Our Passage South from Tonga
There was a mass exodus from Big Mamas anchorage off Pangaimotu Island, Tongatapu on this partly cloudy Wednesday morning in November. Several of us had gathered at Big Mamas the previous evening for the last supper (whoops! we were an hour late as we hadnt changed our clocks to Tongan Summer time, didnt seem worth it for 2 days)
The consensus was unchanged Wednesday and Thursday were the best days to sail to Minerva Reef, 270 miles south. The winds would be out of the south-south-east but light, the swell under a metre, the skies partly cloudy, the moon waxing in the final quarter- ah perfect!
When we got up at 7am the first 3 boats had already left and we could see them slipping out of the pass to the east. A couple more left soon after, they exited via the north pass. When we left at 9.30am we had Randivag in front of us and Windance III behind us, we all went out the western pass. Funny how we all have different tactics to get to the same place! 3 more left in the afternoon, the mass exodus was underway.
Day One was somewhat more lively than expected, funny that, we really should know better by now. The winds were 15 18 knots in front of the beam so we sailed as close to the wind as we could without becoming a submarine, the waves crashed over the bow frequently ~ on a positive note the teak deck got a very thorough water blasting, but the clean stainless steel got thoroughly covered in salt yet again!
Day Two conditions were far more favourable, the wind eased to around 12 knots, much more comfortable and lovely sailing on the wind.
North Minerva Gets Invaded
Just after dawn on Day Three we were amongst the leaders in the procession of yachts arriving, not just the 12 we knew about but more floated in directly from Vavau and the Haapai, it was party time in this very remote paradise. The clouds parted, and daylight exposed this mid ocean masterpiece. North Minerva Reef is like a donut with a little piece nibbled out of the west side to allow entry into the inside ring. You can anchor almost anywhere in here but we all headed up to the Northern end for the best protection for the next few days.
Boats just kept arriving, we peaked at 26, one of the busiest anchorages we had been in for a while. The promised weather window to migrate south was still developing and no one wanted to miss out !! Meanwhile the weather was perfect here while we listened to the reports of gales buffeting northern New Zealand and temperatures of 10c in our homeland. No one was in a hurry to leave this last slice of the tropics!
The Water Has Got Cold!
We dinghied in company with Confidence and Gypsy Heart to the reef entry to snorkel the pass. Definitely something to do in company as you dont want to break down out here alone with the closest land 270 miles away! Jumping overboard took our breath away, the water temperature felt freezing initially but it wasnt so bad once we adjusted to it. We saw live colourful coral, thousands of Sergent-Majors, several white tipped sharks, a brown puffer fish (with a happy looking face on top if you look at the photo again) and several dinner sized fish down in the depths.
One afternoon there was a buzz of activity as we were overflown by the New Zealand Air Force Orion. VHF Channel 16 burst into (official) life as we were all asked to provide our boat names for them. They circled a couple of times, were very friendly and professional, wished us all a safe sail then flew off into the sun. It was reassuring to know we were being watched!
Pizza Delivery in Paradise
The days passed by, a couple of boats left but were replaced by late runners from Tonga. There were 7 boats with children onboard so there was a holiday atmosphere as endless activities were planned to keep them all amused. Michelle on Jade risked total chaos in her galley when she had 8 children making pizza dough one afternoon. Early the next evening Pizza on the Reef delivered piping hot pizzas to the yachts that had pre-ordered, unfortunately we had moved anchorage so missed out. All proceeds were donated to a Kiwi Sanctuary in Whangarei, well done to all the budding pizza chefs!
The snorkelling inside the reef edge was very good and walks on the reef were popular at low tide, especially on the eastern and southern reefs which dried completely. The reef was vast, about 400 metres deep and in places flat and even enough to run along or even ride a bike ~ no we didnt take our bikes ashore!
On the seaward side there were hundreds of indentations along the edge, full of hidey holes for dinner sized fish and lobsters. Those with spear guns would catch enough to feed everyone in a matter of minutes, and were happy to share them around. We had a very good diet of fresh fish and lobster during our stay.
We moved around the inside of the reef as the winds changed direction and ended up enjoying 3 anchorages, it was surprising how different the reef was at low tide in the various spots, great to have time to see it all. We even found the sand cay inside the southern curve, you had to be quick though, it only dried for about 2 hours each low tide.
Is It Really Time To Go?
The promised weather window of a big slow moving high continued to develop although shortened slightly by a mild low that was to follow.
The slower boats in the fleet started to eye up a departure a day before the rest of us so they could arrive into Opua in New Zealands Bay of Islands before the low, this meant however that they would leave Minerva and beat into a 20 knot souwester and 3 metre swell for the first day, the remnants of the big low we were waiting to pass ~ yuk. One boat left and soon after there was a steady trickle heading for the pass. Half the fleet did go and reported a bouncy first night and little gain of their distance to Opua. The rest of us enjoyed another peaceful and calm night in our remote Pacific paradise, the last night at anchor on our amazing voyage ~ what a spot to end it all.
All good things do have to come to an end, this was a major ending for us and 3 other kiwi boats though, we were all on the last leg of our circumnavigation of this huge planet.
Next morning we completed our final preparations for our passage home and lifted anchor at 7.30am. We were the second yacht to exit the pass out of North Minerva that morning, by 11.30am the last had left, peace returned to this outstanding tiny speck in the South Pacific.
There Is Nowhere Else To Stop We Are Going Home

Now I will describe the course of the Third World War. It will be a hell on earth. And yet in its greatest fury it will last only three and a half months. The Third World War will begin in Italy. There will be an appallingly bloody revolution there, which will start within the Vatican City itself. A Communist government will be set up, and the Communists will harass, torture and murder the clergy. Amidst this disorder, and surrounded by the corpses of his faithful Cardinals, Pope John Paul II will flee from the Holy See to France, and then to Poland. He will remain in Poland - at Czestochowa, and elsewhere - until after the end of the war. During much of this period he will in some sense be 'invisible' - perhaps in hiding? Altogether, Pope John Paul II will be in exile for three and a half years. During this time, the Communists will mock and lay waste to the Holy See. It will be a great punishment on the Church, to atone for the personal shortcomings of certain Popes in the past. It is possible that around this time there will be a surprise Soviet military invasion of southern Europe. What is certain is that the revolution will be deliberately introduced from Italy into France and Spain, and Communist governments established in those two countries. However, these regimes will survive for only between forty and forty-six days, and will quite quickly collapse. West Germany will feel desperately threatened by all these developments, but will also see an opportunity at hand to re-unite with East Germany, and to encircle the Red Army divisions stationed there. And so the southernmost division of the West German Army will suddenly move into Czechoslovakia. The invading troops will be welcomed by the local civilian population, and also by the Czech elements in the state army. However, the Slovak Military Units will try to oppose the German advance. From Czechoslovakia, the West German forces will drive deep into Poland, penetrating as far as Walbrzyeh. Walbrzych, Klodzko, Zloty Stok and all the countryside round about those places will be utterly laid waste in the ensuing fighting.
On the opposite flank - that is to say, to the north - German forces will invade Poland both from sea, and by airborne landings at Kolobrzeg. I have seen that Kolobrzeg will be utterly devastated (particularly the resort area of the town), the destruction being as severe as that which it suffered in the Second World War. There will be a great number of casualties, but finally the Germans will take Kolobrzeg, and will hold it for eight days. On the ninth day, however, the joint Polish-Russian Armies will surround and overwhelm the German positions at Kolobrzeg, and the survivors will be taken prisoner. After this, the conflict in the north will escalate in intensity, and the area of heavy fighting will spread out right along the Baltic Sea, in a belt fifty kilometres wide and extending from Klajpeda to Szczecin. Individual towns and villages will be attacked from the direction of the shore, where a NATO operational Headquarters will have been established. In some places, the Red Army will for a while be forced back, and as they withdraw, they will demolish entire cities (like Gdansk, and Elblag) behind them. In central Poland, meanwhile, there will have been no fighting at all. However, that isn't to say that there won't, in the near future, be any destruction there of any sort, since those central provinces (like everywhere else in the world) will be affected by the earthquakes, gales, thunderstorms, famine and other calamities which will rage across the globe. Once Kolobrzeg has been recaptured and secured, the Warsaw Pact forces will formally wage war on, and invade West Germany. In the first Russian counter-thrust, therefore, the German Division in the south of Poland will be driven back to Prague. There will be an enormous military build-up there; and fighting so fierce that the streets will be ankle-deep in the blood of both soldiers and civilians, and all the splendid buildings reduced to rubble. This dreadful catastrophe will befall the Czechs as a result of that nation's apostasy from Christ. Prague will never be rebuilt. In the next thrust, the Red Army will strike across West Germany, right up as far as the French border, and at the limit of their advance will be occupying three-quarters of German territory. They will be assisted in their attack by the Czechoslovakian army (although the actual Czech units, as I've said, will have joined the Germans.) This will be the end of the initial phase of the Third World War.
All kinds of patriotic Ukranian factions will have been formed round about this time, all having an independent Ukraine as their common goal. These Ukranian nationalist groups will try to drive off the Russian armies. But tilings will turn out even worse for them than they did for the Czechs, as the Russians will adopt a 'scorched earth' policy. Anything and everybody they come across will be set on fire, or otherwise destroyed. At this point the Ukranians, seeing themselves to be on the brink of extinction as a nation, will appeal for help to the new Polish ruler. This help will be granted them immediately, and the Polish army will march east at the greatest possible speed. Soon, the front line from Klajpeda down to the Mediterranean will have been made secure against the Russians. The armies of certain other countries will now come into the fray, on the Polish side. These nations will be, to the north, Sweden, Norway and Finland; and to the south, Hungary and Romania. (These last-named countries will both have experienced their own anti-Communist risings, at round about the same time as those in Poland.) France, too, will offer her economic and military help in the Polish cause; as also will a number of black African states. The Russian troops will disperse in the face of the combined allied might, and will scatter widely. Near Kostopol, on the river Horyn, they will re-group, but will be routed in the ferocious battle which will follow, and which will last three days and nights. There will be so many casualties on each side that the Horyn will flow red with blood. In the aftermath of this crushing defeat, all surviving Russian units will surrender. The Polish army will continue its advance until it reaches the river Dniepr - in former times, the eastern frontier of the Kingdom of Poland. The troops will halt there and rest, for a number of days.

That is so offensive! Don't you know that only the Northern Hemisphere has Winter in December! note (they also forgot that some religions DO celebrate the Winter Solstice as such, as well as forgetting that Christmas takes place a few days AFTER the Winter Solstice) "And in a gutless act of political correctness, 'Pizza Day' will now be known as 'Italian-American Sauced Bread Day.'" This title, taken from an infamous Catch Phrase of the Daily Mail, a British tabloid newspaper, can refer to one of two things. In some cases, this might be literally about political correctness taken too far, presented through a Granola Girl or Soapbox Sadie who embodies the negative aspects of the PC movement. It may also involve Moral Guardians attempting to Bowdlerize a work in order to remove anything, no matter how trivial, that might be considered "offensive". However, in other cases, the accusations of political correctness are baseless. Along the same lines, a governmental authority (often a local council or Media Watchdog) is accused of being over-zealous to the point of parody in trying to avoid offense to minority groups - not unlike the Culture Police but in the other direction. Certain words or phrases are said to have been "banned", as if, say, Chipping Sodbury Borough Council has any effective power over the English language or, indeed, anything. Often, the body in question are not only being overly cautious, they're actually oppressing the group that is the target of their actions, and are shocked should their targets explain that a patronizing, paternalistic attitude can be just as offensive as the perceived slight. On the other hand, since this is often a satire we're dealing with, it's just as likely that the mere hint of the word "offense" will indeed result in the offending work being Banned In Chipping Sodbury. Politically Correct History is a specific variant where Common Knowledge historical accounts are treated as Fanon to avoid Unfortunate Implications such as Values Dissonance or having to explain Aluminum Christmas Trees. I'm a board-certified anatomic and clinical pathologist and operator of the largest one-person medical information site on the web. As a pathologist, it's my job (among others) to examine tissue, tell what's the matter, and predict the behavior of the disease and response to therapy. Like most other pathologists, I'm extremely successful at this. Like most other pathologists, I take a lot of pride in this. (Call us arrogant if you like. I am an honest physician who engages in public debates. When I catch somebody deliberately deceiving the public, they never defend their cases on the facts, but almost always call me "arrogant" or "elitist" and claim I am secretly in the pay of the wicked pharmaceutical companies.) And if I screw up even once, I'm in MAJOR trouble.
Unlike many M.D.'s, I'm open-minded about what's known as "alternative medicine", i.e., therapies that are not recognized by mainstream medicine. During the 1980's, I reviewed alternative medicine and found there was little to recommend. As the alternative medical community has responded to pressure to defend its claims by the usual methods of science, some areas have improved.
This site aims to let the public know what empirical evidence is available for various alternative remedies, especially studies published in refereed journals. This will enable people who must make decisions to rely on more than anecdotes and advertising.
This site will always be under intensive construction. Only a fool pretends to know everything. I cannot buy or read a book, but I am interested in your personal experiences ("anecdotes"), and especially in real work by real scientists (i.e., people taking serious precautions against self-deception.) Unless you specify otherwise, I'll feel free to quote you.
I would be remiss without placing links to Quackwatch . The fact that I am less likely than some members to dismiss alternative claims out-of-hand probably reflects our differing life experience. Remember there are plenty of bad doctors in both "mainstream medicine" and "alternative medicine".
Here's the ranking system that this site will use:
The remedy has a plausable mechanism and has been given some basic tests, and/or has solidly passed two good, clear, controlled studies
The remedy makes sense pathophysiologically, and there is at least impressive anecdotal evidence
The anecdotal evidence seemed interesting to me, but that's all there was.
I can see why somebody might have thought of this. But if this actually works better than a placebo and a little human kindness, we are all going to have to make some major readjustments in how we think about health and disease. Don't spend too much money, or get your hopes up.
Bold indicates the remedy has passed a controlled, reasonable-sounding study for this use. Underlining means it failed. Claims that lack substantial testing are unmarked.
Here are some things that are NOT "alternative medicine".
People who believe their own claims will make every effort to do controlled studies. If their therapy works, it should pass some controlled study sooner or later. If positive results are obtained, some other scientist will always try to duplicate the work. If this succeeds, the claim is "reproduced", and you can present a truthful, honest claim to the public.People who don't believe their own claims will start complaining about "lack of funding", "the Heisenberg uncertainty principle", "placebos are valuable and ethical too", "politics in science", "social causation", "you create your own reality", "Thomas Kuhn", "closed-minded medical establishment", "persecuted geniuses", "we will NEVER treat individual whole-persons as statistics", etc., etc.
Another very popular claim by charlatans, who admit they have no placebo-controlled studies, is to observe that the vast majority of today's therapies have not been placebo-controlled. These people either don't understand or are lying about the central model of a modern medical study -- clinical equipoise. The control group isn't people receiving no treatment. It is people receiving the most popular standard treatment. To be ethical, there must also be a reason to think the treatment will be superior.
"The Beautiful Truth" / "Dying to have known": In Max Gerson's era, no child was ever cured of leukemia. To demand that in 2009 we randomize children with leukemia between the modern therapy that cures that vast majority, and a "treatment" group getting only a magic raw-liver-and-vegetable-based diet and coffee enemas, without even an animal model, would be a crime against humanity. Go ahead and call me an unspiritual corrupt brainwashed bigot if you want -- I've stopped answering my crank mail.
When lives are at stake, I don't think asking for a controlled study is asking too much. Do you?
If there are published, controlled studies, find out what they showed.
If the statistical effect is pronounced and reproducible, you can be confident we have something real. If it is not reproduced, there may have been some intentional or unintentional bias in the original lab.
CAUTION: As charlatans become more sophisticated, you occasionally find books that list refereed journal publications by the dozen. For example, somebody promoting oral superoxide dismutase to prevent aging will cite references to the substance's activities in the body, the harmful effects of free radicals, and so forth. This is the old salesman's technique of telling a bunch of truths, so you won't notice the lies... (1) Superoxide dismutase isn't going to make it from your stomach into your cells, but will be destroyed; (2) free radicals may contribute to degenerative disease, but they do not cause aging; (3) animals that produce huge amounts of superoxide dismutase age as fast as others. If you're in doubt, feel free to phone the authors of the papers that are cited in the dubious book... I've done so occasionally, and they have been VERY unhappy to learn that...
Possibility 2: Everybody knows it works. I'd like to illustrate this with an example. I like working out, and in the late 1980's, I obtained an EMS unit that I'd heard could accelerate my muscle growth. The anti-quackery literature listed this as fraudulent, but it made sense biologically, and I decided to do a pilot study, using the EMS unit only on the right side of my body. The end-point would be three people telling me (without my asking) that I was asymmetric. This took about a month. I decided to report my study in a letter to the JAMA, but first I went again to the refereed literature and I discovered an article that described EMS as generally known to be effective in accelerating muscle hypertrophy.
Possibility 3: Nobody stands to make a buck. Nowadays I really doubt it. The unpatentable alternative remedies that obviously work (melatonin, DHEA, creatine, St. John's wort, strontium for osteoporosis) are widely marketed, presumably for just a modest profit.
Any proposed mechanism of action can be wrong. For example, I was taught totally-wrong mechanisms of action for bismuth anti-ulcer remedies, dandruff shapoos, nitroglycerine for angina, and nitroprusside for hypertension. (I congratulate myself for having been skeptical as a student.) So if a proposed mechanism for an "alternative remedy" sounds wrong or even silly, don't dismiss the remedy out-of-hand.
Be skeptical about remedies that cannot work by any means presently known to science or religion. I'm open to the reality of the supernatural -- in fact, as a Christian, I'm committed to it (though not necessarily to the effectiveness of intercessory prayer or laying-on-of-hands.) Enough of this for now.
Acai Berries
The fruit of the acai palm tree, which like everything else contains some biologically active molecules, was presented as a multi-level marketing scheme in 2004. Claims included weight loss and "cleansing". The shady work of the marketers is now history, as is Oprah's successful lawsuit against them. A pilot study of acai for weight loss was a miserable and total failure (Nutr. J. 10: 45, 2011). At least the juice seems not to be toxic or carcinogenic (Toxicology 278: 46, 2010. There junk journal claims ("adding it to cigarets prevents emphysma in mice"), etc., etc.
Acupuncture
References to follow.
Many people who have experienced acupuncture treatment believe that it caused physiologic changes beyond just suggestion and relaxation. As acupuncture moves from folk medicine into real scientific therapeutics, physicians will insist on sorting out the placebo effect and the cultural overlay.
Acupuncture appears to have effects on neurally-mediated reflexes. Because the reflexes are so subtle, studies will remain empirical for a long time to come. Positive studies will need to be replicated, especially since the strong feelings that some people have in favor of acupuncture may introduce bias. This will probably happen soon, but to date, there are no findings of effectiveness (i.e., this particular acupuncture procedure works in this particular situation) that are robust after being replicated in several different series.
Serious studies of whether traditional acupuncture is actually more effective than placebo now use sham acupuncture as the control. In "sham" acupuncture, the operator deliberately needles the wrong points. This isn't double-blind, but it's a start. There are positive results (i.e., real acupuncture is significantly more effective than sham acupuncture) for nausea and vomiting after gynecologic surgery (weak), epicondylitis, anxiety in the emergency pre-hospital care setting, and even parental anxiety during anesthesia induction in a child. In one study of nausea and vomiting after tonsillectomy, the control group did better and the sham group did worse than those not treated at all.
In a few instances, acupuncture has proved superior to a standard medication. One example is an electrical technique for post-operative nausea and vomiting after cosmetic surgery. In another instance, stimulation of a particular needle-point proved as effective as a standard anti-emetic for post-operative nausea and vomiting in children. Another study obtained a similar result for children undergoing anesthesia in the dentist's office.
In the anesthetized patient, the placebo phenomenon is less likely to be operating. Electro-acupuncture is now widely used in Europe to reduce the need for anesthetic agents, and the effect was strongly significant in a US double-blind study.
There are also numerous negative studies, in which particular techniques applied to particular clinical problems showed no significant effect. This is in spite of the fact that acupuncture proponents might be reluctant to share a negative study. An electrical technique failed for low back pain. Another electrical technique failed to reduce the need for anesthetics. A major study showed no effect for asthma. Urologists were unable to obtain any benefits by needling the "kidney-ureter-bladder" meridian. "Minute sphere acupuncture" failed to help postoperative pain or morphine use. Despite an apparent effect in one study of cocaine addicts, acupuncture did not outperform relaxation or sham treatment for cocaine addiction in a second study. Unlike some other complementary therapies, acupuncture did not show an effect in a major study of chronic low back pain. Although two non-blinded studies of acupuncture for tinnitus suggested an effect, four blinded ones showed no significant effect.
Some large studies have actually not included a sham-acupuncture group when it would be easy to do so. These do help make it clear that acupuncture is relatively safe. Recent studies without a sham control but with positive results compared to no-acupuncture include one for low back pain in the elderly, another for nausea and vomiting during cyclophosphamide infusion for rheumatic disease, another for wheelchair-user's shoulder, another for childhood constipation, and another for labor pain. Two British studies found that a trip to the acupuncturist gave good results for chronic headache patients at relatively low cost to the health care system. The question was, "Is this worth the money?" rather than "Is this anything more than a placebo?" The authors characterized their own approach as "pragmatic". In turn, there are ethical questions involved in placebo treatment, even to make people feel good.
Some studies of electroacupuncture claiming to show a benefit (i.e., for low back pain, nausea and vomiting of pregnancy, nausea and vomiting of myeloablative chemotherapy) have used as controls a non-electrical apparatus, which is not really blinding.
Physiologists are starting to characterize the reflexes involved in needle insertion. One surprising finding, awaiting confirmation, is the induction of mirror-image electrical activity when a myofascial trigger point is stimulated. Controlled studies showing no clinical benefit (for example, post-stroke leg spasticity) still showed curious reflex effects from treatment. Animals have reflexes in response to acupuncture treatment that may be abolished by certain medications.
Despite the training they receive, several acupuncturists examining the same patient are likely to recommend widely different needle placements. This was demonstrated in a test using a low-back- pain patient, and perhaps this is no different from other physicians. Practice is likely to become more standardized as the scientific work continues. Acupuncturists will need to decide how much to retain of the cultural trappings and imaginative physiology. We can expect that most will regard the "theory" as something to be treasured as a bygone age's attempt to understand the riddles of the body. Instead, its practitioners will recognize that the effects are really mediated by subtle reflexes that are not fundamentally unlike the other processes by which the body maintains its health.
Acupuncture seems to be safe overall. One acupuncturist perforated the right ventricle of the heart causing hemopericardium, and there have been several instances of pneumothorax. I have been pleasantly surprised with how few other complications have been reported during the last few years. My friends in oriental medicine asked me to mention that it's now standard to use single-use, presterilized, disposable needles.
Artemisinin for cancer
The anti-malarial drug artemisinin and its relatives are being promoted by the alternative-medicine community for cancer in general. There is some interest in their possible anti-cancer properties, and a few decent papers, mostly focusing on which patterns of gene expression predict that the drug will kill cells in tissue culture (Pharmacogenetics Journal 6: 269, 2006). They're well-known to do this, because they are poisons, and the fact that they kill cancer cells (J. Med. Chem. 49: 2731, 2006, from the Hop) should come as no surprise. Especially, they may have activity as angiogenesis blockers.
The foremost proponent in the US seems to be Dr. Henry Lai, whose professional degree is in psychology and who teaches in the department of bioengineering at U. Wash. His focus on the effects of non-ionizing fields on humans seems to have led him into fringe medicine, and he has been writing papers about artemisinin as an anti-cancer agent since 1995. He notes that breast cancer cells reportedly (a few old papers in obscure journals) tend to have more surface transferrin (iron-binder) than their benign counterparts. So artemisinin (which generates toxic free radicals when exposed to iron) could induce apoptosis selectively in breast cancer. He managed to demonstrate this effect in a culture of breast cancer cells awash in iron-binder (Life Sciences 70: 49, 2001). Artemisinin alone was a dismal failure. At least he's honest. It sounds to me as if the breast cancer cells simply were more adherent for the iron-binder; the experiment does not support the claim that they have greatly increased transferrin surface levels. However, around this time, Dr. Lai speculated about how one could saturate the allegedly-increased transferrin molecules with enough iron, not mentioning that flooding the body with iron is itself dangerous. The iron-bearing pigment that accumulates in malaria is orders-of-magnitude richer in iron than one could possibly accumulate simply from having extra surface transferrin. (At least, both are ferric.)
Readers should know that there are no reports to date (despite ten years of interest, especially by Dr. Lai) of artemisinin inducing even a partial remission of any cancer in any animal system. The claim that there are 350 papers showing an effect on cancer is just another lie. The 88 that I found were mostly cell-culture studies without benign cells as controls. Conspiracy buffs who assume that the drug companies have shunned artemisinin since it's a naturally-occurring substance and therefore less profitable should note that taxol (a similar case) became part of mainstream breast cancer therapy as soon as it proved to work.
There just might be an effect. Dr. Lai actually got a chance to try it as a breast cancer preventative in mice in 2006 (Cancer Letters 231: 43, 2006). This was the only in vivo study I could find. He claimed an effect with p<0.1 (i.e., suggestive that the effect might be real). He ended his abstract "Since artemisinin is a relatively safe compound that causes no known side effects even at high oral doses, the present indicate that artemisinin may be a potent cancer-chemoprevention agent." Dr. Lai was somehow unaware that the year before the neurologists at UC-Frisco had reported a grisly case of toxic brainstem encephalopathy after artemisinin treatment for breast cancer in a lady who'd just had a cancer resected and thought it would be a good idea to add artemisinin (Ann. Neuro. 59(4): 725-6, 2006). Brainstem side-effects of artemisinin are in fact known clinically (NEJM 336: 1328, 1997). Thankfully, her illness subsided when her artemisinin was discontinued. Cause and effect? We can't prove it, but it's worrisome.
If you want to try artermisinin for cancer prevention or treatment, it's your decision.
UPDATE: 2011. The discussion continues. A correspondent who believes herself to have been cured of breast cancer entirely by artemisinin brought to my attention a very lively ongoing discussion as to whether the substance produces neurotoxicity (see Clin. Inf. Dis. 43: 1618, 2006.) This actually does not reference the index case. Dr. Lai continues to publish both on animals and cell culture and has findings that are interesting. There are still no reports of cancer regression in an animal system, but Cancer Letters 231: 43, 2006 (which is an elite journal) published the results of a model in which the treated animals got fewer / smaller tumors after treatment with a carcinogen (anti-cancer effect, altered carcinogen metabolism, or someting else?) I'm going to stand by my statement, "There just might be an effect", and wait with hope for the success of Dr.Lai, an investigator who is obviously a sincere and decent person.
Beta-mannan to reverse dysplasia of the cervix
Beta-mannans are presently being promoted by one individual as able to reverse most cases of dysplasia (pre-cancer) of the cervix. The principal promoter bases his claim on anecdotal evidence, but does claim 95% success.
Mannans are found in tomatoes and may have something to do with their empirical link to a lower rate of some cancers. They may prevent some of the mutations that accumulate to cause cancers. It's harder to see how they would reverse the mutations once they have happened. ("That'd be like reversing loss of virginity.") The promoter claims instead that beta-mannan stimulates the immune system, which is weak in Americans because of our alleged poor diet and smoking habits.
To his credit, the principal proponent has a side-note that urges women with frank cancer to get the required surgery.
People considering this "complementary remedy" need to know the facts.
Until I see a publication, I'll reserve final judgement. But I'm very much afraid this one won't work out.
The principal promoter of this complementary remedy is none other than the author of the old "Phantom Notes", which I found very helpful when I was on my surgery rotation. They were a superb resource; curiously, we had to send away for them and get them delived to us by mail. A few months later, a sheaf of "Bible Prophecy" stuff "that proved the truth of the Christian religion" was mailed to our PO boxes from "The Phantom". My Jewish friends especially did not appreciate this. "Bible Prophecy" still appears on the "beta mannan for cervical dysplasia" site. Again, you'll need to draw your own conclusions. In September 2003, a correspondent shared with me the court decision in a lawsuit against Dr. _______ for plagairism in connection with the Phantom notes. The judge had some very harsh things to say about him even back in the 1970's.
Anti-Malignin Antibody Test for Cancer
See my notes. This allegedly is an extremely sensitive and specific way of determining whether cancer is present in the body, and its proponents talk about its making pap smears, mammograms, and so forth obsolete. But after more than 20 years, only the original "discoverer" has described this substance as really existing. In a short (unrefereed) letter in "Lancet" announcing that his serum stains three different kinds of cancer cells, the discoverer failed to mention any control using any benign cells. (If the fundamental idea is correct, benign cells would be unstained.) I'm ready to draw the obvious conclusion. To the lab's credit, there is no talk of "conspiracies" or "cover-ups" or "persecution".
Botanicals for Diabetes
There is presently an online promotion of a "secret" natural remedy for both type I and type II diabetes. You'll have to find the site yourself, but the claims are obviously bogus.
A supposed scientific article is appended to the site. It is clear that this was not accepted for publication, even by a non-refereed junk journal. For starters, the composition of the remedy is not given. Second, the authors mention at least three previous studies but do not cite references. Third, there are no controls. There are also illiterate expressions. ("There is a remarkable phenotypic difference in Type 2 Diabetes. The connective importance of the genetic and environment causes of type 2 diabetes varies between people.") These people claim, in their ad, to make pancreatic islands regrow, but there are no tissue studies in the article. This is a sensational claim, and if there were any reason to think it were true, some scientific journal would have grabbed up the evidence. The shabby quality of the work is shown by the ad page, which states "The clinical study further concluded, '... treatment with _____ partially brought about a regenerative capability for the damaged endocrine tissues as evidenced by increased islet cell numbers and resulted in restoration of near normal architecture of pancreatic islet (sic.).'" Anyone who reads the fine print will see that this is simply untrue. The study cited shows nothing of the sort, but simply makes this statement about a second, unreferenced study. Even the name of the "independent lab" that supposedly did the tests is concealed from the reader.
If you want to send these people a few hundred dollars for their secret mix, that is your business.
Right now (2005), current articles in the genuine scientific literature on the use of "natural" remedies for diabetes are conspicuous by their absence. For a review of how herbalists design complementary therapy for diabetics, see Acta. Diab. 41: 91, 2004. "The ten most frequently suggested herbal remedies were gymnema, psyllium, funagreek, bilberry, garlic, Chinese ginseng, dandelion, burdock, prickly pear cactus, and bitter melon. The ten most frequently recommended dietary supplements were biotin, vanadium, chromium, vitamin B6, vitamin C, vitamin E, zinc, selenium, alpha-lipoic acid, and fructo-oligosaccharides." The reviewers felt some of these might help at least some. This is far from the grandiose claims made by the current promotion.
Bromelain / pineapple for goiter and so forth
Bromelain is an enzyme in pineapple that, as it happens, pathologists use in blood bank testing. In July 2010 I was alerted to promotion of magic pineapple juice, especially as a treatment for goiter (enlarged thyroid gland). This is very, very surprising. If enough bromelain were to get through your gut mucosa to have any effect, it would start by gravely altering your red cell antigens, like it does in lab.
Just to be sure, I ran a check of the NIH database that would find any study -- even a mouse study in a bottom-class junk journal -- on bromelain / pineapple and thyroid disease. Exactly nothing.
Various plants contain various chemicals that can enlarge thyroid glands. There may perhaps be something in some plant that has as as-yet-unknown effect on thyroid glands. The burden of proof is on the person trying to sell you the magic pineapple extract. It's your money.
If you have a goiter, the most important thing to find out is "Why?" Common nodular goiter often responds well to conventional treatment with thyroid supplementation. Medical disease of the thyroid is likely to kill if not diagnosed properly. And of course there's plenty of thyroid cancer. It's your life.
Follow-up: When I originally heard of the claim, I did not believe that any bromelain would make it through the gut mucosa. A correspondent brought to my attention Am. J. Phys. 273: G139, 1997. After taking 3 grams of bromelain a day, plasma levels reached as high as 5,000 picograms/mL. A picogram is one trillionth of a gram. I did the arithmetic and assuming a serum half-life of one day, one molecule of bromelain out of 600,000 will be absorbed. No drug company would issue an oral preparation with such a poor level of absorption. I stand corrected, and would invite the promoters of magic pineapple juice to take some of the stuff, or pure bromelain, intravenously and see how much good it does them. By the way, when I was in the blood bank, technicians were warned against inhaling bromolein powder because many people (maybe 50% of technicians) become allergic to it by this route and develop skin and lung problems.
Cesium Chloride for cancer
Cesium is an ion that cannot bond covalently with any other atom or molecule under any circumstances in a living body. Except for its ability to interact with electrical membranes, with potentially lethal results especially in the presence of kidney failure or if given by vein, it is as inert a substance as you can introduce into your body. However, taking a large dose is presently being touted as a cancer preventative or remedy, especially by a group representing itself as the "Life Science University Medical Center" or the "Life Science Universal Medical Center". (One must be a misprint, which is surprising in their own publication. I've taught in accredited medical schools for a quarter-century and I have never heard of them.) The author claims to conduct experiments in Rockville, Maryland, suggesting to the unwary that they are affiliated with the National Institues of Health. These people report an uncontrolled series of 50 end-stage cancer patients who were given cesium chloride plus other "holistic" remedies. The reported results are hard to understand:
An overall 50% recovery from cancer by the Cs. therapy was determined in the fifty patients treated. Data from the autopsy (sic.) indicated the absence of tumors in patients dying within fourteen days of the Cs-treatment.
One wonders what killed the people who died if they had no tumors. The author is a person using the pen name "Annie Appleseed" who admits to having no medical qualifications, but apparently claiming she performed and supervised these activities in 1981-2. It is hard to understand how the three patients in coma were fed whole grains and vegetables. Even harder to understand is why, if these accounts are true, there was never a publication, not even in an unrefereed junk journal. Further, why was this not noticed by the communist nations? Cancer was rampant in Russia and China, and they had an effective spy network. The supposedly-corrupt profit-driven capitalist medical establishment would have had no way of stopping the use of an effective cancer remedy which (had it worked) would have been a masterful stroke in the propaganda war against the West.
Of course, there is no refereed-journal publication on cesium chloride's anti-cancer effects. The explanation of how cesium chloride is supposed to work is obvious baloney. Supposedly, cesium in the extracellular milieu causes the pH of the cell to increase. Cesium chloride is cited as an alkaline salt, which raises the pH of the fluid itself. Cesium can supposedly enter a cancer cell but not a benign cell, and neutralize the acids that supposedly cause cancer. Finally, they claim that the pH in a cancer cell is "as low as 5.5", and that cesium in the milieu raises the pH to 8.0 which results in cell death within hours.
People considering this proposed mechanism should remember their high school biology. Simply because a cell is not dividing does not cause it to die. (Consider your healthy brain, heart, muscle, and most other cells.) Cesium chloride is not an alkalinizing agent any more than is table salt. Ask a grammar-school chemistry teacher. The claim that cesium can enter cancer cells but not benign cells is referenced only to the work of Brewer, a mid-1900's cancer charlatan with a physics background and if its own proponents believed it, they could easily test their own claim in any tissue-culture lab and publish in one of the junk journals for an honest reference. Of course they have not done so. The idea that unnamed acids cause cancer and can be neutralized is like saying the moon is made of green cheese. The claim that a cancer cell might have an internal pH of 5.5 is ridiculous. (Below 6.5 will kill any cell in a few minutes. And the dyes I use to stain cancer cells include pH indicators similar to litmus; of course no such pH change is evident.)
Of course, there are anecdotes. One patient whose cancer supposedly was observed by the author to shrivel to almost nothing within one hour after cesium administration. (Regrettably, soon afterwards she fell and broke her neck from a cancer-related hip fracture.) If this had actually happened anywhere near the National Institutes of Health, it would have been stolen by one of the research piranhas and published in a real journal. Of course there is no such publication, and "Annie Appleseed" cites a massive conspiracy.
Other sites repeat the grossly false claim that Otto Warburg's 1931 Nobel Prize was awarded for demonstrating that anaerobiasis causes cancer. He actually distinguished between aerobic and anaerobic metabolism and figured out how the cytochromes work. You can read his Nobel Prize lecture for yourself if you still don't realize that these people are trying to sucker you. Not surprisingly, these people also repeat the false claims that the Hunza people and reservation-dwelling Hopi people have a remarkably low incidence of cancer, attributed this time to abundant cesium in the diet.
Cesium chloride is a common chemical that costs almost nothing, though there might be a fee for administering it orally. If the proposed mechanism is accurate, then it should be sufficient therapy to provide a cancer cure. However, its proponents say it only works when given with other holistic remedies and a diet, typcially of uncooked foods, and under the supervision of a holistically-minded nutritionist.
Cesium in combination with aloe vera went to law in Maryland after a physician and two other people pretending to be physicians promised cures for cancer and AIDS. They went to prison. It used to be described at the Maryland Attorney General's site. At his site on coral calcium, Steve Barrett claims the regimen actually killed some people, but I couldn't find anything to support this.
Some of the cesium chloride sites accuse mainstream physicians of willful ignorance, attribute the vilest motives to them, compare them all to Hitler, etc., etc. If you still wish to become involved with the cesium chloride people, that is your business.
Citrus bergamot for dyslipidemia
The oil from the peel of an exotic orange has been used for decades by aromatherapists for various reasons. It is pungent and fragrant. The oil components also have some pharmacologic activity; it contains naringin, the bitter substance in grapefruit which is known to have a host of pharmacologic actions and especially drug-interactions.
One article from Spain in 2009 has been much-cited but I could not find it in a literature search, reports are that it has no controls, and the results seem too good to be true (which usually means they won't be verified.)
The one article in a NIH-listed journal (the obscure Fitotherapia 82: 309, 2011, from the med school in Catanzaro, Italy) gives results of oral trial on rats and people; there was a moderate cholesterol-lowering effect and some tendency to lower blood glucose in diabetics. The effects were most marked in folks with the metabolic syndrome. The authors simply called for some real, quality studies on humans because the kind of work they were doing is prone to false-positives. They did note that the oil inhibits HMG-CoA reductase just like today's statins.
That's it so far. Remedies that actually work generally get snapped up by the research piranhas and become mainstream, even when nobody stands to make a lot of money.
There's also a rat study in which the oil, injected into the blood, made the rats excited; no surprise. I eat orange peel myself sometimes, and if you want to try this out, it's your choice.
Clay Eating / Clay Therapy
Using clay as an aid to health. Special miracle clays from exotic locations (some of which supposedly concentrate cosmic energies) are sold to the "alternative and complementary community." There are probably some reasonable uses for clays in cosmetics, and I can't address the use of clay as a deodorant.
The claims are extremely diverse. Common sense would suggest that clay-eating would alter the gut flora and physical properties. For many years, a kaolin clay-based formulation has been in use in mainstream medicine as a diarrhea remedy, and some obscure journals are now looking at bentonite as well. Clay is included in some animal feeds, and some species consume certain clays selectively. Pilot studies are just now starting to appear in support of some of the more reasonable health claims for humans.
A study out of U. Az. confirmed the common-sense idea that components of clay are 'cidal for some pathogenic bacteria (J. Antimicrob. Chemo. 61: 353, 2008. Some obscure journals are looking at other clays especially for control of functional bowel syndrome, and it's not surprising that some clays adsorb and thus protect from mycotoxins. Thanks to my correspondent Kjell K. for bringing these to my attention.
Clay eating is known medically as "geophagia", a variant of pica. It's seen among the mentally ill, and in some places it's a cultural phenomenon, mostly among the poor (do we dare say "ignorant"?) See J. Roy. Soc. Med. 95: 143 and 274, 2002; South. Med. J. 95: 1228, 2002. One group in J. Exp. Bio. 207: 319, 2004 speculates how the widespread practice may have developed (trace-mineral availability, diarrhea control). Known hazards are intestinal obstruction (Archives de Pediatrie 11: 461, 2004), perforated colon (Acta Chir. Belg. 99: 130, 1999), lead poisoning (Clin. Ped. 43: 189, 2004; Amb. Ped. 3: 37, 2003), hypokalemia (a young mother-to-be's agonizing misadventure: Ob. Gyn. 102: 1169, 2003), and toxacara roundworm infection (you can get it in the US: South. Med. J. 91: 882, 1998; massive problem in Sri Lanka: Southeast Asia Journal of Tropical Medicine 34: 7, 2003; Brazil Curr. Op. Ophth. 12: 450, 2001; in Trinidad TRS Trop Med 96:139, 2002; several others).
Given that many members of the "alternative medicine community" believe that mercury in dental fillings is a terrible health hazard, it is surprising that there was no outcry after eating certain clays was found to produce clinical mercury poisoning (Conn. Med. 61: 207, 1997) or that there are no assays for mercury levels or other poisons on the clay promotion websites. If the consumers were clear thinkers, you'd think they'd demand to know.
I was able to find single hard-science study of a health claim for clay. A clay-based product was promoted for sheep to protect from locoweed toxicosis. It failed a controlled test miserably (J. Animal Science 75: 1867, 1997). As a food additive, there are two small controlled studies showing benefits for pigs and rats respectively. There may be more such in the future, with positive results.
One article that really helped me understand how people adopt their "cherished beliefs" was MMWR 47(43): 928, 1998. A lady from an anti-immunization family almost killed her baby by putting "health and beauty clay" on the umbilical stump, causing a dreadful anaerobic infection and neonatal tetanus. The clay was of course laced with tetanus spores, probably from decades of horse manure. When the baby recovered, the mother refused to have the child immunized because of "concerns about potential adverse effects".
Clay-eating is widespread and most people seem not to be harmed. Please be sure your clay comes from someone you have good reason to trust.
Colonic Irrigation for "Autointoxication"
Colonic irrigation with saline with or without phosphate is standard for a variety of diseases of the large intestine, including chronic fecal incontinence and the acute management of some mechanical and functional problems.
Presently there is a resurgence of interest in the old claim that the colon contents produce poisons that damage the rest of the body. This is actually true in liver failure, in which enemas and laxatives help appreciably with the brain malfunctions. (Octopamine and other bacterial products from the gut, if allowed to bypass the liver, act as false neutransmitters, sort-of-like "reverse prozac"). Evidence that anything like this happens when the liver is healthy hasn't been forthcoming.
I own a popular book promoting colonic irrigation. It showcases pictures of barium enema x-ray photos, and states that the areas where the colon is narrow are sites of "toxic bowel settlement", a substance (variously described as "slimy" and "cement-like") that accumulates on the wall of the colon, and that colonic irrigation removes. This is just a bold lie. The pictures represent the narrowings by which the colon propels its contents ("peristalsis"). As a pathologist, I have opened hundreds of colons and never seen anything like "toxic bowel settlement".

Double Jeopardy Clause – Wikipedia

The Double Jeopardy Clause of the Fifth Amendment to the United States Constitution provides: "[N]or shall any person be subject for the same offence to be twice put in jeopardy of life or limb . . . ."[1] The four essential protections included are prohibitions against, for the same offense:
Jeopardy attaches in jury trial when the jury is empaneled and sworn in, in a bench trial when the court begins to hear evidence after the first witness is sworn in, or when a court accepts a defendant's plea unconditionally.[2] Jeopardy does not attach in a retrial of a conviction that was reversed on appeal on procedural grounds (as opposed to evidentiary insufficiency grounds), in a retrial for which "manifest necessity" has been shown following a mistrial, and in the seating of another grand jury if the prior one refuses to return an indictment.
In United States v. Felix 503 U.S. 378 (1992), the U.S. Supreme Court ruled: "a[n]...offense and a conspiracy to commit that offense are not the same offense for double jeopardy purposes."[3][4]
Sometimes the same conduct may violate different statutes. If all elements of a lesser offense are relied on to prove a greater offense, the two crimes are the "same offense" for double jeopardy purposes, and the doctrine will bar the second prosecution. In Blockburger v. United States, 284 U.S. 299 (1932), the Supreme Court held that "where the same act or transaction constitutes a violation of two distinct statutory provisions, the test to be applied to determine whether there are two offenses or only one, is whether each provision requires proof of an additional fact which the other does not".[5] The test was applied in Brown v. Ohio, 432 U.S. 161 (1977), where the defendant had first been convicted of operating an automobile without the owner's consent, and later of stealing the same automobile. The Supreme Court concluded that the same evidence was necessary to prove both offenses, and that in effect there was only one offense. Therefore, it overturned the second conviction.
In other cases, the same conduct may constitute multiple offenses under the same statute, for instance where one robs many individuals at the same time. There is no explicit bar to separate prosecutions for different offenses arising under the same "criminal transaction", but it is not permissible for the prosecution to re-litigate facts already determined by a jury. In Ashe v. Swenson, 397 U.S. 436 (1970), the defendant was accused of robbing seven poker players during a game. John Ashe was first tried for, and acquitted of, robbing only one of the players; the defense did not contest that a robbery actually took place. The state then tried the defendant for robbing the second player; stronger identification evidence led to a conviction. The Supreme Court, however, overturned the conviction. It was held that in the first trial, since the defense had not presented any evidence that there was no robbery, the jury's acquittal had to be based on the conclusion that the defendant's alibi was valid. Since one jury had held that the defendant was not present at the crime scene, the State could not re-litigate the issue.
Once acquitted, a defendant may not be retried for the same offense: "A verdict of acquittal, although not followed by any judgment, is a bar to a subsequent prosecution for the same offense."[6] Acquittal by directed verdict is also final and cannot be appealed by the prosecution.[7] An acquittal in a trial by judge (bench trial) is also generally not appealable by the prosecution.[8] A trial judge may normally enter an acquittal if he deems the evidence insufficient for conviction. If the judge makes this ruling before the jury reaches its verdict, the judge's determination is final. If, however, the judge overrules a conviction by the jury, the prosecution may appeal to have the conviction reinstated. Additionally, although a judge may overrule a guilty verdict by a jury, he or she does not have the same power to overrule a not guilty verdict.
More specifically, as stated in Ashe v. Swenson, 397 U.S. 436 (1970): "...when an issue of ultimate fact has once been determined by a valid and final judgment, that issue cannot again be litigated between the same parties in any future lawsuit." Res judicata is a term of general application. Underneath that conceptual umbrella is the concept of collateral estoppel. As applied to double jeopardy, the court will use collateral estoppel as its basis for forming an opinion[citation needed].
If a defendant charged with murder in the first degree is convicted for murder in the second degree, and later the jury's conviction is overturned on procedural grounds, the defendant may be retried for second degree but not first degree murder; the jury, by convicting the defendant of second degree murder, is deemed to have implicitly acquitted them of first degree murder.
As double jeopardy applies only to charges that were the subject of an earlier final judgment, there are many situations in which it does not apply, despite the appearance of a retrial. For example, a second trial held after a mistrial does not violate the double jeopardy clause because a mistrial ends a trial prematurely without a judgment of guilty or not, as decided by the U.S. Supreme Court in United States v. Josef Perez (1824). Cases dismissed because of insufficient evidence may constitute a final judgment for these purposes, though many state and federal laws allow for substantially limited prosecutorial appeals from these orders. Also, a retrial after a conviction that has been set aside following the grant of a motion for new trial, that has been reversed on appeal, or that has been vacated in a collateral proceeding (such as habeas corpus) would not violate double jeopardy because the judgment in the first trial had been invalidated. In all of these cases, however, the previous trials do not entirely vanish. Testimony from them may be used in later retrials, such as to impeach contradictory testimony given at any subsequent proceeding.
Prosecutors may appeal when a trial judge sets aside a jury verdict for conviction with a judgment notwithstanding verdict for the defendant. A successful appeal by the prosecution would simply reinstate the jury verdict and so would not place the defendant at risk of another trial.
If a defendant appeals a conviction and is successful in having it overturned, they are subject to retrial.
Retrial is not possible if the verdict is overturned on the grounds of evidentiary insufficiency, rather than on the grounds of procedural faults. As noted above, if the trial court made a determination of evidentiary insufficiency, the determination would constitute a final acquittal; in Burks v. United States 437 U.S. 1, (1978), the Court held that "it should make no difference that the reviewing court, rather than the trial court, determined the evidence to be insufficient."[9]
If the earlier trial is a fraud, double jeopardy will not prohibit a new trial because the party acquitted has prevented themselves from being placed into "jeopardy" to begin with.[10]
The Double Jeopardy Clause of the Fifth Amendment does not attach in a grand jury proceeding, or bar a grand jury from returning an indictment when a prior grand jury has refused to do so.[11]
A person who is convicted of one set of charges cannot in general be tried on additional charges related to the crime unless said additional charges cover new facts against which the person in question has not yet been acquitted or convicted. The test that determines whether this can occur is the Blockburger test.
An example of this are the charges of "conspiring to commit murder" and "murder". Both charges typically have facts distinct from each other. A person can be charged with "conspiring to commit murder" even if the murder never actually takes place if all facts necessary to support the charge can be demonstrated through evidence. Further, a person convicted or acquitted of murder can, additionally, be tried on conspiracy as well if it has been determined after the conviction or acquittal that a conspiracy did, in fact, take place.
Mistrials are generally not covered by the double jeopardy clause. If a judge dismisses the case or concludes the trial without deciding the facts in the defendant's favor (for example, by dismissing the case on procedural grounds), the case is a mistrial and may normally be retried. Furthermore, if a jury cannot reach a verdict, the judge may declare a mistrial and order a retrial as was addressed in United States v. Josef Perez, 22 U.S. 579 (1824). When the defendant moves for a mistrial, there is no bar to retrial, even if the prosecutor or judge caused the error that forms the basis of the motion. An exception exists, however, where the prosecutor or judge has acted in bad faith. In Oregon v. Kennedy, 456 U.S. 667 (1982), the Supreme Court held that "only where the governmental conduct in question is intended to 'goad' the defendant into moving for a mistrial may a defendant raise the bar of double jeopardy to a second trial after having succeeded in aborting the first on his own motion."
The defendant may not be punished twice for the same offense. In certain circumstances, however, a sentence may be increased. It has been held that sentences do not have the same "finality" as acquittals, and may therefore be reviewed by the courts.[citation needed]
The prosecution may not seek capital punishment in the retrial if the jury did not impose it in the original trial. The reason for this exception is that before imposing the death penalty the jury has to make several factual determinations and if the jury does not make these it is seen as the equivalent of an acquittal of a more serious offense.
In Arizona v. Rumsey, 467 U.S. 203 (1984), a judge had held a separate hearing after the jury trial to decide if the sentence should be death or life imprisonment, in which he decided that the circumstances of the case did not permit death to be imposed. On appeal, the judge's ruling was found to be erroneous. However, even though the decision to impose life instead of death was based on an erroneous interpretation of the law by the judge, the conclusion of life imprisonment in the original case constituted an acquittal of the death penalty and thus death could not be imposed upon a subsequent trial. Even though the acquittal of the death penalty was erroneous in that case, the acquittal must stand.
Double jeopardy also does not apply if the later charge is civil rather than criminal in nature, which involves a different legal standard (crimes must be proven beyond a reasonable doubt, whereas civil wrongs need only be proven by preponderance of evidence or in some matters, clear and convincing evidence). Acquittal in a criminal case does not prevent the defendant from being the defendant in a civil suit relating to the same incident (though res judicata operates within the civil court system). For example, O. J. Simpson was acquitted of a double homicide in a California criminal prosecution, but lost a civil wrongful death claim brought over the same victims.[12]
If the defendant happened to be on parole from an earlier offense at the time, the act for which he or she was acquitted may also be the subject of a parole violation hearing, which is not considered to be a criminal trial. Since parolees are usually subject to restrictions not imposed on other citizens, evidence of actions that were not deemed to be criminal by the court may be re-considered by the parole board. This legal board could deem the same evidence to be proof of a parole violation. Most states' parole boards have looser rules of evidence than is found in the courts for example, hearsay that had been disallowed in court might be considered by a parole board. Finally, like civil trials parole violation hearings are also subject to a lower standard of proof so it is possible for a parolee to be punished by the parole board for criminal actions that he or she was acquitted of in court.
In the American military, courts-martial are subject to the same law of double jeopardy, since the Uniform Code of Military Justice has incorporated all of the protections of the U.S. Constitution. The non-criminal proceeding non-judicial punishment (or NJP) is considered to be akin to a civil case and is subject to lower standards than a court-martial, which is the same as a civilian court of law. NJP proceedings are commonly used to correct or punish minor breaches of military discipline. If a NJP proceeding fails to produce conclusive evidence, however, the commanding officer (or ranking official presiding over the NJP) is not allowed to prepare the same charge against the military member in question. In a court-martial, acquittal of the defendant means he is protected permanently from having those charges reinstated.
The most famous American court case invoking the claim of double jeopardy is probably the second murder trial in 1876 of Jack McCall, killer of Wild Bill Hickok. McCall was acquitted in his first trial, which Federal authorities later ruled to be illegal because it took place in an illegal town, Deadwood, then located in South Dakota Indian Territory. At the time, Federal law prohibited all except Native Americans from settling in the Indian Territory. McCall was retried in Federal Indian Territorial court, convicted, and hanged in 1877. He was the first person ever executed by Federal authorities in the Dakota Territory.
Double jeopardy also does not apply if the defendant were never tried from the start. Charges that were dropped or put on hold for any reason can always be reinstated in the futureif not barred by some statute of limitations.
Although the Fifth Amendment initially applied only to the federal government, the U.S. Supreme Court has ruled that the double jeopardy clause applies to the states as well through incorporation by the Fourteenth Amendment (Benton v. Maryland).
The government of the United States and of each State therein may each enact their own laws and prosecute crimes pursuant thereto, provided there is no prohibition by the Constitution of the United States or of the state in question. Such is known as the "dual sovereignty" or "separate sovereigns" doctrine.
The earliest case at the Supreme Court of the United States to address the matter is Fox v. State of Ohio[13] in 1847, in which the petitioner, Malinda Fox, was appealing a conviction of a state crime of passing a counterfeit silver dollar. The power to coin money is granted exclusively to Congress, and it was argued that Congress's power precludes the power of any State from prosecuting any crimes pertaining to the money, an argument the Supreme Court rejected in upholding Fox's conviction.
A case that followed on Fox is United States v. Cruikshank,[14] in which the Supreme Court stated that the government of the United States is a separate sovereign from any State:
This does not, however, necessarily imply that the two governments possess powers in common, or bring them into conflict with each other. It is the natural consequence of a citizenship which owes allegiance to two sovereignties, and claims protection from both. The citizen cannot complain, because he has voluntarily submitted himself to such a form of government. He owes allegiance to the two departments, so to speak, and within their respective spheres must pay the penalties which each exacts for disobedience to its laws. In return, he can demand protection from each within its own jurisdiction.
In 1920 the United States was fresh in to the Prohibition Era. In one prosecution that occurred in Washington state, a defendant named Lanza was charged under a Washington statute and simultaneously under a United States statute, with the federal indictment stating several facts also stated in the Washington indictment. The Supreme Court addressed the question of the Federal government and a State government having separate prosecutions on the same facts in United States v. Lanza:[15]
We have here two sovereignties, deriving power from different sources, capable of dealing with the same subject matter within the same territory. Each may, without interference by the other, enact laws to secure prohibition, with the limitation that no legislation can give validity to acts prohibited by the amendment. Each government in determining what shall be an offense against its peace and dignity is exercising its own sovereignty, not that of the other.
It follows that an act denounced as a crime by both national and state sovereignties is an offense against the peace and dignity of both and may be punished by each. The Fifth Amendment, like all the other guaranties in the first eight amendments, applies only to proceedings by the federal government (Barron v. City of Baltimore, 7 Pet. 243), and the double jeopardy therein forbidden is a second prosecution under authority of the federal government after a first trial for the same offense under the same authority.
There may also be Federal laws that call other facts into question beyond the scope of any State law. A state may try a defendant for murder, after which the Federal government might try the same defendant for a Federal crime (perhaps a civil rights violation or a kidnapping) connected to the same act. The officers of the Los Angeles Police Department who were charged with assaulting Rodney King in 1991 were acquitted by a jury of the Superior Court, but some were later convicted and sentenced in Federal court for violating King's civil rights. Similar legal processes were used for prosecuting racially motivated crimes in the Southern United States in the 1960s during the time of the Civil Rights movement, when those crimes had not been actively prosecuted, or had resulted in acquittals by juries that were thought to be racist or overly sympathetic with the accused in local courts.
Federal jurisdiction may apply because the defendant is a member of the armed forces or the victim(s) are armed forces members or dependents. U.S. Army Master Sergeant Timothy B. Hennis was acquitted in state court in North Carolina for the murders in 1985 of Kathryn Eastburn (age 31) and her daughters Kara, age five, and Erin, age three, who were stabbed to death in their home near Fort Bragg, North Carolina.[16] Two decades later, Hennis was recalled to active duty, court-martialed by the Army for the crime, and convicted.[17] Richard Dieter, executive director of the Death Penalty Information Center, observed of this case, "Certainly, no one [in the US] has been exonerated and then returned to death row for the same crime except Hennis."[18]
Furthermore, as ruled in Heath v. Alabama (1985), the "separate sovereigns" rule allows two states to prosecute for the same criminal act. For example, if a man stood in New York and shot and killed a man standing over the border in Connecticut, both New York and Connecticut could charge the shooter with murder.[19]
Only the states and tribal jurisdictions[20] are recognized as possessing a separate sovereignty, whereas territories, commonwealths (for example, Puerto Rico), the military and naval forces, and the capital city of Washington, D.C., are exclusively under Federal sovereignty. Acquittal in the court system of any of these entities would therefore preclude a re-trial (or a court-martial) in any court system under Federal jurisdiction.
Though the Supreme Court of the United States has recognized the dual sovereignty doctrine as an exception to double jeopardy, the United States will not exercise its dual sovereignty power on everyone who becomes subject to it. As a self-imposed limitation on its dual sovereignty power, the United States Department of Justice has a policy called the "Petite" policy, named after Petite v. United States, 361 U.S. 529 (1960). The formal name of the policy is "Dual and Successive Prosecution Policy" [21] and it "establishes guidelines for the exercise of discretion by appropriate officers of the Department of Justice in determining whether to bring a federal prosecution based on substantially the same act(s) or transactions involved in a prior state or federal proceeding."
Under this policy, the Department of Justice presumes that any prosecution at the State level for any fact applicable to any Federal charge vindicates any Federal interest in those facts, even if the outcome is an acquittal. As an example, a person who commits murder within the jurisdiction of a State is subject to that State's murder statute and the United States murder statute (18 U.S.C.1111). The Federal government will defer to the State to prosecute under their statute. Whatever the outcome of the trial, acquittal or conviction, the Department of Justice will presume that prosecution to vindicate any Federal interest and will not initiate prosecution under the United States Code.
However that presumption can be overcome. The policy stipulates five criteria that may overcome that presumption:
The existence of any of these criteria is to be determined by an Assistant Attorney General of the United States. If a prosecution is determined to have proceeded without authorization, the Federal government may and has requested the Court vacate an indictment. Such a move is in line with the Courts vacating indictments wherein prosecutions were discovered to have violated Department of Justice policy. Indictments have also been vacated when the Federal government first represents to the Court the prosecution was authorized but later determines that authorization to have been mistaken.[22]

As Ron Paul detailed earlier, President-elect Donald Trump told a Cincinnati audience this week that he intends to make some big changes in US foreign policy. During his thank you tour in the midwest, Trump had this to say:
We will pursue a new foreign policy that finally learns from the mistakes of the past. We will stop looking to topple regimes and overthrow governments. In our dealings with other countries we will seek shared interests wherever possible...
If this is really to be President Trumps foreign policy, it would be a welcome change from the destructive path pursued by the two previous administrations. Such a foreign policy would go a long way toward making us safer and more prosperous, as we would greatly reduce the possibility of a blowback attack from abroad, and we would save untold billions with a foreign policy of restraint.
However as we know with politicians, there is often a huge gap between pronouncements before entering office and actions once in office. Who can forget President George W. Bushs foreign policy promises as a candidate 16 years ago? As a candidate he said:
I am not so sure the role of the United States is to go around the world saying this is the way its got to be. If were an arrogant nation they will resent us, if were a humble nation but strong theyll welcome us.
Unfortunately as soon as he took office, George W. Bush pursued a completely different foreign policy, attacking countries like Iraq at the urging of the neocons he placed in positions of power in his White House and State Department.
Some people say that personnel is policy, and that much can be predicted about Trumps foreign policy by the people he has appointed to serve his Administration. That is where we might have reason to be worried. Take Iran, for example. While Trump says he wants the US to stop overthrowing governments, on the issue of Iran both the candidate and his recent appointees have taken a very different view.
Trump's pick for National Security Advisor, Michael Flynn, has said the following about Iran: "I believe that Iran represents a clear and present danger to the region, and eventually to the world..." and, regime change in Tehran is the best way to stop the Iranian nuclear weapons program.
Trumps CIA choice, Mike Pompeo, has said of President Obamas Iran deal, The Iranian regime is intent on the destruction of our country. Why the President does not understand is unfathomable.
And Trumps selection for Defense Secretary, General James Mattis, was even more aggressive, saying, The Iranian regime in my mind is the single most enduring threat to stability and peace in the Middle East. ...Iran is not an enemy of ISIS. They have a lot to gain from the turmoil in the region that ISIS creates."
Donald Trump's words in Cincinnati don't seem to match up with the views of the people that he's assigning to high places. At least when it comes to Iran.
While I hope we can take President Trump at his word when it comes to foreign policy, I also we think we should hold him to his word especially his encouraging words last week. Will the incoming president have the ability to rein in his more bellicose cabinet members and their underlings? We can be sure about one thing: if Trump allows the neocons to capture the State Department, keeping his foreign policy promises is going to be a lot more difficult.

Human Nature Prepares for a Momentous Leap

A new psychological theory holds that human beings exist at different levels of existence. At any given level, an individual exhibits the behavior and values characteristic of people at that level; a person who is centralized at a lower level cannot even understand people who are at a higher level. In the following article, psychologist Clare Graves outlines his theory and what it suggests regarding man's future. Through history, says Graves, most people have been confined to the lower levels of existence where they were motivated by needs shared with other animals. Now, Western man appears ready to move up to a higher level of existence, a distinctly human level. When this happens there will likely be a dramatic transformation of human institutions.
For many people the prospect of the future is dimmed by what they see as a moral breakdown of our society at both the public and private level. My research, over more than 20 years as a psychologist interested in human values, indicates that something is indeed happening to human values, but it is not so much a collapse in the fiber of man as a sign of human health and intelligence. My research indicates that man is learning that values and ways of living which were good for him at one period in his development are no longer good because of the changed condition of his existence. He is recognizing that the old values are no longer appropriate, but he has not yet understood the new.
The error which most people make when they think about human values is that they assume the nature of man is fixed and there is a single set of human values by which he should live. Such an assumption does not fit with my research. My data indicate that man's nature is an open, constantly evolving system, a system which proceeds by quantum jumps from one steady state system to the next through a hierarchy of ordered systems.
Briefly, what I am proposing is that the psychology of the mature human being is an unfolding, emergent, oscillating, spiraling process marked by progressive subordination of older, lower-order behavior systems to newer, higher-order systems as man's existential problems change. These systems alternate between focus upon the external world, and attempts to change it, and focus upon the inner world, and attempts to come to peace with it, with the means to each end changing in each alternatively prognostic system. Thus, man tends, normally, to change his psychology as the conditions of his existence change. Each successive state, or level of existence, is a state through which people pass on the way to other states of equilibrium. When a person is centralized in one state of existence, he has a total psychology which is particular to that state. His feelings, motivations, ethics and values, biochemistry, degree of neurological activation, learning systems, belief systems, conception of mental health, ideas as to what mental illness is and how it should be treated, preferences for and conceptions of management, education, economic and political theory and practice, etc., are all appropriate to that state.
In some cases, a person may not be genetically or constitutionally equipped to change in the normal upward direction when the conditions of his existence change. Instead, he may stabilize and live out his life at any one or a combination of levels in the hierarchy. Again, he may show the behavior of a level in a predominantly positive or negative manner, or he may, under certain circumstances, regress to a behavior system lower in the hierarchy. Thus, an adult lives in a potentially open system of needs, values and aspirations, but he often settles into what appears to be a closed system.
Human existence can be likened to a symphony with six themes. In a symphony, the composer normally begins by stating his themes in the simplest possible manner. In human existence, our species begins by stating in the simplest way those themes which will preoccupy us through thousands of variations. At this point in history, the societal effective leading edge of man in the technologically advanced nations is currently finishing the initial statement of the sixth theme of existence and is beginning again with the first theme in an entirely new and more sophisticated variation. That is, man has reached the point of finishing the first and most primitive ladder of existence: the one concerned with the emergence of the individual of the species Homo sapiens and his subsistence on this planet. The first six levels of existence, A-N through F-S, have accordingly been called Subsistence Levels. (A stands for the neurological system in the brain upon which the psychological system is based; N for the set of existential problems that the A neurological system is able to cope with. Thus, in the A-N state, one calls on the A system to solve the N problems of existence.) These six subsistence levels comprise the initial statement of man's themes in its very simplest form.
The six subsistence levels of man's existence have as their overall goal the establishment of individual survival and dignity. Once having become reasonably secure, both physically and psychologically, in his existence, the individual becomes suddenly free to experience the wonder and interdependence of all life. But he must notice at the same time that the struggle for man's emergent individuality has imperiled the very survival of that life. Thus, just as early man at the most primitive level of subsistence (A-N), had to use what power he could command to stabilize his individual life functions, so G-T man, the individual who has reached the first level of being must use what knowledge he can command to stabilize the essential functions of interdependent life. Similarly, B-O or tribal man gathered together in communities to insure his individual, physical survival, and our G-T man of the future must form communities of knowledge to insure the survival of all viable life upon this Earth. We see therefore that the six themes constantly repeat, even though man progresses from the simple statement of individual subsistence to the variation of the interdependence of life. This stately succession of themes and movements is the general pattern of the levels of existence.
In this discussion of man's present and future, the first three subsistence levels must still concern us because many people, from aborigines to newly emergent nations, are still living at these levels of existence.
Here are brief descriptions of the levels as I have come to know them through my research:
Some Characteristics of Various Levels
Automatic Existence (First Subsistence Level)
Man at the first subsistence level (A-N), the automatic state of physiological existence, seeks only the immediate satisfaction of his basic physiological needs. He has only an imperative need-based concept of time and space and no concept of cause or effect. His awareness excludes self and is limited to the presence of physiologically determined tension when it is present, and the relief of such tension when it takes place. He lives a purely physiological existence. Man the species, or man the individual, does not have to rise above this level to continue the survival of the species. He can continue the survival of the species through the purely physiological aspect of the process of procreation. He can live what is for him, at the A-N level, a productive lifetime, productive in the sense that his built-in response mechanisms are able to reduce the tensions of the imperative physiological needs and a reproductive lifetime. But this level of existence seldom is seen in the modern world except in pathological cases.
As soon as man, in his food-gathering wanderings, accrues a set of Pavlovian conditioned reflexes, which provide for the satisfaction of his imperative needs, and thus enters his 'Garden of Eden,' he slides almost imperceptibly out of this first stage into the second existential state, and established form of human existence, the tribalistic way of life.
Tribalistic Existence (Second Subsistence Level)
At the second subsistence level, the B-O autistic state of thinking, man's need is for stability. He seeks to continue a way of life that he does not understand but strongly defends. This level of man has just struggled forth from striving to exist and now has his first established way of life. This way of life is essentially without awareness, thought, or purpose, for it is based on Pavlovian classical conditioning principles. Therefore, B-O man beliefs his tribalistic way is inherent in the nature of things. As a result he holds tenaciously to it, and strives desperately to propitiate the world for its continuance.
At this level a seasonal, or naturally based concept of time prevails and space is perceived in an atomistic fashion. Causality is not yet perceived because man perceives that forces at work to be inherent. Here a form of existence based on myth and tradition arises, and being is a mystical phenomenon full of spirits, magic and superstition. Here the task of existence is simply to continue what it seems has enabled my tribe to be.
But here, more by chance than by design, some men achieve relative control of their spirit world through their non-explainable, elder-administered, tradition-based way of life a way of life which continues relatively unchanged until disturbed from within or without. When the established tribal way of life assures the continuance of the tribe with minimal energy expenditure by solving problems N by neurological means A, it creates the first of the general conditions necessary for movement to a new and different steady state of being. It produces excess energy in the system which puts the system in a state of readiness for change. But unless another factor, such as dissonance or challenge, comes into the field, the change does not move in the direction of some other state of being. Instead, it moves toward maximum entropy and its own demise, since it becomes overloaded with its accretion of more and more tradition, more and more ritual. If, however, when the state of readiness is achieved, dissonance enters, then this steady state of being is precipitated toward a different kind of change. This dissonance arises usually in youth, or in certain minds which are not troubled by memories of the past and are capable of newer and more lasting insights into the nature of man's being. Or it can come to the same capable minds when outsiders disturb the tribe's way of life.
When, at the B-O level, readiness for change occurs, it triggers man's insight into his existence as an individual being separate and distinct from other beings, and from his tribal compatriots as well. As he struggles, he perceives that others - other men, other animals, and even the spirits in his physical world - fight him back. So his need for survival comes to the fore.
With this change in consciousness, man becomes aware that he is aligned against predatory animals, a threatening physical universe, and other men who fight back for their established way of existence, or against him for the new way of existence he is striving to develop. Now he is not one-with-all, for he is alone in his struggle for his survival against the draconic forces of the universe. So he sets out in heroic fashion to build a way of being which will foster his individual survival.
Egocentric Existence (Third Subsistence Level)
At the egocentric level (C-P), raw, rugged, self-assertive individualism comes to the fore. This level might be termed 'Machiavellian,' for within it is all the author of The Prince considered the essence of being human. History suggests to us that the few who were able to gain their freedom from survival problems surged almost uncontrollably forward into a new way of being, and also dragged after them the tribal members unable to free themselves of the burden of stagnating tribalistic existence. History also suggests that the few became the authoritarians while the many became those who submitted. The many accepted the might-is-right of the few because such acceptance assured their survival. This was so in the past and it is still so today.
This Promethean (C-P) point of view is based on the prerogatives of the haves and the duties of the have-nots. Ultimately, when this way of life, based historically on the agricultural revolution, is established, life is seen as a continuous process with survival dependent on a controlled relationship. Fealty and loyalty, service and noblesse oblige become cornerstones of this way of life. Assured of their survival, through fief and vassalage, the haves base life of the right way to behave as their might dictates. A system develops in which each individual acts out in detail, in the interest of his own survival, how life is to be lived, but online a small number ever achieve any modicum of power and the remainder are left to submit.
Both the authoritarian and the submissive develop standards which they feel will insure them against threat, but these are very raw standards. The submissive person chooses to get away with what he can within the life style which is possible for him. The authoritarian chooses to do as he pleases. He spawns, as his raison d'tre, the rights of assertive individualism. These rights become, in time, the absolute rights of kings, the unassailable prerogatives of management, the inalienable rights of those who have achieved positions of power, and even the rights of the lowly hustler to all he can hustle. This is a world of the aggressive expression of man's lusts openly and unabashedly by the 'haves,' and more covertly and deviously by the 'have nots.'
Now man moves to the lasting security level of need and learns by avoidant learning. As he moves to the D-Q level he develops a way of life based on the conviction that there must be a reason for it all, a reason why the have shall possess so much in life yet be faced with death, and a reason why the have not is forced to endure a miserable existence. This search leads to the belief that the have and have not condition is a part of a directed design, a design of the forces guiding man and his destiny. Thus, the saintly way of life, based on one of the world's great religions or great philosophies, comes to be. Here man creates what he believes is a way for lasting peace in this life or everlasting life, a way which, it seems to him, will remove the pain of both the have and the have not. Here he seeks salvation.
Saintly Existence (Fourth Subsistence Level)
At the saintly level (D-Q), man develops a way of life based on 'Thou salt suffer the pangs of existence in this life to prove thyself worthy of later life.' This saintly form of existence comes from seeing that living in this world is not made for ultimate pleasure, a perception based on the previous endless struggle with unbridled lusts and a threatening universe. Here man perceives that certain rules are prescribed for each class of men and that these rules describe the proper way each class is to behave. The rules are the price man must pay for his more lasting life, for the peace which he seeks, the price of no ultimate pleasure while living. The measure of this worthiness is how much he has lived by the established rules. But, after security is achieved through these absolutistic rules, the time comes when some men question the price. When this happens, the saintly way of life is doomed to decay, since some men are bound to ask why they cannot have some pleasure in this life. Man then struggles on through another period of transition to another level, now slipping, now falling in the quest for his goal. When man casts aside the inhuman aspect of his saintly existence, he is again charged with excess energy because his security problems are solved; but this very solution has created the problems R, how to build a life that will offer pleasure here and now, which eventually he meets through the neurological means of system E.
Materialistic Existence (Fifth Subsistence Level)
At the materialistic level (E-R_, man strives to conquer the world by learning its secrets, rather than through raw, naked force as he did at the C-P level. He tarries long enough here to develop and utilize the objectivistic, positivistic, operationalistic, scientific method so as to provide the material ends for a satisfactory human existence in the here and now. But once assured of his own material satisfaction he finds he has created problems S, a new spiritual void in his being. He finds himself master of the objective physical world but a prime neophyte in the subjectivistic, humanistic world. He has achieved the satisfaction of a good life through his relative mastery of the physical universe, but it has been achieved at a price, the price of not being liked by other men for his callous use of knowledge for himself. He has become envied and even respected, but he is not liked. He has achieved his personal status and material existence at the expense of being rejected even by his use of neurological sub-system F, and begins man's move to his sixth form of existence.
Personalistic Existenence (Sixth Subsistence Level)
At the personalistic level (F-S), man becomes centrally concerned with peace with his inner self and in the relation of his self to the inner self of others. He becomes concerned with belonging, with being accepted, with knowing the inner side of self and other selves so harmony can come to be, so people as individuals can be at peace with themselves and thus with the world. And when he achieves this, he finds he must become concerned with more than self or other selves, because while he was focusing on the inner self to the exclusion of the external world, his outer world has gone to pot. So how he turns outward to life and to the whole, the total universe. As he does so he begins to see the problems of restoring the balance of life which has been torn asunder by his individualistically oriented, self-seeking climb up the first ladder of existence.
As man moves from the sixth or personalistic level, the level of being with self and other men, the seventh level, the cognitive level of existence, a chasm of unbelievable depth of meaning is crossed. The gap between the sixth level (the F-S level) and the seventh (the G-T level) is the gap between getting and giving, taking and contributing, destroying and constructing. It is the gap between deficiency or deficit motivation and growth or abundance motivation. It is the gap between similarity to animals and dissimilarity to animals, because only man is possessed of a future orientation.
Cognitive Existence (First Being Level)
Once we are able to grasp the meaning of passing from the level of being one with others to the cognitive level (G-T) of knowing and having to do so that all can be and can continue to be, it is possible to see the enormous differences between man and other animals. Here we step over the line which separates those needs that man has in common with other animals and those needs which are distinctly human.
Man, at the threshold of the seventh level, where so many political and cultural dissenters stand today, is at the threshold of being human. He is truly becoming a human being. He is no longer just another of nature's species. And we, in our times, in our ethical and general behavior, are just approaching this threshold, the line between animalism and humanism.
Experientialistic Existence (Second Being Level)
At the second being level, the experientialistic level (H-U), man will be driven by the winds of knowledge, and human, not godly, faith. The knowledge and competence acquired at the G-T level will bring him to the level of understanding, the H-U level. If every man leaps to this great beyond, there will be no bowing to suffering, no vassalage, no peonage. Man will move forth on the crests of his broadened humanness rather than vacillate and swirl in the turbulence of his animalistic needs. His problems, now that he has put the world back together, will be those of bringing stabilization to life once again. He will need to learn how to live so that the balance of nature is not again upset, so that individual man will not again set off on another self-aggrandizing binge. His values will be set not by the accumulated wisdom of the elders, as in the B-O system, but by the accumulated knowledge of the knowers. But here again, as always, this accumulating knowledge will create new problems and precipitate man to continue up just another step in his existential staircase.
Applying Gravess Theory to Management
Graves criticizes management training programs for trying, in all too many instances, to change managers' beliefs and ways of behaving so as to bring them more in line with the organization's pre-existing methods and beliefs. For instance, such programs may manage from a hierarchical to a team management.
These programs do not try to fit managerial development to the beliefs and ways of behaving that are those of the managing person," says Graves. They attempt, instead, to get the manager to change his beliefs. When organizations foster this kind of incongruency, they cast the manager into a severe value crisis, which often affects his performance adversely.
A second mistake of management, he says, is that it typically does not manage people the way they want to be managed. For instance, many persons like participation management but others do not, yet management has implicitly assumed that participation affects all persons in more or less the same way. In fact, people with an authoritarian cast of mind or with weak independence needs apparently are unaffected or even negatively affected by an opportunity to participate in decision-making.
Graves's research indicates that a worker with a closed personality normally prefers to be managed by the style congruent with his level of existence. If his personality is still open and growing, he prefers to be managed by a supervisor at the next higher level. For example, a closed personality at the D-Q level prefers a paternalistic form of management, while a worker with an open personality at the same level would like to be managed by E-R methods, which allow more freedom for individual initiative.
Personalistic Values Now Flower in America
Using this framework to approach current American society, we can easily see an efflorescence of personalistic (F-S) values in the popularity of such things as Salem, yoga, the encounter group, the humanistic psychology movement and participatory decision-making in management. By all these means and many others, personalistic (F-S) man endeavors to achieve self-harmony and harmony with others. These individuals do not, of course, see their striving for harmony with the human element as merely a stage they are going through, but as the ultimate, the permanent goal of all life. This short-range vision, which views the current goal as the ultimate goal of life, is shared by human beings at every level of existence for as long as they remain centralized in that particular level.
Using the Theory of Levels, we see that the so called generation gap of the recent past was in reality a values gap between the D-Q and the E-R and F-S levels of existence. For example, many of the parents of F-S youth subscribed to E-R values, which emphasize proving one's worth by amassing material wealth. To individuals operating at this level it was inconceivable that their children might reject competition for cooperation and seek inner self-knowledge rather than power, position and things. Worse yet to the E-R parents was the devotion of these young people to foreigners and minority groups who, according to E-R thinking, deserved their unfortunate condition because the were too weak or too stupid to fight for something better. Thus, the foreigners and minorities were characterized as lazy and irresponsible and the youth who defended them as lily-livered bleeding hearts.
In turn, F-S youth contributed to the confrontation because their civil disobedience and passive resistance offended their parents more than outright violence ever could have. These young people not only challenged Might (and therefore Right), but offered no new Might and Right to replace that which they mocked. Consequently, they were rightly (to the E-R mentality) called anarchists, and it was widely said that such permissiveness was wrecking the values which made America great. Of course, our hindsight now tells us that America was not, in fact, "wrecked," and today one can see a great many of the E-R parents who protested against anarchy getting in touch with themselves at Esalen and advocating theories of participative management.
Another outgrowth of the transition of our society from E-R to F-S values was the de-emphasis of technology. Technology was the principal means by which E-R man conquered the world. He did not, like his ancestor C-P man, use force alone, but rather he attempted to understand the natural laws in order to conquer men and nature. Because of the close historical association of technology with E-R values, the emerging F-S consciousness could not help but view technology as a weapon of conquest. Thus, along with rejecting conquest, F-S man rejected technology and in its place set up its exact opposite: Nature. In other words, the exploration of inner man and a return to nature (including all manner of idealized natural foods) replaced the exploitation of nature and other human beings in a quest for material wealth.
The idea of a future suffered a similar fate. American E-R man was always insistent that he had a great future, a manifest destiny somehow enhanced by never having lost a war. Therefore, F-S man, in his rebellion, was forced to throw the future into the same garbage heap as technology, erecting in its place the here and now.
Picture, if you will, F-S man seated in a yoga position, contemplating his inner self. He has completed the last theme of the subsistence movement of existence. There are no new deficiency motivations to rouse him from his meditations. In fact, he might well go on to contemplating his navel to the day of his death, if he only had some suitable arrangement to care for his daily needs. And it is quite possible for a few F-S individuals to live this way. But what happens when the majority of a population begins to arrive at the F-S level of existence? Who is left to care for their daily needs? Who is left to look after the elaborate technology which assures their survival? If we return to F-S man seated in his yoga position, we see that what finally disturbs him is the roof falling in on his head.
This roof can be called the T problems, the ecological crisis, the energy crisis, the population crisis, limits to growth, or any other such thing which is enough of a disturbance to awaken F-S man. Naturally enough, his first reaction will be that evil technology is taking over and that all the good feeling and greenery which made the Earth great is in the process of being wrecked forever. (We remember that attitude from the days when his father, E-R man, had much the same erroneous notion.) F-S man is correct in the sense that his entire way of life, his level of existence, is indeed breaking down: It must break down in order to free energy for the jump into the G-T state, the first level of being. This is where the leading edge of man is today.
The People that Drive Managers Crazy
Most people in organization in the western world are in the middle levels of existence (D-Q, E-R, and, increasingly, F-S). Managers are used to dealing with such people. Occasionally, however, a manager must deal with people at either a lower or higher level, and then his customary methods fail, Graves says.
People at the C-P level (Egocentric) are found frequently in very impoverished areas. These people exhibit the least capability to perform in a complex industrial world. When a job is available, they do not apply. If they get a job, they do not show up for work or they soon quit. While they are on the job, their habits are so erratic that little work is actually accomplished. Exasperated managers find such people unemployable. Society labels them hardcore unemployed.
To a Gravesian, people at the C-P level are employable, but they must be managed in a special way. The Graves theory holds that C-P people are driven primarily by the need to solve immediate survival problems. Applying the theory, a Gravesian manager would arrange the work situation so that the immediate survival needs of the worker are not threatened and would give him work that can be learned almost immediately.
The manager would also change the hiring requirements so that they do no threaten a C-P person. For instance, the Gravesian manager would simplify and speed up the processing of applications so that people know in minutes if they are hired and, if not hired, are taken immediately to some place where they might find jobs. He would make sure that C-P people are not supervised by self-righteous, do-good managers.
The hard-core unemployed person lives in a world of immediacy, says Graves. Often he must pay money down for almost everything he gets, and because of his immediate reactions to the crises he faces, he may be an absentee problem. To counteract these problems, a member of the organization might be assigned to administer an emergency fund to help the C-P person through difficult periods.
At the opposite extreme, managers must also deal with another group of people whom they find extremely troublesome, the G-T and H-U people. Ironically, these are among the most competent people. They possess knowledge needed to improve productivity in the organization, but often they are kept from improving productivity by ancient policies, inane practices, out-moded procedures and inappropriate managerial styles.
The G-T and H-U people want autonomy, the freedom to do their jobs the best way they know. When management requires such a person to procure permission to institute change when he sees change is needed, it stifles what he can contribute.
The sacred channels of communication seriously hamper the productivity of G-T people, who want to be able to decide when they know what to do. When he doesn't know, the G-T is motivated to seek guidance from those who do know. But a G-T employee's motivation becomes negative when he must waste time going through channels which require him to explain what does not need to be explained to people who do not need to have it explained to them.
The G-T worker reacts negatively when required to ask an administrator's approval for materials he needs in order to be productive. He reacts positively when he can tell his supervisor what he needs to do a job and when the supervisor considers that it is his job to do as his subordinate says. The G-T employee believes that he, not a superior, should make the decisions whenever he is competent to make it, and most G-T workers know that their supervisors are not competent to make the decision.
People who operate at the Being levels are typically competent regardless of their surroundings. Therefore, their productivity is not a function of lower-level incentives. Threat and coercion do not work with them, because they are not frightened people. Beyond a certain point, pecuniary motives do not affect them. Status and prestige symbols, such as fancy titles, flattery, office size, luxurious carpeting, etc., are not incentives to them. Many of them are not even driven by a need for social approval. What is important to them is that they be autonomous in the exercise of their competence, that they be allowed all possible freedom to do what needs to be done as best they can do it. In other words, they want their managers to let them improve productivity the way they know it can be improved. They do not want to waste their competency doing it management's way simply because things always have been done that way.
G-T people are becoming more prevalent, says Graves. They must do their own managing of their own work and of their own affairs. Their procedures must be their own, not those that tradition or group decision-making have established. When G-T employees are autonomous and are properly coupled with jobs that utilize their competence, one can expect optimum productivity from them.
An H-U employee does not resist coercion and restrictions in a flamboyant manner as does the G-T type, but he will avoid any relationship in which others try to dominate him. He must therefore be approached through what Graves calls "acceptance management" - management which takes him as he is and supports him in doing what he wants to do. It is useless, says Graves, to get an H-U employee to subordinate his desires to those of the organization. Instead, the organization must be fitted to him. If he cannot get the acceptance he wants, an H-U employee will quietly build a non-organizationally oriented world for himself and retire into it. He will do a passable but not excellent job. If there is no change in management and he cannot go elsewhere, he will surreptitiously work at what is important to him while putting up a front to management.
Human Progress Can Be Arrested
At this point it might be good to take a closer look at what happens when man changes levels of existence. The process itself is similar to some very basic phenomena in quantum mechanics and brain physiology, suggesting that it may in fact derive from the same laws of hierarchical organization. Basically, man must solve certain hierarchically ordered existential problems which are crucial to him in his existence. The solution of his current problem frees energy in his system and creates in turn new existential problems. (For instance, both the self-centering and other-awareness of the F-S state are necessary if the G-T problems of how life can survive are to be posted.) When new problems arise, higher order dynamic neurological systems are biochemically activated to solve them.
Will man inevitably progress, both as an individual and as a species, to higher levels of existence? Or can he become fixed at some level, even regress? The answer is that man can indeed become fixed at one level, and he can regress. A frightening example of cultural regression to the most primitive level of existence is that of the Ik tribe of Uganda which, after losing its lands, degenerated past any recognizable sign of humanity. (See anthropologist Colin Turnbull's book, The Mountain People.) Many tribes of American Indians at the end of the last century shared a like fate. Despite this, we must remember that the tendency for man to grow to higher states is always present, and may be likened to the force that enables a tree to crack boulders so that each year it can add another ring to its heartwood. Like the tree, man is most often stunted in his growth by external circumstance: poverty, helplessness, social disapproval and the like. Often, the full expression of the level of existence at which man finds himself is simply not possible. Few people, for instance, have the opportunity of fully indulging their E-R values by attempting to conquer man and nature. Consequently, man often is halted at this level and develops the lust for power which is so frequently believed to be universal in man.
Man, the species, must fully realize each level of existence if he is to rise to the next higher level, because only by pursuing his values to their limits can he recognize the higher-order existential problem that these particular values do not apply to. E-R man had to become powerful over nature in order to see that beyond the problem of power was the problem of knowing the inner self: the F-S level. He could not very well coerce or manipulate his neighbor into knowing himself. Therefore, his useless E-R values inevitably began to disintegrate as a way of life. Thus it seems that a moral breakdown regularly accompanies the transition from one level of existence to another. Man drops his current way of perceiving and behaving, and searches his cast-off levels for a way of behaving that will solve his new problem. In his frustration, E-R man may protest that he sacrificed for what he got (D-Q level) or make an appeal to law and order (C-P level) to end the demonstrations against him. All this will be to no avail because, naturally, no lower level behavior will solve his new higher-order problem. E-R man will be forced to take the first steps towards a new way of perceiving and behaving: the F-S system. With his first step he becomes F-S man, both because he is now understanding and respectful of the inner self of others rather than being powerful and manipulation, but because the greater part of his energy is now devoted to the problem of how to achieve community through personal and interpersonal experiencing.
We can therefore see that our time at each level of existence is divided between an embryonic period of identifying the values needed to solve the new existential problem, a period of implementing the values toward the solution of the problem, and a period of values breakdown following the successful solving of the problem. It is this final phase of break-down which causes such periodic dismay in society, but dissolution is necessary so that man can be free to recognize new existential problems. There is, in addition, an appearance of breakdown which results from the realization of the new values themselves, because these new values are so often the exact antithesis of the old. In that sense, the new values do represent the ultimate breakdown of the current basis of society, or of the individual's way of life.
Finally, there is a singular empirical fact associated with man's transitions from one level of existence to another. As our species moves up each step on each ladder of existence, it spends less and less time at each new level. It took literally millions of years for our ancestors to become tribalistic B-O man, while in the technologically advanced nations today man is moving from the E-R level through F-S to G-T in a scant twenty years. There is every reason to expect we will remain for a long time at the G-T level, then a shorter time at the H-U and other second ladder levels. At the G-T level, man will begin the task of subsistence again but in a new and higher order form (the survival of the human race), assuming, of course, that no external circumstances, such as a major war or other catastrophe, intervene to arrest our growth.
Levels of Existence
First Subsistence Level (A-N): Man at this level is motivated only by imperative periodic physiological needs. He seeks to stabilize his individual body functions. This level of existence is perfectly adequate to preserve the species, but it is seldom seen today except in rare instances, as in the Tasaday tribe, or in pathological cases.
Second Subsistence Level (B-O): At this level, man seeks social (tribal) stability. He strongly defends a life he does not understand. He believes that his tribal ways are inherent in the nature of things, and resolutely holds to them. He lives by totems and taboos.
Third Subsistence Level (C-P): Raw, self-assertive individualism comes to the fore at this level, and the term Machiavellian may be used. This is the level where might makes right thinking prevails. There is an aggressive expression of mans lusts, openly and unabashedly by the haves, more covertly and deviously by the have nots. Anyone dealing with the C-P type must resort to the threat of sheer naked force to get him to do anything.
Fourth Subsistence Level (D-Q): At this level, man perceives that living in this world does not bring ultimate pleasure, and also sees that rules are prescribed for each class of people. Obedience to these rules is the price that one must pay for more lasting life. D-Q people generally subscribe to some dogmatic system, typically a religion. These are the people who believe in 'living by the Ten Commandments,' obeying the letter of the law, etc. They work best within a rigid set of rules, such as army regulations.
Fifth Subsistence Level (E-R): People at the E-R level want to attain mastery of the world by learning its secrets rather than through brute force (as at the C-P level). They believe that the man who comes out on top in life fully deserves his good fortune, and those who fail are ordained to submit to the chosen few. E-R people tend to be somewhat dogmatic, but they are pragmatic, too, and when they find something that works better theyll change their beliefs.
Sixth Subsistence Level (F-S): Relating self to other human selves and to his inner self is central to man at the F-S level. Unlike the E-R people, F-S man cares less for material gain or power than he does for being liked by other people. He's ready to go along with whatever everyone else thinks is best. He likes being in groups; the danger is that he gets so wrapped up in group decision-making that little work gets done.
First Being Level (G-T): The first being level is tremendously different from the earlier subsistence levels, says Graves. Here as man, in his never-ending spiral, turns to focus once again on the external world and his use of power in relation to it, the compulsiveness and anxiousness of the subsistence ways of being are gone. Here man has a basic confidence that he, through a burgeoning intellect freed of the constriction of lower level anxieties, can put the world back together again. If not today, then tomorrow. Here he becomes truly a cooperative individual and ceases being a competitive one. Here he truly sees our interdependence with all things of this universe. And here he uses the knowledge garnered through his first-ladder trek in efforts to put his world together again, systemically.
Second Being Level (H-U): People operating in an H-U fashion have been rare in Graves's studies. Almost all of Gravess subjects who so behaved have been in their late fifties and beyond. What typifies them is a peculiar paradoxical exploration of their inner world. They treat it as a new toy with which to play. But even though playing with it, they are fully aware that they will never know what their inner selves are all about. Graves says this idea is best illustrated by a poem of D. H. Lawrence, Terra Incognita.

Man Now Faces Most Difficult Transition
The present moment finds our society attempting to negotiate the most difficult, but at the same time the most exciting, transition the human race has faced to date. It is not merely a transition to a new level of existence but the start of a new movement in the symphony of human history. The future offers us, basically, three possibilities: (1) Most gruesome is the chance that we might fail to stabilize our world and, through successive catastrophes regress as far back as the Ik tribe has. (2) Only slightly less frightening is the vision of fixation in the D-Q/E-R/F-S societal complex. This might resemble George Orwell's 1984 with its tyrannic, manipulative government glossed over by a veneer of humanitarian sounding doublethink and moralistic rationalizations, and is a very real possibility in the next decade. (3) The last possibility is that we could emerge into the G-T level and proceed toward stabilizing our world so that all life can continue.
If we succeed in the last alternative, we will find ourselves in a very different world from what we know now and we will find ourselves thinking in a very different way. For one thing, we will no longer be living in a world of unbridled self-expression and self-indulgence or in a world of reverence for the individual, but in one whose rule is: Express self, but only so that all life can continue. It may well be a world which, in comparison to this one, is rather restrictive and authoritarian, but this will not be the authority of forcibly taken, God-given or self-serving power; rather it will be the authority of knowledge and necessity. The purpose of G-T man will be to bring the earth back to equilibrium so that life upon it can survive, and this involves learning to act within the limits inherent in the balance of life. We may find such vital human concerns as food and procreation falling under strict regulation, while in other respects society will be free not only from any form of compulsion but also from prejudice and bigotry. Almost certainly it will be a society in which renewable resources play a far greater role than they do today: wood, wind and tide may be used for energy; cotton and wool for clothing, and possibly even bicycles and horses for short trips. Yet while more naturalistic than the world we know today, at the same time the G-T world will be unimaginably more advanced technologically; for unlike F-S man, G-T man will have no fear of technology and will understand its consequences. He will truly know when to use it and when not to use it, rather than being bent on using it whenever possible as E-R man has done.
The psychological keynote of a society organized according to G-T thinking will be freedom from inner compulsiveness and rigidifying anxiety. G-T man, who exists today in ever increasing numbers, does not fear death, nor God, nor his fellow man. Magic and superstition hold no sway over him. He is not mystically minded, though he lives in the most mysterious of mystic universes. The G-T individual lives in a world of paradoxes. He knows that his personal life is absolutely unimportant, but because it is part of life there is nothing more important in the world. G-T man enjoys a good meal or good company when it is there, but doesn't miss it when it is not. He requires little, compared to his E-R ancestor, and gets more pleasure from simple things than F-S man thinks he (F-S man) gets. G-T man knows how to get what is necessary to his existence and doesn't not want to waste time getting what is superfluous. More than E-R man before him, he knows what power is, not to create and use it, but he also knows how limited is its usefulness. That which alone commands his unswerving loyalty, and in whose cause he is ruthless, is the continuance of life on this earth.
The G-T way of life will be so different from any that we have known up to now that its substance is very difficult to transmit. Possibly the following will help: G-T man will explode at what he does not like, but he will not be worked up or angry about it. He will get satisfaction out of doing well but will get no satisfaction from praise for having done so. Praise is anathema to him. He is egoless, but terribly concerned with the rightness of his own existence. He is detached from and unaffected by social realities, but has a very clear sense of their existence. In living his life he constantly takes into account his personal qualities, his social situation, his body, and his power, but they are of no great concern to him. They are not terribly important to him unless they are terribly important to you. He fights for himself but is not defensive. He has no anxiety or irrational doubt but he does feel fear; he seeks to do better, but is not ambitious. He will strive to achieve- but through submission, not domination. He enjoys the best of life, of sex, of friends, and comfort that is provided, but he is not dependent on them.

These are the Futurists Maps of the World. I have scoured much of the internet for quite some time now compiling these maps, and I know they are the favorite topic of my readers. This may not be all of them, but from what I found while searching the internet, this is the most you will find in one place- neatly grouped together. I hope you guys enjoy this, and check back in the future because if I find more I will add them!

Two questions came to mind when putting this together.. 1. Why are the majority of them just the USA? Is that a coincidence? ..and.. 2. Why do they all look so eerily similar?
