lastresistance.com Court Upholds Law That Could Imprison Pastors For Preaching Biblical Doctrines In 2009, President Barack Obama signed the Hate Crimes Prevention Act into law. The law was pushed by every gay rights organization in the country. They claim that anyone who says anything negative about homosexuality is guilty of bullying them and therefore constitutes a hate crime. Under the strictest definition of the law, any biblical preaching against sin in general, especially that of homosexuality could be considered hate language and therefore a hate crime. If convicted of the felony offense, a person could spend as much as 10 years in prison. In 2010, the Hate Crimes Prevention Act #39;s constitutionality was challenged in court by the American Family Association of Michigan along with several Michigan pastors, Levon Yuille, Rene Ouellette and James Combs. The pastors and AFA of Michigan president Gary Glenn actively preached against homosexuality and that it was a sin according to the Bible. They saw the Hate Crimes Prevention Act as a violation of their constitutional rights for free speech and religion. Their federal lawsuit was filed against US Attorney General Eric Holder. Later that year Holder filed for a dismissal of the lawsuit on the grounds of standing and ripeness. Standing and ripeness are legal terms that have to do with their legal ability to file the suit for future circumstances that may or may not ever happen. There is a firestorm over a Virginia marketing firm that allegedly flooded mobile devices with political text messages. But lost in the media coverage is the price some consumers might pay if they lack unlimited texting plansand whether free speech will keep the practice alive.
TextingThe controversy is about a large number of text messages originating from websites tied to a marketing firm called ccAdvertising. On October 30, Washington, D.C., residents received the messages in the aftermath of Hurricane Sandy.
The messages werent storm updates: They were short missives attacking Barack Obamas presidential campaign and his stance on same-sex marriage and abortion. And they were showing up on mobile phones apparently at random.
Enough messages were received by reporters in the D.C. area to cause them to look up the owners of the websites and link them to ccAdvertising.
But anyone following the issue of political text messages wouldnt have been surprised at the tactic, since the firms owner said just a week ago such campaigns were just an another example of free speech, and permissible under the Telephone Consumer Protection Act.
Gabriel Joseph told the website Campaigns & Elections on October 25 that he was taking part in an FCC review of the practice, and that any action that banned the mass messaging campaigns was unconstitutional and against the intent of the First Amendment.
Such efforts take away Americans free speech rights that are now protected by current law, FCC regulations and the Constitution of the United States, Joseph told Campaigns & Elections.
What Joseph calls his constitutional right is labeled an FCC loophole by his opponents.
The controversy is about the practice called email-to-text messaging. It uses websites, instead of texting services, to send an outgoing email to someones cellphone number as a text message. It looks like a text message to the person who receives it, and the FCC doesnt bar such messages as spam in its current regulations.
The rub, says Campaigns & Elections, is that ccAdvertising claims people who have unlimited texting plans arent paying for the messages, so they are permissible under the TCPA.

Two dozen attend free speech rally

About 25 people staged a free speech rally Thursday on the corner of McBean Parkway and Valencia Boulevard.
The Santa Clarita Valley Free Speech Coalition staged the demonstration, where attendees waved American flags, chanted and held up signs condemning what they claim is coercion or suppression of local media organizations.
One such incident they cite is the recent firing of two KHTS AM-1220 employees who claim they were dismissed as a result of critical stories they wrote about Rep. Howard Buck McKeon (R-Santa Clarita). But group members say the issue is larger than that one incident.
We support all media, said Valencia resident Larry McClements. We need to take a stand against outside influence on the media, no matter the level.
Though McClements said the rally was meant to be non-partisan, several local political candidates were invited to attend, including McKeon, Edward Headington, Scott Wilk and Lee Rogers.
Rogers, the Democratic candidate for Californias 25th Congressional District, was the only one to attend the event, McClements said.

But not everyone loved it. In fact there was mass outrage on twitter after the release of the move. These twitter users now have a permanent record of their racism, but have seen no punishment, even if just by social pressures. Multiple groups have covered this outburst or racism among Generation C, from online commentary to national news agencies, but no solution has been thought of. How about this? The internet is a new open forum that anyone can participate in, and as the first Generation to live almost completely through the interactions of the internet- we define it #39;s culture.
