NY trial over US Capitol riot tests freedom of expression limits – FRANCE 24

Free speech may be sacred in the United States but calling for the killing of US lawmakers on social media is unlawful, a New York jury ruled Wednesday after a weeklong trial that revisited the January 6 riot at the Capitol.
The federal trial, the first related to the storming of Congress by supporters of ex-president Donald Trump, was viewed as a test case for the limits of freedom of expression protected by the First Amendment of the US constitution.
After just three hours of jury deliberations, Brendan Hunt, a 37-year-old court employee who uses the alias "X-Ray Ultra," was found guilty of threatening to murder elected officials including Democratic congressional leaders Nancy Pelosi and Chuck Schumer, and progressive congresswoman Alexandria Ocasio-Cortez.
He was convicted of an "intent to impede, intimidate and interfere" with the performing of their official duties, specifically Congress's vote on January 6 that confirmed President Joe Biden had won November's election over Trump.
Hunt was also charged with "intent to retaliate" over the electoral college vote count, which affirmed that Trump would have to leave the White House after just one term.
The charges related to several messages that Hunt posted on social networks. The first dated back to December 6 when, on Facebook, he called on Trump "to hold a public execution of pelosi aoc schumer etc."
"And if you dont do it, the citizenry will," he wrote.
"Start up the firing squads, mow down these commies, and lets take america back!"
On January 8, two days after Trump supporters stormed the Capitol to try to stop the count, Hunt posted an 88-second video on BitChute, a platform beloved by the far right, titled "KILL YOUR SENATORS."
"We need to go back to the U.S. Capitol when all of the Senators and a lot of the Representatives are back there, and this time we have to show up with our guns," he said, addressing the camera.
Hunt, using a number of expletives, added that he would "go there myself and shoot them and kill them."
It was because of the video message that the jury found Hunt guilty, a spokesman for prosecutors said after the verdict.
The FBI has arrested more than 400 people in relation to the January 6 violence, which Biden called "an insurrection."
Among the thousands of calls they received was one alerting them to Hunt's video.
Hunt, the son of a retired judge, calls himself an actor, musician and journalist. He was arrested at his home in the New York borough of Queens on January 19, the day before Biden's inauguration.
Officers did not find any weapons, or evidence of involvement or communication with any extremist groups.
- Threats or 'nonsense rant'? -
Prosecutors did not claim that Hunt, who read "Mein Kampf" and called on Trump to seize power "like Hitler," was in Washington on January 6 or even that he intended to go.
The trial focused on whether Hunt's threats were serious and whether he really intended to attack elected officials as prosecutors argued.
Hunt's court-appointed lawyer Leticia Olivera said the messages were just "a nonsense rant" that were constitutionally protected free speech.
She argued that they should not have been taken seriously given that Hunt had admitted alcohol problems and his video channel only had 99 subscribers.
"As nonsensical and offensive as it may be, he has the right to say these things," Olivera told the trial, adding that "no one" took the posts seriously and Hunt himself removed his video from BitChute the next day.
Prosecutor David Kessler said in closing arguments Wednesday that "the first amendment does not protect" against such threats.
"The government does not need to prove that the defendant attempted to kill. Making the threat is the crime," even if it is made on social networks and not addressed directly to the people targeted, he added.
The jurors, who were made to watch a video of the attack on the Capitol and who listened to evidence by a police officer who was there that day, ultimately agreed with the prosecution.
But experts expect the verdict to be contested in a country where the constitution is sacrosanct.
"On appeal, I am sure the free speech issue will be raised," Dmitriy Shakhnevich, a criminal law professor at New York City University, told AFP.
Hunt faces up to ten years in prison.

American Freedom Insurance Company Refusing To Pay For Crash Victims Repairs After They Cant Reach Their Own Client, Who Caused The Wreck – CBS…

CHICAGO (CBS) Complaint after complaint; several online reviews allege an Illinois company is routinely denying insurance claims. Experts tell CBS 2 the reason being given is nonsense.
Morning Insider Lauren Victory takes you inside a suburban mans fight to get his car fixed.
Tom Noonan isnt sure what sound is worse: the scraping of his battered Buick on the ground, or the silence on his claim to fix it.
You gotta keep calling them, and calling them, and calling them. They dont answer, said Noonan of the insurance company hes fighting.
His problems began at a Tinley Park intersection back in February. Police arrested a man for driving without a license, who minutes before cut a left too closely.
Just went right in front of me and I smacked him right there, said Noonan pointing to a diagram of the accident.
He told CBS 2 he had the right of way.
I hit him on the passenger side rear, Noonan said.
Thankfully, no one was hurt. The cars were the real casualties.
Bumper. Gotta get the grill [fixed], said Noonan, explaining necessary repairs which he estimates will cost about $3000. I think this is the big empty space where the light goes.
The other drivers insurance provider, American Freedom Insurance Company, denied Noonans claim. A recent letter from the company read our insured has failed to provide the company with a written statement of facts.
They cant get a hold of him, so Im on my own. Ill have to sue the guy that hit me, Noonan said.
CBS 2 shared Noonans situation with Bob Hunter, the former Insurance Commissioner for the state of Texas.
The excuse that theyre giving for not paying promptly is inappropriate, said Hunter, who now works as the Director of Insurance for the Consumer Federation of America. They should be able to contact their own client. If they cant, then thats their problem, not the person who is waiting to be paid.
Multiple Better Business Bureau reviews of American Freedom Insurance detail the same problem.
Dan H writes in one review: denied my claim because their insured would not answer the phone.
Data from Illinoiss Department of Insurance (IDOI) shows American Freedom Insurance Company has nine times the amount of complaints of a typical business its size.
Its a history that doesnt surprise Noonan. Hes been waiting on repairs for almost three months.
CBS 2 gave American Freedom Insurance days to review Noonans claim and to respond to this story.
Cris, from American Freedom Insurance marketing, finally wrote back to us saying the company feels its denial was appropriate based on a breach of policy provisions. We asked, but Cris did not clarify who breached what policy.
CBS 2 asked IDOI what a consumer should do if the person liable for damaging a vehicle is a policy holder with a company that is refusing to cover costs. An IDOI spokesperson said, if a policyholders vehicle is damaged in a collision, and they are unable to get reimbursement/repairs from another drivers insurance company, they can file a claim under their own policy if they have collision coverage. If the policyholder does not have collision coverage, then they may seek recovery by filing suit against the other driver.
Noonan did not have collision coverage on his Buick.
Consumers can also file a complaint with the IDOI.

‘This is not freedom’: People around the world react with disgust at high US healthcare costs – Raw Story

"I couldn't have survived if I was in America."
That's what one woman concluded in a video published Wednesday by the New York Times' opinion section, after recounting the weeks she spent in the hospital as a child being treated for a brain virus.
She was just one of several people from around the world who participated in the Times project. Throughout the video, residents of Canada, Finland, Germany, Japan, Singapore, Sweden, Taiwan, and the United Kingdom respond to the high costs of healthcare in the for-profit U.S. system.
The United States is the only industrialized country in the world without universal health coverage. While the stars of the Times video were shocked and outraged upon learning how much care costs in the so-called "land of the free," progressives in the U.S. responded with calls for Medicare for All.
"No one in America should vote for politicians who choose to subject us to this," Briahna Joy Gray tweeted in response to the video. The Bad Faith podcast co-host and Current Affairs contributing editor served as press secretary to the 2020 presidential campaign of Sen. Bernie Sanders (I-Vt.), a longtime champion of Medicare for All.
In the video, residents of various countries reviewed some private health insurance options for U.S. residents and tried to make sense of terms like copay, deductible, and OOP max, which stands for out-of-pocket maximum, or the highest amount of money enrollees have to pay annually for healthcare services covered by their plan.
People for Bernie, which grew out of Sanders' 2016 run for president, also shared the video and asserted that the "acceptable OOP max is $0."
Some people in the U.S. praised the video as "so, so good" and "very well done." Waleed Shahid of Justice Democrats called it an "excellent video about the cruelty and inefficiency of our healthcare system."
Others echoed the outrage of video participants. As NARAL Pro-Choice America president Ilyse Hogue put it: "The definition of insanity is this."
In the video, a man in Sweden contrasts the healthcare system in his country with that of the United States. "To know that I can get sick, I can get injured, but I will still be taken care of, that is freedom," he says. "This is not freedom."
Despite conclusions from policymakers and medical expertsincluding a Lancet panel in Februarythat "single-payer, Medicare for All reform is the only way forward," President Joe Biden has made clear he opposes that path to universal coverage.
Biden unveiled his American Families Plan early Wednesday. Despite pressure from progressives in the House and Senate as well as dozens of advocacy groups, he declined to include an expansion of Medicare and drug pricing reforms in the plan.
Ahead of Biden's Wednesday night address to Congress, Sanders declared in a video from his Senate office that "we've got to deal with healthcare."
"We remain the only major country on Earth not to guarantee healthcare to all people as a human right," he said. "We pay the highest prices in the world for prescription drugs. We have got to summon up the courage to take on the healthcare industry, the pharmaceutical industry."
"My own view, as you know, is that we need a Medicare for All, single-payer system," the Senate Budget Committee chair added, expressing hope that lawmakers can begin that process by expanding the programby both lowering the eligibility age from 65 and including dental, hearing, and vision benefits.
"We pay for that by demanding that Medicare start negotiating prescription drug prices with the pharmaceutical industry," Sanders explained, citing estimates that the reform would raise $450 billion over a decade.

Arkansas Legislature sends third and final constitutional amendment concerning religious freedom to November 2022 ballot Ballotpedia News -…

On April 27, the Arkansas State Legislature passed a third constitutional amendment titled the Arkansas Religious Freedom Amendment, which will appear on the states November 2022 ballot.
The measure would amend the state constitution to provide that government shall not burden a persons freedom of religion even if the burden results from a rule of general applicability. The amendment would provide an exception to this requirement if the burden to the person is in furtherance of a compelling government interest and is the least restrictive means of furthering that compelling government interest
To put a legislatively referred constitutional amendment before voters, a simple majority vote is required in both the Arkansas State Senate and the Arkansas House of Representatives. The Arkansas Legislature is able to refer up to three constitutional amendments to the ballot for each general election.
The amendment was passed in the Senate on April 22, 2021, by a vote of 27-4 with four members absent or not voting. The House passed the amendment on April 27, 2021, by a vote of 75-19 with six members absent or not voting. The measure was passed along party lines with most Republicans in favor and Democrats against it. Republican Representative Josh Miller was the only Republican legislator to vote against the amendment. Larry Teague was the only Democratic legislator to vote in favor of the amendment.
One of the other referred amendments would require 60% supermajority voter approval to ratify constitutional amendments (legislatively referred and citizen-initiated) and citizen-initiated state statutes. The other amendment would allow the state legislature to call itself into special sessions. Arkansas is one of 14 states where only the governor can call a special session.
A total of 44 measures appeared on the statewide ballot in even-numbered years between 2000 and 2020. During even-numbered years between 2000 and 2020, 73% (32 of 44) of statewide ballot measures in Arkansas were approved by voters, and 27% (12 of 44) were defeated.
The amendments to prohibit government burdens on religious freedom and to allow the state legislature to call itself into special session were proposed at least partially in response to the COVID-19 pandemic and related restrictions and government responses. Ballotpedia has tracked at least seven statewide measures put on the ballot in response to the COVID-19 pandemic and related regulations. Ballotpedia is also tracking seven potential statewide measures proposed in response to COVID-19.

Jada revealed her first reaction after Willow opened up about being polyamorous. She recalled, "When you were like, Hey, this is my get down.I was like, I totally get it.'Wanting to set up your life in a way that you can have what it is that you want, I think anything goes as long as the intentions are clear". Gammy (Adrienne), too, admitted that sheconsidered polyamory with her hubby, Rodney, before they got married.
Adrienne stated,Even outside of the counselling that you get from your pastor before you get married, 'cause most people that get married, will get counselling from their pastors because there is a religious aspect to it, a God aspect to it, Jada," she said. "And we had a deep conversation about, what does this mean to us? What do we wanna create for ourselves?". "And we actually talked about polyamory, and was that something that we wanted to explore? We had that conversation".
The word polyamorywas first coined in the late 20th century, with Greek and Latin roots. It means 'multiple loves'. In interaction with USA Today, therapistSheila Addison shared thatpolyamory is a 'particular approach to consensual non-monogamy' that 'prioritizes ongoing emotional and sexual connections with multiple partners'.She said that it is not to be confused with polygamy which means 'multiple wives'.

On April 22, the world marked the 51st annual Earth Day. This years theme was Restore Our Earth. It represents a chance to learn about the environmental challenges we face today, how to become more involved and ways to align ones personal choices to make a positive impact.
One way to make a positive impact is through sustainable investing. Not only does sustainable investing help fortify returns with its unique focus on risk management, it also aligns an investor with investee companies seeking to improve their environmental, social and governance (ESG) impacts.
Sustainable investment portfolios can provide increased transparency, align with investee companies that publicly disclose their efforts to improve their ESG impacts and utilize asset managers that fulfill a stewardship role by holding investee companies accountable to improve their ESG impacts.
Responsible investing, or sustainable investing, is the explicit inclusion of ESG risks and opportunities in investment analysis. This investment approach allows for increased awareness of what is in a portfolio through the process of ESG investing. This allows for alignment with what matters to the investor by using screens and ESG integration. It also calls for accountability on the part of the asset manager to act as a steward of the investors assets through active engagement with the investee company.
Asset managers can utilize increased awareness from ESG investing to decide whether to avoid, reduce or increase exposure to an investee company. This process helps an investor align with an improvement story investee companies that are intentionally striving to improve their environmental impact. For example, to limit carbon exposure in a portfolio, an asset manager may avoid all carbon-extracting companies (i.e., oil or coal). Alternatively, using a scorecard approach, the asset manager may only include those companies that have the best environmental scores, which is known as a best-in-class approach.

Administration working to move Reproductive Freedom Act, Murphy says – New Jersey Globe | New Jersey Politics

Gov. Phil Murphy said his administration is working to advance a bill codifying abortion protections in the face of a conservative majority on the U.S. Supreme Court that stalled after President Joe Biden entered the White House.
Announced last October, the Reproductive Freedom Act has now sat for more than six months without seeing so much as a committee hearing.
Senate Majority Leader Loretta Weinberg (D-Teaneck), its prime sponsor, in March told the New Jersey Globe the measure had stalled after pushback from some members in both houses who dont think we really have to do this now.
Murphy isnt among the naysayers.
We need to do it preemptively so were not being dragged by some decision not yet taken by the U.S. Supreme Court, he said. I think its imperative. Were working it. Were working it with legislators, with advocates.
But the bill will likely languish despite the governors urging. A senior Senate source on Wednesday told the New Jersey Globe the proposal would likely not move until the lame duck session, if it moves at all.
The states abortion protections stem from a 1982 New Jersey Supreme Court ruling that found restrictions on the procedure infringed on womens right to control their bodies, but that opinion acknowledged abortion as an issue assumed a new dimension after Roe v. Wade, the landmark 1963 U.S. Supreme Court case that legalized abortion nationwide.
The bills backers fear a 6-3 conservative majority on the U.S. Supreme Court could imperil the state protections along with the federal ones.
The general fact of the matter is its not moving at the pace it needs to move, and I think people are in fact lulled a little bit asleep on this one at the moment and they should not be, Murphy said. This is needed, and its needed right now.

House adds ‘religious freedom’ amendment to slate of constitutional amendments – Arkansas Times

The House today is prepared to add SJR 14, a so-called religious freedom amendment, to two other constitutional amendments proposed earlier for the 2022 election ballot.
A vote was delayed by a computer glitch and the House recessed until 2 p.m. for it to be fixed. The amendment was expected to be approved by a wide margin.
UPDATE: As expected, it passed easily 75-19, with one voting present.
The measure would give constitutional protection to an existing statute and says the government could not put any burden on religion unless it could prove a compelling government interest. The Arkansas Constitution already has religious freedom protection, too.
As with gun bills, the advocates talk darkly of the possibility of future horribles. Rep. David Ray noted court rulings that have blocked some enforcement on church gatherings during the pandemic as an indication of the types of government action the amendment could guard against.
The amendment is also aimed at allowing infringement of rights using a religious pretext. It can be used to justify discrimination based on sexual orientation and gender identity, not to mention sex and religion.
Republican Rep. Josh Miller said the amendment was repetitive and redundant. He said, Im tired of doing stuff that doesnt matter. He said it could someday protect a mosque blaring prayers on a loudspeaker next to a Baptist daycare.
Rep. Jimmy Gazaway, the House sponsor, said it was important to enshrine religious rights because nobody knew what the state or legislature or courts would look like in the future.
If people put it in the constitution, its going to be there.
The legislature earlier approved proposed amendments requiring a 60 percent vote for approval of constitutional amendments and initiated acts and to allow the legislature to call itself into special session, now a power solely given to the governor.

There is no compulsion in religion. Surely, right has become distinct from wrong; so, whosoever refuses to be led by those who lead astray and believes in Allah (by following the course beneficial to human development and progress), has surely grasped a strong handle which knows no breaking. And Allah is All-Hearing, All-Knowing. Allah is the friend of those who believe: He brings them out of every kind of darkness into light. And those who disbelieve, their friends are the transgressors who bring them out of light into every kind of darkness. These are the inmates of the Fire; therein shall they abide. (2:256/257-257/258)
People are free to choose and practice their religions. Humans possessing free will cannot exercise their comprehension if there is compulsion, and, therefore, they will be constrained from using their faculties to analyze and distinguish the right from wrong. Without the freedom of conscience, they will not be able to observe themselves and exhibit to others the benefits to humanity emanating from the exercise of the free will. Compulsion would hinder humans from developing their natural abilities to the fullest.
Compulsion is not necessary because the beneficial and harmful aspects of human actions have been manifestly distinguished from each other through revelation on the one hand and through every day human experience on the other hand. If God is the creator and fashioner of this world, then his word, the functioning of his creation and the human experience on earth, should be in harmony with each other and should support each other. There should be no contradiction between revelation and the knowledge developed from the long human experience on earth.

The right course justifies itself by manifesting that it is beneficial to the human body, mind, heart and spirit and it contributes positively to human physical, intellectual, social, economic and spiritual well-being, and progress. If a course or a lifestyle proposed by an ideology or religion is not proven beneficial to humans through their experience over centuries, then either it is misrepresented, misinterpreted or is a human addition.
The word of God is not arbitrary, rather is based on reason and knowledge.
The heavenly guidance is provided for the benefit of people. Its purpose is to help people to tread on a course that helps in their progress, makes them stronger and resilient to change and diversity. Adherence to these principles improves human condition. When people deviate from heavenly guidance supported and validated by long term human experience, humans are pushed in diverse directions proposed by self-styled leaders that cause harm to individuals, families and societies.
Deviation from the right course affects overall human progress and achievement and mires individuals, families and societies into the fires of anguish, distrust, quarrel, discord, unrest, disorder, disease and even war, confirming the truth of true revelation and thus also validating the existence of God.
The gift of freedom of religion flourishes with free will recognition and free will righteous fellowship of the right course.

Freedom baseball scores 7 in 2nd inning to earn first win of the season – lehighvalleylive.com

Due to several COVID-19 issues at other schools, the Freedom baseball team had to wait about two weeks longer than expected to get its season underway.
After dropping their season opener to rivals Liberty on Thursday, the Patriots responded in style on Saturday.
Freedom defeated Bethlehem Catholic 11-3 in an East Pennsylvania Conference Northampton County division matchup on Saturday afternoon.
The Patriots scored seven runs in the second inning to open up a lead that did not come under threat the rest of the game.
It feels great, theyve been working hard. To go a month of practicing with no games and no scrimmages, we werent allowed to scrimmage, is tough, Freedom coach Nick DAmico said.
Sophomores Peter Hrousis and Ryan Hoffman each singled for Freedom to start the top of the second inning. A sacrifice bunt from junior Michael Moniz advanced Hrousis to third and Hoffman to second.
After senior Luis Osorio lined out to second, the Pates were in jeopardy of leaving two runners in scoring position stranded. Then Hrousis scored when Golden Hawks pitcher Beckham McNally couldnt field Joey Fanceras grounder up the middle.
These kids have worked hard, they missed out on last year. To score a bunch of runs, I think it was all with two outs which was amazing. They just kept pounding the ball, DAmico said.
McNally walked seniors Nick Sciarra and Garret Glick which scored Hoffman and loaded the bases. Senior Nate Mikulski belted a line drive to right field that took one bounce before going over the wall for a ground rule double.
I hit it on more of a line drive. If I got under it a little more, that was probably gone, Mikulski said. Just the energy, we all came up big at some points. We all have to work as a team to do get things done.
A hit to left field from senior pitcher Zion Frailey drove home two before Mikulski scored the final run in the second off of an error.
Frailey got out of some early trouble as Bethlehem Catholic put a runner on third base in the first and second before the senior forced ground outs to end each inning.
You just have to have confidence in yourself when youre pitching. Just be really confident in executing pitches, thats a big thing, Frailey said. You just have to trust yourself and trust what youve been working on and practicing for over a month now.
After walking Golden Hawks seniors Matt Martinez and Jaden Clements to start the bottom of the third, Frailey struck out Anthony Martinez, forced junior Peter Martinez to pop out and Cole Hershman to ground out to keep the shutout in tact.
Those were big moments and he pitched very, very well, DAmico said of Frailey, who struck out five in five innings pitched. Being able to be in those tough spots early in the season and to trust your defense, he did a great job. He kept them off balance all day, thats a good team over there.
Frailey, Mikulski and Glick each tallied multiple RBIs for Freedom, who will now have to deal with a condensed schedule for the next month after having earlier games postponed.
We definitely have to come together as a team, Mikulski said. The (2019) season, we started out slow then, towards the end of the season, we got really hot. Hopefully that comes again this year.
Matt Martinez had Bethlehem Catholics lone extra-base hit, a seventh inning double which drove home sophomore Eric Wert to score the final run of the game.
The Golden Hawks dropped their third straight game after starting the season 3-1.
We talked about this in the preseason. We talked about whats going to happen when you lose two or three in a row. In the conference that were in, thats going to happen, Bethlehem Catholic coach Matt Corsi said.
Corsi, who is in his first year in charge after taking over for long-time coach Mike Grasso, will have four games this week to assess his teams response starting with a trip to Freedom on Monday.
There was no quit, they definitely didnt quit. I wanted to see them fight, I saw the fight. Now its about executing, Corsi said.
