Colorado Springs Sued Over F the Police Arrest | Westword – Westword

You don't have to be Nostradamus to realize that Michael Sexton isn't a favorite among authorities in Colorado Springs.

For the second time this year, Sexton has sued the city and its police department for violating his constitutional rights. The first complaint, filed in January, was prompted by an incident in which he flipped off an officer. The second, put forward last week, involves Sexton's arrest over his use of the word "fuck" in phrases such as "fuck the police."

The latter exchange was captured in a video (below). At one point, an officer says, "I'm more than happy to have you stand there and yell. However, yelling the word 'fuck' like that is coarse or offensive language."

In response, Sexton asks: "Do you want to lose in court? Do you really want to take that to court and lose in court?... That will not stand up in federal court. The Supreme Court will slap that in your face. Thank you!"

The city's response to the new lawsuit, delivered via email, reads: "The Colorado Springs Police Department appreciates Westword reaching out to our organization to discuss this incident, but we are unable to speak on any matter that is under litigation."

Attorney Andrew McNulty of Denver-based Killmer, Lane & Newman, LLP, who represents Sexton in both cases against Colorado Springs, describes the arrest as "an obvious free speech violation. And it is not the first time Colorado Springs officials have arrested and maliciously prosecuted Mr. Sexton, and others, for simply criticizing them."

Sexton's YouTube channel is called Pikes Peak Auditors, and it's dominated by videos in which he records police interactions in ways that can be provocative. But as indicated by his remarks, he has a keen understanding of free speech law, which the most recent lawsuit underscores by way of an introductory passage that references 1971's Cohen v. California, in which the U.S. Supreme Court ruled that Paul Robert Cohen wasn't guilty of disturbing the peace simply for arriving at a courthouse wearing a jacket emblazoned with the phrase "Fuck the Draft."

One passage reads: "Plaintiff Michael Sexton was subjected to a humiliating arrest for simply saying the four-letter word that the Supreme Court of the United Stated held, over fifty years ago in Cohen, is protected by the First Amendment: fuck."

Also shared in the document is this excerpt from the Cohen v. California majority decision: "[T]he State has no right to cleanse public debate to the point where it is grammatically palatable to the most squeamish among us.... For, while the particular four-letter word being litigated here is perhaps more distasteful than most others of its genre, it is nevertheless often true that one man's vulgarity is another's lyric. Indeed, we think it is largely because governmental officials cannot make principled distinctions in this area that the Constitution leaves matters of taste and style so largely to the individual."

Here's the video that's key to the second lawsuit. The main action begins at the 18:40 mark and escalates over the next five-to-ten minutes.

McNulty is a veteran of unusual First Amendment challenges. He was among the attorneys who defended Free the Nipple Fort Collins in a landmark case that toppled a city ordinance that made female toplessness a crime, and last year, he took on a charge stemming from a topless Frisbee game that eventually cost Loveland $50,000.

More recently, McNulty and fellow lawyer Mari Newman sued the City of Aurora over an attack on a violin vigil in honor of the late Elijah McClain that made international headlines after police broke up the crowd using chemical agents.

Of the latest Sexton case, McNulty contends that "there is little separating authoritarian regimes and Colorado Springs when it comes to censoring individuals for criticizing the government. The First Amendment is under attack in Colorado Springs and citizens, like Mr. Sexton, who are willing to stand up for their rights are the only bulwark against Colorado Springs' repeated tyranny."

Recently, there has been a widespread movement in several counties in the Thumb where political candidate yard signs affiliated with the Democratic Party have been taken from private properties. According to many residents, the Port Austin area has been targeted. And to be fair, I have heard from Republicans that their signs are being stolen too in the Elkton area. This is unacceptable behavior by anyone involved in this taking of personal property.

These antics have been going on for years from all parties. That does not make it right. In todays political climate, where we are in serious need for more civility and courtesy, our patience and tolerance is waning.

Political signage, and in a broader sense our First Amendment right, affords all of us, right and left, freedom of speech and expression. I ask that you please be vigilant and watch out for the theft of political signs. Some property owners have gone to extreme measures to protect their signs: trail-cams, locks on flagpoles, and bringing signs in at night.

There is an all too common perception that removing a political sign from someone's private property is a matter of no legal concern. On the contrary, it is a theft. Its stealing, plain and simple. Our local peace officers have better things to do than chasing down sign thieves.

The right to endorse and promote our candidates is a large part of election campaigns. A hallmark of our rural communities is yard signs. So stop the nonsense, Huron County.

Respect your neighbors and their right to free speech. Speak up when violated and by any means necessary, vote.

Compliant Cryptocurrency Derivatives Exchanges Accounted for Only 1% of the Trading Volume of the Sector During Q2 2020 with $21.62 Billion in…

The overall performance of the nascent cryptocurrency market during Q2 2020 was not as good as it was when compared to the previous quarter.

According to Token Insight, the main reason for the relatively poor performance this past quarter may be attributed to very little fluctuation in the price of Bitcoin (BTC) and other major digital assets.

The Token Insight team pointed out in its report that the BTC and larger crypto market trading during the month of June 2020 remained sideways.

The report states that the positive market sentiment due to the Bitcoin (BTC) halving in May 2020 has now been exhausted. The report also mentions that when the money-making effect is low, the entire market is relatively quiet.

According to research conducted by Token Insight, industry participants believed that the cryptocurrency derivatives market, particularly the competition in contract-based transactions, will become more intensified in the near future.

The researchers claim that this will be due to incomplete product forms of different cryptocurrency exchanges at this particular stage. They argue that if and when similar products (for example, forward perpetual, reverse perpetual, delivery, and options) are complete, the competitive landscape will change or be broken again.

The research teams findings indicate that Tether (USDT) contracts will continue to occupy the mainstream crypto market. Because of this, crypto exchanges with leading positions in forward contracts should have more of an advantage, the researchers claim.

They noted:

The reverse contract market will continue to exist. At this stage, large positions still account for a relatively high proportion of reverse contracts, especially at the BitMEX exchange.

The transaction volume of deliverable contracts in the cryptocurrency market rose quickly during Q1 2020, the report confirmed. Huobi appears to have offered the most attractive options in this particular market segment, the Token Insight team claims.

The report also pointed out that Binance recently introduced deliverable contracts.

The report predicted:

We [believe] that more exchanges will also launch deliverable contracts in the near future. [However,] the market share of Huobi and OKExs deliverable contracts is likely to fall; Binances deliverable contracts will also occupy part of the market, while Bybit will also gain a certain market share if it launches deliverable contracts.

They added:

The leverage ratio of the overall contract market should be between 20-50 times. The use of high leverage ratio will shorten the life cycle of ordinary users. At this stage, the life cycle of contract users is about two months.

The report revealed that many crypto trading platforms have adopted a customer loss model.

It also mentioned:

After users lose money in the industry, the funds earned by exchanges, and a large part of it is actually transferred out of the industry. Therefore, high-risk, high-leverage and other irregular behaviors in the derivatives field are actually consuming the vitality of the industry and users. Exchanges have to face the problems of high customer acquisition costs and high retention costs.

The report notes that specialization is most likely the future of cryptocurrency-based derivatives trading. It claims that contract fund transactions will account for more trading volume; but at this stage, the imperfect cryptocurrency custody infrastructure will limit the development of GP and LP; and the Counterparty Risk that LPs face is also an important factor.

Crypto exchanges will be competing with each other, more than ever, when it comes to offering the best or most affordable prices, the report states.

According to TokenInsight, transaction fees remain relatively high when compared to traditional market rates. Theres a significant gap among different digital currency exchanges in API, document specification and quality, and the poor infrastructure is also a reason why many professional investors have not yet entered the crypto market, the report revealed.

During Q2 2020, TokenInsight determined that the crypto derivatives market was valued at $2.159 trillion. The estimate is reportedly based on the activity of 42 digital asset exchanges. There was a modest increase of 2.57% in the size of the emerging derivatives market during Q2 2020 when compared to the previous quarter. There was a more impressive year-on-year growth of 165.56%.

The Tory Burch Foundation Summit in early March was a gathering of some of the most prominent executives and entrepreneurs in the world.

Bank of America COO Thomas Montag former AOL CEO Steve Case, and Dina Powell McCormick, partner and member of the Management Committee at Goldman Sachs, were a few of the execs who spoke about how they sought to make their companies more inclusive.

A prominent theme throughout the conference was gender parity in the workplace.

The word ambition takes on a completely different meaning when applied to a woman than when applied to a man, Burch told Business Insider. Women are criticised for exhibiting the exact same quality men are praised for. This has to change. We do that by shining a light on unconscious gender bias, which was the focus of our Summit.

Yasmin Green, director of research and development at Jigsaw, a unit of Google parent company Alphabet, spoke about one particularly complex hurdle in modern society: the difficulty of programming artificial intelligence without bias.

The problem with training AI on humans, Green said, is that humans are biased, and when the data that feeds AI is biased, then the AI becomes biased itself.

Green detailed an experiment that demonstrated this unconscious bias in AI. She and her team created the same fake professional profile for a woman and a man and browsed online job sites as each of these imaginary people. In the end, they found that men were five times as likely to see ads for higher-paying jobs than women.

This, she said, was because women believe they must fulfil 100% of the requirements before they apply to a job, whereas men believe they only need to meet at least 60% of the requirements before they apply to the job.

So at the same skill level, we [women] are clicking on jobs that are less senior and less well paid, Green said. But if we click that way, then the internet is going to learn and thats what were going to see.

Green cited another example, in which she and her team had trained an AI model to pick up on hate speech on social media. After a few trials, their AI model began to flag the sentence, I am a proud gay man, as a hate sentence.

Green said this was because they trained the AI model by using millions of example sentences that humans wrote on the internet, and most sentences and comments that contained the word gay were negative 80% of them, in fact.

Therefore, the AI model Greens team experimented with took this data and learned to associate the term gay with something negative and hateful.

I ask myself how can I raise my daughters to make good decisions in life, [and] to be more compassionate and less prejudiced than the world around them, Green said at the conference. The question for us are we content with algorithms that reflect back to us the way the world works?

To help prevent situations like this and lessen the bias in AI, Green said social justice activism needs to be expanded to include algorithm. She also noted the importance of having diverse representation in AI programming.

Its not enough just to automate human behaviour, she said. We need to make sure that whats reflected back to us in algorithms is something thats better than we are.

Mastermind Florida teen behind Twitter hack arrested and facing 30 felony charges – 9to5Mac

It looks like the person behind the massive Twitter hack that happened two weeks ago may have been caught as a Florida teenager has been arrested for the exploit on 30 counts of felony. 17-year-old Graham Clark has been taken into custody in Tampa, Florida.

The huge Twitter hack saw major accounts like Apple, Elon Musk, Barack Obama, Bill Gates, Jeff Bezos, and more compromised and used to spread a bitcoin scam. Notably, it went on for hours as Twitter scrambled to find a way to stop the exploit. Eventually, the platform blocked verified accounts from tweeting.

Today, reported by local News Channel 8 in Tampa, 17-year-old Graham Clark has been accused of the serious hack and arrested with a total of 30 felony charges. Those include organized fraud, communications fraud, fraudulent use of personal information, and more.

Hillsborough State Attorney Andrew Warren filed 30 felony charges against the teen this week for scamming people across America in connection with the Twitter hack that happened on July 15. The charges hes facing include one count of organized fraud, 17 counts of communications fraud, one count of fraudulent use of personal information with over $100,000 or 30 or more victims, 10 counts of fraudulent use of personal information and one count of access to computer or electronic device without authority.

California and Florida along with the FBI, IRS, as well as Secret Service worked to investigate the crimes before making the arrest today.

They worked quickly to investigate and identify the perpetrator of a sophisticated and extensive fraud, State Attorney Warren said in his statement.

Two others have also been charged in the crimes including a 19-year-old from the UK and a 22-year-old from Florida.

According to the U.S. Attorneys Office in the Northern District of California, Clark is one of three people charged for their alleged roles in the Twitter hack. The two other suspects were identified as 22-year-old Nima Fazeli, a.k.a. Rolex, of Orlando and 19-year-old Mason Sheppard, a.k.a. Chaewon, of the United Kingdom.

Twitter also shared an update on its blog about the hack that used an elaborate social engineering approach worked. 130 accounts were attacked with 45 being tweeted from during the exploit and DMs of 36 compromised accounts were accessed.

The social engineering that occurred on July 15, 2020, targeted a small number of employees through a phone spear phishing attack. A successful attack required the attackers to obtain access to both our internal network as well as specific employee credentials that granted them access to our internal support tools. Not all of the employees that were initially targeted had permissions to use account management tools, but the attackers used their credentials to access our internal systems and gain information about our processes. This knowledge then enabled them to target additional employees who did have access to our account support tools. Using the credentials of employees with access to these tools, the attackers targeted 130 Twitter accounts, ultimately Tweeting from 45, accessing the DM inbox of 36, and downloading the Twitter Data of 7.

Twitter also detailed how its changed its policies since the attack to better protect users:

Since the attack, weve significantly limited access to our internal tools and systems to ensure ongoing account security while we complete our investigation. As a result, some features (namely, accessing theYour Twitter Datadownload feature) and processes have been impacted. We will be slower to respond to account support needs, reported Tweets, and applications to our developer platform. Were sorry for any delays this causes, but we believe its a necessary precaution as we make durable changes to our processes and tooling as a result of this incident. We will gradually resume our normal response times when were confident its safe to do so. Thank you for your patience as we work through this.

Satellite Office Supports Joint Research with Technical University of Munich (TUM)

NTT Research, Inc., a division of NTT (TYO:9432), today announced that it has opened an office in Munich, in support of a joint research agreement it entered with the Technical University of Munich (TUM) in November 2019. The joint research agreement associates the NTT Researchs Medical and Health Informatics (MEI) Lab with the Neuroelectronics Group within TUMs Munich School of BioEngineering. Leading the Munich office is Dr. Tetsuhiko Teshima, an expert in nanomaterials who holds the dual titles of Research Scientist in the MEI Lab and Visiting Researcher in TUMs Neuroelectronics Group.

The MEI Labs two primary fields of research involve the bio digital twin initiative and nanosensor technology. Collaboration with TUMs Neuroelectronics Group involves the latter, in particular, three-dimensionally transformable and implantable electrodes. The scope for this multi-year research project includes screening and optimizing functional materials, assembling 3D structures and evaluating their biocompatibility. The MEI Lab office in Munich, located on Otl-Aicher Strasse, is a few kilometers northwest of the Englischer Garten, between the city center and TUM to the north. The office is another sign of NTT Researchs commitment to this venture, as well as to expanding its presence beyond Silicon Valley.

At TUM, Dr. Teshima is on the scientific staff of the Neuroelectronics Group, which is led by Dr. Bernard Wolfrum, Professor of Neuroelectronics at TUM in the Department of Electrical and Computer Engineering and the Munich School of BioEngineering (MSB). Dr. Wolfrums research focuses on neuro- and bioelectronics. Dr. Teshima, who began his three-year appointment to the MEI Lab on March 1, 2020, has conducted research on bio-interfaces, soft matter and other areas that overlap with specialties of the Neuroelectronics Group. His plan in Munich is first to study conductive and biocompatible materials, new printing techniques and the electrochemical measurement of the developed electrodes; then to develop new types of nanomaterial based sensors that can work inside the body; and finally to obtain data from the targeted tissues using these new sensors and work with NTT Research data scientists to develop automated predictive and diagnostic tools.

The first project that Dr. Teshima is engaged in evolves adding "transformability," or the ability to change dimensions, to conventional electrodes. Related work in this area includes the questions of which stimuli can generate shape transformation and what changes in electrical or electro-chemical properties are associated with electrode transformation.

In contrast to hard, 2D and brittle electrodes, semiconductors and sensors that are widely available today, Dr. Teshima anticipates a paradigm shift. "I believe that some types of soft, flexible and transformable products will be commercially available, especially in medical fields in the next five years," he noted in an interview on the NTT Research blog. "By working with the wonderful team at TUM, I hope to provide findings or engineering breakthroughs that can contribute to or accelerate this scientific and industrial trend."
