Texas CBD products are everywhere. Here’s what you should know. – The Texas Tribune

In 2017, business was slow for Sarah Kerver. She was a sales rep for a Colorado-based company trying to push hemp and CBD products in Texas. But customers were apprehensive.

No one wanted to touch [CBD]. No one wanted to talk about it. No one was interested in carrying this product in any sort of spa or retail space, Kerver said.

Today, the market for CBD, or cannabidiol, is exploding. Stores are popping up across the state selling tinctures and topicals. Its being mixed into smoothies and coffee at cafes. Spas are advertising CBD massages and therapies. And much of the sudden spike in popularity is thanks to a Texas law last year that legalized hemp, the plant from which CBD is derived.

You go anywhere now, and you find something that says CBD on it, said Kerver, whos now in talks with Austin distributors interested in carrying her CBD product line, called 1937 Apothecary.

But buyer beware, experts warn. Anyone can sell CBD in Texas. Many of the products are advertised as natural alternatives to prescription medications and make unfounded claims to treat conditions like chronic pain, depression, anxiety, insomnia, diabetes and psychosis. None of these claims are recognized by the U.S. Food and Drug Administration.

And because of lax labeling and licensing regulations, unsuspecting consumers may not actually know what theyre buying.

Unless you really know that its something reputable, I would say to be wary because you dont really know that it is even CBD, Kerver said.

In 2018, the federal government passed a new Farm Bill legalizing hemp and derivatives, like CBD, with less than 0.3% of THC, or tetrahydrocannabinol. Hemp and marijuana are both part of the cannabis plant family, but while marijuana is rich in THC and produces a high, hemp contains only traces of the psychoactive compounds and is richer in CBD.

In June, Gov. Greg Abbott signed a bill legalizing hemp and bringing state policy in line with federal law.

Confusion on the part of law enforcement has led to the wrongful arrests of some in possession of CBD or hemp even after the Texas law went into effect. Still, the policy change is an important step on the way to allowing Texans to partake without fear of reprisal, according to Lisa Pittman, a lawyer on the Texas Department of Agricultures industrial hemp advisory council.

Because Kerver launched her line before the Texas bill, shes seen firsthand how changes in the law have led to evolving attitudes in Texas about the products. Previously, she was able to sell Colorado CBD products before the federal government legalized hemp because of the 2014 Farm Bill, which started a pilot program for participating states to grow industrial hemp.

Theres been more media around it since Texas has come on board, definitely, Kerver said. Texans are becoming more educated about it and much more open to it.

Industry leaders say they cant calculate the exact number of new CBD businesses that have opened in Texas over the past year in part because the Texas Department of State Health Services won't implement licensing requirements until early this year though anecdotally, many say theyve seen an uptick.

The Austin Chamber of Commerce counted at least three CBD-related relocations or expansions since the bill passed last summer, creating about 140 new jobs in the emerging sector. But the list, which is compiled from public media announcements and deals the chamber is involved in, isnt comprehensive.

Sisters Shayda and Sydney Torabi founded Restart CBD in September 2018, just before the Farm Bill passed. Sydney Torabi said the changes in the law have made business run more smoothly.

The two originally intended to operate the business exclusively online but decided to open a brick-and-mortar location in Austin after having difficulty with several online payment companies, from mom-and-pop merchants to giants like PayPal, that didnt want anything to do with cannabis.

We were a business, but it wasnt as functional as it couldve been until the [Texas] law passed, Sydney Torabi said.

The Torabis started with a pop-up store and expanded to a permanent location last April, a month before Texas law changed.

We were operating in a gray area until the Texas bill passed, Sydney said. It did take away a little bit of the stigma. Like, OK, now its legal in Texas. We can go to a CBD shop and not feel like were doing something bad."

CBD comes in many forms: smokeable flower, tinctures, topicals, edibles and much more.

Its not cheap. For example, offerings at Custom Botanical Dispensary, Kervers Austin-based collective, range from capsules ($96 for 30) and a Full Spectrum Tincture ($82 for 1 ounce) to a PMS Dark Chocolate Bar ($18), infused popcorn ($7) and even Pet Hemp Oil in flavors bacon and tuna ($40).

Despite lofty and wide-ranging claims, CBD is only FDA-approved to treat two rare kinds of epilepsy via prescription drug Epidiolex. In part, this is because little research has been done in the U.S. on the hemp derivative.

But the FDA also says the jurys still out as to whether CBD is considered a safe substance.

CBD has the potential to harm you, and harm can happen even before you become aware of it, the agency said in a November consumer update, going on to list potential repercussions like liver injury. The effect on children and pregnant or nursing women is unknown, the FDA added.

In the meantime, businesses nationwide are getting wrist slaps for making medically unproven promises.

In November, the FDA sent warning letters to 22 CBD sellers across the country, including Noli Oil in Southlake. The letter to Noli Oil cited a myriad of illegal health claims, from inhibiting cancer cell growth to treating schizophrenia and antibiotic-resistant infections.

Also flagged was the companys sale of edibles, like gummy bears and caramels, in interstate commerce. While CBD-infused food products can be manufactured and sold in Texas, they cant cross state lines because the FDA considers the compound an adulterant.

Other sellers were targeted for falsely marketing CBD as a dietary supplement.

When it comes to touted benefits, Dr. Yasmin Hurd of Mount Sinais Addiction Institute said shes cautiously optimistic.

Can I say go be a guinea pig yourself? Unfortunately, just because of my position, I cant really approve that, Hurd said. But clearly, hundreds of thousands of people are doing research on themselves and trying to find out what works on their particular ailment.

There is some evidence to suggest it could be beneficial for anxiety, psychosis and substance abuse, Hurd said. Other claims, like its effect on chronic pain, are more dubious, at least until more research is done, she added.

But Kerver said her own experience and the testimonies of friends and family have convinced her of CBDs efficacy.

Her husband found relief from inflammation after back surgery, and her siblings from anxiety and sleep issues. She said she has seen her own gut problems clear up completely.

When someone has been constantly taking something for well over a year, and its still working for them for the same thing, and they have to have it, thats not the placebo effect anymore, Kerver said.

Hurd also warns that CBD can impact the performance of other medications, so those interested in trying it should first consult a doctor to learn more about potential interactions. Otherwise, CBD is relatively safe, she said, with the most common side effects being diarrhea and sleepiness.

Until stricter regulations, like requiring retailers to have CBD-specific licenses, are put in place this year, Kerver said there is little protecting consumers from bad actors. Still, there are some measures people can take to protect themselves while the Texas hemp industry is in limbo, starting with labels and vendors.

Pharmacies and health food stores are preferable to smoke shops and gas stations, according to Pittman.

Avoid anything that has a pot leaf on it or that doesnt look like a clean, medical product, Pittman said.

Any reputable company will make test results easily accessible, and customers can use them to check THC content; trace amounts under 0.3% may still cause someone to test positive for marijuana on a drug test, Hurd said.

Buyers should also be wary of products that make any explicit health claims, which are considered illegal by the FDA. While retailers can say a particular CBD product helps alleviate a symptom, like difficulty sleeping, they cant say it treats or cures a diagnosable condition, like insomnia, according to Pittman.

Thats where we walk the fine line, Kerver said. We cant say anything, but luckily weve been in business long enough to go, Ive got 10 customers, they all use this for sleep, and theyre all coming back for it for sleep, and they buy it every month for sleep, and theyre really happy with it.

Blan Holman, a lawyer specializing in federal water policy at the Southern Environmental Law Center, said: This puts drinking water for millions of Americans at risk of contamination from unregulated pollution. VANCOUVER , Jan. 22, 2020 /CNW/ - 1933 Industries Inc. (the "Company" or "1933 Industries") (TGIF.CN) (TGIFF), a vertically-integrated and growth-orientated cannabis consumer packaged goods company, is pleased to provide a progress update regarding its hemp processing facility ("Lab").

Phase 1The Company has been diligently working with a team of engineers and chemists to develop a customized hemp extraction facility capable of producing isolated cannabinoids such as CBD, CBG, CBC and CBN, as well as full spectrum and broad spectrum oils without THC, at full scale while maintaining a significantly lower cost structure than other comparable hemp extraction facilities. The Lab is being designed to comply with existing and anticipated state and federal hemp manufacturing rules and GMP guidelines. The Company is taking necessary steps to ensure the long-term viability of the Lab and has undertaken a mandatory peer review of the proposed equipment as required by Clark County .

Project Scope and Expected OutputThe Lab will be located adjacent to the Company's current cultivation facility in Las Vegas . The 12,160 sq. ft. existing building has received the necessary approvals for new zoning and permitting for hazardous materials from County authorities and has secured an Industrial Hemp Handler Certificate from the Nevada Department of Agriculture (NDA) Industrial Hemp program. Permitting has been completed for fire and city inspections as well as H-3 hazard zoning.

The facility's monthly processing capacity is estimated at approximately 68,000 kg. (150,000 lbs.) of hemp biomass toproduce 5,000 kg of full spectrum oils or 4,500 kg of CBD isolate.

Design Benefits The proprietary FDA level, state-of-the-art hemp extraction system has been designedto extract CBD oil with an average efficiency rate of 2.3 times greater than the current industry standard, thereby cutting costs by at least 50 percent. The alcohol extraction process, coupled with aproprietary short chain/long chain liquid/liquid extraction customized system, has been designed by a team of engineers and chemists from FDA regulated facilities in the pharmaceutical, bioplastic and biofuel industries. The process has been thoroughly tested with positive results in, among other things, automation, the elimination of expensive chilling, recovery of all solvents and reducing the carbon footprint to approximately 12 times less than other facilities.The Company's proprietary extraction system is projected to produce the same quality of CBD oil for less than half of the $1.50 /g average extraction cost for the hemp industry.

The Lab will also have the ability to deliver broad spectrum oils and distillates consistently without tetrahydrocannabinol (THC), the principal psychoactive constituent of cannabis and one of over 100 cannabinoids identified in the plant. Processing will ensure the THC content registers under the current 0.3 percent legal limit. The Lab has been uniquely designed to process live plants, and the Company will have the ability to formulate cannabinoid content into its own oil compounds and customize its own blends.

Phase 2 Construction and InstallationWhile the Company expects that the required peer review will take four weeks to complete, electrical and mechanical systems are being prepared in order to ready the building to receive the new equipment. Tenant improvements of the existing building and all phases of construction will require approval by Clark County . The project will take anywhere from 4 to 8 months to complete, based on the response times and approvals by the city and county.

What is CBD oil, and why is it so expensive? – Business Insider

Narrator: Depending on who you ask, CBD oil can be a miracle cure, a snake-oil placebo, or something vague in between. This poorly regulated industry, which has boomed over the last three years, is a minefield for newcomers. Considering that manufacturers are unauthorized to make medical claims, how can one CBD oil cost $50, while another of the same volume costs $390? And are premium CBD oils justified for being so expensive?

Firstly, what is CBD?

Dani Gordon: CBD stands for cannabidiol. That's the chemical name for one of the chemicals in the cannabis plant. The CBD oil that you're seeing on shelves that consumers can buy without a prescription is actually from low-THC, the stuff that makes you high, varieties of the cannabis plant.

Narrator: CBD is a new and rapidly growing phenomenon, with sales tripling in the last three years. But the line between what consumers are using it for and what manufacturers can say to attract them is increasingly blurred.

Gordon: It can be used for a variety of purposes, things like inflammation, anxiety, stress, and it can also be used just to support general wellness. Now, the differentiating criteria between a medicine and a supplement is you cannot make a claim that it treats or cures a specific medically diagnosed disease. And that's really important for companies to understand, because they can get their products pulled off the shelves, and they can also potentially sometimes unintentionally mislead consumers.

Narrator: But in the age of anxiety, it's no surprise that CBD has become a hot ticket for manufacturers, who infuse all sorts of products with cannabidiol, shrewdly tapping into its perceived wellness benefits and bumping up the price of otherwise standard items, like gummies, sportswear, tampons, and even dog treats. But how do we assess the value of CBD oil, which is actually produced in two different ways?

Gordon: A full- or broad-spectrum product is made from the whole plant extract. They take the flower and they process it, and they come up with an extract that not only has CBD, but it has other plant chemicals, other cannabinoids, other terpenoids, other things in the plant that work together in this, what's called this herbal synergy, this entourage effect. And what you get is greater than the sum of its parts.

Narrator: But some manufacturers process the extract even further into CBD isolate, a substance devoid of all other plant chemicals and labeled as "pure CBD." But this isolate, which often features in expensive products, is generally considered to be less effective and cheaper to make.

Gordon: Some brands and some companies will put CBD isolate into a product and then brand it as a premium product, even though the cost of actually making it, because the cost of the isolate, is quite a lot lower than the cost of a full- or broad-spectrum CBD.

Narrator: But because of lax regulations in the industry, this fundamental difference in CBD oils is often disguised by manufacturers. The front of this premium $300 bottle, for example, does not display that it is, in fact, made from isolate.

Gordon: Sometimes you have to dig into the nitty-gritty of the ingredients. And sometimes you even have to, you might have to call the company and see what they've actually used. But in general, the labeling criteria are becoming a little bit stricter, so more and more consumers will be able to know what is a CBD isolate product and what comes from a full- or broad-spectrum source.

Narrator: These products can also be measured by the amount of cannabidiol in each bottle.

Gordon: What you really need to look for is the number of milligrams in the entire bottle, and then the number of milligrams of CBD per dose. And that's really gonna tell you the bang for buck.

Narrator: But even high-dosage, full-spectrum CBD doesn't have the approval from the Food and Drug Administration. The FDA says it "recognizes the significant public interest in cannabis and cannabis-derived compounds, particularly CBD. However, there are many unanswered questions about the science, safety, and quality of products containing CBD."

More worryingly, lab tests conducted by the Centre for Medicinal Cannabis found that 62% of CBD products tested in the UK didn't contain the cannabidiol content promised on the label. One product actually contained no CBD whatsoever.

CBD is shrouded in mystery and confusion for the consumer. On the one hand, a 2018 cross-sectional study of CBD users found that almost 62% "reported using CBD to treat a medical condition," stating that CBD has "broad therapeutic value. But on the other hand, manufacturers cannot use the research data to make medical claims, leaving spokespeople in the unenviable position of having to promote their products to a certain demographic while avoiding endorsing the public's perception of CBD.

Brett Heaps: So, what we're not allowed to do with our products is make any medicinal claims, 'cause they're not medical products. All our products that we sell are wellness products to improve sleeps and moods. We see CBD as a homeostasis product, which balances the levels in your body to get you into a normal state and balanced mind.

Narrator: Thankfully, despite the misconceptions, no matter what you use it for, there is a way to get a snapshot of the quality of CBD oil.

Gordon: You wanna look for a certificate of analysis. That means that that is a third-party-tested lab report. They test their product to make sure that it's not contaminated, make sure it doesn't have accidental THC levels above the allowed limit. Make sure it doesn't have heavy metals in it. Make sure there's no microbials, so, bacteria or fungus that can grow in these plants. No herbicides, pesticides, things you don't want in it.

Narrator: So, why is it so expensive? The cost of producing CBD oil isn't particularly high in relation to other large-scale crops. But there appears to be a premium on all cannabidiol, as revealed in this comparison of full-spec CBD, which shows that its prices grow pretty uniformly, according to the price per milligram in each bottle. With any wellness product with a global hype, high demand means high prices. Statistics show that sales of CBD will likely reach $1.8 billion in the next two years. But without regulation, medical research, and clear consumer knowledge, the human value of CBD oil will, for now, remain a matter of opinion.
