Office of the Comptroller of the Currency Affirms Authority of a National Bank to Provide Cryptocurrency Custody Services – JD Supra

The Office of the Comptroller of the Currency (OCC) recently signaled its approval for banks to fully wade into the cryptocurrency custodian space. On in a July 22, 2020 interpretive letter, the OCC concluded that a national bank may provide cryptocurrency custody services on behalf of its customers, including by holding the unique cryptographic keys associated with cryptocurrency, so long as the institution is able to effectively manage the risks and complies with applicable law.

In the letter, the OCC recognized a growing demand for banks to hold unique cryptographic keys associated with cryptocurrencies on behalf of customers and to provide related custody services. The demand is driven by the need for secure custody of cryptographic keys, which are irreplaceable and loss of the key is essentially loss of the cryptocurrency assets themselves. Existing cryptocurrency exchanges that currently offer custodial services have proven vulnerable to hacking and theft. The OCC also recognized a benefit to permitting investment advisers that manage cryptocurrencies on behalf of their clients to use national banks as custodians for the managed assets.

The OCC highlighted several key differences between providing custody for cryptocurrencies as opposed to other assets. First, because digital currencies exist only on the blockchain or distributed ledger on which they are stored, there is no physical possession of the asset; rather, ownership of a particular unit of digital currency is transferred from party to party by the use of unique cryptographic keys. As such, a bank holding digital currencies on behalf of a customer would take possession of the cryptographic asset keys and maintain them in a wallet that shields the key from discovery by a third party. Second, bank custody of digital assets also implicates the distinction between non-fiduciary and fiduciary custodians. Non-fiduciary custodians, including many existing cryptocurrency exchanges, simply provide safekeeping services that allow for control and transfer of the asset. In contrast, a bank holding assets in a fiduciary capacity (e.g., as a trustee, an executor or administrator of an estate, a receiver, or an investment advisor) is subject to heightened standards of care.

A bank engaging in new activities, such as custody of cryptocurrency assets, should develop and implement those activities through the lens of a comprehensive risk assessment. A number of factors make cryptocurrency custodial services a high risk activity, including cryptocurrencys particular susceptibility to cyberattack, its attractiveness to money launderers, and its unique, nonfungible value. In addition, Banks will need to establish specialized audit procedures to ensure the effectiveness of their controls for digital custody activities and compliance with all applicable laws. Finally, would-be digital custodians will have to strictly assess the risks associated with each individual cryptocurrency account, before opening. The custodian will have to demonstrate its capacity to meeting all required initial and ongoing diligence obligations associated with such accounts, including the Bank Secrecy Act, 31 U.S.C. 5311, et seq., and anti-money laundering considerations, information security, and the banking institutions own knowledge of the different cryptocurrencies and their individual characteristics.

They also mean all amateur football matches, five-a-sides and even training sessions are banned.

The confusing new rules have been greeted with disbelief.

Harry Price, 32, a customer service worker from Altrincham, Greater Manchester, said: This is yet more madness.

Im not allowed to have my girlfriend stay over but I can book in with her in a hotel where Ill bump into dozens of strangers.

It will be good business for the hotels but it is completely baffling.

I can go to the pub but I cant go to a friends house.

These rules dont make any sense, I dont know how they expect us to follow them.

Technically I can still jet off on holiday but Ill be fined 100 if I set foot in my mums garden.

Ministers say the new restrictions could be applied to any part of England where the virus soars.

Yesterdays official figures showed the average daily number of infections has topped 800 for the first time in a month.

From midnight last night, anyone found flouting the new rules in the restricted areas could be fined 100 and up to a maximum of 3,200 for repeat offences.

Police have been given the legal right to use force to break up gatherings.

The only exemptions to the ban is for any two households who have linked to form a support bubble.

But last night several councils in Lancashire and Greater Manchester wrote to amateur clubs banning all football activity on council-owned land. It is understood to include kickabouts in the park.

The rules announced by Health Secretary Matt Hancock are called The Health Protection (Coronavirus, Restrictions on Gatherings) (North of England) Regulations.

They state people must not meet:

The regulations say: No person may participate in a gathering in the protected area which consists of two or more persons and takes place in a private dwelling, including a houseboat.

It adds: There is a gathering when two or more people are present together in the same place in order to engage in any form of social interaction, or to undertake any other activity with each other.

From August 5, if you live in the protected area, which includes Greater Manchester and parts of Lancashire and West Yorkshire, its now a criminal offence to have sex in a private dwelling with someone not from your household. You cant even travel outside the protected area to do it.

This may sound bizarre but its true.

All gatherings, defined as two or more people present together in the same place in order to engage in any form of social interaction with each other, taking place in a private dwelling, are banned.

And that includes gatherings for sex.

There are some exceptions. If you are in the same household, a linked household, or are having sex for work, education and training, to provide emergency assistance or a charitable service (insert your own gag), youre safe.

And if you pay for a hotel or B&B to do it in, thats fine too. Otherwise, you may face a very unromantic fine or even a criminal charge.

Imagine texting a message and having it blocked because an agent hired by your provider has determined that it is racist, homophobic, anti-feminist, too political, or just improper. But thats the way Facebook and Googlenow work with messages transmitted by their members. Countless members of Facebook have been punished and temporarily or even permanently barred for the contents of their communications. Joe Biden has gotten into the act by sending multiple letters to Facebook attacking the company for policies that allow politicians, Trump specifically, to freely make false claims on its site. If he becomes president, will he follow through with legislation banning what he considers false messages on any and all platforms?

The dangerous reality of asociety in which the expression of a certain opinion is turned into a crime has already been seen across Europe. Dutch citizens were reportedly visited by police and warned about posting anti-mass immigration sentiments on social posts. It can happen here. The sinister thing about what Facebook is now doing is that it is now removing speech that many may consider racist, along with speech that only some worker at Facebook decides is racist. Censorship is growing within these huge messaging platforms. What, if in the near future, racist speech appears to include anything critical of a black, brown or person of color, religion,politician, sports figure or any other media star? And that decision is made by a corporation controlling the messaging? Censorship?

Mark Zuckerberg, in recent Congressional hearings stated that his company aims to allow as much free expression as possible unless it causes imminent risk of specific harms or damage. We believe in values democracy, competition, inclusion and free expression. But he hires censors to go through our messages and are the judges and juries to determine if they are harmful to society. This doesnt sound right.

Rather than initiating and participating in violence, speech is one of the best ways for people to vent their feelings, anger, fear hate or frustrations. Put it down in words, rather than in hurtful physical actions. If the right to speak out about ones displeasures is banned, only violence is left. Free speech is at stake here. Every single dictatorship in recent memory Nazi Germany, Stalinist Russia, Castros Cuba, were all replete with hate-speech laws that were intended to limit free speech that the state disapproved of.

Extremism still grew and flourished. We cannot tolerate such a situation here in America. We stand for the freedom of expression, the right to speak out. Let society either accept, condemn or ignore what you say. But you have the right to voice your opinion without being censored, banished or punished. And corporations should not have the right to determine what is hate, racist or xenophobic speech. Were treading in dangerous waters.

The GreatFire AppMaker is meant to allow third parties blocked in mainland China to build apps that will bypass those restrictions.

According to the announcement, one such organization, the Human Rights Foundation (HRF) has already made use of the GreatFire AppMaker to create its own app. This means that while the website of this group dedicated to human rights and freedoms remains inaccessible to users in China, they can now see that content by installing the app built using the GreatFire AppMaker.

GreatFire which says it has in the past directed Chinese internet users more than 13 million times to censored news stories about government corruption, politics, scandals and other sensitive issues explained how organizations, media outlets, and individual bloggers can make use of the new tool free of charge.

They are invited to visit the GreatFire AppMakers website and compile their app following a number of steps, such as naming it, providing the homepage of the website it will draw content from, etc. The app will be branded both with theirs and GreatFires logo and downloadable as an APK file.

The organization said that it appeared on the scene in 2014 with the support and funding of the Open Technology Fund (OTF), including to develop AppleCensorship.com, which is tracking Apples censorship of app stores around the world, including Hong Kong.

Quantum computing continues to advance and a computer has managed to simulate a journey back in time to dismantle the theory of the butterfly effect.

If you go back in time dont touch anything, any change could be catastrophic We all know similar phrases from movies and books, but is it true? At Los Alamos National Laboratory, in the United States, have tried to test this thesis and the results obtained deny this widespread belief.

Using a quantum computer, they conducted an experiment to test the so-called butterfly effect and how changes in the past affect the present. To make it simulated the conditions of time travel thanks to the IBM-Q quantum processor and they sent a damaged set of qubits with the intention of seeing if that information returned in the same state to the present and how it altered it.

The results obtained have been that only part of that data has been returned damaged, most qubits were intact, the so-called butterfly effect had not occurred, which should affect much of that information.

IBM has just announced a new milestone within the quantum computing industry: They have created the most powerful quantum computer yet, capable of operating at 53 qubits.

On average respondents indicated that two (median) of the activities make up on important part of their role. The entire list of activities (shown in Figure 1) were:

The The top work activity was somewhat practical in nature, helping the company improve how it runs the business: analyzing data to influence products and decisions. The work activity with the lowest endorsement was more theoretical in nature: doing research that advances the state of the art of machine learning.

Next, I examined if there were differences across different data roles (as indicated by respondents job title) with respect to work activities. I looked at 5 different job title for this analysis. The results revealed a couple of interesting findings (See Figure 2):

First, respondents who self-identified as Data Scientists, on average, indicated that they are involved in 3 (median) activities at work compared to the other respondents who are involved in 2 job activities.

Second, we see that the profile of work activities varies greatly across different data roles. While many of the respondents indicated that analysis and understanding of data to influence products/decisions was the top activity for them, a top activity for Research Scientists was doing research that advances the state of the art of machine learning. Additionally, the top activity for Data Engineers was building and/or running the data infrastructure.

The top work activity for data professional roles appears to be very practical and necessary to run day-to-day business operations. These top work activities included influencing business decisions, building prototypes to expand machine learning to new areas and improving ML models. The bottom activity was more about long-term understanding of machine learning reflected in conducting research to advance the state of the art of machine learning.

Different data roles possess different activity profiles. Top work activities tend to be associated with the skill sets of different data roles. Building/Running data infrastructure was the top activity for Data Engineers; doing research to advance the field of machine learning was a top activity for Research Scientists.These results are not surprising as we know that different data professionals have different skill sets. In prior research, I found that data professionals who self-identified as Researchers have a strong math/statistics/research skill set. Developers, on the other hand, have strong programming/technology skills. And data professionals who were Domain Experts have strong business-domain knowledge. Data science and machine learning work really is a team sport. Getting data teams with members who have complementary skill sets will likely improve the success rate of data science projects.

Remember that data professionals have their unique skill set that makes them a better fit for some data roles than others.When applying for data-related positions, it might be useful to look at the type of work activities for which you have experience (or are competent) and apply for the positions with corresponding job titles. For example, if you are proficient in running a data infrastructure, you might consider focusing on Data Engineer jobs. If you have a strong skill set related to research and statistics, you might be more likely to get a call back when applying for Research Scientist positions.

How Artificial Intelligence is Helping to Fight against Coronavirus in India? – Analytics Insight

With the number of COVID-19 cases crossing 18 million mark, the healthcare system across the globe has suffered a major blow against the management of COVID-19. In India, COVID-19 has proved challenging initially for identifying the COVID patients and diagnosing the disease. However, the use of Artificial Intelligence (AI) over the past few years, has rendered the Healthline workers and the government for solutions, to stall this roadblock.

Artificial Intelligence uses the technology of powerful algorithms which then processes the data, thus identifying patterns. Thus, for any Artificial Intelligence to be successful, big data is necessary.

Across the globe, as Polymerase Chain Reaction (PCR) is expensive and time-consuming, Chest X-rays are now used as a standardized procedure for the diagnosis of COVID-19. However, a simple chest X-ray cannot distinguish the disease and the extent of infection affecting the lungs.

Artificial Intelligence, in collaboration with Chest X-rays, helps in identifying the abnormal findings, thus diagnosing the ground glass opacities in the lungs, which is a classic feature of the COVID-19 disease. Many companies such asQure.ai, a Mumbai based start-up, andTata consultancy serviceshave used AI in a chest X-ray for the diagnosis of COVID-19. The AI developed by Qure.ai also helps in identifying the extent of infection affecting the lungs. This is usually valuable for patients who remain in the Intensive Care Unit (ICU).

In April, Apple and Google, the two big tech giants, colluded for developing a contact-based app to trace COVID-19 patients. The app works on Bluetooth and has been mostly used in western countries. In India, the government ruled out a similar strategy by developing the Aarogya Setu app.

In June, India told the UN, that drones and contact tracing apps have helped India in managing COVID cases. The app employs Bluetooth and location data to let the user know of any suspected COVID-19 patients nearby. This app is developed in 12 languages and has a user database of more than 10 million people.

Other mobile applications such as GoCoronaGo and Sampark-o-meter have also been developed for contact tracing by the Indian Institute of Science (IISc), Bangalore and IITs.

In Odisha, the state health department co-operated with the IT industry for developing drones which were proven helpful in checking infringement of rules in containment zones.

Apart from using the Aarogya Setu app, for contact tracing, many states have exercised AI to identify people who are mask violators with the help of AI cameras.

InTelangana, due to a surge in the COVID cases, the police department has come up with installing a software tool in the CCTV cameras to identify the mask violators. After identifying it sends a notification to the police headquarters, which in turn sends the update to the patrolling police team.

This model is similar to the AI model developed by China for tracking mask violators. This kind of AI technology is initially installed in Hyderabad, Cyberabad, and Rachakonda.

During the progression of the coronavirus, AI has facilitated manual repurposing of drugs to treat COVID-19. Indraprastha Institute of Information Technology (IIIT) has developed an AI model that can repurpose medicines according to the highest success probability against the disease, instead of going through the entire process manually.

Tata Consultancy Services is also using AI technology to crunch down the large molecule of drugs into highly effective molecules against the disease, thus reducing the time duration of the process.

Besides this, AI has proven effective in providing Tele-medicines and Tele-consultation, online consultation with health experts concerning a particular disease. In many states, likeChhattisgarh, AI is proven as a success by online training of the medics for controlling the COVID-19 pandemic.

In Kerala, Robots are used fordelivering hand sanitizersand delivering public health messages at the entrance of the office buildings and in isolation wards, to combat COVID-19.

The IIT and Stanford Alumni have also come up with a solution fordisinfecting public spaces. They have developed a machine called Robo Sapien, which controls the spread of the virus by ionizing the corona discharge.

Many start-ups are nowusing AIto come with solutions against the spread of COVID-19.
