In early August, a panel of circuit judges in the U.S. Court of Appeals for the Ninth Circuit issued a unanimous 3-0 decision in favor of Qualcomm in its appeal against Judge Lucy Kohs ruling in favor of the Federal Trade Commission (FTC), which featured an injunction against Qualcomm for its patent licensing practices in the semiconductor industry. The Future of American Spectrum Policy: Is DoDs Request for Information the Best Direction?

In early August, the White House and the U.S. Department of Defense (DoD) announced a plan to devise a spectrum sharing framework that frees up 100 megahertz (MHz) of continuous mid-band spectrum currently held by the DoD to be auctioned by the Federal Communications Commission (FCC) for supporting the growth of 5G networks across the U.S. A request for information (RFI) issued by the DoD on September 18 to identify innovative solutions for dynamic spectrum sharing which effectively supports national security while freeing up additional spectrum to be used by the 5G industry.
