"There's always been debate over if you're going to have gambling, if the government is going to be offering it, what are you going to do to help those who might fall into problem gambling situations and the impact it would have on not only them but their families."

A new tax on online gambling operators in the Philippines could drive up the nations already high office vacancy rate.

The tax, signed into law last month by President Rodrigo Duterte, may prompt foreign gambling outfits and Chinese-owned companies in particular to move elsewhere, according to Hong Kongs South China Morning Post. Vacancy rates may rise to 18 percent by the end of the year, the highest in 17 years, said Claro Cordero Jr., the local director of research at Cushmans.

The measure imposes a 5 percent tax on gross revenues of overseas-owned gaming companies, also known as Philippine offshore gaming operators, or Pogos. Foreigners employed by them must pay a 25 percent withholding tax. The nation is losing as much as 300 billion pesos ($59.2 million) a year to Pogos that move money overseas, according to local accounting firm Isla Lipana.

With the new and expanded tax regulations, both on the operations and employment of foreign nationals, Pogos may decide to locate in other jurisdictions, Cordero said.

Like many industries, Pogos have been hit hard by the pandemic. More than half the nations 60 registered Pogos have shuttered since it began. New Jersey voters face two ballot questions when they vote this November, both asking them to rewrite the state Constitutions rules on legalized gambling.

The first is whether to expand the ability to bet on collegiate teams and sporting events in New Jersey; the law already allows betting on college sports events that take place outside the state. The ballot question is ultimately an extension of the law signed in 2018 that permits sports betting in casinos and racetracks but excludes any gambling involving New Jersey college teams and any collegiate sporting events in the state.

The second is whether to allow nonprofit groups that conduct games of chance like bingo or raffles to use the proceeds to fund their operations. Because wagering is enshrined in the state Constitution, any changes must be authorized by voters.

At the top of the Nov. 2 election is the choice for governor between Phil Murphy, the Democratic incumbent, and Republican Jack Ciattarelli. All 120 seats in the Legislature are also up for election, as are local offices.

College sports betting was not included in the original gambling legislation because lawmakers and others had concerns that student athletes may be subject to match-fixing if gambling was authorized. However, the NCAA recently adopted a policy allowing college athletes to receive compensation from endorsements and commercials following a U.S. Supreme Court ruling that prevented the organization from barring that compensation. That change has lowered the risk of gamblings possible effect on athletic performance.

Another reason New Jersey lawmakers sought the change: the prospect of the tax revenue that could come from gambling on in-state college sports.

The state now charges an 8.5% tax for in-person betting and 13% for internet wagers. The nonpartisan Office of Legislative Services estimates that, if passed, this amendment will increase revenues to the state and some counties and municipalities as a result of the expansion of sports wagering, but it was unable to determine exactly how much revenue might come in. According to Bloomberg, casinos, racetracks and online gambling providers generated $302.7 million in tax collections for the state in 2020. Of that sum, about $50 million in tax revenue was generated from sports betting, according to data compiled by the state Division of Gaming Enforcement.

Sen. Vin Gopal (D-Monmouth), a primary sponsor of the resolution asking voters to make the change in November, credits his support to the tax revenue that would be generated as a result.

Sports betting generates a large tax revenue for New Jersey, and sports betting operations pay a 1.25 percent tax that goes to towns and counties, Gopal said. That is money that goes towards economic development, including road improvements, transportation and infrastructure, tourism, public safety, and properties located on or near the racetrack.

A specific source of revenue that lawmakers are hoping to capitalize on is the NCAA Mens Basketball Eastern Regional Tournament set to take place in Newark in 2025. Sen. Paul Sarlo (D-Bergen) has said that prohibiting gambling on an event of that size would be a missed opportunity for the state.

But that may not be enough to convince New Jerseyans to pass the legislation. A recent poll from Stockton University indicates that voters are leaning against permitting gambling on college sports. The poll said 45% opposed the amendment, with 40% in support and 14% unsure. These results reflect a shift in public opinion from an earlier poll, in which only 25% of voters supported the proposal to expand sports betting, 26% were undecided and 49% were opposed, but does not indicate voters will approve the decision. The poll was conducted during the week of Sept. 17-25 and featured responses from 552 registered and likely voters who were interviewed by phone. The polls margin of error is +/- 4.1 percentage points at a 95% confidence level.

New Jerseyans have not always embraced all kinds of legal gambling, said John Froonjian, executive director of the William Hughes Center for Public Policy at Stockton University. In 1974, they voted against allowing casino gambling statewide, but two years later approved it while restricting it to Atlantic City. In 2016, voters rejected an expansion of casino gambling to north Jersey.

Voters have always been cautious about what forms of gambling they allow, Froonjian said.

In the case of this specific ballot question, the poll indicates that men ages 18-29 are most likely to vote in favor, while a majority of women and people ages 50 and older are more likely to oppose it, Froonjian said.

The question does not have universal support due to a lack of messaging, Froonjian said, adding, No one is advocating for why we should make this change.

Froonjian said Stockton plans to conduct another poll closer to November to get a more accurate representation of where New Jersey voters will stand on Election Day.

The second question on the ballot asks voters to allow certain organizations that can now legally conduct such games of chance as bingo or raffles to use the proceeds from the games to finance their operations.

Currently, nonprofit groups, including charitable, religious, fraternal and civic organizations, volunteer fire companies, and first aid or rescue squads must use the proceeds from any game of chance for charitable purposes.

If voters agree, the new amendment will allow the groups to direct proceeds from the games to their own operations. This privilege has already existed for veterans and senior citizens groups because of an approved ballot question in 2013.

The resolution to put the question before voters passed the Senate and Assembly unanimously.

Many non-profits have seen major financial set-backs over the last year, said Assemblywoman Yvonne Lopez (D-Middlesex), one of the sponsors, after the resolution passed the Assembly last June. We have seen that allowing veterans and senior citizen groups to use the proceeds from bingo and raffles has helped them tremendously and it is time we expanded those benefits to more groups.

Many nonprofit organizations have been negatively impacted by the pandemic, and this law could help them stay afloat, she stated. The charitable community is incredibly important to the people of New Jersey in times of crisis.

Assemblyman Gordon Johnson (D-Bergen) said that not only would this help organizations, but also the more than 30,000 individuals employed by them.

These hard-working employees perform incredibly important jobs, and the pandemic has dramatically impacted these programs ability to function, he said. The net proceeds from game nights will provide much needed support for these organizations.

So far, no groups or committees have formed to support or oppose this second ballot question and there has been no public polling to show where voters stand on this matter.

Election Day is Nov. 2. Early voting will commence Oct. 23 and end Oct. 31. Mail-in ballots need to be postmarked or deposited into a drop box by 8 p.m. on Nov. 2.

In the last 15 years, a lot has changed in the world of online gambling. We now have not only legal online sports betting available in more than 20 states, but growing numbers of states are exploring legalizing broader forms of online gambling.

Much of the recent discussion around UIGEA has been focused on the statutes daily fantasy sports carve-out, which allowed DFS to grow into a nationwide phenomenon that in some ways tested the waters for legalized sports gambling in the years before the Supreme Court issued its decision in the Murphycase.

UIGEA was a reactionary response to the growth of online gambling following the rise of household access to the internet.

Efforts to ban internet gambling began in the mid-to-late 1990s when the Internet existed in something of a regulatory black hole, with uncertainty over how and who should regulate the space. Never one to shy away from regulating a space it does not fully understand, Congress tried initially to ban online gambling outright. However, the votes were not there to pass an outright ban.

While the impetus for UIGEA has been tied to a variety of factors, including uncertainty as to whether other federal gambling statutes like the Wire Act incorporated the Internet and speculation that some terrorist organizations were using online gambling sites to launder money, the reality is that a number of different factors probably combined to push for a ban on Internet gambling.

The statute makes reference to Internet gambling causing debt-collection problems and uncertainty over existing laws applying to the Internet as the findings justifying enactment.

However, a ban would not prove feasible. Instead, Congress concluded its near-decade-long effort to ban online gambling with a statute riddled with exceptions that did not even define illegal internet gambling. It instead made it illegal for payment processors or operators to knowingly allow for or accept funding of unlawful internet gambling operations. UIGEA effectively made it illegal to transmit or accept money in association with an illegal gambling operation.

UIGEA came into being only as a legislative rider to the unrelated SAFE Port Act.

Recently, UIGEA has been associated with the rise of daily fantasy sports. The statute, amongst its many carve-outs, held harmless fantasy sports contests that meet certain criteria from its definition of bets and wagers, or the activities that are prohibited.

Of course, in the late 90s and early 2000s, virtually no one conceived of the idea of playing fantasy sports over a shorter time horizon than a full season. But leave it to online gamblers to find a workaround, and they did.

Shortly, after the passage of UIGEA, daily fantasy sports would be created out of the mind of Kevin Bonnet, a poker blogger, who was forced to shift gears when UIGEA shut down the world of legal online poker in the United States.

The carve-out for fantasy sports would not really gain traction until FanDuel and DraftKings made big advertising strides on the scene beginning in 2014. With popularity growing in daily fantasy, lawmakers began to take notice, but the train had largely left the station on putting daily fantasy sports back in the box.

Even when some daily fantasy sports companies departed from the UIGEA carve-outs language, there did not appear to be much interest from the Department of Justice (though there were rumored grand juries in Florida, we still do not know what was the scope of those federal investigations.)

Despite being around for 15 years (though passed in 2006, the bill was not effective for several years), the statute has not generated a lengthy history of application against online gambling operations.

Indeed, the most prominent prosecutions under the statute came following the April 2011 indictments of the operators of several prominent poker sites. The sites ran into trouble because they were allegedly attempting to disguise deposits as other types of commercial transactions in order to thwart banking systems, which would automatically block payments to gambling sites.

Despite a few high-profile applications of the law, like other federal gambling laws, UIGEA prosecutions appear to be low priorities for the federal government.

Even before UIGEA came into effect, there were efforts to undo what the statute was about to do and replace it with sensible restrictions. However, the legislation introduced by then-Rep. Barney Frank went nowhere.

If history is any predictor of the future, we are likely to see one or two high-profile prosecutions under UIGEA over the next 15 years. However, the statute is so riddled with exceptions that it may be a less-desirable weapon for prosecutors than other federal statutes.

For all its deficiencies, UIGEA does a few things well. Most prominently, the statute clarifies the question of intermediate routing (where data passes through a state en route to a state where the activity is permissible.) However, even where UIGEA provides a useful clarification, the statutes rule of construction limits that interpretation to UIGEA alone, leaving the question open for other federal laws including the Wire Act.

Times have changed since UIGEA was passed. While deficient, the statute could be a useful tool to protect the legal and regulated market by targeting those who violate the statute and threaten to undermine the regulated operators in the emerging U.S. market.

The Netherlands Gambling Authority KSA has released new guidance on advertising just before 1 October 2021, the opening of the Dutch licensed online gambling market. Furthermore, a Dutch gambling trade group has drafted an Advertising Code for Online Gambling and a concept of this Code was leaked to the press.

KSA advertising guidance

The KSA guidance concerns advertisements aimed at vulnerable groups, such as minors and young adults, and the use of role models in advertising, such as professional athletes and sports teams.

It is illegal to aim advertisements at vulnerable groups. In assessing whether an advertisement is targeting vulnerable groups, the KSA states that the following should be taken into account:

Content: what design, language, products and people are used in the advertisement, and do these appeal to a vulnerable target group?

Medium: is the advertisement visibly present in or around radio and television programmes or social media channels aimed at or popular among a vulnerable target group?

Location and time: is the advertisement broadcasted in commercial breaks on children's programmes, family programmes, and is the advertisement visible at or around secondary schools and childcare centers?

Target audience: is the audience age and the number of followers of the media or social media channels taken into account?

In addition, it is not permitted to use role models in advertisements under the age of 25 or role models with "substantial reach" among minors or young adults. The KSA has issued a guidance on the terms "substantial reach" and "reach of the role model".

Substantial reach: this term is not specified in law. The KSA assumes that there is no substantial reach if the percentage is between 25% and 30%.

Reach of the role model: license holders are obliged to research the reach of the role model among minors and young adults before collaborating with the role model. In order to establish the reach, all media channels on which the role model is active should be involved, including social media, TV, radio, lectures, interviews in magazines, etc. The results of the research should be an up-to-date and representative reflection of the reach of the role model at the start of the collaboration.

Note that it is not relevant whether an advertisement has substantial reach among young adults or minors when determining whether an advertisement targets a vulnerable group. Content, location and time of the advertisement can mean that an advertisement is aimed at vulnerable groups, even though the substantial reach of the deployed role model remains within the standard of 25% to 30%. In that case, advertising is not allowed.

Advertising Code for Online Gambling

The Netherlands has a self-regulating system regarding advertising, which means that the advertising industry (i.e. advertisers, advertising agencies and the media) in cooperation with the Dutch Consumer Association formulates the rules for advertisements. The Advertising Code Committee (ACC) is the body dealing with this system and the rules on advertising are contained in the Dutch Advertising Code (DAC), which contains a general section and special advertising codes. All advertisements must comply with the rules in the general part of the DAC. The special codes apply to advertising for specific products and services. Anyone who thinks that an advertisement violates the DAC can submit a complaint to the ACC. In case of a DAC violation, the ACC will uphold the complaint and recommend that the advertisers involved discontinue this advertising. The ACC cannot grant damages or impose fines. However, there is a compliance rate of 95% of all ACC recommendations, due to the ACC's policy of "naming and shaming" publishing the names of advertisers unwilling to comply and cooperate on the ACC website.

In early September, a draft version of a special advertising code for online gambling was leaked to the press. A trade group representing the VAN, made up of Dutch land-based gambling companies, prepared this Code, which apparently contains a rule limiting online gambling commercials per TV commercial break to a maximum of three. One online gambling advertisement will be permitted in a three-minute TV commercial block. A maximum of three gambling advertisements will be permitted when there is a three-to-five minute TV commercial block.

NOGA, the Dutch trade group for online gambling companies, reacted with disappointment to the text of the draft Code. According to the NOGA, the rules for online and offline gambling advertisements must be the same since consumers do not distinguish between offline and online gambling advertisements.

NOGA wants operators and groups from across the online and offline sectors to come together and agree on a workable advertising code to avoid saturation advertising and the risk of a total ban.

HARTFORD, Conn. (AP) The long-awaited rollout of sports wagering in Connecticut will begin on Thursday when Foxwoods Resort Casino and Mohegan Sun officially launch their retail operations.

The long-awaited bets can be placed now that the state Department of Consumer Protection has approved the state licenses Foxwoods Resort Casino and Mohegan Sun need to launch sports betting on the tribal reservations.

With NFL season in full force, its game on, and we look forward to a successful launch.

Meanwhile, the Connecticut Lottery Corporation says its aiming to begin retail and online sports betting during the first week of October. All three entities the two tribal casinos and the states lottery have been working to get their necessary approvals in time for the NFL regular season, which opened Sept. 9.

The Mashantucket Pequot Tribal Nation and its partner DraftKings Inc. announced Wednesday that players will be able to place bets beginning Thursday at the temporary DraftKings Sportsbook at Foxwoods and betting kiosks throughout the casino. Statewide, off-reservation online sports betting and iGaming are expected to be launched in early October, pending regulatory approvals.

The Mohegan Sun FanDuel Sportsbook is scheduled to open Thursday morning at Mohegan Sun, enabling players to place bets at four live betting windows or through 50 self-service betting terminals. A ribbon-cutting ceremony is planned.

It will mark the first step in Connecticuts unveiling of retail and online sports betting and other internet gambling in the state over the coming weeks. Its been roughly four months since the General Assembly approved an agreement reached between the two federally recognized tribes and Democratic Gov. Ned Lamont, allowing the states gambling agreements with the tribes to be amended and enabling both to offer sports betting, online gambling and online fantasy sports in return for providing the state a share of the revenues.

Lamont is expected to appear at both casinos on Thursday.

Connecticuts new law also allows the states quasi-public lottery to offer online sports wagering and retail sports betting at 15 locations, including ones specifically located in Hartford and Bridgeport. At least 10 of those locations will be existing retail locations owned by Sportech, the states off-track betting operator. The lotterys retail and online sports betting offerings will operate under the PlaySugarHouse brand.

On Tuesday, DCP approved the master gaming licenses and other licenses needed for on-reservation sports betting for the two tribal casinos after a decision from the U.S. Department of Interior approving the gambling arrangement between the state and the tribes was published in the Federal Register.

The agency also approved master gaming licenses for the lottery and its partner Rush Street Interactive. But Kaitlyn Krasselt, a spokesperson for DCP, said the agency is still waiting on some documents before a soft launch can be scheduled.

During an interview on Tuesday, Sportech and Rush Street Interactive executives said the first three Sportech venues in Stamford, Windsor Locks and New Haven which all have restaurants and numerous television screens for patrons to watch sports are expected to roll out sports betting kiosks in the first week of October. Theyll have proprietary software that offer players a slew of betting options. There will also be staffed teller windows at each site.

The other seven Sportech locations are expected to begin offering sports betting through the remainder of October. Richard Schwarz, president of Rush Street Interactive, said mobile betting is expected to be launched in early October as well.

Despite the competition from Foxwoods and Mohegan, Schwarz said he believes the lotterys offerings will stand apart considering the variety, cross-marketing opportunities with the lotterys 2,900 CT Lottery locations, and the proximity of residents to Sportech venues across the state.

I think the proximity to population centers and the convenience that we offer is something thats going to stand out, Schwarz said. We also have a lot of innovation on the product side.
