Cannabis: a complex, regulated industry in NYS – The Batavian

He kind of hates to admit it, but the doom of COVID for most businesses was actually a boon for Empire Hemp Company, Chris Van Dusen says.

Back then we had hired some employees, and we had COVID hit. So we did a walk-up window for COVID. And it was taking off. So we decided, to survive here we were going to open a store, said Van Dusen, company founder and CEO. So we had to let the guys go. And that's how we opened the store. So the store really took off it was just the two of us doing everything.

His other half, wife Shelly Wolanske, has been as fully immersed in the business as he has, first with a site on Swan Street in 2019, and a downtown store in April 2020. Van Dusen recently heard of a convenience store about to open with plans for selling cannabis products, and he wanted to clarify how one becomes a legal entity in the ever-growing field of cannabis establishments.

Its not as easy as hanging up a sign, he said.

First, theres an official Office of Cannabis Management that operates through the New York State Department of Labor. It regulates everything. That means applications, certifications, inspections, and many administrative hoops to jump through in order to be above board, he and Shelly said.

According to cannabis.ny.gov, theOffice of Cannabis Management (OCM)is charged with issuing licenses for businesses to participate in New Yorks adult-use, medical, andcannabinoid hempindustries.TheOCMis developing regulations that will outline how a person or business can apply for and receive a license in the new adult-use cannabis industry.

TheOCMwill promote social and economic equity for applicants who have been harmed by the prohibition of cannabis for adult-use licenses, establishing a goal of awarding 50 percent of licenses to social and economic equity applicants, the site states.

Due to the nature of cannabis more loosely known as marijuana, pot, weed it has been tough going with those hoops, especially with banks and credit card companies that want no part of the business, Van Dusen said. That has made it tough to get loans and revert to a cash-only operation for sales, they said. And at the opposite end, there are the certified growers.

We currently are working with, right around 20 growers right now. So we need this. They're calling us every day ever since we got the conditional licensing process, we're on the list, he said. There's people who know what they're doing. There's people who don't know what they're doing. So we need to secure our supply in the supply chain to make sure that we can get products to the dispensaries when they are ready to open at the end of the year.

What? Empire Hemp is not a dispensary? Nope. It is the top-tier guy who does all of those applications to be able to buy, process and then dispense products. The store carries CBD products, made by the extraction of oil from the cannabis plants. As for straight-up cannabis, that will get shipped to a certified dispensary for retail sale.

That extract was priced at $4,500 a kilo in September 2019, and dropped to $500 a kilo by November of that year, he said.

So our whole business model just went, and then the price just dropped because the supply became so huge because the whole country was doing it, he said.

COVID actually was a blessing for us. We would be out of business, because it got us through with those PPP loans to bridge that gap because that's when we said we're either gonna go out of business or we need to open a store, because we need cash, we need to get it; our online sales have dropped dramatically he said. We were doing really well. But because of the credit card processing getting canceled all of our ranking on Google dropped and we've never been able to recover.

They built the store at 204 EastMain St., Batavia, on a shoestring budget, and said its been well received so far. There are at least 50 different types of CBD oils, lotions,balms and scrubs that have garnered loyal customers with praise for the pain-relief properties, Wolankse said.

So anyone can sell these products? No.

We have a CBD retail license, and we have a manufacturing processing license so we can sell them. There's a lot of people that carry CBD products and they don't have a retail license. I don't even know if they know they need a retail license, Wolanske said.

Merchants that are selling cannabis products without the proper license are not registered with the state, and therefore most likely bypassing sales tax payments. The state will be cracking down on these entities to ensure that only law-abiding and tax-paying businesses are operating, he said.

What type of licensing do you have?

"Okay, so the first one we got was a retail license for CBD, but that one is for the adult-use cannabis. We got the adult-use cannabis processing and manufacturing license, and then there's the adult use cultivation license," he said. "So we are now a recreational marijuana cultivator as well as processor so we can grow, process, manufacture, and distribute, Van Dusen said.

Everyone, from the growers to the Empire Hemp facilities, must be inspected for proper documentation, cleanliness, packaging, and hygiene practices, he said. Empire Hemps wholesale license allows them to sell products to the dispensaries when they open up the legal ones, he said.

He is waiting for more than 800 dispensary applicants to be reviewed and chosen by the state for the first legal dispensary license. Once selected, those applicants will get a choice of a few locations to set up shop. They wont be able to dictate where their dispensary will be, he said.

For example, an applicant in Erie County may have a choice of being in Batavia or Brockport, but not necessarily in his/her hometown location. The upside is that the designated site will be a turnkey operation, ready to open for business, Van Dusen said.

Working the steps

The state took steps to first license growers, then the processors and manufacturers, and now the final point of retail sale dispensaries. He, his wife and his silent partner cannot turn their store into a dispensary, since they are the processor, manufacturer and distributor. But they can have someone else come in and, as a legally chosen dispensary, sell cannabis products in the future, he said.

But what about all of these small shops selling cannabis, usually under the guise of selling a sticker or T-shirt that includes up to 1/8 of an ounce of marijuana?

Theyre not legal, Van Dusen said. They havent jumped through the hoops of applications, certifications and inspections of the product and sales site. Furthermore, the state has not even selected and announced the legal ones yet.

His frustration is not just sour grapes that others are opening more quickly and with less expense, he said, but also about taking the proper steps to sell a safe, quality product as Empire Hemp has done these last three years.

And consistent products, you know you're getting the same product each time, you're getting a safe product, he said. And the growers, before we even get their cannabis, they've got to go through a line of testing. You want to make sure that their cannabis is secure. We cant even receive it unless it has passed.

It's like when I see that it's really upsetting because we've played by the rules, we do everything we're supposed to do to be complicit and compliant with the law, and then these guys just come in and open up the stores like they're gonna make tons of money, Van Dusen said. I think it's had an impact on our retail store.

So people are trying to do it the right way, they're trying to follow what New York State has laid out. And then you have this whole other group of people that are just doing like this wild, wild west, and they're just doing whatever they want to I mean, the milligrams in some of these products. I'm surprised these people aren't in the hospital, he said.

State cannabis law requires that individual packages contain a maximum amount of product, such as 100 milligrams per package. Some stores are selling 500-milligram packages since theyre not inspected, he said.

These are messing people up, like people don't know what they're getting into, he said.

Another issue is the packaging, he said. There are packages out there that are clear, which allows UV rays in that can alter the product, versus Empire Hemps opaque packaging with nitrogen injected inside to keep the product fresh for more than a year, he said.

As for smoke shops on the nearby Reservation, those business owners dont have to legally abide by the same protocols as other New York State owners have to, similar to the sale of tobacco and gasoline products.

Van Dusen said that selling cannabis is not much different than alcohol. Both are legal in the state, however, you cant just go and open up a shop to sell alcohol. Same with cannabis. And he wants the public to be aware of illegal operations. He visited a shop in Batavia and bought a package of cannabis quite easily, he said. However, he doesn't know where the product was grown and how it was processed, packaged and distributed. It did only contain 1/8 of an ounce.

The products that you buy at these illicit smoke shops that are selling what they think is legal cannabis, are not, he said. Legal dispensaries will be opening by the end of the year, and keep your eye out for Empire Hemp products.

Queen Mary chemical engineers have developed technologies to slash energy consumption in industry – QMUL

In two papers published in the journalsNatureandScience, Queen Mary's Professor Livingston and Dr Zhiwei Jiang present their work on nanomembranes exquisitely thin membranes that can provide an energy efficient alternative to current industry practices.

They demonstrate their technology can be used to refine crude oil and cannabidiol (CBD) oil two industry giants. Around 80 million barrels of crude oil are processed every day to create fuel and plastic, in a process which consumes massive amounts of energy. The cannabidiol oil industry is fast growing - the Global Cannabidiol (CBD) Market is estimated to reach USD 47.22 Billion by 2028, up from USD 4.9 Billion in 2021.

Andrew Livingston, Professor of Chemical Engineering at Queen Mary, said: 'A vast amount of energy is consumed in industry separating molecules. The aim of our research is to provide low energy alternatives to these processes. Due to the innovations in the chemistry we used to make these membranes, we can achieve molecular architectures that achieve exquisite separations, and provide less resource intensive techniques for the separation of molecules.'

Dr Zhiwei Jiang, Research Associate at Queen Mary,said: 'Thinner is better - the liquid passes through the membranes much more quickly, rapidly speeding up the process, and therefore reducing the plant footprint while processing same quantity of liquids.

Hydrophobic polyamide nanofilms for refining crude oil into fuel and plastic

Hydrocarbons extracted from crude oil are the main ingredients for manufacturing fossil fuels, plastics, and polymers. The process by which they are extracted is extremely energy intensive.

Most refineries process crude oil using atmospheric and vacuum distillation, in which crude oil is heated to separate compounds according to their boiling points. Typical refineries process 100,000-250,000 barrels/day there are some processing over 1 million. The maximum temperature for the distillation varies based on the quality of the crude, but the distillation temperatures can exceed 500 C. This process consumes1100 terawatt-hours per year nearly 1% of global energy use.

Membrane technology that can separate the molecules in crude oil by their different sizes and classes could be a far more energy efficient process, consuming 90% less energy than distillation columns. Exceptionally thin nanomembranes have proved successful for extracting fresh water from sea water by rejecting the salt while allowing the water to permeate through reverse osmosis (RO) process. The researchers sought to separate hydrocarbons from crude oil by a parallel method.

This requires nanomembranes to be hydrophobic (water repellent), which can provide high affinity and rapid pathways for processing hydrocarbons. However, conventional nanomembranes used for RO are hydrophilic (having affinity for water) in nature and exhibit limited permeance of hydrocarbon liquids, remaining too low for industrial crude separation.

Professor Livingston's team used multiblock oligomer amines to create hydrophobic polyamide nanofilms that provide100 times faster permeance than that of hydrophilic nanofilms. By reducing the membrane thickness to approximately 10 nanometers, they achieved permeance one order of magnitude higher than the current state-of-the-art hydrophobic membranes, with a comparable selectivity in fractionation of real crude oil. As a result, the membranes developed by the team could markedly reduce the energy consumption of processing crude oil. The analysis of the fractionation was performed by ExxonMobil in a laboratory in the United States.

Polymer nanomembranes for enriching cannabidiol (CBD) oil

Conventional chemical and pharmaceutical industries use 45-55% of their total energy consumption during production in molecular separations. In a paper in Nature, Professor Livingston's team, including researchers at Northwestern University in Evanston (USA), and Bielefeld University (D), present polymer nanomembranes with aligned supramolecular macrocycles. These exhibit superb and extremely selective filtration properties that exceed the conventional polymer nanomembranes currently used across the chemical and pharmaceutical industries. Conventional polymer nanomembanes have broad distribution of the pore size that lacks a controllable way to be precisely tuned.

In this new breed of polymer nanomembranes, the molecularly predefined macrocycles are aligned to provide sub-nanometer pores as a highly effective filtration gateway that separates molecules with a size difference as low as 0.2 nm. The researchers show that the arrangement, orientation and alignment of these small cavities could be realized by selectively functionalized macrocycle molecules.

As a functional proof of concept, these nanomembranes are applied to high-value pharmaceutical separations for enriching cannabidiol (CBD) oil, exhibiting higher ethanol permeance and molecular selectivity than commercial state-of-the-art membranes. This novel concept offers feasible strategies to orientate porous materials into nanopores in membranes that can provide accurate, fast and energy-efficient molecular separations.

I Tried Compressed Cannabis ‘Pucks’ and They’re Strange, But Really Good – High Times

I remember buying weed from my friends boyfriend one muggy day the summer after I graduated high school. After whispering an ashamed hello to his wheelchair-ridden grandfather in the living room and avoiding the tiny, yapping pomeranians nipping at my ankles, he shuffled me up the stairs. His loft, if you could call it that, consisted of no more than an old couch in front of a massive television with an XBOX and some crooked Grateful Dead posters pinned to the scuffed walls. The smell of half-smoked joints and Nag Champa hung thick in the air.

You can sit if you want, he mumbled with a crooked smile through his dreads. Before I could get comfortable on the stained cushions he handed me a clear hose.

Breathe in. Its just weed, he reassured me. As I inhaled, he held up the other end of the hose to a small, wooden, electric pencil-sharpener looking device. I noticed the taste first.

It tastes just like weed smells, I remember thinking in awe as I mentally compared it to the rips from my dirty bong I had grown to love. Floating, I handed him a twenty, took my sandwich bag eighth of mids and left.

While dry herb vaporization remains my favorite consumption method to this day, I rarely partake, purely out of convenience and portability. A Massachusetts cannabis startup is attempting to change that narrative with the introduction of HUUE.

Man arrested on suspicion of 20 burglaries in Hastings – SussexWorld

Police said they are investigating a recent spate of break-ins at commercial properties in the town and last Friday (September 30), arrested a suspect in connection with all offences.

He was also arrested on suspicion of theft from a shop, and for breach of bail conditions in relation to an earlier offence. Police said he was charged with the theft and appeared before Brighton Magistrates Court on Saturday (October 1).

The court released him on bail with strict conditions. He was released under investigation in relation to the 20 burglary offences.

Police said they are continuing to investigate each of the burglaries and added that they are working hard to gather evidence, including forensic tests, to present to the court.

One of the businesses targeted was The Hempist, now trading as A Taste of Vitality, on Marine Parade. Police said a considerable amount of stock was taken from the premises during the break-in and officers are asking people to keep an eye out for any products possibly being offered for sale.

Police said stolen items include cannabidiol (CBD) toothpaste, CBD face cream, CBD hand cream, CBD bath bombs, incense sticks and wooden holders, CBD body butter, Tea Tree and Hemp body wash, Hempseed body lotion, Hemp massage oil and shampoo. Large quantities of CBD oil and CBD vape liquids in various flavours were also taken.

Anyone who has any information that could assist the ongoing police investigation is asked to report online or call 101.

These days, many of us could certainly go for a miracle cure-all, especially those of us who struggle with chronic pain, overwhelming anxiety, cancer-related symptoms and/or hard-to-treat neurological disorders. So, its no wonder that CBD oil is popping up in our search results. But can we really count on CBD oil to positively impact our symptoms in the ways we hope? Internal medicine specialist Paul Terpeluk, DO, explains why CBD oil may not be as effective as wed like.

CBD, or cannabidiol, is just one of more than 100 chemical compounds found in the cannabis sativa plant. But its THC (tetrahydrocannabinol), not CBD, thats the main psychoactive compound in cannabis that gives you a euphoric high.

CBD is pulled from hemp, a type of cannabis plant that contains very low levels of THC, so it doesnt get you high. CBD oil is simply a product that contains CBD extract and an oil, like coconut oil, typically for topical use.

Its important to know that since the implementation of the 2018 Farm Bill, the production and sale of CBD products in the U.S. has been legalized on the federal level as long as they contain less than .3% of THC. However, its still illegal under some state laws.

Plus, Dr. Terpeluk explains the market has been oversaturated with CBD products from bath bombs to gummies, lotions, creams, tinctures and oil none of which are Food and Drug Administration (FDA) approved and may not be 100% pure CBD. As of mid-December 2021, the FDA has only approved one cannabis-derived and three cannabis-related products, all of which you can safely get with a prescription from a licensed healthcare provider.

Theres no oversight of the majority of CBD products from a regulatory authority, says Dr. Terpeluk. Most of the CBD that youre buying, unless they have a rigorous marketing campaign and quality control that says its 100% CBD oil, more than likely, its contaminated with other cannabinoids, including THC.

Several studies show the benefits of pure CBD may have wide-ranging positive effects, though. To understand those benefits, its important to consider our bodys endocannabinoid system, a complex system of enzymes, neurotransmitters and receptors that plays an important role in the development of our central nervous system. This system helps regulate a variety of functions, including pain, motor control, memory, appetite, inflammation and more. By further studying CBDs effects in these specific areas, we may better understand how CBD impacts a variety of conditions and disorders.

The FDA has approved Epidiolex as a treatment for several seizure disorders, including two rare disorders known as Duvet syndrome and Lennox-Gastaut syndrome. Several case studies suggest CBD may also be beneficial to patients who are resistant to anti-epileptic drugs. With epilepsy, theres a threshold in your brain that gets excitatory, and you go into a seizure, says Dr. Terpeluk. CBD increases that threshold.

Other studies suggest CBD may also be useful in managing symptoms of multiple sclerosis, Parkinsons disease and Alzheimers disease, as it has neuroprotective, anti-inflammatory properties. More studies are needed, however, as many suggest that its not just CBD alone, but a combination of CBD and other cannabinoids, that may help reduce many of these symptoms.

By interacting with neurotransmitters in your central nervous system, CBD could potentially relieve pain related to inflammation, arthritis and nerve damage (peripheral neuropathy). In one four-week trial, people who had nerve damage in the lower half of their body reported a significant reduction of intense, sharp pain after using a topical CBD oil.

All of our different anti-pain drugs affect some section of our pain system, whether its Tylenol, Aspirin, morphine or opioids, explains Dr. Terpeluk. No one wants to be addicted to opioids, so if theres a cannabinoid you can take thats not addictive but can repress the pain, that would be the Holy Grail with chronic pain.

Still, he cautions, theres a lot left to be studied, including whether there are significant adverse long-term effects of CBD when used for pain relief.

If youre taking it in an unregulated fashion, you dont know how much is in there, and youre not quite sure how it affects you outside of your particular pain, says Dr. Terpeluk.

Anxiety and mood disorders like depression or post-traumatic stress disorder can have a severe effect on your daily life and may often cause both physical and emotional stress that could lead to other underlying conditions like sleep disorders, high blood pressure, chronic pain and heart disease. Its too early to understand the full gamut of effects that CBD may have on anxiety and mood disorders, but individual studies seem to suggest varying positive results. In one study of 57 men who received either oral CBD or a placebo 90 minutes before participating in a simulated public speaking test, researchers learned that a 300-mg dose of CBD significantly reduced social anxiety during the test.

And while there are a wide variety of treatments available for anxiety and mood disorders ranging from talk therapy and counseling to prescribed medications Dr. Terpeluk suggests the most important thing is to get at the root of the underlying causes of the anxiety youre experiencing.

Anxiety is better approached by looking at whats causing it in your life rather than trying to figure out which drugs can reduce it, says Dr. Terpeluk.

CBD may help with nausea, vomiting and weight loss caused by chemotherapy treatments. The FDA has approved three cannabis-related products to help alleviate these symptoms, as well as help increase the appetite for those who have AIDS. These drugs all contain some level of THC or synthetic THC and are not purely CBD alone.

But some studies seem to suggest that CBD can help decrease the size of tumors and help stop the spread of cancerous cells in skin cancer, breast cancer, prostate cancer and more. As with other areas of study, further human clinical trials are needed to understand the full effect CBD has on various kinds of cancer.

If youre purchasing CBD oil and other products online or from a local vendor, Dr. Terpeluk says theres no real way of knowing the purity of the CBD youre using, as it could be mixed with other cannabinoids, such as the dangerous delta-8, or THC.

Its a little bit mysterious. Its not as harmless as you think, says Dr. Terpeluk. If you take CBD oil because you buy it on the market, you have a very high likelihood that you could turn a drug test positive for THC because it could actually contain THC.

CBD can also affect a variety of medications, including pain medications, antidepressants, antipsychotics and more. It could also cause several side effects that may include:

The best advice? Before considering CBD oil or other CBD products, make sure you talk to your healthcare provider to decide whether its safe for you and to ensure it doesnt have harmful interactions with any medications youre currently taking.

CBD Food and Drinks are Becoming Popular, But the FDA isn’t Biting – Healthline

More food manufacturers are cashing in on the publics interest in cannabidiol, or CBD, and adding this compound to beverages and food products, including meals sold at high-end and fast-food restaurants.

Although several states have passed laws to legalize CBD, products containing this compound are technically illegal at the federal level. This includes CBD dietary supplements, as well as CBD-infused sodas, sparkling water, and cold brew coffee.

In spite of this conflict between federal law and the patchwork of state laws, the U.S. market for cannabis beverages in 2022 was an estimated $752 million, accounting for over 70% of the global market, reports Yahoo Finance.

The growth of this market is driven in part by the legalization of cannabis and CBD in certain states, but also by strong consumer interest in these products.

But dont expect to see cannabis-infused beverages or food products to show up just yet in Walmart, Target and other big box stores, say some experts. These stores may wait for federal clarity on CBD foods and beverages before entering the market.

CBD is a chemical compound naturally found in cannabis and hemp plants, which are both versions of the plant species Cannabis sativa.

The main difference between the two is that hemp typically contains lower levels of THC, the main intoxicating psychoactive compound found in cannabis. While CBD is also a psychoactive compound, it wont produce the same high.

At the federal level, cannabis is considered a Schedule 1 substance, so it is illegal as are the flower of the cannabis plant and any compounds derived from the cannabis plant, including THC and CBD.

However, the 2018 Farm Bill legalized at the federal level the production and sale of hemp plants and compounds extracted from it. Under this law, hemp plants cant contain more than 0.3% THC by dry weight; otherwise they would be considered illegal.

Likewise, CBD extracted from hemp is considered legal at the federal level if it contains 0.3% or less THC. States may have different restrictions on CBD. For example, in Idaho CBD cant contain more than 0.1% THC.

Complicating matters, in 2018 the Food and Drug Administration approved Epidiolex, a pharmaceutical grade CBD oral solution for the treatment of seizures related to two rare forms of epilepsy.

Under federal regulatory law, once a substance is used as the active ingredient in an approved drug or has undergone substantial clinical investigations as a medication foods and dietary supplements containing this substance cant be introduced into interstate commerce.

This makes sense because you would not want your food to be laced with medication, for several obvious reasons, said Dr. Harrison Weed, a professor of internal medicine at The Ohio State University College of Medicine in Columbus, Ohio.

So the FDAs approval of Epidiolex effectively made all foods and dietary supplements containing CBD illegal at the federal level.

THC is illegal at the federal level for the same reason it is the active ingredient in the FDA-approved drugs Marinol and Syndros.

There are exceptions to this aspect of the Federal Food, Drug, and Cosmetic Act, such as if a substance was marketed in food before the drug containing it was approved or underwent clinical investigations.

However, the FDA has determined that neither CBD nor THC qualifies under this exception, said Weed.

As a result, he said the FDA can use its authority to regulate foods and dietary supplements that contain CBD or THC. The agency has already sent warning letters to several companies for selling food products containing CBD.

While both CBD food products and dietary supplements are illegal according to federal regulatory law, the FDA appears to be taking a more hardline position against foods and beverages containing this compound compared to the supplements.

Jamie Corroon, ND, MPH, the founder and medical director of the Center for Medical Cannabis Education in Del Mar, California, said this is understandable because there is a higher standard for safety when it comes to food additives compared to dietary supplement ingredients.

Given this higher threshold, if the FDA is unsure that CBD is safe as a dietary ingredient, it means they are also unsure it is safe as a food additive, he said.

The FDA recently warned Congress that legalizing CBD foods would put the publics health at risk, reports Forbes.

Among its concerns are potential risks of liver injury, drug interactions and negative effects on male fertility from use of CBD products.

The FDA said on its website that it is actively working to learn more about the safety of CBD and CBD products. But Weed said right now we dont know enough to draw strong conclusions about the safety of CBD and THC.

Given this gap in our knowledge, it seems to me that the duty to restrict sales, or regulate content and labeling, falls upon the individual states that have chosen to legalize cannabis products despite the federal ban, he said.

Corroon pointed out that the risks that come from ingesting CBD foods or dietary supplements depend on the dose of CBD and how quickly it is consumed.

Its possible that the milligram amount of CBD in a single gummy would be greater than the milligram amount of CBD in a large bag of CBD-infused popcorn, he said. In that case, the exposure could be lower in the food product, unless a consumer ate the entire bag [of popcorn] in one sitting.

Risks will also be different for specific populations.

For example, there are potential drug interactions between CBD and anti-epileptic medications, said Corroon. However, the dose of CBD required [for a drug interaction] far exceeds what would reasonably be included in a food product.

Others are concerned that the legal grey area that CBD exists has allowed unscrupulous companies are using the lack of oversight to put dangerous products on the market.

Without regulation, it is up to companies to ensure that the CBD used in their food is free of contaminants, mold, solvents, pesticides and heavy metals.

Some companies use independent laboratories to ensure that the CBD in their products is high quality; these companies may share the certificate of analysis on their website.

This month U.S. Representatives H. Morgan Griffith (R-Virginia) and Brett Guthrie (R-Kentucky) sent a letter to FDA Commissioner Dr. Robert Califf advocating for the agency to protect public health by changing its approach to CBD products.

Rather than denying new products from coming to market, the FDA must take action and establish a clear set of standards for companies to adhere by, especially since these products are already being sold in states across the nation, they wrote.

There must be a uniform and established standard that responsible actors can follow that will allow for safe CBD and CBD-derived products to come to market, they added.
