On-going humanitarian emergency threatens the nutritional status of vulnerable children and women in the Central African Republic – Nutrition Cluster…

Nutrition Cluster partners in the Central African Republic (CAR) are extremely concerned about the risk of deterioration in the nutritional status of vulnerable children and women due to the on-going humanitarian emergency.
For the 2021 CAR Humanitarian Needs Overview (HNO), the Nutrition Cluster estimated that approximately 1.1 million of persons need nutrition assistance, with 205,642 children under five years acutely malnourished. 62,327 with severe acute malnutrition (SAM), who risk death without immediate treatment, and 143,315 with moderate acute malnutrition (MAM). Additionally, an estimated 37,000 pregnant or lactating women (PLW) are also malnourished making them vulnerable to maternal mortality and varied morbidities that will negatively affect their infants. Furthermore, an estimated 90,000 children aged between 6 -59 months and 140,000 PLW are in need of Blanket supplementary feeding programme. According to UN estimates, nearly 1.93 million people in CAR are expected to be in high acute food insecurity (IPC Phase 3 or above) through April 20211 . The procurement capacities of CARs markets have greatly diminished, and price monitoring has demonstrated a rise in the price of staple foods since December 20202 . Many large traders and herders have fled the country, raising fears of a market collapse that could exacerbate the current food crisis. At least 63,800 people have been internally displaced3 and another 105 300 seeking shelter in neighboring countries.
In addition to mounting food insecurity, vulnerable populations have also had to cope with a collapse of basic healthcare services since the beginning of the crisis. As of to date 13 mobiles clinics and 60 health facility have suspended their health and nutrition services due to insecurity. The rainy season may start as early as March in CAR, leading to an increase in the incidence of malaria and diarrhoea. Childhood underweight (low birth weight, wasting and/or stunting) is the number one risk factor for death in children under five in CAR.
Limited access due to insecurity, population displacement, deteriorated food security, limited access to portable water, increased morbidity and lack of healthcare services will inevitably have an impact on the nutritional status of the most vulnerable, particularly children under five and pregnant and lactating women. In fact, the impact is already evident. Recent data from partners indicates that at Bouars IDP in Ouest part of the country in January 2021, 3 out of 4 IDP sites already have a GAM rate >15%. The same situation was observed in Cesakoba and Dekoa s IDP in Bangassou and Kemo where the GAM was recoded at 26% and 13% respectively. In addition, data from 26 localities (with GAM rate >15%) demonstrated an alarming situation. Still prevailing pocket of high prevalence of acute malnutrition. These localities are: Dekoa, KagaBandoro, Bambari, Grimari, Bouca, Koui, Bocaranga, Paoua, Bouar, Gamboula, Amadagaza, Nola, Carnot, Gadzi, Mingala, Alindao, Nzangba, Mobaye, Kembe, Satema, Gambo, Pombolo, Ouango, Bakouma, Rafai, Bangassou. This may be indicative of a wider nutrition problem in hard-to-reach populations in these areas or for people who fled to the bush for long period with no access to health and nutrition services. Nutrition cluster partners have also noted an increase in displaced populations with high levels of malnutrition.
Humanitarian partners, both international and local, are doing remarkable work implementing care and treatment activities for malnourished children in very difficult circumstances. However, the needs are considerable and life-saving activities to screen, treat and prevent malnutrition need to be drastically scaled-up, particularly in these priorities areas in order to reduce the mortality and morbidity of young children and women. Preposition life-saving materials in warehouses and in health facilities has become challenging as road transport has become nearly impossible due to insecurity. Air transport is the main current option of supply delivery to partners where assistance can be provided with a minimum degree of security. However, challenges related to costs remain.
Nutrition Cluster partners aim to treat at least 50,000 children suffering from SAM, 164,500 children suffering from MAM and 37,000 malnourished PLW in 2021, as well as targeting 90,000 children aged between 6 -59 months and 140,000 PLW with nutritious food supplements to prevent acute malnutrition. However, given the increase of the insecurity, it is extremely possible that the number of children and PLW in need of nutrition assistance may rise substantially in the coming months. Consistent and predictable funding is crucial to ensure continuous, quality malnutrition treatment and prevention for these children and women. Current requirements for the nutrition response stand at 35 million USD, of which $ 18,2 million are required before the end of June 2021. Resources ($ 11,2 million) are urgently needed before end of Mai 2021 to ensure that an adequate pipeline of supplies provided by UNICEF and WFP is in place and that life-saving malnutrition treatment and prevention activities can be maintained and expanded to meet the needs of all those affected by the current humanitarian crisis in CAR.

Caliper Foods Unveils Results of Landmark Colorado State University CBD Study – The First Human Clinical Study Measuring and Comparing the Absorption…

Pharmacokinetics (PK)isthe scienceof how bioactivesdiffuse throughthe body, and it reveals the difference between what we consume and what we absorb (vs. what we excrete), as well the rate and efficiency of absorption. PK studies are critical to understanding the efficacy of any bioactive compound, including CBD, since a bioactive's effect is a function of its presence. In other words, you can't feelwhat you don't absorb. PK studies provide the scientific foundation for claims such as "fast acting," "long lasting," and "superior bioavailability."
To date, when CBD product manufacturers have claimed fast action or superior absorption, they have generally based those claims to the extent they've predicated them at all on mouse studies or analogies to non-cannabinoid bioactives (often curcumin). Caliper's study represents the first human clinical substantiation of such claims, as well as the first to do so using commercially available products and an IRB-approved study design. Moreover, with the CBD industry generally mired in fraud and mistrust enabled by the prominent absence of Food & Drug Administration (FDA) oversight or enforcement over the past four years, this study is unique in its academic integrity. Although Caliper provided funding for the study, Colorado State University exercised complete and independent authority over the collection, analysis, and publication of these results.
Conducted by CSU researchers and published in a special issue of the medical journal Pharmaceuticals entitled Cannabidiol: Advances in Therapeutic Applications and Future Perspectives, the study compared the pharmacokinetic profiles of three proprietary soluble CBD formats Caliper Powder, Caliper Quillaia-based Liquid Concentrate, and Caliper Gum Arabic-based Liquid Concentrate against two control formats: oil-based CBD tincture and unemulsified CBD isolate, which together power the majority of available consumer CBD products in use today. The blinded, randomized, crossover study design involved 15 healthy men and women, ages 21-62, each consuming 30 mg of CBD in each product format. Participants provided venous blood samples prior to ingestion, and then at regular intervals over the ensuing four hours. Blood analysis revealed that all of Caliper's product formats were absorbed significantly faster than either control:

"It's incumbent upon our company, our industry, and, above all, our regulatory agencies to ensure that consumer products meet the promises made on their labels. That's why we invested heavily in a well-designed clinical study with a credible academic partner and supported its publication in an open access, peer-reviewed journal," said Jolene Jacobs, general manager of Caliper Ingredients. "We didn't conduct this study on mice in a lab. We used real people and real products, and the results provide real-world support for our product claims. The fact that different product formats exhibited different absorption profiles demonstrates why brands need to base their claims on empirical data rather than empty buzzwords like 'nano' when talking about fast action or improved absorption."
Caliper has expendedconsiderable time and energy battling charlatanism inthe CBD marketplace, including lobbying the FDA and Congress to demonstrate their concern for consumers by regulating the ongoing, widespread production and sale of consumer products infused with CBD and other hemp-derived cannabinoids. Caliper has taken the lead in pushing FDA to hold cannabinoid manufacturers to the same baseline standards for labeling accuracy, good manufacturing practices, and claims substantiation that non-CBD food & supplement manufacturers have operated under for decades.
"In their well-meaning search for better data and real world evidence, the FDA has unfortunately opted for delaying the regulatory process time and again in the alleged pursuit of enacting perfect regulation in the future over the necessity of enacting basicregulation today. The regulatory delay has, and will continue to, endanger consumers," said Justin Singer, CEO of Caliper Foods. "We agree that real world evidence is important, which is why we've long urged the FDA to impose the same labeling and manufacturing requirements on hemp product manufacturers as they do on other foods and supplements. Green-Lipped Mussel: Benefits, Forms, and Effectiveness – Healthline

Named for its green edges, the green-lipped mussel also known as the New Zealand mussel is a shellfish native to New Zealand.
It has been claimed to have medicinal properties and thus become popular as a supplement.
The mussel contains several anti-inflammatory compounds claimed to treat inflammatory conditions, including asthma and arthritis.
This article explains everything you need to know about green-lipped mussel supplements, including their potential benefits, forms, and safety.
The green-lipped mussel is a staple food of the indigenous Mori people of New Zealands coasts.
Interest in the mussels potential health benefits began in the early 1970s and stemmed from the observation that Mori people had a lower incidence of arthritis than people who lived inland (1).
It was later determined that the mussels were a rich source of anti-inflammatory omega-3 fatty acids, especially eicosapentaenoic acid (EPA) and docosahexaenoic acid (DHA) (2, 3, 4).
Furthermore, researchers have identified other types of fatty acids from the mussels. They may also possess anti-inflammatory effects by inhibiting enzymes and proteins that produce inflammation and pain (5, 6, 7).
Similarly, green lipped-mussels contain chondroitin sulfate, a component of connective tissues like joints and bones that may reduce inflammation in the same way (8).
In addition to these anti-inflammatory nutrients, the mussels are a good source of zinc and an excellent source of iron, selenium, and several B-vitamins (9).
Green-lipped mussels contain anti-inflammatory nutrients, such as omega-3 fatty acids and chondroitin sulfate. They also contain several key vitamins and minerals.
Green-lipped mussel extracts have been studied for various inflammatory conditions, namely asthma and different forms of arthritis.
Asthma is a chronic inflammatory condition that affects your lungs and can make breathing difficult.
By helping reduce inflammation in the lungs airways, green-lipped mussels may benefit people with asthma.
In one study, researchers gave people with asthma either 400 mg of green-lipid mussel extract or a placebo every day for 3 weeks before having them try the opposite treatment for another 3 weeks (10).
Compared to the placebo, the extract led to significant reductions in airway inflammation and asthma symptoms.
Another 8-week study in people with asthma found that a similar extract containing 400 mg of the mussel reduced asthma symptom frequency and airway inflammation when taken daily, compared with a placebo (11).
While these results are promising, more research is needed.
Arthritis, which is characterized by painful swelling and stiffness in one or more of your joints, results from chronic inflammation.
The most common types of arthritis are osteoarthritis (OA) and rheumatoid arthritis (RA).
Due to its anti-inflammatory properties, green-lipped mussel extract has been claimed to reduce joint inflammation, helping relieve arthritis symptoms.
However, one review concluded that limited evidence exists to support the use of green-lipped mussel extract for RA or OA, especially when compared with other nutrition supplements like glucosamine and chondroitin, which have more scientific backing (12, 13).
In contrast, another review of four randomized clinical trials concluded that green-lipped mussel extract improved joint stiffness and pain in people with OA (14).
However, these findings cant be attributed to the extract alone, as people in each of the studies were also taking pain-relieving medications.
The studies were also of poor quality and influenced by biases that could have altered the results.
Additional trials have been conducted in the last few years, but they have either demonstrated inconsistent findings or were of low quality (15, 16).
Therefore, the effectiveness of green-lipped mussels for relieving arthritis symptoms remains weak based on the current research.
The current research remains limited or fails to support the use of green-lipped mussels supplements for asthma or arthritis.
Beyond asthma and arthritis, green-lipped mussel extracts have been studied for their potential benefits in athletes, as well as children with mental disorders.
Delayed onset muscle soreness (DOMS) is characterized by muscle soreness and stiffness that occurs 2448 hours after an intense or unfamiliar workout and can last for several days (17).
Several factors are thought to contribute to DOMS, one of which is muscle damage incurred from a workout that causes an inflammatory response (18).
While studies have failed to find any improvement in DOMS from a commercial extract of green-lipped mussels in well-trained athletes, 400 mg of the extract taken for 11 weeks reduced pain sensations in lesser-trained individuals (19, 20).
Attention deficit hyperactivity disorder (ADHD) is a common childhood disorder that causes trouble paying attention and organizing tasks and activities (21).
The causes of ADHD remain largely unknown, but genetics are thought to play a significant role (22).
And while more research is necessary, ADHD has also been associated with inflammation (23).
One study in children ages 6 to 14 with ADHD symptoms showed significant improvements in attention and learning ability following 8 but not 14 weeks of supplementation with a commercial extract containing 150200 mg of green-lipped mussels (24).
Because this is the only trial to date investigating the effects of a green-lipped mussel extract on ADHD symptoms, more research is necessary.
Green-lipped mussel extracts may benefit other inflammatory conditions like DOMS and ADHD in children, but more research is needed.
Green-lipped mussel extracts can be found in oil or powder form and should be easy to find online or at your local health store.
While less common, you can also find gels and creams that claim to ease joint pain and muscle soreness when applied to the skin.
Most of the studies examining the anti-inflammatory properties of green-lipped mussels have used an oil extract.
Interestingly, research indicates EPA may be better absorbed from powdered forms than from oil extracts (25).
In either case, if youre looking to try a green-lipped mussel supplement, ensure that it was produced using methods that retain the mussels natural nutrient profile.
One example is freeze-drying, which removes water at low temperatures, providing product stability and nutrient retention.
Also, look for reputable supplement companies that undergo third-party testing to ensure product quality and safety.
Several forms of green-lipped mussel supplements exist, including powders, pills, creams, and gels. Regardless of the form, ensure it was produced in a way that preserves the mussels nutrients.
As green-lipped mussels are a type of shellfish, you should avoid these supplements if you have a shellfish allergy or intolerance.
You should also avoid the supplements if youre pregnant or lactating due to a lack of safety information (1).
Outside of these populations, some adverse side effects have been noted with green-lipped mussel supplements.
For example, early studies reported liver inflammation associated with a brand of supplements that contained toxins produced by the mussel (1).
Other reported adverse effects linked with green-lipped mussel supplements include fluid retention, nausea, and upset stomach (1).
That said, more recent studies have failed to find serious adverse side effects associated with supplements containing the mussel (15, 16).
Finally, green-lipped mussel supplements may negatively interact with or enhance the side effects of certain medications, such as blood thinners and anti-inflammatory medications like nonsteroidal anti-inflammatory drugs (NSAIDs).
Keep these things in mind before trying a green-lipped mussel supplement, or talk with your doctor if youre unsure whether this supplement is safe for you.
A few negative side effects have been linked to green-lipped mussel supplements, which should be considered before trying them.

Diet and fitness experts debunk 10 glaring weight loss myths that could be sabotaging your goals – Insider – Insider

From extreme juice cleanses to supposed miracle supplements, some folks seem willing to try just about anything to lose weight. However, experts say many of these fast-track methods are based on myths, since weight loss is the result of consistently taking in fewer calories than you expend over time and making smart dietary choices.
According to Artur Viana, MD, clinical director of the Metabolic Health & Weight Loss Program at Yale Medicine, one of the most popular weight loss myths is that all you have to do is exercise more and you'll lose weight.
"Exercise is fundamental to a healthy lifestyle, weight loss, and weight maintenance, but it has to come with a change in diet as well," Viana says.
Below, experts in diet and exercise debunk some of the most common misconceptions about weight loss.
Your body doesn't metabolize all foods the same way. And how quickly you digest something can affect insulin levels, blood sugar spikes, and fat storage.
For example, compare 100 calories worth of cake to 100 calories of carrots. The calorie amount is the same, however, the cake is made with refined carbohydrates whereas carrots contain more fiber and nutrients.
This difference is important because your body digests the cake more quickly. This floods your system with glucose, spiking blood sugar and insulin levels in the process, which can promote fat storage.
Carrots, by contrast, are digested more slowly which means less glucose in your blood. This helps to maintain healthy blood sugar levels and it can also keep you fuller, longer, which may prevent overeating.
So, while 100 calories worth of cake and 100 calories worth of carrots provide the same energy output, one is clearly superior for weight management over the other, says exercise physiologist Joel Seedman, PhD.
Viana also says processed foods don't send the same satiety signals to your brain as whole foods do, meaning you're more likely to overeat and thus, gain weight.
Research suggests that it's what you eat and how much that matters, not necessarily what time you eat.
What the research says: A large 2016 study found no link between eating dinner past 8 p.m. and weight gain in children. However, a 2008 study revealed that people who ate between the hours of 11 p.m. and 5 a.m. consumed roughly 500 more calories per day and gained more weight than those who only ate during daytime hours. However, other research has shown that mealtime may affect glucose intolerance and reduce fat utilization, especially if you're habitually eating a late dinner.
The takeaway is that eating at night may make you gain weight if it causes you to go over your daily calorie budget, says Andres Ayesta, MS, a registered dietitian and certified strength and conditioning coach.
Carbohydrates are often billed as the enemy when it comes to weight loss, but a 2018 study revealed that adults who followed a low-carb diet lost the same amount of weight, on average, as those who followed a low-fat diet.
Not all carbs are created equal, though. Whole grains pack more fiber than refined carbs, meaning they're metabolized more slowly and don't cause big insulin surges.
In fact, a 2017 study found that people who ate a diet with enough whole grains to meet the recommended dietary allowance for fiber burned 100 more calories per day, in part due to a slight increase in their resting metabolic rate, when compared to people who ate refined grains with little fiber.
Ayesta says that fat contains more calories per gram than protein and carbohydrates, which means fat is much easier to overconsume.
However, a 2019 review revealed that the Mediterranean diet which entails getting about 35% to 40% of your calories from heart-healthy fats may prevent increases in weight and waist circumference in non-obese individuals.
Researchers noted that a Mediterranean diet supplemented with extra virgin olive oil, for example, can decrease total body weight and BMI.
A 2016 study revealed that people without Celiac disease are buying gluten-free products because they believe they're a "healthier option."
In reality, "many processed gluten-free products are actually more calorie-dense than their gluten-containing counterparts because they may contain more fat and sugar," says Viana.
A 2017 review found that overall, gluten-free foods had more saturated fat, sugar, and salt, and less protein and fiber than regular foods. Specifically, gluten-free bread and flour products tended to contain high fat and sugar in comparison to their gluten-containing counterparts.
When it comes to weight loss, eating breakfast is a mixed bag. Some research indicates it can help with weight loss while other research suggests the opposite. For example, a 2018 review found no strong evidence to support the idea that eating breakfast helps you to lose weight.
Viana says the only case in which eating a large breakfast might be beneficial is if it helps you to eat fewer calories later in the day.
According to Harvard Medical School, a 155-pound person burns roughly 372 calories while running an average 10-minute-per-mile pace for 30 minutes, and about 112 calories lifting weights for the same amount of time.
Even though cardio workouts may burn more calories in the moment than strength training, at least one small study has shown that you may burn more calories in the hours after lifting weights, because your metabolism may stay elevated longer.
Seedman says that when it comes to losing weight, the ideal exercise regimen includes a combination of both cardio and resistance training.
Studies have shown that many exercisers resort to "compensatory behaviors" after working out that offset the calories they expend. For example, a 2009 study of postmenopausal women, who were either overweight or obese, revealed that participants seemed to increase their food intake after working out on a treadmill or exercise bike, either because they felt hungrier or because they thought they burned off a lot of calories.
The idea behind small, frequent meals is that it helps better control hunger and keeps your metabolism up throughout the day for easier weight loss. However, in practice, this isn't what happens, according to scientific research.
For example, a 2007 study examined two groups of people who consumed an equal number of calories per day: one that ate three meals with no snacks, and another that ate three meals and three snacks. By the end of the year-long experiment, researchers found no difference in weight loss between the two groups.
According to Seedman, meal size and frequency is a matter of figuring out which approach best fits your lifestyle and helps you to stay within your daily calorie budget.
While a juice cleanse may result in short-term weight loss, Viana says that's due to a severe calorie deficit one that's not realistic to uphold for more than a few days at most. Once you re-introduce solid foods, you're likely to regain any weight that was lost.
Ayesta also points out that you're mostly losing water weight with this strategy because drinking so much juice can cause you to urinate more often.
Dietary supplements aren't regulated by the Food and Drug Administration (FDA), and the FDA says that many of them do not live up to their weight-loss promises and may even contain dangerous hidden ingredients, such as chemicals contained in blood pressure medications and antidepressants.
Moreover, a 2004 review found no convincing evidence that dietary supplements help with weight loss.
Ayesta and Viana say that many of the persistent weight-loss myths stem from social media, the ever-changing realm of nutrition science, as well as the $71 billion weight loss industry, which is continually churning out new products to remain competitive.
The bottom line? If a weight-loss method sounds too easy or too good to be true, it probably is.
Weight loss is "a journey that requires patience, education, and consistency to yield sustainable results," says Ayesta. "People don't have to follow strict rules and eliminate entire food groups simply to accomplish weight loss."
Rather than taking extreme measures, Viana advises focusing on sticking to an exercise regimen that includes both cardio and resistance training, and maintaining a diverse diet that emphasizes whole foods over processed ones.
Lastly, Ayesta says it's important to keep in mind that diets only work when they restrict calories, but the only way to keep that weight off is to make sure your dietary changes are sustainable over the long term.

A well-planned vegan diet is rich in fruits and vegetables and generally low in highly refined foods.
However, any diet that does not contain whole food groups may contribute to a lack of certain nutrients. Animal products can be rich sources of certain nutrients that are more difficult to derive from a plant-based diet.
For example, animal products are the only natural sources of vitamin B12, which helps maintain blood cells and prevent anemia.
Researchers have also found that levels of zinc, protein, selenium, and other nutrients are low in vegan diets.
However, consuming fortified foods and supplements can ensure that a person with a vegan diet is receiving sufficient nutrition.
Below, we describe symptoms of common deficiencies and strategies for tackling them.
Omnivorous diets typically contain enough B12 to meet most peoples needs. As vegan diets do not include animal products, vitamin B12 deficiencies may occur.
A cross-sectional analysis of participants with omnivorous, vegetarian, or vegan diets found that about half of the 232 vegan participants had vitamin B12 deficiencies. Compared with the other groups, the vegan group had the lowest overall levels.
According to the National Institutes of Health (NIH), most teenagers and adults need 2.4 micrograms (mcg) of vitamin B12 per day. This increases to 2.6 mcg or 2.8 mcg for people who are pregnant or breastfeeding, respectively.

Right now, vitamin D is hot as many doctors, registered dietitians, and other health experts are saying it could lessen the severity of COVID-19 symptoms.

"Recent reviews of literature on the topic say that sufficient evidence to support vitamin D supplementation for the prevention or treatment of COVID-19 is still lacking," she says.
Still, taking a vitamin D supplement can't hurt you,that is, unless you overdose. Adult men and women are encouraged to consume 15 micrograms (mcg) or 600 international units (IU) of this vitamin each day, Webster says. For those over 70 years of age, the recommended dietary allowance is 20 mcg or 800 IU.
In some cases, health care providers will prescribe higher doses of the supplement to patients who are deficient or low in this vitamin. However, taking high doses when your levels are fine not only isn't necessary, but it could also be dangerous.
"Before starting a supplementation regimen, it's important to consult with a health care professional and make sure that your vitamin D status is continually monitored to assess any changes that may need to be made after you begin taking the vitamin," she adds.
Below, you'll see five potential side effects of taking too much vitamin D.
Since vitamin D is a fat-soluble vitamin, which just means it's better absorbed and transported in your body if it's consumed with fat. This, in part, makes it possible to consume in toxic amounts. Webster explains that this vitamin increases the uptake of calcium in the bloodstream which can cause a variety of issues. One such issue is nausea or, even vomiting.
If you're starting to feel nauseous while taking supplements, this could be an indication that you're taking too much of the fat-soluble vitamin.
Webster also says you could also be at risk of experiencing dehydration when taking too much vitamin D. Vomiting and dehydration can leave you feeling weak, but taking too much vitamin D can also lead to unexplained exhaustion. You may even experience a loss of appetite, which could also make you feel fatigued.
Another risk factor in taking too much vitamin D is the development of kidney stones. Why? As Webster said, vitamin D increases the uptake of calcium from the gastrointestinal tract, which can then lead to too much of the mineral in the bloodstream. Having too much calcium in your blood can then cause kidney stones to form.

"It's important to note that excessive intakes of vitamin D are primarily the result of misusing dietary supplements," she says. "It's not thought to be possible to get too much vitamin D from sun exposure, and since vitamin D is in relatively few foods, consuming toxic amounts of it would be very unlikely."

Last week, in a substantial win for the dietary supplement industry, the Ninth Circuit Court of Appeals upheld the Northern District of Californias grant of summary judgment to Target, ruling that state law false advertising challenges to permissible structure/function claims are preempted by the Federal Food, Drug and Cosmetic Act (FDCA).
Plaintiff Todd Greenberg alleged that he bought a bottle of Up & Up Biotin, a private label vitamin sold by Target, as part of his battle with hair loss. Up & Up Biotins label states that biotin helps support healthy hair and skin. The label also states that [t]his statement has not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease. Greenberg conceded that biotin is a nutrient that supports healthy hair and skin, but nevertheless claimed the label was misleading because most people obtain all the biotin they need from their diet, rendering the vitamin superfluous to all but a tiny percentage of people who have a biotin deficiency.
Under the FDCA, dietary supplement labels are required to be truthful and not misleading. The statute also authorizes certain categories of statements, including structure/function claims, provided they are adequately substantiated. As a general matter, structure/function claims describe the role of a nutrient or dietary ingredient intended to affect the structure or function in humans or that characterizes the documented mechanism by which a nutrient or dietary ingredient acts to maintain such structure or function[.] 21 C.F.R. 101.93(f). Statements suggesting an ingredients ability to strengthen, improve, or protect a structure or function in the human body are structure/function claims so long as they do not suggest disease prevention or treatment. The FDCA was intended to establish a national and uniform labeling standard for dietary supplements, expressly preempting any state law labeling requirement that is not identical to the labeling requirements in the FDCA.
The Ninth Circuit affirmed the District Courts ruling that Up & Up Biotins label satisfied all of the statutory requirements for a structure/function claim under the FDCA, namely that: (1) there was substantiation for the claim, (2) the label included the proper disclosures, and (3) the label did not suggest the product could treat diseases. More specifically, and in contrast to a disease claim, the FDCA only requires substantiation for the ingredients function on the human body, not the health impact of the product as a whole. In other words, manufacturers may make structure/function claims about a nutrients general role on the human body without disclosing whether the product will provide a health benefits to each consumer.
Accordingly, the Court found that the plaintiffs state law false advertising claims essentially s[ought] to impose an additional requirement that dietary supplement labels can make structure/function claims only if consumers are likely to benefit from the product. Because this requirement is not identical to the labeling requirements in the FDCA, the claims were preempted.
Dietary supplement companies are often targeted by class action plaintiffs asserting various theories about how carefully-drafted label claims are nevertheless deceptive to the proverbial reasonable consumer. This decision brings a new level of comfort to the industry that if a structure/function claims complies with the FDCA, it is less likely to be challenged (at least in the Ninth Circuit).
