This analysis of the role of open source in APIs is written by Postman CEO Abhinav Asthana with offices in Bangalore, Austin and San Francisco, Postman aims to simplify API development with its industry-standard API Development Environment.

Postman has more than four million users growing from a simple REST client in 2012, Postman now helps developers do everything from design, testing, mocking to monitoring and publishing in a real-time collaborative environment.

The open source software (OSS) movement has forever shifted how the world develops applications. The movements central idea is that source code is made freely available, which means you can modify it at will. This enables you to build upon the hard work of others as you create your own app. This, in turn, opens up the possibility of contributing back to an original codebase that expands the value of software to the entire community. Through open source, developers now easily access the building blocks they need to deliver modern applications and that has led to someastounding success for OSS.

The Application Programming Interface (API) world can learn a lot from the OSS movements successful commitment to collaboration because historically, the world of APIs has not been open enough and that has hindered innovation and progress. Heres why the time to address that is now.

The growth of APIs is skyrocketing; every piece of software built today either uses an API or is an API. Amidst all of this API growth, top cloud providers like AWS, Microsoft Azure and Google have acted as massive centralising hubs of technology that primarily consist of APIs. This has laid the foundation for consecutive waves of countless software-as-a-service (SaaS)offerings and other companies who all deliver and consume APIs as part of their regular operations and integrations.

This means that APIs are going to stick around for quite some time, so we need to develop a basic set of rules to help guide, open and stabilise the wider API software ecosystem. We all need to ensure that our shared digital ecosystem has the right foundation. If we work together to develop common and open API principles, then APIs can realise their full potential and help us all deliver on the future we envision for our industries. Well be able to do our best as independent businesses, while also sharing specifications, code and other common blueprints that benefit the whole.

All of this shows why now is a pivotal time to study and apply open source learnings to what the world is doing with APIs. By combining the core philosophies and patterns of OSS with what weve learned from the last 20 years of software development, we can build a future that benefits everyone through APIs.

APIs allow applications to connect to each other. They allow data to go from one place to another. That is all made possible using fundamental code that should be available for use by all developers and companies to build on.

Asthana: a: API are gateways, lets stay open.

Any restrictions that limit the access and reimplementation of the API pipes we all depend on will hinder developer productivity across industries.

APIs should always allow easy access to data and people consuming the API should be able to take data out in the shape and form they want and be able to reimplement as they see fit, as long as it is in accordance with the open source licensing.

This type of reciprocity is extremely valuable. Just look at how APIs are making data sets available for the COVID-19 fight. The use of established guidelines and open data formats is ensuring data interoperability amongst scientists and healthcare providers as they address the pandemic. The open source philosophy works for the greater good by powering businesses of all shapes and sizes rather than a single proprietary format that is dictated by a few.

Another aspect of open source that developers and companies should examine involves striking a balance between data accessibility and privacy guidelines in APIs. For example, lets say Im accessing my data from an API. While I should have complete control and visibility over it, somebody else accessing my data through the same API should have limited capabilities. This protects the end users data rights and personal privacy.

Open source software is all about lowering barriers and making it easier for developers to meet their goals. While there should be common agreed-upon business rules in place, if developers want to send a million records over the wire for an API call, they should be able to easily redesign their API using open source components that allow for batched access to API data without onerous controls.

This makes for a better API while still respecting the personal rights and privacy of end users.

More and more, were seeing OSS-based themes at the highest levels of business. Industry groups are emerging to look at how data should flow between different entities. All of this increases the value for API providers to be more consistent with well-known APIs, while also making the lives of those consuming APIs much easier.

Los Alamos National Laboratory technologies brought in eight R&D 100 Awards and Special Recognition Awards, including a Gold Award for Corporate Social Responsibility, Gold and Silver Awards for Market Disruptor Services, and a Bronze Award for Green Technology, presented ByR&D Worldmagazine.

Amanzi-ATSThe open-source software models complex environmental systems across multiple scales. The innovation includes the most complete suite of surface/subsurface processes, built on a flexible infrastructure that allows users to select physical processes and their coupling interactions without rewriting software. AmanziATS has been used to analyze pristine local watersheds, wildfire impact on watersheds, subsurface contaminant transport at legacy waste sites, the effect of a warming climate on the Arctic tundra, and groundwater in fractured porous media.

Los Alamos led the joint entry with Oak Ridge National Laboratory, Lawrence Berkeley National Laboratory, and Pacific National Laboratory. Cluster Integrity, Exception Resolution, and Reclustering Algorithm (CIERRA)CIERRA is the first and only software that assesses massive amounts of data from real-time satellite lightning observation and reprocesses that data to ensure an accurate, comprehensive interpretation of the lightning flashes. This enables observation and analysis of previously unstudied, complex cases of extreme and exceptional lightning and provides situational awareness of lightning hazards.

Michael Peterson teamed with Scott Rudlosky (University of Maryland). CIERRA also received a Gold Special Recognition Award for Market Disruptor-Services, which highlights any service from any category as one that forever changed the R&D industry or a particular vertical within the industry.

Legion: A data-centric programming systemLegion is a supercomputing programming system that boosts application performance and speed by automating task scheduling and data movement. The open-source software employs a novel programming language, Regent, which is compatible with all supercomputing architectures. Legion reduces the effort required to write supercomputing applications, eliminating the bottleneck to next-generation exascale computing and enabling the highest levels of performance. Legion is now being applied in computational science, machine learning, and data-centric computing.

Los Alamos led the joint entry with Stanford University, NVIDIA, Sandia National Laboratories, University of California-Davis, and SLAC National Accelerator Laboratory. Galen Shipman and Patrick McCormick directed the Los Alamos research team of Jonathan Graham, Irina Demeshko, Nirmal Prajapati, and Wei Wu.

Multi-Burn Solid RocketSolid rockets are high thrust, safe, scalable, and can be stored for long periods. However, they traditionally only provide a single burn per motor. The Multi-burn Solid Rocket is a revolutionary system providing multiple independent thrusts from a single solid rocket.This new capability could provide agile maneuverability for even the smallest and lowest cost satellites.The Earths orbital zones are an important natural resource.The Multi-burn Solid Rocket could help protect this resource by enabling satellites to avoid orbital debris and to de-orbit at the end of life.

QUIC-FireThe software is the first fast-running, laptop-capable, 3D fire-atmosphere feedback model for complex wildfire and prescribed fire scenarios. It simulates critical influences of 3D vegetation structure, variable winds, interaction between multiple fires, and complex topography at meter-scale spatial resolutions. QUIC-Fire transforms fire and fuel managers ability to assess risk, optimize fuel treatments, and plan prescribed burns to prevent catastrophic wildfires.

Rodman Linn of Los Alamos, Scott Goodrick of the USDA Forest Service, and J. Kevin Hiers of Tall Timbers Research Station led the team of Los Alamos researchers Sara Brambilla, Michael Brown, Alexandra Jonko, Alexander Josephson, Richard Middleton, and David Robinson plus collaborators from the USDA Forest Service.

In addition to the R&D 100 Award, Quick-Fire won a Gold Medal in the Corporate Social Responsibility Category. This award honors organizational efforts to be a greater corporate member of society, from a local to global level.

Smart Microbial Cell Technology Biocatalysts are essential for food production, pharmaceuticals, specialty chemicals, renewable energy, and environmental cleanup. Current methods to find biocatalysts are slow. Smart Microbial Cell Technology scans genetic variations to optimize a single enzyme or microbial cell to generate a product efficiently. It selects rare mutations needed for biocatalyst optimization orders of magnitude faster than current screening methods. A custom sensor reporter gene circuit causes cells to fluoresce when they are making the target product. When coupled to flow cytometry, a million biocatalyst variants can be screened in hours.Ramesh Jha led the team of Taraka Dale and Charlie Strauss.

Spectroscopic Detection of Nerve Agents (SEDONA)Current airport detection system cannot scan for the threat of toxic organophosphorus nerve agents and insecticides. The SEDONA portable system screensthrough an unopened bottle using the principles of nuclear magnetic resonance spectroscopy. The system could be deployed and operated with minimal training. SEDONA dramatically reduces the likelihood of a successful nerve agent attack at airports, government buildings, embassies, sporting events, concerts, and political rallies.

Robert F. Williams led the team of Michelle Espy, Jacob Yoder, Derrick Kaseman, Per Magnelind, Algis Urbaitis, Michael Janicke, Ryszard Michalczyk, Jurgen Schmidt, Pulak Nath, and Scarlett Widgeon Paisner.

Additional Recognition The Laboratory also received a Bronze Medal for Green Technology. The awards recognize those innovations that help make our environment greener and our goal towards energy reduction closer.

Oleo-Furan Surfactants Made from Renewable BiomassOleo-furan surfactants (OFS) is a new class of non-toxic, non-irritating cleaning agents (surfactants) for laundry detergent. It is the only surfactant that performs effectively in cold water and in hard water, without additional chemicals that other detergents must use to bind the minerals in hard water. OFS can be produced readily from sustainable, bioderived molecules that dont tax the environment or compete with the food supply chain.

Electrochemical Hydrogen Contamination Detectorprotects zero-emission fuel cells by detecting the presence of impurities in hydrogen fuel. Fuel cells power environmentally clean vehicles, forklifts, drones, and provide auxiliary power.High-purity hydrogen is essential to avoid poisoning fuel cells. Current analysis methods are costly and cannot detect impurities in real-time. The Hydrogen Contamination Detector measures some of the highest impact Department of Energy-identified impurities with a simple, low-cost unit that provides 24/7, point-of-service analysis.

Nextcloud 20: One private cloud to rule them all – ZDNet

I've long recommended Nextcloud as a wonderful open-source, private Infrastructure-as-a-Service (IaaS) cloud. I run it myself both on a server in my office and on my TMDHosting remote server. Over time, though, Nextcloud has been adding more features. These include built-in video-conferencing and group meeting services. Nextcloud Talk and Software-as-a-Service (SaaS) version of the LibreOffice office suite,Collabora. Now, with Nextcloud 20, other third-party services such asMicrosoft Teams,Slack,Jira, GitHub, Twitter, and dozens of others are being integrated.

As Frank Karlitschek, Nextcloud's CEO and founder, explained, "Nextcloud Hub 20 is a dramatic step for users, bringing the different platforms they use during the day into an integrated experience. This can reduce friction, improve reaction times, avoid context switching and ultimately bring greater productivity to our tens of millions of users across the globe -- all the while protecting data security and digital sovereignty of private and enterprise users."

It adds on to its existing strengths by using an open application programming interface (API), the Open Collaboration Services (OCS). This is a long, established API. Started as part of KDE's open desktop standardization effort in 2009, OCS now handles basic file functionality like file access, sharing, versioning, and commenting. It also covers communications, calendaring, and task management.

Nextcloud is using it to bridge the gap between its own Talk chat service with other communications services, besides the ones mentioned earlier, such as Matrix, IRC, XMPP, and many others. More IM services, such as HipChat and Telegram, are in the works.

It's also using it to glue together Nextcloud's integrated, unified search with ticketing systems such as Jira and Zammad, development platforms like GitHub and Gitlab, e-learning systems like Moodle, forums like Discourse and Reddit, and social media platforms such as Twitter and Mastodon.

It also comes with a new user status. With this, you can not let your co-workers know when you're available, or, if you like, you can let them know what you're working on at any given moment.

You can also search across the entire Nextcloud platform, instead of being application-specific. Yes, that means you can search over all your files and programs' data. You can also extend the search to other apps. So far, Nextcloud's developers have extended it over the Github and Gitlab coding platforms, the Zammad and Jira helpdesk tools, Discourse forums, and the Moodle e-learning system.

Under the hood, Nextcloud Talk 10 brings performance and call reliability improvements. This includes an emoji picker and upload view, better camera and microphone settings, mute abilities for moderators, and more.

Nextcloud Mail has also been improved. It now includes extensive mailbox management features such as threaded email views and other interface updates.

In the Nextcloud back-end, numerous performance and security improvements were made to make the Nextloud interface more responsive. It's Lightweight Directory Access Protocol. (LDAP) back-ends have also been tuned up.

To make the most from all these features still requires an expert administrator. Nextcloud is a do-it-yourself platform in many ways. For example, you'll need to manually activate many of the new functions before users can put them to work.

Still, the basic IaaS and SaaS functionality are already there and ready to run for anyone. The other features may take some time and effort, but in the end, you'll have an open-source private cloud workspace that you can use with popular public services and your own in-house storage and services.

Michelle Borkin, an assistant professor in the Khoury College of Computer Sciences at Northeastern University, and her doctoral student, Laura South, have a new way to answer these questions and distill the often unwieldy debates into coherent, easy-to-access information: an online tool called DebateVis.

The project was created by an interdisciplinary team of researchers at Northeastern following a two-year-long study of argument structure and text summarizationthe process of creating short, accurate, and fluent summaries of longer text documents.

Rather than repeating soundbites and Twitter hot-takes, DebateVis downloads the entire debate and mines it for relevant information to help voters compare the candidates on a substantive level.

The tools website displays three sections. In the middle, visitors can scroll through a full transcript of the debate. On the left, they can track the number of times each candidate mentions a topic or the name of an opponent. To the right, a timeline shows when the different topics came up for discussion. When readers click on a topic, such as climate change or education, the tool directs them to the relevant sections of the transcript. Audience reactions are also marked.

Borkin and South initially rolled out the website for the 2016 debates. Theyve re-launched the site for this years debates ahead of the Nov. 3 election.

With the elections coming up, we felt it was really important to educate the public and to have tools out there to make information accessible and clear, Borkin says.

During the first presidential debate on Sept. 29, the researchers paid close attention to topics and interactions. Later that evening, using a Python scriptan open-source programming languageSouth created visualizations for DebateVis by picking out the topics from a transcript.

Their findings confirmed what many viewers had witnessed: The much-anticipated face-off between the contenders was largely devoid of substance.

One of the main takeaways I got from looking at our visualization of the debate is just how little debating there was [last] Tuesday, says Borkin. Much of our algorithm lay quiet because so much of the evening did not include substantive conversations and arguments about policy, but rather petty conversations with no substance.

South says that for the casual time-constrained viewer looking for recaps of debates, DebateVis offers a visual alternative to soundbites. Andthe visualizations may offer political junkies broader policy insights about the candidates.

Someone who was able to watch the debate and is active and interested in keeping up with the political debates still might not be able to fully analyze the higher level patterns that are occurring, she says. Its hard to see recurring patterns when youre just sitting and watching it from start to finish.

After the election, the team of researchers (which includes Michail Schwab, Lu Wang, Nick Beauchamp, John Wihbey and Aleszu Bajak) plans to evaluate the kind of impact the website had and examine how much of a difference it made.

Creating an informed citizenry is the researchers ultimate goal, says Borkin. The data visualizations are meant to equip citizens with the tools and knowledge they need to make informed decisions on issues and candidates.

Initially it was how do we visualize the debate? But once we got into thinking about this, it was we want an informed electorate, she says. This is just our little tiny contribution to that.

South says more action needs to be taken to make data visualization accessible and useful for people who historically have been marginalized or kept out of positions of power.

I view visualization as a tool for democratization in some ways, she says. I think that it has the potential to give at least some power back to the people who maybe would be otherwise very distanced from this data that is about their lives and impacting their lives.

Lydia partners with Tink to improve open banking features – TechCrunch

French fintech startup Lydia is going to work with financial API startup Tink for its open banking features in its app. Lydia started as a peer-to-peer payment app and now has 4 million users in Europe.

Lydias vision has evolved to become a financial super app that lets you control your bank accounts and access various financial services. In France, you can connect your Lydia account with your bank account using Budget Insights Budgea API.

Over the coming weeks, Lydia is going to switch over and use Tink for some clients going forward. If you have a bank account that works better with Budget Insight, Lydia will keep using Budget Insight for those accounts. If Tink is a better option, Lydia will use Tink.

Its going to be a progressive rollout and well use the best service depending on our users, Lydia co-founder and CEO Cyril Chiche told me.

Open banking is a broad concept and covers many different things. In Lydias case, were talking about two features in particular account aggregation and payment initiation.

In the app, you can connect your bank accounts and view the most recent transactions. This feature is important if you want to become the go-to financial app on your users home screen.

As for payment initiation, as the name suggests, it lets you start a SEPA bank transfer from a third-party service. For instance, you can transfer money from your bank account to your Lydia wallet directly in the Lydia app. You also can move money between multiple bank accounts from Lydia.

Tink provides a single API that manages all the complexities of the information systems of European banks. An API is a programming interface that lets two different services talk and interact with each other. Tink does the heavy lifting and translates each banking API into a predictable API that you can use for all banks.

Since 2018, banks have to provide some kind of API due to Europes DSP2 regulation. Its been a slow start, as many French banks still dont provide a usable API. But its slowly evolving.

Tinks API supports 15 financial institutions in France, including major banks, N26, Revolut and American Express. And it covers a dozen European markets, which is going to be important if Lydia wants to grab more users outside of its home country.

At first, its not going to add new things to the app. But it will allow us to provide features in a very stable environment and at a European scale, Chiche said.

We want to have the most uniform product across different markets, he added later in the conversation.

When you first install Lydia and want to pay back a friend, you associate your debit card with your Lydia account. The startup charges your card before sending money to your friend.

If open banking APIs become the norm, you could imagine grabbing money from someones bank account directly instead of paying card processing fees. But this sort of feature is nowhere near ready for prime time.

What made us choose card payments is that its a stable system with widespread usage and it works every time. When youre dealing with payments, it has to work every single time, Chiche said.

Lydia isnt changing anything on this front for now. But you could imagine some changes in a few years. We are the beginning of a new system that is not going to be ready within the next 18 months, Chiche said.

Cards also provide many advantages, such as the ability to chargeback a card. And card schemes have been trying new things, such as the ability to transfer money directly from a card to another card. So youre not going to ditch your Mastercard or Visa card anytime soon. But Chiche thinks there will be some competition in Europe between DSP2-ready banks and card schemes. European consumers should see the benefits of increased competition.

In other news, Lydia usage dropped quite drastically during the full lockdown earlier this year. But transaction volume has bounced back since then and reached all-time highs. The company processes 250 million in transactions every month and it is currently adding 5,000 new users every day.

Arming smart factories with the right tools to keep threats at bay – The Manufacturer

Cybersecurity is a must for any smart factory set up, by ignoring the issue you could leave your company exposed to threats.

A common problem cybersecurity professionals have when talking about online threats is making the listener care. Things that happen in the cyber world lines of code, complex machinery, virtual systems often dont have the required impact because of their abstraction from everyday reality. The more technical the discussion gets, the more difficult it is to make it relevant.

However, when we talk about smart factories the risks are very real. Malicious code could shut down production lines, sabotage facilities and even put factory floor workers in physical danger. Tackling these challenges will require a new focus on co-operation between IT and OT teams.

Patching problems

In fact, it is IT-OT convergence in the modern manufacturing facility that has precipitated the cybersecurity crisis currently facing the industry. Before the Internet of Things (IoT) started to bring connectivity and computing power to operational technologies, manufacturing systems were arguably more secure. They ran on obscure proprietary software which made attacks often too expensive to research and carry out and, most importantly, were not internet-connected, making it extremely difficult for remote attackers to reach.

That has largely changed as systems were modernised, with internet-connectivity everywhere and many systems running Windows: one of the most popular and most targeted operating systems in the world. Yet while the sector has changed, cybersecurity in many cases has not kept pace.

Take industrial robots: the backbone of the modern factory and the driving force behind Industry 4.0 digital transformation. They typically run on proprietary programming languages, some of which will be out-of-date now and therefore cant be patched. Elsewhere, patches may not be applied because mission critical systems cant be taken offline to test them, or else because of non-security priorities. This is where OT and IT teams clash: OTs priority is usually uptime and safety, while IT will focus more on patching a known vulnerability to mitigate risk going forward.

Robots exposed

Many of the robotic machines on which smart factories rely have extensive access to resources on the shop floorand its often important that they do. File shares, industrial control systems (ICS), human machine interfaces (HMIs) and other elements also have a critical part to play in driving productivity and Industry 4.0 success. However, often theres no access control or isolation between these discrete parts of the manufacturing OT-IT environment. This matters, as it could enable attackers to compromise one part and then move laterally to another. Trend Micros Zero Day Initiative saw a 16% year-on-year increase in the number of disclosed ICS vulnerabilities in the first half of 2020.

Thats not all, sometimes the programming languages used in robots dont have any security validation checking. In fact, secure coding techniques are rarely used, as most of those writing the programmes themselves are process control engineers rather than developers. Code is frequently reused from public repositories rather than designed from scratch, which further exposes manufacturing organisations to cyber-risk. Its claimed that vulnerabilities in open source code libraries have doubled in nearly two years.

Vendor-backed app stores are another potential source of compromise. Until recently these havent applied the same efforts as Apple and Google in validating applications to check if they are malicious. That means malware could find its way onto the platforms, hidden in legitimate-looking software. With this entry point into the smart factory, attackers could carry out a range of theoretical campaigns ranging from theft of sensitive IP and employee/customer data to sabotage of production systems, denial of service and ransomware. Some unauthorised commands may even cause robots to move in such a way as to endanger their operators.

A unified response

Its vital that IT and OT security teams work hard at breaking down the traditional siloes that have kept them apart for so long. There needs to be a unified approach to securing these systems to ensure issues dont fall between the cracks until its too late. Start by conducting an asset inventory and then map data flows and risk scores to it.

Patching is essential for any internet-connected systems. For those on unsupported operating systems or which cant be updated for other reasons, consider virtual patching to keep them protected from threats without the need to take systems offline for testing. Next, its steps like network segmentation to isolate machines that process data from other networks, to minimise the chances of information theft. It goes without saying that protection from a reputable provider, at the endpoint, network and server layers, is vital, as is implementation of a Secure Software Development Lifecycle (SSDLC).

As an industry which employs nearly three million in the UK and accounts for hundreds of billions in exports, manufacturing is very much in the sights of the cybercrime community. As factories become increasingly packed with hi-tech components, its critical that security doesnt remain an afterthought.

COOMBES: Put the First Amendment first – University of Virginia The Cavalier Daily

As bars and restaurants began to reopen this summer, so did religious institutions. The operation of churches posed the issue of remaining in close quarters for extended periods of time in the midst of a pandemic. Last month, Opinion Writer Nicole Chebili argued that the University should cease unconstitutional exemptions for religious gatherings. However, the United States Constitution enshrines the right to free speech, press, assembly, petition and religion. Supreme Court precedent has clearly established that public universities have no exception to these fundamental freedoms.

The freedom of religion has an essential role in United States history, given that the country was founded on that very ideal. This underscores why its so important for the government to uphold religious freedom, especially in times of political unrest and uncertainty. Universities serve to educate the next generation of leaders and must act to protect rather than restrict these freedoms. The First Amendment is often referred to as the first liberty because freedom of thought and belief is thought to be of utmost importance. Diversity of thought and belief should be at the forefront of the learning community at the University.

In this column, Chebili claims that the University should continue to restrict students from going to religious services in Charlottesville. It is important to note that as long as they are not directly affiliated with the University, religious institutions must already follow city ordinances, which require gatherings to remain under 50 people. It is not the Universitys job nor is it the Universitys right to interfere with students' ability to worship. It sets a dangerous precedent to restrict the freedom of religion by any means. The freedom of religion was a founding pillar of our American Democracy and it must be upheld.

Chebili also mentions that online services provide the same quality sermons, community building and worship. This statement lies in direct contradiction to the religious beliefs of many Christians, for example, who place a great importance on worshiping in person. It is indeed not the same to worship online, as in-person fellowship is essential to Christian life, as well as many other religions. Furthermore, it is not the governments right to dictate the means by which its citizens practice religion.

Next, the column claims that protesting is essential and protected under the Constitution, but religious gatherings are not. The right to assemble dually covers protests and gathering for religious reasons. Under her own line of reasoning, religious gatherings are in fact equally essential, and should be regarded as such by the University. Calling for the University to restrict student attendance of any religious service without applying the same standards to protests is blatantly hypocritical.

Recently, students and the University alike have repeatedly called for restrictions to the religious clause of the First Amendment. In another article, students called for the Fellowship of Chiristian Athletes to be disbanded at the University. This is based on the fact that the Fellowship requires students who wish to hold a leadership position to sign a statement of faith that includes the traditional definition of marriage. No matter how some students feel, the University should not restrict religious freedoms and should reject calls to do so. Disagreement with the beliefs of a particular religion does not suddenly grant the University the power to restrict its practice.

Religion is critical to many students on Grounds. There is great diversity in religious organizations, and they provide an essential space for students to practice their religious beliefs. For many, religion is sacred and the opportunity to practice that religion on Grounds is paramount.

It can be difficult to see CIOs promote ideals that one disagrees with. There exist groups like the College Republicans or the University Democrats who highly encourage their members to affiliate with the party. The University is supposed to be a place for intellectual growth and discovery, groups with different opinions on Grounds contribute to and diversify the learning community. The University must not shut down an individual or groups ability to speak or assemble simply because others dont agree with them, on any matter from political speech to religious expression.

Historically, the University has protected and upheld the First Amendment, while other schools have fallen behind the curve, restricting speech with free speech zones. U.Va must continue to lead in this area. It is fitting that the University was founded by Thomas Jefferson, the very man who inspired the Bill of Rights, drafted the Virginia Statute for Religious Freedom and led the charge against the restriction of the church by the state. In keeping with the ideals set forth by Thomas Jefferson, the University must reject calls to restrict the freedom of religion.

Judge amy coney barrett and the First Amendment – Lexology

The nomination of fellow Notre Dame Law alum Judge Amy Coney Barrett has generated considerable controversy. Some of that is related to the process. There are those who feel that the winner of November 3ds Presidential election should make the nomination. That appeared to be the unwritten rule in 2106 when President Obama nominated Judge Merrick Garland, only to see the Senate sit on their collective hands and not conduct a hearing, given the (sort of) pending 2016 election. Apparently, at some point between 2016 and 2020, there was an unwritten amendment to the unwritten rule, such that it is all of a sudden vitally important to confirm Judge Barrett ASAP.

And aside from the procedural controversy, progressives are concerned with Judge Barretts expressed views on abortion and gun control. Given that her appointment will leave the court in a 6-3 conservative versus progressive split, one can understand the concern coming from that side of the aisle.

But Ive been wondering about how Judge Barrett might view the First Amendment and other matters that might affect the journalists I work with. So I was pretty excited when I saw this headline: Would Justice Amy Coney Respect Press Freedom? I was hoping it would shed light on the subject. Unfortunately, it really didnt. The premise is essentially that President Trump appointed her, and President Trump hates the press, so look for anti-press rulings.

A more accurate assessment comes from The Institute for Free Speech. And their report is that she is really a blank slate. Shes been a Judge on the Seventh Circuit Court of Appeals since 2017, and in that time has apparently not written on the issue. It appears that she didnt weigh in as an academic either.

I do think there are some pressing issues in the First Amendment world, not the least of which is the future of New York Times v. Sullivan the 56 year old precedent that is the foundation for First Amendment jurisprudence in the world of journalism. Judge Barretts former boss, Justice Antonin Scalia was not a fan of the holding, nor is Justice Thomas.

So, it might be nice to ask Judge Barrett in her confirmation hearing just what she thinks about the holding in that case. Was it correctly decided? If not, why not? And what should the court have done?

If a future court were to overrule Sullivan, the fallout would be tremendous. We have a right to know where she stands on this.

Tennessee voting rights law needs to be repealed for the sake of civil liberty | Opinion – Tennessean

As Tennesseans who believe in truth, equality, and liberty, we cannot allow this Senate Bill 8005 to continue existing in its current form.

On Aug.20 Gov. Bill Lee quietly signed Senate Bill 8005 into law.

There was no public announcement, not even a tweet.

The lack of announcement signals that Gov. Lee knows this is a bad bill aimed at stifling Tennesseans First Amendment rights by enforcing unnecessarily harsh sentencing for protesters.

To understand the silence, the bill itself needs a bit of unpacking. At a high level, the bill calls for harsh sentencing for what are essentially acts that are protected by the First Amendment.

For example, an individual who is caught camping on state property can now be charged with a Class E felony which includes up to sixyearsin prison and loss of voting rights.

Due to the vagueness of this statute, in addition to preventing individuals from camping during a peaceful protest, a homeless person caught sleeping in a park, or a family setting up an evening or early morning picnic could potentially be charged in the same fashion.

In contrast, an individual would be charged with a Class A misdemeanor for simple assault on a first responder.

This bill implies it is a more heinous crime to camp on state property than it is to spit on, or physically push a first responder. Does that seem just? Do we truly value state property more than our first responders? One could assume so with the consequences as defined in this bill.

To add to the general vagueness of the bills intent, individuals or groups could be charged and handed a mandatory sentence for disturbing public meetings. This disturbance could be interpreted many ways, however the most obvious would involve being too loud.

For example, those who were peacefully assembling outside of the state capitol and requesting an audience with Gov. Lee, could be charged with a Class A misdemeanor.

The bill does call for harsher penalties for property damageas a result ofaggravated rioting and aggravated assault on a first responder. Rightfully so, the state is calling for this harsher sentencingin an attempt todeter these acts that would move a peaceful assembly or protest to an escalated situation, where bodily harm and property damage could be realized.

Despite the necessary components of this bill, the bill has very severe and questionable unintended consequences for individuals or groups that are exercising their First Amendment right to peacefully assemble and petition the government for a redress of grievances.

Does the majority Republican legislature recognize the potential unintended consequences of the bill? Are our elected officials intentionally trying to curb any sort of gathering that would be considered protected under the First Amendment of the United States Constitution?

It is likely we will never know the exact motivations of our elected officials and Gov. Lee with respect to Senate Bill 8005.However, it is clear that this bill needs to be repealed or amended, atminimum.

Please write your district legislator urging them to raise a bill at the next General Assembly, which convenes in January of 2021, to repeal Senate Bill 8005 or, at a minimum, amend it.
