Online Gaming and the Struggles of the State Governments – NewsClick

Over the past two to three years, many states in India passed laws banning online games, primarily because children and young adults were losing money and being pushed to suicide. These laws have been challenged in courts by gaming companies.

Telangana was the first state to promulgate an official ban on online gambling and betting in 2017. Following suit in 2020, Andhra Pradesh banned online gaming.

In the same year, Tamil Nadu also amended laws to ban online gaming, but the Madras High Court struck down the Act, and the state government moved the Supreme Court against it.

Similarly, in 2021, the ban on online rummy in Kerala was lifted by the Kerala high court, stating that it is "a game of skill."

Karnataka's legislation also banned betting and wagering in online games in October 2021. But following a case filed against it, the Karnataka high court put a stay on the new law.

Last week, after an 11-year-old boy allegedly died by suicide after losing Rs 6,000 in an online game in Bhopal, the state home minister said the Madhya Pradesh government would soon introduce legislation to ban online games.

These states have taken the drastic step of banning online games to prevent addiction, debt and suicide. However, we have seen that despite the ban on games like PUBG and Tik Tok, these games continue to have users in India.

The erstwhile All India Anna Dravida Munnetra Kazhagam (AIADMK) government under former chief minister Edappadi K Palaniswami amended a 90-year law banning online games in November 2020.

Within a few months, the amendment was challenged by the gaming company Junglee Games India in the Madras High Court, and in August 2021, the first bench of the court overturned the ban.

The court said that the amendment is "so unequivocally audacious that it rules out any element of choice that an individual may exercise."

In December 2021, the Dravida Munnetra Kazhagam-led (DMK) government moved the Supreme Court against the Madras High Court order. The government argued that gambling addiction is the reason behind many crimes, suicides and social ruin and cited larger public interest to restore the ban on online real money games.

Political parties have urged the govt to take steps to contain online gaming, and chief minister MK Stalin has said he will bring an end to online gaming.

However, the Federation of Indian Chambers of Commerce & Industry's (FICCI) Gaming Committee (FGC) has urged the Tamil Nadu government to adopt an enabling gaming policy protecting players while ensuring a secure and responsible gaming environment.

There is a lot of confusion between gaming and gambling concerning the online space.

Bharatiya Janata Party member Sushil Kumar Modi, who urged the government to come up with a "comprehensive framework" to regulate online gaming during the winter session of the Parliament, conflated legal online gaming with illegal betting and gambling.

Cyber Lawyer Karthikeyan. N told NewsClick, "Game of skill is categorised as a game and game of chance is categorised as gambling. For example, rummy is considered a game of skill because it is necessary to know how to smartly use the cards, unlike card games like mangatha and ulla-veliya, which are purely based on chance."

He also added, "Although skill is necessary to perform well in a rummy game, online rummy games can be pre-programmed based on algorithms, and skill may not suffice, yet as of now it is considered as a game."

Online gaming applications trick people into thinking that they are playing a game against other humans like themselves; however, they are often completely programmed using artificial intelligence. Besides gaming and gambling, this could even amount to cheating.

Gambling is a state subject in India; states can formulate and implement laws banning and regulating them. However, states that have passed laws on online gaming and gambling don't have a method to implement them.

Karthikeyan said, "If a game is banned, how will the state ensure that Google Playstore or other platforms remove the game in a particular state. Given that online gambling is not specific to location, it should be regulated by the Centre. It should at least be brought to the concurrent list."

He further added, "If a game is banned, only the name of the game is banned. The same application might continue to exist with a different name, or people may download it using alternate platforms. The state cannot go after every game. Banning is never a good solution."

"Regulating online gaming and forming a regulatory body to overlook and review implementation is a better solution. Moreover, there is no point in putting a penalty on people; the penalty should be on the companies if laws are not implemented," he added.

Moreover, other countries already have laws in place to regulate online gaming. Karthikeyan said, "China has done a good job regulating online gaming. They have an age limit verification system, and a cap is set on the amount of time and money that can be spent on a game in a day."

One of the main factors that adds uncertainty to online gamblings legality is the lack of a conclusive international gambling law. Many countries legislations are direct oppositions to others views on the topic.

There is no EU legislation regarding gambling services specifically. Instead, the EU leaves the creation of gambling laws to their members autonomously. Except, there is one law that applies to online gambling providers. The Treaty on the Functioning of the European Union (TFEU) is the EU courts list of fundamental freedomswithin the Union.

The way this law has been applied to gambling implied that any online casino with an EU license is allowed to operate in every EU country, regardless of their own legislation. But its never quite as easy when two opposing laws from different courts collide. In Germany in particular, this has led to a gray area when it comes to the legality of online gambling.

The problem in Germany has been, and continues to be, that it is not settled and put down in legally binding form, under which circumstances exactly EU law overwrites the national legislation. Many online casino providers use this legal uncertainty to offer their gambling websites in Germany, until someone makes an indefinite decision and enforces it. Some providers, such as Twin Casino, acknowledge the latest German gambling law to be exactly this.

In July 2021, Germany legalized online gambling for the first time. Any provider who had offered their games to German citizens before was according to national law doing so illegally, but the EU law left them mostly unbothered by German law enforcement. The new law states that only the casino providers who own the new German license are allowed to legally operate there.

With Germany finally defining under which circumstances online gambling is allowed, many casinos who did not meet these criteria changed their stance and removed their service from the German market. There are two reasons why they wont register for the license instead:

Casinos that are currently banned for German players might decide to remain that way, so they wont have to remove game types and restrict their players too heavily. Or they might be waiting for the proper implementation of the law and are working on meeting the license criteria.

Much like in Germany, since the 2014 Gambling Act passed, the national license provided by the United Kingdom Gambling Commission is the only license that allows casinos to legally offer their services in the UK. It wasnt possible to predict every little change that would be set off by the UK leaving the European Union. Especially not regarding topics with such unclear legislations in the first place.

With leaving the Union, the UK lost the treaties that created partnerships between EU states. Without the TFEU, casino providers from the UK or other countries had to rearrange their business affairs. There were many questions to ask:

Are UK casinos now illegal in other EU countries? Are UK licenses owned by international casinos still valid? What about Gibraltars status as an oversees territory? How does Brexit affect the many casino businesses registered there because of the local tax relaxation? Will changes in laws and taxes drive businesses out of the country?

Much like after the freshly introduced law in Germany, not all of these questions can be conclusively answered yet. Business and government issues resolve slowly after many meetings and revisions, till the conditions are finally set in stone and can be acted upon or enforced. Many casinos have halted their services in the UK, while they are unsure whether they must renew their UK license after Brexit or not.

It is unlikely that there will ever be an international authority on online gambling laws. As long as the individual jurisdictions create their own rules, there will be anomalies like this gray area created by the overlapping of multiple laws with different origin and the bureaucratic hurdles from passing a law to properly enforcing it.

Luckily, the effect this has on the players is comparably small. They might be inconvenienced by mandated limits, lose their favorite games, or have to join a different online casino. The bigger burden is on the online gambling providers. Their livelihood depends on these changes and forces them to navigate these complicated circumstances. Many of them will lose players and income, pay higher taxes or fees for additional licenses.

Jan 19 (Reuters) - BetMGM raised its 2022 revenue forecast to more than $1.3 billion from $1 billion on Wednesday and said it expects a core profit in 2023 as the U.S. sports-betting joint venture between MGM Resorts and Britain's Entain expands.

The online sportsbook for betting on NFL American football and NBA basketball was in the spotlight last year when both MGM and DraftKings (DKNG.O) tried and failed to take over Entain (ENT.L).

Gambling companies have been looking to capitalise on the growing U.S. sports-betting market, while online gaming has also taken off since the start of the coronavirus pandemic.

BetMGM said it was gaining market share in line with its long-term target of 20%-25% in U.S. sports-betting and iGaming.

The U.S. venture, which is the No. 2 operator for sports betting and iGaming, has grown steadily and challenged FanDuel owner Flutter , the No.1 player in the American market, with its owners expected to invest another $450 million in 2022.

Shares in Entain rose 1% and New York-listed MGM inched up 0.2% by 1443 GMT.

Peel Hunt analysts said on Tuesday BetMGM was key to their valuation of Entain, saying the venture could be sold at the right price or could be the key reason why MGM makes another approach for the British bookmaker.

Entain's boss said in November that BetMGM was one of the reasons why DraftKings' $22 billion offer to buy the British firm fell through as MGM would have sought to take full control of the joint venture. read more

BetMGM's net revenue is expected to be about $850 million in 2021, up nearly five times from 2020, while its core loss is seen in the range of $420 million to $440 million.

Gambling killed my husband. We must stop this predatory industry claiming more lives – The Guardian

This time last year, my husband Luke and I had everything we wanted: each other, a lovely house and two wonderful children. Three months later, this life was shattered. On 22 April 2021, Luke took his own life.

About two years before his death, Luke developed a gambling disorder. He started gambling with friends on a Saturday, placing bets at a local bookies while watching Leicester City, his football team. At the time, I didnt think it was dangerous I had no idea that gambling kills so many people.

Soon, Luke began to bet online. He opened multiple accounts, taking advantage of free bets aggressive marketing offers used by online bookmakers to lure people into gambling. From there, he was encouraged to bet on sports, like horse racing, that he knew little about. It didnt take long for him to get into a lot of debt and start chasing his losses.

If you knew Luke, youd find it hard to comprehend that he gambled. My husband was sensible and careful with money. He would save whenever he could, and bills were always paid on time. As a warehouse manager at a local family printing firm, he often found ways of saving the company money, something he was held in high regard for.

I only became aware he was in trouble after I noticed he was struggling to pay for cinema trips or meals out. Gambling on a phone is very isolated, and it took me a year to understand he was gambling so much. We had just sold our house, so luckily we could pay off the debts he had accumulated and, much to my relief, Luke closed his gambling accounts. This seemed enough. Luke had never had issues with gambling before and I had no reason to think he would again.

But in 2020, Luke was furloughed because of the pandemic. He began gambling again in secret, reopening his old accounts. I remember him often commenting on how relentless the marketing emails he was getting were; he was concerned about the impact they would have on people who were already struggling with money. Naively, I thought this meant Luke could stop gambling when he wanted to like the GambleAware slogan: When the fun stops, stop.

Three weeks after his suicide, the police gave Lukes phone back to me. It was then that I realised his gambling disorder had returned. His relapse was so rapid that I still cannot believe it was never picked up by these gambling companies who at the start of the pandemic had promised to do more to protect vulnerable customers like Luke. On one account he reopened during the pandemic, the pattern of his gambling was obviously harmful. He took advantage of a free bet offer, deposited money, lost money, was immediately advertised another free bet offer, and the cycle would begin again.

It is not in the gambling industrys interests to stop people developing gambling addictions. It spends 1.5bn a year on advertising to bring in customers to get hooked on its products for profit. Some 60% of its profits come from from 5% of customers who are already problem gamblers, or are at risk of becoming so. And they are huge profits the UK industry is worth about 14bn. These companies know a staggering amount about their customers in some cases they will know if someone earning 30k a year has gambled 60k in a few months, and do nothing to stop it. They track their habits and patterns and vulnerabilities online to find out when best to advertise to them and what kind of emails they are most likely to open. They could, if they wanted to, use this information to help people, to block their accounts; but often they use it to drag them further into addiction. When people like my husband try not to gamble, they are targeted more aggressively. One gambler who got his data back from an online gambling company and shared it with the New York Times found that as someone who had given up gambling, he had been profiled as a customer to win back.

How do these gambling companies get away with it? Because they can. The entire industry is fuelled by a money above all else mentality that is devoid of morality.

In a 2021 report, Public Health England estimated that there are more than 409 gambling-related suicides in England every year. That is more than one life lost every single day. That is why I am campaigning for Lukes law to ban gambling incentives such as free bets. Luke found that being bombarded with ads from that 24-hour bookies and casino in his pocket made it a problem that became impossible to escape. Banning these incentives may go some way to alleviating the misery that gambling companies cause families like ours with their predatory actions.

The gambling lobby is very powerful just look at all the MPs who get paid off with tickets to sports games to speak in its favour. But unlike so many who caution against change to gambling regulation, I am not on anyones payroll. I would give anything for this catastrophe to not have happened to me and my family. It has been traumatic and the fight is draining, but I do not feel I have a choice. The government is currently reviewing gambling legislation laws that were drawn up before smartphones. This is a real chance to make changes that could benefit everyone not just the few who are making money from misery.

We banned tobacco marketing; we can do the same for gambling.

My children will never see their father again. But I hope that by getting Lukes law passed, he may have saved others from falling for the same fate. It gives me some small solace, and I hope it gives our children that too among their grief.

As Premier Doug Ford's government prepares to open up the online gambling market in Ontario, there's a warningthat its plans could see the province and municipalities lose out on hundreds of millions of dollars in annual revenue.

That warning is in a new report by a gambling industry consulting firm, obtained by CBC News. The report was prepared for Great Canadian Gaming, the company with the largest share of Ontario's casino market.

Even though Ontario will have a new source of revenue from taxing the newly regulated online gaming sites, the report argues that the province will end up short-changed.That's because itpredicts a big shift in spending from land-based casinos to internet gaming.

Because the tax rate Ontario is expected to impose on online gambling sites is much lower than thepercentage the government takes from casino spending, the report concludes that the province stands to lose out on $550 million in annual revenuefor a total of $2.8 billion over the next five years.

Pre-pandemic, annual provincial revenues from lottery and gambling amounted to as much as $2.5 billion.

But companies involved in the online gaming sectorsay the report's conclusions are flawed.

In particular, they question the key assumption underpinning the report: that existing casino customers will suddenly start spending much less of their money in casinos and more on internet gambling websites that are already available to them.

"When the regulated market opens in Ontario, nothing is going to change in respect to players' entertainment habits," said Jeffrey Haas, senior vice-president of DraftKings Inc., which offers U.S.-based online sports betting and online casino products.

"People who are playing in online casinos and online sportsbooks and online poker rooms will continue to do so, except they're going to go from playing offshore to onshore," he saidin an interview. "And anybody who continues to walk into real casinos in order to play games there will continue to do so."

Officials from Great Canadian Gaming declined CBC's request for comment about the report's findings.

The report by HLT Advisory Inc., titled Ontario Gaming Market Assessment,is labelled "Private & Confidential" and dated Jan. 11.

It says the government's proposed "open licence" model for e-gaming will result in online sites more than tripling their share of Ontario's overall gambling market, estimated at around $7 billion a year.

"If an open-licence e-gaming model is implemented in Ontario, e-casino would capture a significant share of the total casino market," says the report, basing that conclusion largely on the U.K.'s experience after opening its e-gaming market in 2005.

Land-based casinos in Ontario must currently hand over 55 per cent of net gambling proceeds to the province. The Ford government has yet to announce what percentage it will take from regulated online gambling sites, but the report bases its assumptions on a 20 per cent tax rate, which industry sources say is likely accurate.

Finance Minister Peter Bethlenfalvy, who is responsible for Ontario's internet gambling regime, declined a request for an interview.

Ontario's casinos have been hammered during the COVID-19 pandemic. They were completely shut down for months, and when they were allowed to reopen, they faced capacity limits. Travel restrictions at the border also meant casinos in such cities as Niagara Falls and Windsor were starved of their U.S. customers.

All casinos in Ontario are currently shut down right now under the province's latest restrictions, brought in on Jan. 3 as a result of the Omicron variant of COVID-19.

Industry figures estimate that Ontariansspend some $500 million a year on internet gambling, nearly all of it on companies that operate outside of Canada. The provincial government puts the figure at $1 billion.

Sites such as PokerStars, JackpotCity and Bet99 advertise widely to Ontario audiences, and there is no enforcement stopping Ontario residents from gambling online through sites based in other jurisdictions.

Last July, the government announced the creation of iGaming Ontario, the agency that will oversee the online gambling offered by the companies that sign agreements with the province.

CBC News asked the Ministry of Finance to provide its forecasts for the impact that online gambling will have on provincial revenues.

The province has not incorporated e-gaming into its financial projections, but more information may be provided in the next budget, said ministry spokesperson Scott Blodgett.

"The government intends to establish a competitive market for online legal gambling that will reflect consumer choice while minimizing the risks to consumers who play on these websites," said Blodgett in an email.

"The new iGaming market is being developed to exist in parallel with land-based gaming activities in Ontario's regulated market, and not detract from [Ontario Lottery and Gaming's]revenue generation."

Just how much online gaming will eat into Ontario casino revenue is a hotly debated question, says Paul Burns, president of the Canadian Gaming Association, which represents companies in all sectors, including land-based and web-based operators.

"Drawing comparisons from different markets in different jurisdictions" may not be an accurate picture of what will happen when Ontario starts regulating online gaming, Burns said in an interview.

"Online gaming is [in Ontario], it's just not regulated, it's not controlled. It's not put to the same regulatory standards the casinos are held to," he said.

Ontario's casino operators want to have a role in the online gaming market, and a level playing field with the online-only operators, said Burns.

"They're anxious to be able to participate and compete and create an opportunity for their own customers who may be gambling on other people's sites, to try and bring them back into their business," he said.

The consultant's report predicts the changes will result in land-based casinos shrinking their workforce by 25 per cent, resulting in the loss of some 2,500 jobs.

"I am deeply concerned about the impact this is going to have on jobs, but also the overall impact on our communities and province," said Jerry Dias, national president of Unifor, the union that represents the bulk of the 10,000-strong casino workforce in Ontario.

"From a jobs point of view or an economic strategy point of view, it's a fool's game," said Dias in an interview. "It doesn't make any sense to me at all."

Ontario municipalities that host casinos would also lose out on $35 to $40 million in annual revenue, according to the consultant's report.

"There is cause for concern, but we're not overly concerned," said Dave Ryan, the mayor of Pickering, Ont.,where a casino with 2,400 slot machines opened last summer just off Highway 401. The municipality is projected to take in $14 million per year in proceeds.

"We believe that there is always going to be room for the bricks-and-mortar gaming," he saidin an interview. "We're social animals. People like to get out, congregate and enjoy that experience. Plus there's the entertainment factor that you don't have online."
