OPINION: School Boards and Local Elections Are Ground Zero for Our Values – southseattleemerald.com

Local elections dont just matter: They are a matter of life and death for far too many in our communities.

About a month ago, I learned that my hometown of Newberg, Oregon, became the center of attention for all the wrong reasons. The local school board voted to ban symbols such as Pride flags and signs declaring that Black Lives Matter, calling them political statements and therefore inappropriate for school. What they really did was politicize humanity and, in the name of neutrality, help the oppressor.

As someone who also had to navigate predominantly white spaces as a student of color, my heart went out to students who, in that vote, witnessed representatives of the community invalidate their entire existence as a mere political statement that didnt belong in a classroom setting.

The fact that Newberg is my hometown galvanized me to take action. And I am now working with people in Newberg to hold school board members accountable for this, by supporting recall efforts for Brian Shannon, and making the Newberg School District more welcoming and equitable. And while the story of Newberg is deeply personal to me, it is also far from unique. These incidents are happening in schools all around the nation and in our own backyard.

In Bellevue, candidate Faye Yang peddled dangerous misinformation straight from the eugenics campaigns of the early 20th century including claims that certain races have lower IQs. In Kent, there is a school board candidate amplifying the dog whistles of QAnon candidates an action harmful in and of itself as Kent is one of the most diverse cities in the entire nation. Constituents of Kristiana de Leon, councilmember for Black Diamond, Washington, have told her horror stories. She and I work together at my consulting firm.

In Enumclaw, a lone school board director resigned after less than a year into her appointment during fall of 2020. While her official statement claimed she resigned because this last year, particularly the last 6 months, has been incredibly difficult for all of [my family] and ultimately I need to do what is best for [them], the full story is that this director was harassed at work, including in her neighborhood, namely for wearing a mask and defending the school districts practice of acknowledging Indigenous land and peoples, an agreement reached in partnership with the Muckleshoot people.

This director brought her husband to school board meetings because parents followed her to her car, verbally abusing her. De Leon recalls attending one of these meetings, saying The vitriol during the board meeting was overwhelming. The amount of anger directed at masking, which rolled directly into tension over the acknowledgement of Indigenous communities, was palpable.

PTA volunteers and teachers in the Tahoma School District, including community members of color, have also been doxxed, harassed, and threatened over everything from masking to using pronouns to attending trainings on equitable teaching practices. The teacher union president also received threatening and abusive voicemails over a comment she made about her choice to discontinue patronizing a local establishment as a result of the owners political actions.

From conversations with constituents, educators, and neighbors, it was clear that this was a coordinated attack from the QAnon school board candidate. Much of this organizing happened on the private Facebook page, of which Kyle Meyers is an admin, said de Leon who went on to explain that much of this reaction is traced back to controversy of critical race theory (CRT) in schools. She added that she had seen screenshots from coordinated online efforts to get rid of any educator seen to support CRT. Its absolutely shameful that instead of putting forth policies, these people are running on a platform of terrorizing PTA parents and educators.

There are countless more stories throughout King County alone, to say nothing of the national narrative that echoes similar themes. A recent Salon article described how the GOP and the QAnon movement as a whole are regrouping to make school board narratives the new battleground. If this feels coordinated, its because it is; it is the newest chapter in the playbooks of the Heritage Foundation, ALEC, and beyond. Indeed, while the Koch brothers claim to disavow anti-CRT movements on paper, their long-standing history of antagonism against desegregation and basic safety measures such as masks in public schools, as well as ongoing contributions to conservative organizations, suggest otherwise. This is the monster that was decades in the making.

This toxicity is nothing short of an ongoing insurrection to terrorize people particularly Communities of Color who are working to increase equity and inclusion whether in schools or local elections. While some mobs build gallows and draw guns, others chase down teachers and threaten school board directors lives. Rather than taking responsibility to regroup their members, the Republican Party openly embraces this violent hostility while hoping that burned-out liberals and moderates will shrug off the dog whistles blowing louder and more fervently.

So, what can we do?

We can take what happened to King County Councilmember Kathy Lambert as an example of how we can organize to tell both ourselves and our elected officials that this is where we draw the line. Lambert signed off on her campaigns blatantly racist, sexist, and anti-Semitic mailer that sought to demonize her opponent by villifying King Countys only Black councilmember, Girmay Zahilay, as well as two additional People of Color and Bernie Sanders, who is Jewish.

The literature lit a fire under voters, elected officials, and activists alike, and the maelstrom of outrage was channeled into one central focus of demanding Lambert to apologize, and when that didnt happen, asking those supporting her to decide if they stood by her actions and words. While I was part of that effort to hold Lambert accountable resulting in her losing not only campaign endorsements but committee assignments the final say on accountability rests with voters.

Do not sit out this election. Vote like your lives depend on it, because they do. Defy the projections that voter turnout is predicted to be abysmally low. The future of healthy democratic institutions depends on us defying those odds and defying the rising tides of violent extremism that seek to silence us.

Opinion | The Problem With the Supreme Courts Shadow Docket – The New York Times

But when a justice issues an opinion in connection with a dispute that the court has expressly declined to decide, the justice is acting outside this narrow constitutional mandate and using his or her position to influence social issues in just the way the framers thought should be left to the people and their elected representatives to resolve.

When the court declined in 2019 to accept an appeal of an Indiana law prohibiting abortions motivated by the sex, race or disability status of the fetus, Justice Thomas attached a long opinion indirectly arguing in favor of such laws by linking abortion to early-20th-century eugenics practices. Later that year, Justice Brett Kavanaugh strongly signaled that with his appointment to the court, there were a majority of conservative justices receptive to overturning old rulings giving Congress wide latitude to delegate lawmaking powers to administrative agencies. Far from acting as the dispassionate umpire of legal disputes the framers envisioned, Justice Kavanaugh was basically suggesting that new lawsuits seeking profound changes to our current system of government would be favorably received.

The issuance of cert-denial opinions also creates impartiality problems for justices obligated to resolve cases in as neutral, unbiased and fair-minded a manner as possible. To enable them to do this, the Constitution gives justices a strong position of independence from political pressures. Moreover, a federal statute reinforces this constitutional norm by requiring any justice or other federal judge to disqualify himself in any proceeding in which his impartiality might reasonably be questioned.

And it has become routine for nominees to the court, in their Senate confirmation hearings, to refuse to answer questions about controversial legal issues like abortion and gun rights on the grounds that they might be prejudging an issue that could come before the court.

In cert-denial opinions, however, justices frequently prejudge legal questions in ways that create serious impartiality problems in cases the court later accepts for review. A stark example of this is the challenge to New Yorks requirement that people demonstrate a special self-defense need for carrying concealed firearms in public that the court is hearing on Wednesday. In a cert-denial opinion issued by Justice Thomas last year, when the court denied review of a ruling upholding a New Jersey concealed-carry requirement similar to New Yorks, he made a lengthy historical argument concluding that the Second Amendment protects some form of public carrying of firearms.

Perhaps not surprisingly, this is the argument now being made by the gun rights plaintiffs in the New York case. Just as troubling, in a portion of Justice Thomass opinion that Justice Kavanaugh joined, they criticized the main lower court ruling upholding New Yorks concealed-carry requirement. How can anyone seriously contend that the impartiality of these justices cannot reasonably be questioned in the New York case?

Some might argue that justices also create future impartiality problems when they issue unnecessary separate opinions or make gratuitous comments in cases the court actually does decide. These practices are not ideal and have been criticized, but in these situations at least the justices are issuing them in connection with deciding cases or controversies as authorized by the Constitution.

The Purdue bankruptcy plan was approved. Where is the money? – STAT

Nearly two months ago, a U.S. bankruptcy court judge approved a controversial Purdue Pharma plan that would funnel billions of dollars to pay for the harm caused by the OxyContin opioid painkiller.

At the core, the deal calls for some members of the Sackler family which controlled Purdue to contribute more than $4.3 billion over nearly a decade to compensate individuals, state and local governments, and tribal communities for the cost of the opioid crisis. The deal was in response to some 3,000 lawsuits that prompted the company to seek bankruptcy in 2019. But even though the plan was approved, the money hasnt started flowing and it remains unclear when that will happen.

The developer of one of the biggest homes ever built in the U.S. featuring a moat and 30-car garage filed for bankruptcy to keep lenders from foreclosing on the Los Angeles property.

Dubbed The One, the mansion was being developed by Crestlloyd LLC when a fight broke out with lenders, including Hankey Capital. The lenders went to court in Los Angeles claiming they werent being paid, according to court papers. Eventually, a receiver was appointed to handle the project.

Crestlloyd believes that the receiver has hampered efforts to complete the property, as well as to market, show, and sell the property in its current state, the company said in bankruptcy court papers.

Ted Lanes, the court-appointed receiver, declined to comment Wednesday.

Im disappointed, Don Hankey, whose specialty is subprime auto financing, said about the bankruptcy filing. All we want is to get our capital returned.

Hankey, who loaned more than $82.5 million for the project, had a foreclosure sale of the property set for Wednesday.

In addition to a 74,000-square-foot main house, the compound has a guest house and staff quarters totaling another 8,150 square feet, city records show.

An aerial photo shows construction under way at the 104,000-square-foot compound, on a 4-acre lot thats about 2 1/3 football fields long. Developer Nile Niami broke ground in 2014 and is expected to complete construction in late 2017. He says he is asking $500 million for the compound when its finished. Although some West Los Angeles brokers are skeptical, they say its still possible its sale price will surpass the world record of $301 million.

Property developers sometimes use bankruptcy as a way to block lenders from foreclosing. Under Chapter 11 rules, lawsuits, including state foreclosure actions, are halted to give a company the chance to reorganize and clear its debts.

The One is worth about $325 million, but only has $176 million worth of secured loans attached to the property, Crestlloyd claimed in court papers. Even if the property sells for half its original $500 million price, theres still plenty of value to pay all the debts, Crestlloyd said.

Lanes planned to list the home for $225 million. The 105,000-square-foot (9,750-square-meter) main house almost twice the size of the White House features four swimming pools, a two-story waterfall, a nightclub, movie theater, four-lane bowling alley, beauty salon, spa, gym and cigar lounge.

The case is Crestlloyd LLC, 21-bk-18205, U.S. Bankruptcy Court, Central District of California (Los Angeles).

[COLUMN] Bankruptcy can be the first step to financial recovery – Asian Journal News

I remember the story of a poor, old beggar who died one day- and to everyones surprise, a money belt found wrapped around his waist contained thousands of dollars in cash. Apparently, he had found the money belt while digging through trash, decided to keep it but never really opened it. Thus, he lived the rest of his days without even knowing what he had. Had he known about what was available to him to alleviate some of his suffering, life could have been a little better.

The story of this poor, old beggar comes to my mind when I see how many people continue to suffer needlessly in debt when the law provides a remedy for them to change their financial situation for the better. By saying this, I realize that some people may accuse me of being biased in favor of bankruptcy because I make my living as a bankruptcy attorney. I urge you, however, to keep an open mind at least for a moment as you read this article. What I hope to accomplish here is to make you understand that the purpose of our laws is to help and not hurt people. So, stay with me here for a few minutes.

The legislative intent of Congress in passing our bankruptcy laws is to allow a fresh start to those honest individuals who have found it impossible to cope with debt problems. Because life is not perfect, Congress realized that a person who needs to recover financially after experiencing serious debt problems should at least be given a chance to do so. This concept of a fresh start is the foundation of our bankruptcy laws and has become an integral part of our economic system and our society.

Because money affects almost all areas of our lives, money problems can have an extremely devastating effect on the family, our most fundamental social structure. It is probably fair to say that it is the families of this country that ultimately benefit from the protection afforded by our bankruptcy laws. Can you imagine how many families suffering in debt could possibly be out in the streets right now if it werent for the fresh start that our bankruptcy laws provide? For parents with dependent children, the challenges presented by insurmountable debt problems are even bigger because ultimately, the childrens welfare may be at risk.

So, bear in mind if you are considering bankruptcy as a possible solution to your debt problems that the purpose of our bankruptcy laws is to make financial recovery attainable as soon as possible to those who need it. Of course, this does not mean that filing bankruptcy is always the solution to every financial problem. Your bankruptcy lawyer must carefully review your situation, weigh the pros and cons, and make appropriate recommendations. When filing, there must be a clear objective and the chances of success for the type of bankruptcy being filed must be assessed. Is it your objective to eliminate debts you can no longer afford to pay, or do you simply need to consolidate your debts to make them more manageable? Are important legal rights or your assets at stake? What can be done to protect them and at what expense? These are some of the questions that must be answered.

Why:

In an effort to expand art engagement with students, the Tweed Museum of Art is inviting students to join Jonathan Thunder in the creation of a new mural.

Thunder says the mural title, My Grandma and Your Grandma, is inspired by hip-hop culture in the 1980s and 90s.

Lyricists reflected quite a bit of what I was seeing in my own community because of cultural dynamics in the United States, says Thunder. In current times, I have seen a harmony between the voices of the Indigenous community and the Black community by way of seeking and establishing self-empowerment.

The mural imagery would combine images from the early days of hip-hop with contemporary Ojibwe culture. My maternal Grandmother wore a large, beaded medallion when I was a young boy. I remember seeing it when I see the large, beaded medallions worn today, mostly by men.

UMD students met with Thunder on October 21 to plan the mural, which will be created out of six canvases.

Organizers say students are welcome to jump into the process during the painting, which may be extended into next week if needed.

He is known for his surrealistic paintings, as well as digitally animated films and installations in which he addresses subject matter of personal experience, Indigenous perspective, environmental welfare, and humorous social commentary. Jonathan is an enrolled member of the Red Lake Band of Ojibwe, and makes his home and studio in Duluth, Minnesota.

Representational imagery stemming from my Ojibwe heritage is often a part of my subject matter. They help me to create allegories that reflect things that are important to me as a member of the Anishinaabe urban community.

Female-led local wellness company aims to empower women through events, workshops and retreats – OSU – The Lantern

The Beauty Boost has expanded beyond its Columbus roots to 17 different cities, with women across the country looking to make a difference in each others lives.

The Beauty Boost is an online platform dedicated to womens health and wellness Rachel Kerr, the companys founder, said. Kerr founded the company in 2015 in search of something more personally fulfilling than a desk job. She said The Beauty Boost works with venues in Columbus and in cities such as Austin, Cincinnati and Louisville to offer events for women in each city.

Our mission is to help women feel empowered, healthy and beautiful through the different events and experiences that we put on, Kerr said.

Kerr said each of its four types of events weekend retreats, fitness events, empowerment workshops and social events serve a different purpose.

Weekend retreats include daily workouts and activities such as hiking and paddleboarding, and fitness events offer workout classes through different venues. Empowerment workshops help women feel more connected to their passion and purpose and social events provide an opportunity to get out of the house through activities such as book clubs and clothing swaps, Kerr said.

It doesnt matter which event people come to in these categories, Kerr said. They still are going to be around the same type of people that we attract kind, self-developing, with shared goals and values.

Kate Watson, a brand ambassador for The Beauty Boost and five-year member, said being a part of the community has changed her life.

The Beauty Boost inspires women who are looking for something more in their life, Watson said. Whether it be more friendship, more health, more self-improvement, more happiness just more.

The Beauty Boost will be hosting a Taste of Fitness Sampler at Strongwater Food & Spirits Nov. 14 at 9:30 a.m. The event will consist of four back-to-back workouts from various fitness studios, a health and wellness experience station, and local businesses and vendors such as Jane + Willow boutique and Oliver & Winn Candle Co.

Its a way to bring the fitness world together, not compete, Kerr said. [Its] to give people a tasting of various styles of workouts, to try new studios and to shop locally and spotlight the small businesses that are in our community.

Watson said she is glad to have gotten involved with The Beauty Boost, as it offers a community based on friendship and support, as well as an environment for personal growth, which are both valuable to her.

I like to constantly try and strive for improvement in my life, and I have definitely gotten that since being a part of The Beauty Boost, Watson said. I can say that my whole life has changed because of it. Its had a very heavy impact, in the best way.

As COP26 focuses global attention on the climate crisis, Vanessa Kirby, the actress and Bazaar cover star, has revealed her own personal commitment to the environment. Speaking at the launch of the Womens Pavilion at Expo 2020 Dubai, a collaboration with Cartier that celebrates the contribution of women to society, she moderated a discussion between artists and sustainability activists.

Prior to the talk, she spoke to Bazaars editor-in-chief Lydia Slater about her new role as ambassador for the charity Amazon Frontlines, and her commitment to bringing womens untold stories into the spotlight.

"This is the first Expo in 50 years to have a Womens Pavilion, which is madness when you think about it, and its theme is When women thrive, humanity thrives. And if one man walks in there and changes his mindset, then thats awesome. I really think its not about tearing men down, its about women realising we are more powerful than we have ever been taught - particularly because theres so much to do everywhere around the world.

"I found the exhibition in the Pavilion very moving. It felt like a coming together of what I really believe in, like putting real female experiences on screen after so many decades of cinema being from the male point of view.

"I feel an incredible personal responsibility to do that with my own production company Aluna Entertainment. Its linked to us waking up as women and who we are in our own right, as well as to the environment. It sounds crazy but playing a mother giving birth in Pieces of a Woman really brought home to me the power of women as life-givers and creators. And thats essentially what the earth does its why its called Mother Earth. I think its all linked to female empowerment."

"How artists and activists are coming together dynamically to try and protect the planet. We all have to find a way to cooperate and make a difference. Everyone on the panel has found their own way to do that, from Nemonte Nenquimo, the leader of the Waorani tribe and founder of Amazon Frontlines, to the actress and film-maker Melanie Laurent, and Salma Abdulai, who went away to university and then came back to her community with this particular cereal called fonio, an ancient grain thats climate-resistant, but that nobody was using any more. Im just a tag-along Im humbled by how much I have to learn but I want to change and I am really open to what they want to teach me."

These people have lived there for thousands of years, they have far more wisdom about the planet than we do, and they probably have all the answers. That knowledge mustnt be extinguished. Im really honoured that Cartier is championing such voices, because the more they are heard, the more they can reach people."
