The limits of free speech (when you have 50 million YouTube subscribers) – Polygon

Posted: February 20, 2017 at 7:03 pm

There is an increasing amount of noise surrounding freedom of speech, fake news, and everyones right to be heard. This has particular bearing on the gaming community, where the term freedom of speech is often used incorrectly.

On the other hand, online personalities are often playing a role in game marketing, and issues with GamerGate and other hate groups latching onto gaming means that games, studios and publishers are confronted with the task of moderating community and forum posts and interactions while being told they are censoring others. Hence, depriving someone of their right to free speech.

As an entertainment attorney with over seven years of experience in a practice dedicated exclusively to gaming culture and industry, this has been an ongoing cause for concern. Its an issue my clients face daily.

Legally, theres no argument to be had. Let me explain why.

Felix Kjellberg, aka PewDiePie, blamed the press immediately after apologizing for his bad judgement, which brings up some interesting legal points about his situation.

He seemed to be operating under the assumption that the Wall Street Journal and mainstream media intentionally destroyed his business relationships. However, based on his own explanation, its more than likely he broke his contract under any number of contract theories, as well examine below.

This was my first notice of PewDiePie, so Im not bringing any baggage into this debate. I dont like him or dislike him. I just know hes being widely discussed, and Im familiar with the legal aspects of these situations.

His departure from Google and Disney seems like a no-brainer to anyone with a basic understanding of entertainment contracts. His first mistake likely came from his presumption that either Google or Disney have a sense of humor, or value him for his comedic chops.

Companies typically wont support you when doing so will harm their brand or otherwise expose them to liability

The contracts he signed with Google (through YouTube) and Disney (through Maker Studios) should have made it apparent that they do not. Any tolerance on their part would be based on financial interest, not out of any respect for his freedom of expression or his budding career as a rookie comedian. That is not the business they are in, as evidenced by how quickly they dropped him when his humor became a liability.

Companies typically wont support you when doing so will harm their brand or otherwise expose them to liability. Thats why YouTube has a code of conduct, and why most contracts for endorsement include rather robust non-disparagement/no disparaging effect clauses. Disney includes this in its terms of use:

You may not submit or upload User Generated Content that is defamatory, harassing, threatening, bigoted, hateful, violent, vulgar, obscene, pornographic, or otherwise offensive or that harms or can reasonably be expected to harm any person or entity, whether or not such material is protected by law.

Or, if youd like a more direct example from one of my own agreements:

Influencer may not: [.] engage in conduct or a pattern of behavior that may: (i) diminish Influencers reputation as a personality in the gaming community; or (ii) as a result of [Companys] association with Influencer, harm [Companys] reputation.

Typically a non-disparagement clause wont act alone to limit influencer conduct in an agreement. Some agreements will include strong moral clauses, broad warranties and representations, and at will termination as additional means of controlling the influencer or providing backers a buffer if the Influencers conduct creates a problem.

For example, a moral provision may prohibit an influencer from engaging in behavior in his or her private life that may amount to a scandal, while almost any reps and warranties provision will include a proviso prohibiting content that is defamatory or otherwise subject to legal action. The goal is to make sure, if you get into a scandal, you can be cast off quickly and with little legal repercussion.

In the interest of fairness, it is possible that the relevance of such provisions werent made clear to Kjellberg. In an effort to court lucrative talent, backers may treat such verbiage as boilerplate until and unless something triggers it. Ive heard they said we dont need to worry about that part, from more than a few clients.

This doesnt absolve responsibility on the part of the talent. You should read and treat as enforceable anything you want to sign. If youre not sure, consult an attorney and save yourself trouble down the road. However, its generally common sense that companies like Google and Disney are in this for two main reasons: it helps their bottom line, and its good for brand building.

When an influencer under contract does something that harms that brand, that influencer is materially breaching their contract. That means termination.

Its possible that the relationship can still be repaired. However, he broke the rule any competent attorney would advise in a matter concerning an open dispute: the less you say, the better. An eight minute diatribe placing blame on third parties and treating your business partners as complicit in the conspiracy against you probably isnt going to help smooth this out.

Thus my surprise when Kjellberg admitted that his content was offensive and he crossed the line, that he exhibited poor judgment and that his amateurish attempt at comedy was a failure. He effectively admitted to breaching his contracts with Disney and Google, and then immediately sought to blame the press.

The context for his joke, and whether mainstream media took it out of context, never really had anything to do with it. Its reasonable for companies like Disney and Google to consider mainstream media as the litmus test for what is considered offensive; their respective brands cater to a far broader demographic than PewDiePies followers, after all.

Welcome to the wonderful world of entertainment, Felix. Youve joined an elite club of performers, comedians and artists who crossed the line. No one is entitled to a platform, and your platform is a privilege that you will lose if you breach the terms under which that platform operates. In all likelihood you broke your contract. You even explained how you broke that contract in a video. Its irrational to conclude that a third party is responsible for the failure of your contract.

More alarming is the response by supporters, or rather, the response against detractors. The idea that companies or institutions are infringing on someones freedom of speech is commonly expressed, often in very strong language. When Twitter banned Milo Yiannopolous, we heard the same refrain. Kjellberg himself has already confirmed that a subset of his fan base consists of white supremacists. As many of us have witnessed, that particular subset is known to be more vocal about a perceived injustice than your average netizen.

Let me go ahead and get this out of the way:

A private individuals right to tell you to shut up, and a companys right to censor your offensive content, are both protected by the first amendment.

If a client of mine terminates a players subscription because they violated a games code of conduct by spamming a chat channel with anti-Semitic rhetoric, they are well within their contractual rights to terminate that subscription. Your participation on a platform like Twitter, YouTube or one of the excellent games offered by my clients, however, is not. That is strictly governed by the Terms of Service or EULA you agree to when you sign up.

If you are an Influencer, your continued support from your backers is contingent on your compliance with whatever non-disparagement language youve agreed to. Almost every platform available to you is offered by a private entity. Surprise! Welcome to Capitalism!

The first amendment isnt prohibitive against society at large; it protects society from government action. This typically shouldnt be a point of confusion, as the text itself is clear and unequivocal:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

The context of free speech, in roughly every territory where free speech exists, is uniformly a limitation on government power to suppress that right. Your personal feelings about censorship notwithstanding (or mine, for that matter), your only recourse against censorship on a platform provided by a private company is to not use that platform. There is no legal recourse. In fact, if there were, that really would violate the First Amendment. Clearly no one wants that.

When someone decries censorship and claims free speech, they generally are not talking about the right to say what they want. They are talking about the right to say what they want wherever they want to share it, and that is a distinction that crosses the line between fundamental human right and moral rationalization.

No one is morally obligated to listen to another persons opinion. No one should feel morally obligated to offer a platform for someones message when they consider that message offensive. Freedom of speech does not place one persons rights above another persons right, simply because the other provides the platform. That rationale subverts the fundamental right to freedom of speech generally.

We like to see the Internet as an open platform for the free exchange of ideas. Many of the companies who make the Internet possible, and they are each and every one private corporations, do their best to make that a reality.

But as we begin to recognize the risks associated with that free exchange, companies must take measures to safeguard the privacy and happiness of their consumers. This necessarily means censoring the content shared online. We are comfortable with censorship intended to protect us (e.g., prohibitions against sharing your personally identifiable information, passwords, etc. online), but we are less comfortable with censorship designed to protect others (e.g., codes of conduct).

The bottom line is that when you engage in free speech online, you typically do so as a consumer of the platform you are using. Normally you wont have the opportunity to negotiate the contracts you are bound to (whether it be a ToS or EULA) when you use those services.

Even the most successful influencers, Kjellberg included, are bound by provisions that limit their behavior. Ironically, they are often subject to greater restrictions because of their influence on the brand. The reality is that your right to free speech may directly conflict with the agreement youve entered, and engaging in some kinds of speech will almost certainly cost you a contract.

Malta protesters oppose draft bill that could limit freedom of speech – JURIST

Posted: at 7:02 pm

[JURIST] A draft bill [text, PDF, in Maltese] proposed by the Maltese government [official website] that aims to regulate online news could inhibit freedom of speech, argued protesters Sunday. At the protest, which was organized by the opposition party, opposition leader Simon Busuttil said [EU Observer report] that the bill would be "the beginning of the end of freedom of expression on the internet." The bill would update Malta's defamation and libel laws requiring citizens to provide their name, age, home address and valid government identification to the nearest Maltese government authority before expressing political views online. In an editorial [Independent op-ed], a Maltese newspaper expressed concern about the number of people the bill would impact and commented that "many people out there will be forced to think twice before commenting on current affairs of any sort."

Malta currently holds the rotating six-month presidency of the EU until mid-2017 and will hold elections next year. Reporters without Borders [advocacy website] ranked Malta forty-sixth on its 2016 World Press Freedom Index [ranking]. The country also received a 96 percent score in the Freedom House [advocacy website] ranking and the press freedom status label "free."

Stanford Wages War On Alumnus Peter Brimelow And Free Speech – VDARE.com

Posted: at 7:02 pm

It should come as no surprise that Stanford has followed the University at California, Berkeley (UCB), in suppressing free speech, and insulting a distinguished alumnus as well. Just as VDARE.coms conference was cancelled at Tenaya Lodge in Yosemite, (illegally, by the way as Tenaya Lodge is a Federal contractor and on Federal property) so did Stanford University, who once thought they were superior to UCB in academics and sports. But Stanford has been reduced to the also ran to UCBs virulent Cultural Marxism.

Stanford though thinks too much of itself. It is nothing but the obedient servant of radicals like Jesse Jackson who shut down Western Civilization studies at Stanford in 1996 and the puerile student body who recently voted not to bring back Western Civilization.

And this just inVDARE.com Editor Peter Brimelows alma mater, Stanfords Graduate School Of Business, just cancelled a debate between Brimelow and Tim Kane of the Hoover Institution to be held by the Stanford chapter of the Adam Smith Society, citing the destruction of Berkeley as the reason theyve been scared off. [VDARE.com Conference Cancellation Update: Two Rays Of Hope!, Lydia Brimelow, VDare, February 6, 2017]

This is an example of the hecklers veto, or more accurately the terrorists veto of freedom of speech. But just as the Terrorist Veto of the speech at UCB by Milo Yiannopoulos was not so much a Terrorist Veto, but a conspiracy between the terrorists and the UCB administration and the lesbian university police chief to use the threat of violence or violence that was allowed by inaction to occur to squash Milos speech, so the administrators at Stanford did the same.

But just as the UCB Police allowed the violence in Berkeley to happen, and had the resources to quash to violence quickly and effectively, so the Stanford Department of Public Safety(DPS), a private police department, an accredited and authorized law enforcement authority deputized as Santa Clara County Deputy Sheriffs, but could have easily quashed any violence or provided the necessary security, especially given the Departments bragging about their skill and abilities for presidential visits and major events at the 50,0000 capacity Stanford Stadium.

Braggart Chief Laura Wilson, Stanford DPS Suspiciously Like Another Chief of Police

So, if Stanford GSB Dean Jonathan Levin [Email him ] told the student group that Stanford could not provide security, he was lying. I know this because I worked with the Stanford DPS before, and they can get the job done. (And bring a world of hurt on rioters if necessary.) And Stanford could easily forestall any riots or violence by letting students know before hand that such activity would violate the Honor Code and result in expulsion.

‘Evilution:’ The Secret Luciferian, Spiritual Origin To One of The Biggest Hoaxes in History Evolution – The Christian Truther

Posted: at 7:02 pm

Science and evolution, evilution, are continually carried as fact and theory in regards to how things got started around here. But in reality, its where those facts and theories got started that explains why Christian creationism should be the dominant teaching.

Since the beginning of time, a war has raged, and while the details have remained similar, the methodology has changed. The Bible dictates this war in perfect detail, and clearly states that God has won. It also clearly states that we as Christians are to be opposed to the ways of the world. The Bible, written over the course of creation and history, has dictated the events of today with such incredible accuracy, that it could not have been authored by man alone.

The purpose of this post is to further arm the Christian in dealing with the ways of this world.

Evolutionary theory is largely derived from Charles Darwin and Alfred Russel Wallaces theories of evolution explained in detail in Darwins On the Origin of Species (1859) book. Although, Jean-Baptiste Lamarck (1 August 1744 18 December 1829) was the first to develop a coherent evolutionary theory. However, evolutionary thought can be traced back to the ancient Greeks, Romans, and Chinese as well as medieval Islamic science.

A significant portion of evolution was derived from Charles Darwin and his book Origin of Species. Darwin, himself was an agnostic influenced by spiritualists. However, the co-author of the book, Alfred Russel Wallace, was not agnostic at all; in fact, he was a was a devotee of spiritualism that included pantheism, paganism, occult ideas, and practices. Wallaces beliefs directly coincide with the New Age Movement, and within the New Age ideology lies an alarming coalition between spiritualism and science. Even further, there is an alarming correlation between Hindu occultism, the New Age movement, and evolution.

Within Darwin and Wallaces theory of evolution or natural selection is the belief in a tree of life or a universal tree of life. Although Darwin propagated the theory, it was also discovered in Jean-Baptiste Lamarcks writings as well, Lamarck produced the first branching tree of animals. The tree of life is often prescribed to New Age Philosophy, and can be traced back to the mysticism of the Kabbalah, as well as can be discovered in Hindu teachings, ancient Iranian teachings, and even in ancient Egyptian teachings.

There is significant evidence that evolution is based on occult mysticism rather than science, which can be further understood by William W. Wassynger, M.D., who authored a report for the New York Times on Nov. 27, 1989; in regards to the California Curriculum battle, William claimed

The process of general evolution could theoretically be reproduced through experimentation, but it never has been. Though speciation has been demonstrated in laboratories, no event beyond speciation has ever been demonstrated. Charles Darwin clearly delineated the differences between speciation and general evolution, and noted that the support for general evolution would have to come from the fossil record.

In The Origin of Species, Darwin noted that without the appropriate fossil evidence (which did not exist in his day) his general theory would hold no weight. He and others tenaciously clung to the hope that the unfolding of the fossil record would show all of the intermediate forms necessary to support his claims. Today, however, with more than 100,000 species represented in fossils, the lack of intermediate forms is even greater than it was in Darwins day.

Not only has the fossil record failed, but findings of modern scientists have made general evolutionary theory even less tenable. In Evolution: A Theory in Crisis, for example, Michael Denton methodically analyzes a wealth of evidence that challenges this theory. His subjects include the failure of homology (homologous structures not being represented by homologous genes nor embryonic development); the typological nature of microbiology, and problems associated with chance as a directive force, in addition to the lack of a supportive fossil record.

Contrary to popular belief, many people disagree with the theory of general evolution, and the idea that all opponents base their views on religious belief is groundless. Michael Denton is neither a creationist nor an evangelical Christian, and his book is one of several to challenge evolution in scientific terms. Moreover, having religious beliefs does not preclude the ability to reason scientifically. Many great scientists Isaac Newton, Carolus Linnaeus, Georges Cuvier and Louis Pasteur, to name a few -were devoutly religious.

Even in Darwins day, scientists who opposed evolution were charged with irrationality and religiosity. But they did not attack evolution on religious grounds; rather, they protested its lack of scientific proof and pointed to the evidence that supported a typological nature. The creationists were attacked as scientific heretics, while supporters of evolution refusing to admit the lack of evidence became the true heretics, replacing scientific foundations with metaphysics. See More

What William describes is that those who propagated evolution were in fact scientists fascinated with metaphysics rather than actual science. Interestingly enough, after one glance at who propagated evolution, it is no wonder it is so popular today. The infamous Huxley bloodline is in large part responsible for the distribution of evolution. The Huxley family was a large part of creating the league of nations, and who happened to also be eugenicists. Thomas Henry Huxley was the grandfather to Aldous Huxley, author of The Brave New World, Julian Huxley, evolutionist and first director of UNESCO, and Nobel laureate physiologist, Andrew Huxley.

Thomas Huxley was the first to apply the theory of natural selection to humanity to explain the course of human evolution. Before Darwin, even he was opposed to the earlier ideologies of evolution put forth by Lamarck and Robert Chambers, Huxley claimed that progressionist evolution was based in metaphysics rather than actual science. Although, Darwins bulldog, Huxley, altered his beliefs based on the book written by Darwin and Wallace, which is evident in the letter below;

I finished your book yesterday. . . Since I read Von Baers Essays nine years ago no work on Natural History Science I have met with has made so great an impression on me & I do most heartily thank you for the great store of new views you have given me. . . As for your doctrines, I am prepared to go to the Stake if requisite. . . I trust you will not allow yourself to be in any way disgusted or annoyed by the considerable abuse & misrepresentation which unless I greatly mistake is in store for you. . . And as to the curs which will bark and yelp you must recollect that some of your friends at any rate are endowed with an amount of combativeness which (though you have often & justly rebuked it) may stand you in good stead I am sharpening up my claws and beak in readiness Letter of T. H. Huxley to Charles Darwin, November 23, 1859, regarding the Origin of Species See More

Huxley again was one of the first adherents to Darwins theory of evolution by natural selection and did more than anyone else to advance its acceptance among scientists and the public alike. Thomass grandsons, Aldous and Julius, both saturated with the ideology of their grandfather on evolution, began their own studies which lead them to become proponent eugenists. Julius Huxley, however, was by far more influential than Aldous, being that he was the first director of UNESCO.

UNESCO, United Nations Educational, Scientific and Cultural Organization, is one of the largest organizations for education in the world, most of which was founded and directed by Eugenicists and Evolutionists. It is no wonder, that evolution is such a prominent theory today.

Darwins origin of species book also granted Karl Marx the enthusiasm he needed to create the Communist Manifesto. Karl Marx called the book; the book which contains the basis in natural history for our view. Meaning that Darwins ideology of evolution is the basis of Marxism and Communism. However, Karl Marx did not generate his ideology alone, in fact, Thomas Huxley greatly helped;

In 1862 Marx made a point of attending the public lectures on evolution given by Darwins supporter Thomas Huxley, and encouraged his political associates to join him. Wilhelm Liebknecht, a friend and comrade who often visited the Marx family in London, later recalled, when Darwin drew the conclusions from his research work and brought them to the knowledge of the public, we spoke of nothing else for months but Darwin and the enormous significance of his scientific discoveries. See More

It is incredibly evident that the theory of evolution was the basis for Marxism. In other words, Darwins theories have created the belief that humans are not a special species. Instead, it has created the belief that humans are merely animals, which gives rise to the idea that life is not sacred at all, but rather it is disposable. Below is video evidence of that narrative, and is a clip from the documentary film; Evolution vs. God.

Darwins theories on evolution and the origin of life, are mainly based on single cell ideology. According to the single cell theory, everything on earth, and, earth formed from a single cell some 3.5 to 4.1 Billion years ago. Interestingly enough the single cell ideology can also be traced to spiritualism and mystical occult teachings. In Hinduism, the second oldest religion, it is widely supported that everything formed from a golden womb or golden egg. Which has been poetically translated into the universal germ.

Hindu belief: literally the golden womb or golden egg, poetically translated as universal germ) is the source of the creation of universe or the manifested cosmos in Vedic philosophy, as well as an avatar of Vishnu in the Bhagavata Purana. [1] It finds mention in one hymn of the Rigveda (RV 10.121), known as the Hirayagarbha Skta, suggesting a single creator deity (verse 8: yo devev dhi dev eka st, Griffith: He is the God of gods, and none beside him.), identified in the hymn as Prajpati. The concept of the golden womb is again mentioned in the Vishvakarman Skta (RV 10.82). Wiki

The striking similarities between evolution and spiritualist ideologies, should raise stark questions about just why evolution came about, and who is exactly behind the push to prove evolution over creation from the Biblical narrative.

It can be easily summed up that proponents of the elitist occult societies of the world have pushed Darwins theories to the limelight and further fomented the ideology of evolution for one simple reason, control.

When humanity is not viewed in a sacred light, it becomes easier to mass murder individuals, Karl Marx proved that. When humanity is not viewed in a sacred light, humans become no more than animals, and it could easily be justified to enslave humanity. Understanding the motives behind evolution, and the modern metaphysical science, again brings into question the reality that yet again, the Bible spoke of these times, and they are called the End Times. In these days, according to scripture, science will increase. But wait, doesnt the Bible say knowledge, not science?

Science is derived from the word scientia, in Latin meaning knowledge; the Bible again describes that knowledge will increase in those days according to Daniel 12:4. Mans desire for knowledge is what began all of this, in the garden of Eden, according to Genesis 2:16-17 And the Lord God commanded the man, saying, Thou shalt eat freely of every tree of the garden, 17 But of the tree of knowledge of good and evil, thou shalt not eat of it: for in the day that thou eatest thereof, thou shalt die the death.

According to the Bible, deception comes from the serpent. According to Hinduism and the New Age Movement, knowledge is imparted to an individual after the awakening of the kundalini serpent spirit that lives at the base of the spine and expands to the top of the head. To learn more about the deception of Hinduism, how its woven into the New Age Movement, and how it is subverting the Church; see more here.

Narendra Modi to unveil 112-ft tall Shiva idol on February 24 – India … – India.com

Posted: at 7:01 pm

Chennai, Feb 18:Prime Minister Narendra Modi will unveil a 112-ft tall face of Lord Shiva or Adiyogi at Isha Foundation in Coimbatore on Mahashivaratri, which is on February 24. In a statement Isha Foundation said on Saturday that the face will be largest such on the planet, recognising the first yogis unparalleled contribution to humanity.

This iconic face symbolises liberation, representing the 112 ways in which one can attain the ultimate through the science of yoga, the statement said. According to the Foundation, on Mahasivaratri (February 24) Modi will light the sacred fire to commence the Maha Yoga Yagna across the world when one million people will take oath to teach a simple form of yoga to at least 100 persons in the coming year.

For the first time in the history of humanity, Adiyogi introduced the idea that the simple laws of nature are not permanent restrictions. If one is willing to strive, one can go beyond all limitations and attain liberation, moving humanity from assumed stagnation to conscious evolution, Isha Foundation founder Sadhguru Jaggi Vasudev said in the statement.

Describing the significance of Adiyogi, Vasudev said: It is essential that the coming generations on this planet are seekers, not believers. As philosophies, ideology, belief systems that dont stand the test of logic and the scientific verification will naturally collapse in coming decades, you will see the longing for liberation will rise. When that longing rises, Adiyogi and the science of Yoga will become very important.

Coimbatore: PM Modi to unveil 112-feet tall face of Adiyogi on Feb … – India.com

Posted: at 7:01 pm

Coimbatore (Tamil Nadu) [India], Feb.18 (ANI): Prime Minister Narendra Modi will on February 24 unveil a 112-feet tall face of Adiyogi, the source of yoga, designed and consecrated by Sadhguru, founder of Isha Foundation on Mahashivaratri at the Isha Yoga Center.

This will be the largest face on the planet, recognizing the first yogis unparalleled contribution to humanity. The iconic face symbolizes liberation, representing the 112 ways in which one can attain to ones ultimate through the science of yoga.

As a tribute to Adiyogi, the Prime Minister will light the sacred fire to commence the Maha Yoga Yagna across the world.

Around one million people will take an oath to teach a simple form of yoga to at least 100 people each in the coming year, and touch at least 100 million people before the next Mahashivaratri.

The Ministry of Tourism, Government of India has included the consecration of this glorious face in its official Incredible India campaign as a destination.

The unveiling of Adiyogi is part of the largest Mahashivaratri celebrations in the country which will be telecast live, simultaneously in seven languages to over five crore people through over 23 satellite television channels and several online platforms.

At 11o latitude in India, because of the tilt and precision in the spin axis of the earth, the centrifugal force is nearly vertical, and Isha Yoga Center by virtue of being on this latitude becomes an ideal place to be on the night of Mahashivaratri.

The festivities of Mahashivaratri begin at 6 p.m. and conclude at 6 a.m., the next morning. The nightlong celebrations include the powerful midnight meditation and discourse by Sadhguru, cultural performances by Kailash Kher, Rajasthan Roots with Kutle Khan, Sounds of Isha (Ishas home grown, anomalous group of musicians) and dance troop Nritarutya. Maha Annadanam or the offering of food will be made for all.

Describing the significance of Adiyogi, Sadhguru said, It is essential that the next generations of people on this planet are seekers, not believers. As philosophies, ideology, belief systems that dont stand the test of logic and the scientific verification will naturally collapse in coming decades, you will see the longing for liberation will rise. When that longing rises, Adiyogi and the science of Yoga will become very important.

In Tamil Nadu, Amavasya is considered the most important day in the month. We will leave the first offering to Adiyogi to the local people as a way of honoring the common people of the land, as an expression of their love and devotion. -Sadhguru

Preceding Mahashivaratri is the three day Yaksha festival, aimed at preserving and promoting Indias classical music & dance forms by the most accomplished artistes of India. This years artists include Violin duet by Dr. Mysore Manjunath and Dr. Mysore Nagaraj, Bharatnatayam performance by Padma Shri Smt. Meenakshi Chitharanjan and Odyssey dance performance by Smt. Bijayini Satpathy and Smt. Surupa Sen on 21st, 22nd and 23rd February respectively.

On the occasion of Mahashivaratri at Isha Yoga Center, all are invited to witness the unveiling of this glorious face of Adiyogi.

For the first time in the history of humanity, Adiyogi introduced the idea that the simple laws of nature are not permanent restrictions. If one is willing to strive, one can go beyond all limitations and attain to liberation, moving humanity from assumed stagnation to conscious evolution, Sadhguru added. (ANI)

Last man standing: McMaster for NSA? – Foreign Policy (blog)

Posted: at 6:56 pm

I think Army Lt. Gen. H.R. McMaster will be the next national security advisor. Like Vice Adm. Bob Harward, General David Petraeus reportedly has withdrawn over the issue of being able to bring in his own staff. And Lt. Gen. Keith Kellogg, the acting NSA, is probably too old for a job this demanding, especially in this administration.

That leaves just two. I dont know about Bolton. Id be surprised, though, if he fit the Trump template.

Picking McMaster is not a bad thing. Ive known him since he was major. Hes smart, energetic, and tough. He even looks like an armored branch version of Harward. (Thats him, working out with a punching bag in Iraq, in the foto. I took it in the citadel in downtown Tell Afar one sunny winter day about 10 years ago.) (Btw, Harward was scheduled to appear on ABCs This Week yesterday morning, but backed out an hour before airtime. )

As I said at the end of my Friday post, once Trump was turned down by Harward, it became more likely that he would turn to the active duty military for his 3rd pick for the job. McMaster is among the best of them out there. For his Ph.D. dissertation, he wrote one of the best books on the Vietnam War, Dereliction of Duty: Johnson, McNamara, the Joint Chiefs of Staff, and the Lies That Led to Vietnam.

He has good combat experience, he was a good trainer, and he led the 3rd Armored Cavalry Regiment well in his deployment to Iraq, most notably in pacifying Tell Afar, to the west of Mosul.

I wrote about his operations there in my book The Gamble. I am traveling so I dont have it with me, but I remember him telling his soldiers that understanding counterinsurgency really wasnt hard: Every time you disrespect an Iraqi, youre working for the enemy. They even had Customer Satisfaction Forms that detainees were asked to fill out upon release: Were you treated well? How was the food? What could we do better?

There are two big differences between him and Harward: First, he is on active duty. (Though the Army inexplicably couldnt find a four star job for him, and had told him to plan to retire later this year.) Second, his wife wont kill him if he takes the job, as Harwards wife might have.

That said, the basic problems remain. To do the job right, McMaster needs to bring in his own people. And it remains unclear if he can get that.

As for relations with the Pentagon: McMaster knows Mattis, but not well. (They both spoke at a conference at the University of North Carolina in April 2010.) But they are similar people and will respect each other.

I dont know how McMaster will work Trump. McMaster once wrote that the American war plans for Afghanistan and Iraq were at times . . . essentially narcissistic. (Good line, but I think it is more illuminating to say that they were minimalist plans for maximalist goals, which is of course a bad combination.) At any rate, McMaster may learn a lot more about narcissism in the coming months.

Over the weekend, I did an informal poll of people who have worked for McMaster, asking if they would be willing to follow him to the National Security Council staff. To a surprising degree, they replied, Yes, they would. Thats an indication of loyalty to and confidence in him.

For extra credit, here is a reading list from McMaster.

Meantime, over the weekend, an NSC staffer who had been hired by General Flynn was canned for criticizing the Trumps at a think tank meeting. I actually dont have a problem with this. Either you work for someone or you dont. If you cant be loyal, at least be discreet. I think we may be seeing more such departures throughout the Trump administration, people who are effectively resigning in public.

President Donald Trump has found his national security adviser and once again, its a general. On Monday, Trump named Lieutenant General H.R. McMaster as his replacement for former NSA Michael Flynn and called the 54-year-old a man of tremendous talent and tremendous experience.

Trump made the announcement while sitting on a golden couch at his Mar-a-Lago club in Palm Beach, Florida, where he also said that acting NSA Keith Kellogg, a retired lieutenant general, will serve under McMaster as chief of staff. Additionally, Trump said that former U.N. ambassador John Bolton, a candidate for the NSA job, will be asked to work with us in a somewhat different capacity.

A career Army officer, McMaster previously served as the director of the Army Capabilities Integration Center, described by USA Today as an internal think tank that looks at future threats and how to deal with them. In 2014, he was named to Time magazines 100 most influential list and called the architect of the future U.S. Army. In the magazine, retired Lieutenant General Dave Barno described McMaster as an iconoclast who repeatedly bucked the system and survived to join its senior ranks.

The West Point graduate also has a Ph.D. from the University of North Carolina at Chapel Hill. His dissertation was turned into the 1997 book Dereliction of Duty, which CNN said in 2006 is considered the seminal work on militarys responsibility during Vietnam to confront their civilian bosses when strategy was not working.

While McMasters academic bona fides may stand in contrast with Trumps the Times says hes seen as one of the Armys leading intellectuals he shares the presidents opinion that the U.S. military is too small. We are outranged and outgunned by many potential adversaries, he said at a 2016 hearing of the Air-Land subcommittee of the Senate Armed Services Committee. Our army in the future risks being too small to secure the nation.

McMaster, who has been described as a blunt-spoken bulldog, joins Defense Secretary James Mattis, whose nickname is Mad Dog, and Homeland Security head John Kelly, a no-nonsense pragmatist, as one-time generals who have signed up to work in the Trump administration.

Trump appoints Philly native, Valley Forge grad to lead NSA – Philly.com (blog)

President Trump on Monday named a Philadelphia native, Army Lt. Gen. H. R. McMaster, to serve as his National Security Adviser.

Herbert Raymond "H.R." McMaster, 54, was tapped after Trump's first NSA chief, Michael Flynn, was forced out last week and another candidate, retired Vice Adm. Robert Harward, turned down the position.

Known in military circles as an intellectual strategist, McMaster grew up in the city's Roxborough section and graduated in 1980 from Valley Forge Military Academy and College in Radnor Township. Four years later, he graduated from West Point.

During the 1991 Gulf War, McMaster was awarded the Silver Star for a battle in which his armored cavalry troop of nine tanks destroyed more than 80 tanks and other vehicles from an Iraqi mechanized brigade.

He later earned a doctorate from the University of North Carolina at Chapel Hill, writing a dissertation that turned into a widely-acclaimed book, Dereliction of Duty: Lyndon Johnson, Robert McNamara, the Joint Chiefs of Staff, and the Lies That Led to Vietnam, published in 1997.

A 2006 article in the New Yorker that focused on McMaster's service during the Iraq War said the book "assembled a damning case against senior military leaders for failing to speak their minds when, in the early years of the war, they disagreed with Pentagon policies. The Joint Chiefs of Staff, knowing Johnson and McNamara wanted uncritical support rather than honest advice, and eager to protect their careers, went along with official lies and a split-the-difference strategy of gradual escalation that none of them thought could work. Dereliction of Duty won McMaster wide praise, and its candor inspired an ardent following among post-Vietnam officers."

The same year, CNN called the book "the seminal work on military's responsibility during Vietnam to confront their civilian bosses when strategy was not working."

McMaster also wrote a 2003 monograph for the U.S. Army War College's Center for Strategic Leadership, titled "Crack in the Foundation: Defense Transformation and the Underlying Assumption of Dominant Knowledge in Future War."

The New Yorker piece noted that McMaster, "who describes himself as 'a bit of a Luddite,' argued against the notion that new weapons technology offered the promise of certainty and precision in warfare."

His military education at Valley Forge included several leadership roles and athletics.

"We are very proud of H. R. McMaster's distinguished career in the defense of our nation," saidCol. John C. Church Jr. USMR, president of Valley Forge Military Academy and College.

During his senior year, McMaster was class vice president and a Company Commander, or cadet leader. He was a member of theNational Honor Society and won theSuperintendent Award,Gold and Silver Stars, theschool's interscholastic debate medal, the American Legion Military Excellence medal, and theNational Guard medal, according to school officials.

McMaster was also the co-captain of the football team and played on the baseball team. He participated in intramural soccer, basketball, wrestling, rifle-shooting and swimming.

In Tom Clancy's 1994 book, "Armored Cav: A Guided Tour of an Armored Cavalry Regiment," the famed author interviewed McMaster about his life and career.

McMaster, born July 24, 1964 in Philadelphia, told Clancy that his father was an infantryman during the Korean War and his mother was a school teacher and administrator. He had a younger sister, Letitia, who graduated from Villanova University.

In 2011, he served as a deputy to Gen. David Petraeus in Afghanistan and led a special anti-corruption task force at ISAF (International Security Assistance Force) headquarters in Kabul.

Most recently, McMaster has served as director of the Army Capabilities Integration Center at Fort Eustis in Virginia.

In 2014, Time magazine included McMaster on its list of "The 100 Most Influential People." In a brief essay written for the magazine by Dave Barno, a retired lieutenant general, McMaster was called "the architect of the future U.S. Army."

Barno wrote that McMaster "might be the 21st century Army's pre-eminent warrior-thinker" and "also the rarest of soldiers one who has repeatedly bucked the system and survived to join its senior ranks."

"A system of law that not only makes certain conduct criminal, but also lays down rules for the conduct of the authorities, often becomes complex in its application to individual cases, and will from time to time produce imperfect results, especially if one's attention is confined to the particular case at bar. Some criminals do go free because of the necessity of keeping government and its servants in their place. That is one of the costs of having and enforcing a Bill of Rights. This country is built on the assumption that the cost is worth paying, and that in the long run we are all both freer and safer if the Constitution is strictly enforced." Williams v.
