S. Congress power to regulate the militia and command it.
Article I, Section 8: "Congress shall have power ..."
Clause 15 states, "To provide for calling forth the militia to execute the laws of the union, suppress insurrections and repel invasions;" and Clause 16 states "To provide for organizing, arming and disciplining, the militia, and for governing such part of them as may be employed in the service of the United States, reserving to the states respectively, the appointment of the officers, and the authority of training the militia according to the discipline prescribed by Congress."
Any organized attempt to "defend" against an allegedly tyrannical federal government would become an insurrection, and Congress has the constitutional authority to use the militia, provisioned with arms by the Second Amendment, to put it down. Any unorganized attempts would simply be assault and murder, which are just all-too-common crimes.
This is what we've been reading for a long time from the National Rifle Association with its right-wing talking points. What the NRA has done with its rhetoric is to convince supporters that the purpose of the Second Amendment is to exercise coups d'tat whenever the Republican Party loses elections, which we can expect to continue for at least two more four-year cycles with the election of Hillary Clinton. Doesn't that mean that the right's anger will only continue to mount? In the context of their misguided Second Amendment theories, it's a strong indication that at a certain point, which has yet to be determined, some of them are really going to think that it's time to act like Timothy McVeigh.
Mr. Dow wrote that we should "read the Constitution, know the Constitution and learn from the Constitution about (our) civil rights." He should add the word "understand" and then take his own advice. The theory of the Second Amendment that he endorses is unconstitutional. In the context of American elections, it's virulently antidemocratic. It's intended to reverse voting results. It's also inimical to public order and dangerous to innocent people.
Stephen D. Clark
