On a quiet block in Scarsdale, a physician-turned-consumer-superhero has spent two decades helping keep the $36 billion U.S. supplement industry honest. And COVID-19 hasnt slowed him down.

Tod Cooperman, MD, 58, is founder and president of the Westchester-based ConsumerLab.com, LLC (CL), a leading provider of independent testing and information about health and nutrition products. For 21 years, CL has reviewed and rated more than 100 categories of such supplements; over 6,000 products.

Cooperman has also testified before Congress; raised alarms about tainted products; pinpointed manufacturing deficiencies; and become an unofficial consumer watchdog for the 84 percent of Americans who regularly take supplements. This year, some vitamins, herbal remedies, and treatments touted as COVID-19 preventives were added to that list, with reviews available in CLs Coronavirus Information Center.

Behind Coopermans vigorous pursuit of vitamins? Mom.

The guiding question when ConsumerLab began was the same as today; what would I tell my mother if she asked which specific supplements were safe, says Cooperman. Based in White Plains, with an office in Coopermans home, and a Vernon, N.J. laboratory, CL maintains an updated A (acai) to Z (zinc) directory of products sold in vitamin stores, pharmacies, supermarkets, mass merchandisers, discount clubs, catalogs, health care practitioner offices, and other venues. The companys 12 staffers occupy the space between federally-approved pharmaceuticals and largely unregulated over-the-counter remedies. There, Cooperman knows, pretty much anything can and does go.

The most surprising thing has been realizing how often a manufacturer is simply unaware its product has a problem, he says.

Weve seen vitamins that have up to three times the correct amount of an active ingredient and weve seen the opposite, where the ingredient isnt there at all.

He cites a popular cooking oil that contained none of the oil it advertised; a womens multivitamin with high levels of lead; and a leading probiotic that offered only half the listed number of goodbacterial colonies. Then, there was the undigestible vitamin C tablet.

We tried to test it but couldnt break the pill with a hammer or anything else, Cooperman says. It couldnt be metabolized, so it wouldve been completely useless in the body.

CLs online-only findings are supported by 90,000 member-subscribers, 84 per cent of whom are consumers, says Cooperman. The rest are universities, libraries, and other institutions. Members can access daily-updated news, major probes that appear several times a month, 600 answers to supplement-related questions, over 1000 recall notices and warnings, and regular explanatory videos. A twice-weekly newsletter reaches over 200,000 people many, quite vocal.

And we really listen to what they have to say, says Cooperman.

During the pandemic. readers asked about products touted as immunity boosters, including vitamin D, vitamin C, magnesium, zinc, and elderberry. CL also examined COVID-19-related best-sellers, including masks, pulse oximeters (to measure blood oxygen), air purifiers, and hand sanitizers (which can be deadly).

Cooperman twice brought his concerns about dietary supplement quality to Capitol Hill, testifying before the House of Representatives Committee on Government Reform in 2006 and at the Senate Special Committee on Aging in 2010.

Hes served as a columnist, expert, and industry opinion leader, but never seen patients. At Boston University Medical School, he became so fascinated by the biopharmaceutical industry that, by graduation in 1987, his business aspirations had trumped any interest in a clinical practice. Instead, he launched a company to track consumer satisfaction with some aspects of managed care, while seeking the perfect entrepreneurial opportunity.

It arrived in 1994 when the Dietary Supplement Health and Education Act (DSHEA) allowed manufacturers to make limited claims about their products ability to maintain good health. The law sent vitamin sales soaring but left consumers without reliable information about what they were buying.

The FDA (US Food and Drug Administration) would occasionally come in like a firefighter to douse flames when there was an obvious problem, but they were otherwise hands-off, Cooperman says.

That bothered him.

He sold his company, hired a former FDA tester, established his lab, and launched the first independent, scientifically-based /consumer-focused evaluator of supplements. Where the renowned Yonkers-based Consumer Reports sometimes assessed a single supplement, CL would monitor all products, continually and in depth.

Our goal was to go beyond the best or worst products to drill down to detailed clinical information about whether a product would work or not including safety concerns and drug interactions, says Cooperman.

CL (like Consumer Reports) ensured totally objectivity by refusing advertising, payments, or donations, and by purchasing products for testing itself, from neighborhood stores. Manufacturer samples were not allowed. Subscriptions covered operating costs. (Although CLs voluntary Quality Certification Program assesses products for a fee, permitting those that pass to display a certification badge. Trusted nonprofit U.S. Pharmacopeia or USP also offers certification but reviews fewer products.)

In the years since DSHEA, the FDA has become somewhat tougher on non-prescription drugs, but Cooperman still considers their efforts weak and inconsistent.

Thats not true in the Cooperman home, where his wife and three grown children are routinely drawn into his supplement probes.

My familys acutely aware of the pros and cons of every test. Its common dinner table conversation, he says.

Cooperman regularly takes Vitamin D when sunshine is scare. Hell occasionally add vitamin B12 and protein powder, a necessity for a mostly non-meat-eater. Hes such an ardent fan of dietary fiber (in food) that his college-aged kids call him Fiberman.

Every morning I eat two bowls of hot steel cut oats with kasha, fruit, nuts, and Greek yogurt, he says.

The Fiberman diet helps sustain his energy, but the grateful feedback he gets from subscribers is just as galvanizing.

The thing we most commonly hear is that CL is their go-to source before buying these products, says Cooperman. That makes me and my CL colleagues feel great; motivated, and focused.

And, he adds, its reassuring to moms, too.

In April, much to the relief of food and consumer products industries, Proposition 65 (Prop. 65) citizen plaintiff groups sent roughly half of the number of 60-Day Notices of Violation (Notices) that they sent in prior months. More specifically, citizen plaintiffs sent a total of one hundred fifty-three (153) Notices in April, and have, over the past several years, sent roughly three hundred (300) or so Notices each month.

Prop. 65, the Safe Drinking Water and Toxic Enforcement Act of 1986, requires clear and reasonable warnings on products sold in California if use of the products causes exposure to chemicals on the Prop. 65 List. Prop. 65 also gives interested citizen plaintiffs a private right of action to enforce these claims and recover their attorneys fees if they are successful. Common chemicals in Notices that are typically targeted include lead, acrylamide, cadmium, arsenic, mercury, and phthalates (Di(2-ethylhexyl) phthalate (DEHP), diisononyl phthalate (DINP) and Di-n-butyl phthalate (DBP).

The April reduction in Notice numbers is attributable to citizen plaintiff groups sending approximately half of the total number of consumer product Notices for phthalates previously sent in March (62 Notices sent in April and 122 Notices sent in March) and approximately half of the number of total Notices for heavy metals previously sent in March (60 Notices sent in April and 116 Notices sent in March).

Citizen plaintiff groups also substantially reduced the number of Notices they sent alleging violations of Prop. 65s warning requirement for acrylamide, likely following the recent court ruling banning the filing of new Prop. 65 lawsuits related to cancer warning labels. On March 30, 2021, the U.S. District Court for the Eastern District of California preliminarily enjoined any person from filing new lawsuits seeking cancer warnings for acrylamide on food and beverage products sold in California. (See Cal. Chamber of Commerce v. Becerra, Case No. 2:19-cv-02019 (E.D. Cal. March 30, 2021).) Although the case has been appealed to the Ninth Circuit, at least for now, the ruling ties the hands of citizen plaintiffs with respect to future Notices alleging that food and beverage products containing acrylamide require a Prop. 65 warning.

For the Notices that were sent in April, Plaintiff groups continued to allege that various chemicals in foods and consumer products require Prop. 65 warning labels because the products use or consumption exposes California consumers to chemicals in quantities that could cause cancer or reproductive harm. A discussion of Notice trends in April is below.

Notices discussed previously. The majority of food Notices in April related to allegations of heavy metals, primarily lead, in seafood and dietary supplements. Examples of noteworthy categories of food Notices are as follows.

Again, the majority of the consumer product Notices in April related to alleged phthalataes (DEHP, DINP and DBP) in largely pliable plastic products, though, as mentioned previously, this number was down to a total of 62 Notices in April, from 122 total Notices in March. Prop. 65 trends evolve, change, and shift each month, and the month of April is no exception. The trends in Notices depend on the interests of particular plaintiff groups in certain chemicals and products, the concentrations of certain chemicals in easily accessible products, and on the prior success of citizen plaintiffs in enforcing Prop. 65 in a given area. California businesses should monitor Prop. 65 notices and trends, use the Prop. 65 warning language on California products to avoid receiving a Notice of Violation when necessary, and to try and avoid the threat of litigation in California state court. NAC (N-acetyl-L-cysteine) is a derivative of the amino acid L-cysteine and is a precursor of the cellular antioxidant glutathione. The ingredient was first approved as an inhaled mucolytic drug in 1963. At present it is used in emergency rooms as a treatment in cases of acetaminophen poisoning to prevent severe liver damage.

Despite its early use as a respiratory medication, the ingredient has been widely used for many years in finished dietary supplements, frequently as a standalone product. A search of the Dietary Supplement Label Database from the NIHs Office of Dietary Supplements yields 1,468 products containing NAC (database accessed May 7, 2021), including some of the biggest brands in the industry.

Just last year, food and nutrition giant Nestl launched its Celltrient range, with one of those products featuring NAC as a central ingredient.

According to data provided by SPINS to NutraIngredients-USA, sales of NAC-containing products grow year-on-year, with combined sales of supplements* in the Conventional Multi-Outlet Channel** and Natural Channel totaling $5.68 million in 2020, a 32% increase from $4.31 million in 2019.

FDA was surely aware of the ingredient being on the market in supplement form for decades, but took no action regarding its status until the summer of 2020 when the Agency sentseven warning letters to companies making hangover treatment claims, which FDA construed to be illegal disease treatment claims.

In the warning letter to Wilmington, NC-based Happy Hour Vitamins, the Agency stated: FDA has concluded that NAC products are excluded from the dietary supplement definition under section 201(ff)(3)(B)(i) of the Act [21 U.S.C. 321(ff)(3)(B)(i)]. Under this provision, if an article (such as NAC) has been approved as a new drug under section 505 of the Act [21 U.S.C. 355], then products containing that article are outside the definition of a dietary supplement, unless before such approval that article was marketed as a dietary supplement or as a food. NAC was approved as a new drug under section 505 of the Act [21 U.S.C. 355] on September 14, 1963. FDA is not aware of any evidence that NAC was marketed as a dietary supplement or as a food prior to that date.

The letters marked a sudden and drastic departure from past Agency practice, said the Council for Responsible Nutrition (CRN) in a letter to Steven Tave, then Director of the Office of Dietary Supplement Programs (December 2020).

For decades, manufacturers have safely marketed products containing NAC as dietary supplements in the United States, stated the letter, which was signed by Steve Mister, CRNs President and CEO, and Megan Olsen, Vice President and Associate General Counsel, CRN.

until recently, FDA has consistently and affirmatively permitted manufacturers to market these products. In fact, FDA has considered over 100 structure-function claim notifications regarding NAC and at least one qualified health claim petition for a dietary supplement containing NAC, and has not objected to the presence of NAC in any of these products, added the letter.

Speaking with NutraIngredients-USA, Olsen said: There is strong legal evidence that NAC is a grandfathered ingredient co-existing as a dietary ingredient alongside the drug for decades.

NAC has been available as a dietary ingredient in dietary supplements since before the passage of DSHEA [in 1994] and FDA has never raised any safety issues about the ingredient.

The recent reported move by Amazon to remove NAC-containing dietary supplements from its website has caused concern in the dietary supplements industry, although no other retailers have confirmed they are exploring similar measures.

Cara Welch, PhD, the current Acting Director of ODSP, responded to CRNs letter last week, noting that the Agency is closely reviewing the information provided in your letter and will provide a more substantive response once our evaluation is complete.

Olsen told us that the association has only been in contact with ODSP, and it is not clear if other offices or Centers within FDA are involved in the decision-making process.

CRN is recommending to member to keep selling the NAC-containing dietary supplements, she said. FDA has not given the final word on NAC.

Olsen noted that there is precedent for FDA reversing a stance, citing the KIND LLC issue from 2015 when the Agency sent a warning letter to the nutritional bar maker over label claims on its products and website that were deemed to step beyond the definition of 'healthy' because of the products' fat content. KIND pushed back and in 2016 the FDA conceded the point (with a couple of caveats).

Weve made clear with the Agency the seriousness of this [NAC] issue, said Olsen. This has real world repercussions for companies the longer this continues.

CRN is pleased with the level of correspondence weve received from the Agency, added Olsen. We sent the letter in December 2020 and received a response in May, and that was a response from the Agency during an Administration change, Id add.

"But I am careful about what I'm recommending, depending on the person and what's going on with them." Boling adds that there are a few vitamins and supplements that you should never take, or should only take with serious caution, because of serious health risks of the potential for drug interactions. This once-popular antioxidant shouldn't be taken just for the heck of it. "Unless you have a reason to take vitamin E, you shouldn't be taking it as a random supplement," says Boling. "We used to think it was good to take because it's an antioxidant, but actually it turns out that the risk is higher than the benefit." That risk: Vitamin E thins the blood, which could turn minor injuries into serious bleeding episodes.

This plant extract is one supplement that should never cross your lips. "Kava, which people have taken to help them with sleep, can cause liver failure," says Boling. "I tell patients it's not safe to take orally."

"Tryptophan is also something you can take to help you sleep, but it's linked to a disorder that's called EMS, which is a neurological condition that includes fatigue, intense muscle pain, and nerve pain," says Boling. Tryptophan is naturally present in small amounts in food, such as turkey and milk, "and that's not a problem," she adds. "But you should not take a tryptophan supplement."

This hair-and-nails supplement is available in very high doses, but Boling recommends her patients not take above 1 mg (1,000 mcg) daily. The reason: One study showed that men, in particular, had an increased risk of lung cancer if they were taking megadoses of biotin (5 mg to 10 mg daily); that risk wasn't associated with a 1 mg daily dose.

This supplement was trendily touted as a natural antidepressant several years ago, but it should be taken with caution. "You shouldn't take it along with antidepressants, and it may interfere with birth control," says Boling. "You need to be careful about that."

"Here's what I tell my patients," says Boling. "If you're like everybody else in the whole wide world, and you don't eat a perfect diet every day, a multivitamin is going to fill in the little deficits you have on a daily basis. And if you're OK paying money for something that you're mostly going to pee outbut it's going to fill in those tiny little deficitsthen take a multivitamin. I do. I'm OK with that."

Boling recommends that her patients take 2,000 IU of Vitamin D daily. Medical evidence suggests it can support the immune system, particularly important in the age of COVID.
