How Disney and other theme parks handle medical marijuana and CBD – Leafly

CBD and medical marijuana are both legal in Florida and California, but Disney refuses to allow patients to carry their medicine into any of the company's theme parksand may call the police if you do. (Leafly illustration)

After a four-month coronavirus shutdown, Walt Disney World reopened its gates to thousands of visitors earlier this week near Orlando. But the Magic Kingdomand all Disney parksstill remain closed to certain visitors.

Millions of Americans who rely on medical marijuana or CBD products to treat conditions like epilepsy, cancer, Alzheimers disease and more are prohibited from visiting Disney parks and resorts, thanks to a draconian restriction that has been in place for more than 40 years.

Medical cannabis and CBD therapeutics are considered prohibited contraband at all theme parks, hotels, and shopping areas on Disney properties. Meanwhile, almost every other kind of medical drug is allowed inside. Alcohol is sold openly at Disney properties and at rival operations. In fact, theres an entire website devoted to drinking alcohol at American theme parks.

Similar policies have been adopted by nearly every major American theme park company. Six Flags, Universal, and Cedar Fair prohibit all forms of legal cannabiseven CBD. Only Sea World properties (which include all Busch Gardens and Sea World parks) allow visitors to carry CBDbut no forms of medical marijuana with significant amounts of THC.

To be clear: The parks dont ban visitors who are medical marijuana patients. But they dont permit patients to enter the park with their medicine, and that can be a deal-breaker for many guests.

Even worse, guests who are found to possess any kind of medical marijuana or CBD products at one of Disneys many bag check areas are not only refused entry, but have faced legal prosecution.

Walt Disneys original park, Disneyland, is located in Anaheim, California, where all forms of medical as well as recreational cannabis use are legal for adults.

Despite state law, the parks official property rules state that marijuana (including marijuana enriched products) or any illegal substance is prohibited. CBD is no longer illegal under either federal or state law, but park officials still prohibit the substance.

While some may assume this is an unenforced policy that has yet to be officially removed, Disneyland has a recent history of using local law enforcement to remove guests found with recreational or medical marijuana who try to enter the theme parks, hotels, or the Downtown Disney shopping district.

Anaheim Police Department records show that there have been nine arrests for legal possession of marijuana (or derived products) on Disneyland property since California state legalization went into effect on January 1, 2018, and dozens more in the years prior.

How can someone be arrested for possession a legal substance? Well, there are various kinds of arrest. Writer Lindsey Bartlett looked into the question last year and reported this:

If security guards decide to take a parkgoer into a holding cell, called Disney Jail by former employees, it would appear similar to a holding cell at any security office. One formerDisneyland employee describedit as a 10-foot-by-10-foot white room with benches and a mirrored wall. Guests who have committed a crime will wait while Disney calls Anaheim police, which have two stations located on the Disneyland property.

Bartlett noted that park guests who possess cannabis within the legal limits will be escorted off the grounds but ultimately not charged by local police. Its worth noting that public consumption of any legal cannabis product does remain illegal in most places, though, so there could be charges based on that.

At Walt Disney World, located in Orlando, Florida, the situation is unfortunately similar. Though marijuana is not legal for recreation in the sunshine state, medical marijuana as well as CBD products with high levels of THC are legally available with a prescription in the state.

In addition, patients with an active prescription are legally permitted to have these therapeutics on their person in public places in the state as long as they can produce a medical providers recommendation and an ID card.

And while there havent been as many arrests at Walt Disney World as there have been at Disneyland, in April 2019 there was a massive uproar when Hester Burkhalter, a 69-year-old great-grandmother, was arrested at the Magic Kingdom while possessing legal CBD oil. Burkhalter used CBD as a therapeutic for her arthritis pain.

Public outcry following the arrest was swift and intense. The charges against Burkhalter were dropped only a few weeks laterCBD is completely legal under Florida lawbut the PR damage had been done. Many found Disneys behavior shocking, as the idea that a company that markets itself as family friendly would call local police to arrest a senior citizen for possessing a legal pain therapeutic. But the incident served as a wakeup call for those who were unaware of Disneys policy on all products connected in any way to cannabis.

At the time, some expressed hope that the corporate embarrassment might move Disney to change the companys policy. That has not been the case.

As of July 2020, Disney firmly maintains its ban on legal substances inside its theme parks and resorts in both California and Florida. Guests who rely on the therapeutic effects of medical marijuana and CBD cant enjoy a Disney theme park unless theyre willing to leave their medicine at home.

Disneys refusal to roll back this regulation that directly discriminates against those who rely on this treatment is hard for even the biggest Disney fan to explain awaywhich may be why Disney has yet to release any kind of statement about it, despite public calls for the company to justify its policy.

When Walt Disney first imagined Disneyland in the 1950s, he dreamed of a place where parents, grandparents, and children could all have fun together. The Disney Companys refusal to allow guests to enter its properties with their legal medicine unfairly excludes millions of would-be guests from the happiest place on Earth. That doesnt merely contradict the optimistic, inclusive future the companys founder envisioned in Tomorrowland. Its an ableist attack on the positive values Walt Disney worked so hard to instill in all of his creations.

Medicinal cannabis is legal in Australia, but people like Grace are still turning to the black market – ABC News

After Grace* was diagnosed with cancer earlier this year, she turned to medicinal cannabis.

But accessing it through legal medical channels was a challenge: she faced long waiting times and substantial paperwork.

"I was offered through an illegal source where I could get it very quickly, and because my tumours were aggressive and time is of the essence, I decided to opt for the non-medical option," she tells ABC RN's Life Matters.

Grace started to get cannabidiol (CBD) oil sent to her in the post, in an olive oil bottle.

But concerns about the illegalities of the drug started to weigh on her conscience, and she worried about the chemical composition of the CBD oil she was taking.

"If you're obtaining it through a medical source and it's been approved, there's stringent procedures and processes in order to create that oil. Whereas if I'm getting it off an illegal source, it's hard to actually know exactly what I'm taking," she says.

"It just seemed like the most easiest, cost effective option for me," Grace says.

"The legal system we've had available now has been in place for about four years, and in the early days for the first couple of years we had a very clunky system," he says.

Professor Lintzeris was the lead researcher in a study on how Australians use medicinal cannabis for everything from chronic pain to mental health conditions.

The online survey of more than 1,300 people found that while cannabis is used widely for medicinal reasons, the vast majority of respondents don't get it from their doctor.

"It was very difficult for patients to be able to find doctors who were knowledgeable and interested, the products were quite expensive, the legal hoops were quite pronounced. There were lots of hurdles, paperwork and so forth," Professor Lintzeris says.

"Most of our respondents were working. They were people who were holding down jobs, mums and dads with kids. So engaging with illicit activities such as that was a concern."

Life Matters listeners shared stories of similar hurdles:

"I have a well noted and long-term chronic pain condition, which has proven relief with CBD. Yet I have been constantly stymied in my attempts to get it prescribed. Thus I am forced to go through the black market with all its problems."

"My husband was prescribed medicinal cannabis for his cancer pain incredibly expensive around $350 for a very small bottle that may last a couple of months only. It was very helpful but we just couldn't afford to keep buying it."

"I'd rather be using medical cannabis than opium products any day. But it is so expensive to access legally and yet opium products are subsidised by the government. The addiction story for opioids is horrendous. Cognitive dissonance [is] the right word for our culture."

Access to legal medicinal cannabis is granted under the Special Access Scheme. It's managed by the Therapeutic Goods Administration, and you need a restricted prescription for it.

The application needs to be done by a doctor on your behalf, and it must show you have a medical reason for accessing cannabis.

Between the start of 2020 and May 31, more than 18,000 applications for medical cannabis were approved by the TGA.

Professor Lintzeris says the system has adapted and improved since medical cannabis was legalised at the federal level in 2016.

Initially people would face wait times of up to two months for approval, he says, but now that's more like two to four weeks and that's not the only change.

"I think we're seeing some changes in the development of the marketplace, as more doctors take up this option and get better educated around what medical cannabis is, as the price of products is reducing and as more products come onto the market, and there's more and more consumers who are getting experienced with legal supplies," Professor Lintzeris says.

But he argues that some areas of the law are still lagging behind.

Driving with THC in your system is a criminal offence, even if you've been prescribed medical cannabis.

The standard advice for cannabis patients is to wait five days before driving, or risk a fine or a suspended licence, but there is ongoing debate about how much impairment THC actually causes.

"There's this inconsistency in Australia where we have a group of drug driving laws that really reflect what made sense for illicit cannabis or drug use," Professor Lintzeris says.

"Unfortunately, a THC-based medicine gets caught up in that drug driving. We have this anachronism in Australia where no other medication that's legally prescribed is subject to the same drug driving issues as medical cannabis."

It's something that proved a huge worry for Grace.

"My biggest concern was that if I was to get pulled over while driving, if I registered for THC in a random drug test, I could lose my licence," she says.

Like Grace, Professor Lintzeris also points out that that if you're self-medicating rather than going through a doctor, there are risks.

"There's no capacity of standardisation of product or quality control, both in terms of what's in this batch, how much THC or CBD in this batch compared to the batch from last month," he says.

Despite the legalisation of medicinal cannabis in Australia, group bodies such as the Royal Australian College of General Practitioners (RACGP) continue to take a cautious stance on prescribing medicinal cannabis patients, calling for more high-quality research into the safety and effectiveness of it.

The RACGP pointed Life Matters to a statement, which said it doesn't "recommend the use of cannabis products", but does "recognise that a specialist GP may offer to prescribe it to a limited number of patients".

After four months using CBD oil through an illicit producer, Grace is willing to accept the risks.

"I do find that there is little to no side-effects of using the cannabis oil which was a concern initially and it's a cost-effective option," she says.

"When I went down that [medical] channel, what I found was that there were a lot of hoops I had to jump through, a lot of paperwork, and a lot of people who had to be involved.

"And even then if I was deemed worthy of the CBD oil, I was going to be sent this particular oil every six weeks.

"But the illegal CBD oil I got straight away, it was very easy to access and cost effective. So I opted to stay using the illegal source."

Growing Cannabis in Wine Country: The Shone Farm Project – wineindustryadvisor.com

In 2019, the Santa Rosa Junior College initiated a hemp cultivation project at Shone Farm to specifically identify the best agronomic practices for cultivating hemp and understand the potential terpene drift between hemp and wine grape vines.

Since launching Wine and Weed Symposium, WIN President and CEO George Christie says, Im often asked a question I couldnt find anyone to answer until I met Dr. George Sellu. Will hemp terpenes negatively influence grapes if grown too close to a vineyard?'

A lot of people are concerned about whether hemp will taint wine grapes, agrees Sellu, Santa Rosa Junior Colleges (SRJC) Agribusiness Program Coordinator/Instructor, but I couldnt find any research in the US to support that concern. So, he implemented a study to measure drift from hemp acreage into vineyards at SRJCs Shone Farm. The conclusion: no hemp terpenes were detected on wine grapes or in wine made from those grapes, either by instruments or a wine sensory panel. Drift from spraying vineyards has a higher chance of negatively impacting hemp since far fewer products are approved for hemp than for grapes. Christie points out that this could open grape growers to liability.

Sellu suspects that some may not understand the plant terpenes responsible for aromas and flavors. Two examples, linalool in lavender and pinene in raspberries, carrots and pine trees, are both in hemp and grapes. If you find pinene in wine grapes, he says, you wouldnt blame someone growing carrots nearby.

Christie noted that San Luis Obispo banned hemp in Edna Valley, citing grape taint and crime concerns. Theres not enough THC in hemp to get high, Sellu responds. Why would anyone steal it? Colorado planted thousands of hemp acres and have yet to see any theft. If farmers cant make money from their acreage, theyre going to move away. You might get $30 an acre for corn or wheat, and $1000 an acre with hemp thats the difference between making money and losing your farm.

Sellu promises to expand his research to other wine regions. Then he offers some advice. Plant hemp for fiber instead of CBD oil. CBD oil prices fell 50% last year because too many acres were planted. Demand for CBD will fade, while fiber will be here for a long time. Businesses are switching from products like Styrofoam to hemp fiber, which is more sustainable. Georgia Pacific uses it to make Brawny paper towels and Levis and Patagonia for pants. Others use it for flooring, car parts or sails. Even though youll earn less per acre than for CBD, fiber is the longer-term play.

Q: Can this hemp study be applied to the effects of growing marijuana strains that are grown for medical/recreational purposes? If not, would it have to do with the differences in terpene content?

A: Certainly! CBD Hemp varieties are similar to Marijuana in terms of structure and terpene production. The terpene profile will differ based on the variety of hemp or Marijuana.

Q: If there is a terpene transfer from hemp to wine grapes, did you look at the stage of wine grape ripeness relative to development of terpene development in hemp?

A: Terpene production in hemp increases as the plant approaches flowering and peeks about a month before harvest (for full term hemp varieties). We planted our hemp late so that flowering coincided with fruit ripening in grapes. We harvested the grapes two weeks before the hemp. As you saw from my presentation, terpene production in hemp was declining at the end of data collection.

Q: Could the terpenes in hemp and cannabis behave differently?

A: We have did not explore that question. Generally, specific terpenes in CBD hemp and Marijuana should have the same chemical properties. The terpene profile will differ based on the variety and the levels of individual terpenes. Fiber hemp generally has lower levels of terpenes compared to CBD varieties.

Q: What was the limit of quantification for the terpene method? Terpenes are present in ppb levels. Commercial labs only analyze to PPM level.

A: The limit on quantification for terpenes in commercial labs is PPM. I am not sure if our local commercial wine labs have developed methods for quantitating hemp terpenes in wines.

Q: Many times, Eucalyptus can be tasted in a wine produced from vineyards surrounded by Eucalyptus trees. The wine is often describe as having mint tones. What are your thoughts regarding different terpene sources?

A: Minty taste is associated with eucalyptol. Some researchers have found eucalyptol in grapes that are not planted in close proximity to eucalyptus. They have suggested that eucalyptol in wine is also produced by transformation during the winemaking process.

Q: Are you saving wine samples for future analysis and tasting?

A: Yes, we are saving these wine samples for future testing and analysis.

Q: I have talked with some help producers and they have had to post signs that Hemp will NOT get you high to avoid theft. Did you have any issues with theft at the Shone Farm? If so, how did you address. Asking as other community colleges have raised this question if growing hemp on student farms.

A: We had no problem with theft. We had very clear signage all around the field and we installed cameras.

Q: Can future research also consider proximity of drying/processing cannabinoid species to vineyards? I have been hearing there is potential concentration of terpenes during the drying/processing process.

A: We have not thought about drying close to our field. That could be an interesting study. We would have to do a early hemp variety because wine grapes are harvested before hemp.

Q: Actually, anecdotally, in SBC (Santa Barbara County) we have vintners complaining about the cannabis flavor influencing the wines. Also, we have grows proposed up to 80 acres down here. Thats going to have a significantly bigger impact than 1/3 acre of hemp, the test size.

A: Thanks for your comment. We do not know that the size of the field makes a difference. We were looking at proximity to the vineyard. If the County youre in has an ordinance that stipulates an easement between hemp and vineyards based on research then this will address some of the litigations going on in SBC. This would also give UC Cooperative Extension some time to conduct larger studies.

Q: The Right to Farm was not applied to cannabis because you a) cannot tax a crop, so that is how a County makes money on cannabis, and b) The Right to Farm protects odor and odor is a significant problem for hemp and cannabis.

A: Absolutely agree with you. The right to farm protects farmers from the odor concerns. I think it will be hard for Counties to shutdown hemp cultivation primarily based on odor concerns.

Q: Thank you for this research and conversation. Are there any grape growers that are transitioning or making room to grow hemp? It sounds like it could be a healthy sign for grape growers as hemp is held to a higher standard than conventionally grown wine grapes.

A: I think there are a lot of grape growers who are considering diversifying their farming to include crops such as hemp because of the current drop in grape prices across the US.

George received a Bachelor of Science in Agriculture and Environmental Science with an emphasis in Soil Science from the University of Sierra Leone and a MS and PhD in Agricultural Science/Education from the University of California, Davis. George has 10 years of experience teaching high school agriculture courses in California. In addition to high school teaching, George taught at Woodland Community College for three years prior joining SRJC faculty. Incannex Healthcare shifts from making an impression to setting sales records – Small Caps

Cannabinoid development company Incannex Healthcare (ASX: IHL) has published provisional performance figures for the past quarter, declaring a record three months with sales momentum expected to continue going into the next quarter.

The company is also welcoming July with a name change, substituting its former name, Impression Healthcare, with Incannex Healthcare a name that better reflects its ongoing development of unique cannabinoid products and research into treating obstructive sleep apnoea, traumatic brain injury, acute respiratory distress syndrome (ARDS) and temporomandibular joint disorder.

Crucially, the brand change also symbolises Incannexs commitment becoming a pure-play biotech development company on a mission to develop a range of medicinal cannabis products it can market to patients that have little or no other alternative treatments.

In a statement to the market this morning, Incannex said it expects to report cash sales receipts of up to $671,000 for the second quarter of this year, up 97% year-on-year, when the company publishes its official quarterly results in the coming weeks.

The feat represents Incannexs largest quarterly sales figure since listing on the ASX in November 2016. Coincidentally, the companys surplus market torque coincides with a broad-based increase in medicinal cannabis product sales under Australias Special Access Scheme (SAS) which bodes well for medicinal cannabis adoption and sales for the entire industry.

IHL has also highlighted previously that it is pursuing FDA regulatory exclusivity for three of its products; a strategy that put the company on the path to being a pharmaceutical development company.

GW pharmaceuticals is the only recent medicinal cannabis company to achieve registration, and thus market exclusivity, for its CBD-based product Epidiolex. Epidiolex, which contains cannabidiol to treat severe forms of epilepsy, brought in a total of $296 million in sales in2019across the globe for the British pharmaceutical company.

According to Incannex, the fastest-selling product this past quarter was the Cannagesia CBD oil tinctures and reported that it expects sales momentum to maintain current its pace going into Q3 after receiving a batch of 2,500 Incannex-branded Cannagesia CBD oil tinctures earlier this week.

The companys cannabinoid products are mostly sold under its product supply and distribution relationship with Australias largest network of cannabis medicine prescribers, Cannvalate.

The networks chief executive, Dr Sud Agarwal, is also a director and chief medical officer of Incannex with Cannvalate and Dr Agarwal both holding major shareholdings in Incannex.

Dr Agarwal presented and discussed Incannexs portfolio at the companys annual general meeting last year. In his presentation, he explained that Incannexs program now facilitates a pathway to creating unique treatments for which registration will be sought from various regulators globally.

After sourcing a great range of medicinal cannabis manufacturers, we have been unrelenting in our efforts to grow cash sales of the Incannex range of products, said Incannex managing director and chief executive officer Joel Latham.

I am delighted to report that the company has achieved its greatest quarter of cash sales receipts, being a 97% increase over the previous corresponding June 2019 quarter, he added.
