A team of neuroscientists at the University of Wisconsin claim to have found a way to control how high mice can get on a given amount of cocaine.

And don't worry — while that may sound like a particularly frivolous plot concocted by a team of evil scientists, the goal of the research is well-meaning.

The team, led by University of Wisconsin neuroscientist Santiago Cuesta, was investigating how the gut microbiome can influence how mice and humans react to ingesting the drug.

The research, detailed in a new paper published this week in the journal Cell Host & Microbe, sheds light on a vicious feedback loop that could explain cases of substance abuse disorders — and possibly lay the groundwork for future therapeutic treatments.

In a number of experiments on mice, the researchers found that cocaine was linked to the growth of common gut bacteria, which feed on glycine, a chemical that facilitates basic brain functions.

The lower the levels of glycine in the brain, the more the mice reacted to the cocaine, exhibiting abnormal behaviors.

To test the theory, the scientists injected the mice with a genetically modified amino acid which cannot break down glycine. As a result, the behavior of mice returned to normal levels.

In other words, the amino acid could curb cocaine addiction-like behaviors — at least in animal models.

"The gut bacteria are consuming all of the glycine and the levels are decreasing systemically and in the brain," said Vanessa Sperandio, senior author, and microbiologist from the University of Wisconsin, in a statement. "It seems changing glycine overall is impacting the glutamatergic synapses that make the animals more prone to develop addiction."

It's an unorthodox approach to treating addiction, but could be intriguing — if it works in people, that is.

"Usually, for neuroscience behaviors, people are not thinking about controlling the microbiota, and microbiota studies usually don't measure behaviors, but here we show they’re connected," Cuesta added. "Our microbiome can actually modulate psychiatric or brain-related behaviors."

In short, their research could lead to new ways of treating various psychiatric disorders such as substance use by adjusting the gut microbiome and not making changes to the brain chemistry.

"I think the bridging of these communities is what's going to move the field forward, advancing beyond correlations towards causations for the different types of psychiatric disorders," Sperandio argued.

You know that "research" going around saying humans are going to evolve to have hunchbacks and claws because of the way we use our smartphones? Though our posture could certainly use some work, you'll be glad to know that it's just lazy spam intended to juice search engine results.

Let's back up. Today the Daily Mail published a viral story about "how humans may look in the year 3000." Among its predictions: hunched backs, clawed hands, a second eyelid, a thicker skull and a smaller brain.

Sure, that's fascinating! The only problem? The Mail's only source is a post published a year ago by the renowned scientists at... uh... TollFreeForwarding.com, a site that sells, as its name suggests, virtual phone numbers.

If the idea that phone salespeople are purporting to be making predictions about human evolution didn't tip you off, this "research" doesn't seem very scientific at all. Instead, it more closely resembles what it actually is — a blog post written by some poor grunt, intended to get backlinks from sites like the Mail that'll juice TollFreeForwarding's position in search engine results.

To get those delicious backlinks, the top minds at TollFreeForwarding leveraged renders of a "future human" by a 3D model artist. The result of these efforts is "Mindy," a creepy-looking hunchback in black skinny jeans (which is how you can tell she's from a different era).

"To fully realize the impact everyday tech has on us, we sourced scientific research and expert opinion on the subject," the TollFreeForwarding post reads, "before working with a 3D designer to create a future human whose body has physically changed due to consistent use of smartphones, laptops, and other tech."

Its sources, though, are dubious. Its authority on spinal development, for instance, is a "health and wellness expert" at a site that sells massage lotion. His highest academic achievement? A business degree.

We could go on and on about TollFreeForwarding's dismal sourcing — some of which looks suspiciously like even more SEO spam for entirely different clients — but you get the idea.

It's probably not surprising that the this gambit for clicks took off among dingbats on Twitter. What is somewhat disappointing is that it ended up on StudyFinds, a generally reliable blog about academic research. This time, though, for inscrutable reasons it treated this egregious SEO spam as a legitimate scientific study.

The site's readers, though, were quick to call it out, leading to a comically enormous editor's note appended to the story.

"Our content is intended to stir debate and conversation, and we always encourage our readers to discuss why or why not they agree with the findings," it reads in part. "If you heavily disagree with a report — please debunk to your delight in the comments below."

You heard them! Get debunking, people.

Jeff Bezos' ex- housekeeper is suing him for discrimination that led to her allegedly having to literally sneak out out of his house to use the bathroom.

Jeff Bezos' former housekeeper is suing the Amazon founder for workplace discrimination that she says forced her to literally climb out out the window of his house to use the bathroom.

In the suit, filed this week in a Washington state court, the former housekeeper claimed that she and Bezos' other household staff were not provided with legally-mandated eating or restroom breaks, and that because there was no "readily accessible bathroom" for them to use, they had to clamber out a laundry room window to get to one.

In the complaint, lawyers for the ex-housekeeper, who is described as having worked for wealthy families for nearly 20 years, wrote that household staff were initially allowed to use a small bathroom in the security room of Bezos' main house, but "this soon stopped... because it was decided that housekeepers using the bathroom was a breach of security protocol."

The suit also alleges that housekeepers in the billionaire's employ "frequently developed Urinary Tract Infections" that they believed was related to not being able to use the bathroom when they needed to at work.

"There was no breakroom for the housekeepers," the complaint adds. "Even though Plaintiff worked 10, 12, and sometimes 14 hours a day, there was no designated area for her to sit down and rest."

The housekeeper — who, like almost all of her coworkers, is Latino — was allegedly not aware that she was entitled to breaks for lunch or rest, and was only able to have a lunch break when Bezos or his family were not on the premises, the lawsuit alleges.

The Washington Post owner has denied his former housekeeper's claims of discrimination through an attorney.

"We have investigated the claims, and they lack merit," Harry Korrell, a Bezos attorney, told Insider of the suit. "[The former employee] made over six figures annually and was the lead housekeeper."

He added that the former housekeeper "was responsible for her own break and meal times, and there were several bathrooms and breakrooms available to her and other staff."

"The evidence will show that [the former housekeeper] was terminated for performance reasons," he continued. "She initially demanded over $9M, and when the company refused, she decided to file this suit."

As the suit was just filed and may well end in a settlement, it'll likely be a long time, if ever, before we find out what really happened at Bezos' house — but if we do, it'll be a fascinating peek behind the curtain at the home life of one of the world's most powerful and wealthy men.

In the era of remote work, employers have turned to invasive

Ever since the COVID-19 pandemic drove a wave of working from home, companies have been relentless in their efforts to digitally police and spy on remote employees by using what's known as "bossware." That's the pejorative name for software that tracks the websites an employee visits, screenshots their computer screens, and even records their faces and voices.

And now, the National Labor Relations Board (NLRB), an agency of the federal government, is looking to intervene.

"Close, constant surveillance and management through electronic means threaten employees' basic ability to exercise their rights," said NLRB general counsel Jennifer Abruzzo, in a Monday memo. "I plan to urge the Board to apply the Act to protect employees, to the greatest extent possible, from intrusive or abusive electronic monitoring and automated management practices."

Undoing Unions

In particular, Abruzzo is worried about how bossware could infringe on workers' rights to unionize. It's not hard to imagine how such invasive surveillance could be used to bust unionization. Even if the technology isn't explicitly deployed to impede organization efforts, the ominous presence of the surveillance on its own can be a looming deterrent, which Abruzzo argues is illegal.

And now is the perfect moment for the NLRB to step in. The use and abuse of worker surveillance tech in general — not just bossware — has been "growing by the minute," Mark Gaston Pearce, executive director of the Workers' Rights Institute at Georgetown Law School, told CBS.

"Employers are embracing technology because technology helps them run a more efficient business," Gaston explained. "… What comes with that is monitoring a lot of things that employers have no business doing."

Overbearing Overlord

In some ways, surveillance tech like bossware can be worse than having a nosy, actual human boss. Generally speaking, in a physical workplace employees have an understanding of how much privacy they have (unless they work at a place like Amazon or Walmart, that is).

But when bossware spies on you, who knows how much information an employer could be gathering — or even when they're looking in. And if it surveils an employee's personal computer, which more often than not contains plenty of personal information that a boss has no business seeing, that's especially invasive.

Which is why Abruzzo is pushing to require employers to disclose exactly how much they're tracking.

It's a stern message from the NLRB, but at the end of the day, it's just a memo. We'll have to wait and see how enforcing it pans out.

Another day, another Elon Musk feud on Twitter — except now, he's the owner of the social network, and he's beefing with a sitting member of Congress.

The whole thing started innocently enough earlier this week, when firebrand Rep. Alexandria Ocasio-Cortez (D-NY, and better known by her initials, "AOC") subtweeted the website's new owner.

"Lmao at a billionaire earnestly trying to sell people on the idea that 'free speech' is actually a $8/mo subscription plan," the New York Democratic Socialist tweeted in a post that, upon Futurism's perusal, appeared to load only half the time.

Sweat Equity

Not one to be shown up, Musk later posted a screenshot of an AOC-branded sweatshirt from the congressperson's website, with its $58 price tag circled and an emoji belying the billionaire's alleged affront at the price.

In response, Ocasio-Cortez said she was proud her sweatshirts were made by union labor, and that the proceeds from their sales were going to fund educational support for needy kids. She later dug in further, noting that her account was "conveniently" not working and joking that Musk couldn't buy his way "out of insecurity."

To be clear, any suggestion that Musk personally had anything to do with any Twitter glitches on AOC's part would seem ludicrously petty. But then again, this is a guy who once hired a private detective to investigate a random critic.

Occam's razor, though, suggests that it was probably AOC's mega-viral tweet that broke the site's notoriously dodgy infrastructure. Of course, that's not a ringing endorsement of the site that Musk just acquired for the colossal sum of $44 billion.

China Plans to Send Monkeys to Space Station to Have Sex With Each Other

Chinese astronauts are reportedly planning to let monkeys loose on their brand-new space station to have them have sex with each other.

Chinese scientists are reportedly planning to send monkeys to its new Tiangong space station for experiments that will involve the animals mating and potentially reproducing, the South China Morning Post reports.

It's a fascinating and potentially controversial experiment that could have major implications for our efforts to colonize space: can mammals, let alone humans, successfully reproduce beyond the Earth?

According to the report, the experiment would take place in the station's largest capsule, called Wentian, inside two biological test cabinets that can be expanded.

After examining the behavior of smaller creatures, "some studies involving mice and macaques will be carried out to see how they grow or even reproduce in space," Zhang Lu, a researcher at the Chinese Academy of Sciences in Beijing, said during a speech posted to social media earlier this week, as quoted by the SCMP.

"These experiments will help improve our understanding of an organism’s adaptation to microgravity and other space environments," he added.

Some simpler organisms, including nematodes and Japanese rice fish, have been observed reproducing in space.

But more complex life forms have struggled. In 2014, a Russian experiment to see whether geckos could produce offspring in space failed when all the critters died.

And the failure rate for mammals, so far, has been total. Soviet Union scientists got mice to mate during a space flight in 1979, but none of them gave birth after being returned to Earth.

In other words, getting monkeys to reproduce on board a space station will be anything but easy. For one, just dealing with living creatures in space can pose immense challenges. The astronauts will "need to feed them and deal with the waste," Kehkooi Kee, a professor with the school of medicine at Tsinghua University, told the SCMP.

Then there's the fact that astronauts will have to keep the macaques happy and comfortable, something that experts say will be challenging since long term confinement in the spartan environments of space habitats could cause immense stress for the simians.

And even if astronauts successfully set the mood for the monkeys, the physics of sex in space are predicted to be challenging.

"Firstly, just staying in close contact with each other under zero gravity is hard," Adam Watkins, an associate professor of reproductive physiology at University of Nottingham, wrote in a 2020 open letter highlighted by the SCMP. "Secondly, as astronauts experience lower blood pressure while in space, maintaining erections and arousal are more problematic than here on Earth."

With its new space station in nearly full operation, China isn't shying away from asking some big questions — but whether these experiments will play out as expected is anything but certain.

After launching into orbit roughly three months ago, China's top-secret spaceplane has released a mysterious object, which is now circling the Earth behind it, SpaceNews reports.

There's very little we know about China's "reusable experimental spacecraft," except that it launched atop a Long March 2F rocket back in August. We don't know its purpose, what it looks like, or what cargo it was carrying during launch — but it's an intriguing development, nonetheless, for China's reusable launch platform.

Mysterious Object

The object was released between October 24 and October 31, according to tracking data being analyzed by the US Space Force's 18th pace Defense Squadron.

We can only hazard a guess as to what the mysterious object's purpose is. According to Harvard astronomer and space tracker Jonathan McDowell, it "may be a service module, possibly indicating an upcoming deorbit burn."

Based on the size and weight of payloads Long March rockets usually carry, China's mysterious spaceplane is likely similar to the Air Force's X-37B spaceplane, which is similarly shrouded in mystery and currently on its sixth mission.

We also don't know when the Chinese model will make its return back to Earth, but given recent activity at the Lop Nur base in Xinjiang suggests, it may land there in the near future, according to the report.

It's a puzzling new development for China's secretive spacecraft — but it does raise the possibility of a renewed interest in spaceplanes, a potentially affordable and reusable way to launch payloads into orbit.

Someone apparently thought it was a great idea to fly 500 drones over NYC as part of an ad experiment without much warning.

Someone thinks it's a great idea to fly 500 drones over New York City to create a huge ad in the sky on Thursday evening. Because New Yorkers certainly don't have any historical reason to mistrust unknown aircraft over their skyline, right?

As Gothamist reports, the drone swarm is part of a "surreal takeover of New York City’s skyline" on behalf of — we shit you not — the mobile game Candy Crush.

Fernanda Romano, Candy Crush's chief marketing officer, told Gothamist that the stunt will "turn the sky into the largest screen on the planet" using the small, light-up drones.

Though this is not the first time the Manhattan skyline has been used as ad space — that distinction goes to the National Basketball Association and State Farm, which did a similar stunt this summer during the NBA draft — local lawmakers are ticked off about it nonetheless.

"I think it’s outrageous to be spoiling our city’s skyline for private profit," Brad Hoylman, a state senator that represents Manhattan's West Side in the NY Legislature, told the local news site. "It’s offensive to New Yorkers, to our local laws, to public safety, and to wildlife."

Freak Out

Indeed, as the NYC Audubon Society noted in a tweet, the Candy Crush crapshoot "could disrupt the flight patterns of thousands of birds flying through NYC, leading to collisions with buildings" as they migrate.

Beyond the harm this will do to birds and the annoyance it will undoubtedly cause the famously-grumpy people of New York, this stunt is also going down with very little warning, considering that Gothamist is one of the only news outlets even reporting on it ahead of time.

While most viewers will hopefully be able to figure out what's going on pretty quickly, the concept of seeing unknown aircraft above the skyline is a little too reminiscent of 9/11 for comfort — and if Candy Crush took that into consideration, they haven't let on.

So here's hoping this event shocks and awes Thursday night city-goers in a good way, and not in the way that makes them panic.

Advertisers are fleeing Twitter in droves now that Tesla CEO Elon Musk has taken over control. Now, he's trying to pick up the pieces and begging them to return.

Advertisers are fleeing Twitter in droves now that Tesla and SpaceX CEO Elon Musk has taken over control.

Ever since officially closing the $44 billion deal, Musk has been busy gutting the company's executive suite and dissolving its board. Senior executives, as well as Twitter's advertising chief Sarah Personette, have departed as well.

After all, Musk has been very clear about his disdain for advertising for years now.

The resulting uncertainty has advertisers spooked — major advertising holding company IPG has already advised clients to pull out temporarily — and the billionaire CEO is in serious damage mode.

Now, Reuters reports, Musk is spending most of this week meeting with advertisers in New York, trying to reassure them that Twitter won't turn into a "free-for-all hellscape."

According to one of Reuters' sources, the meetings have been "very productive" — but plenty of other marketers are far from satisfied.

Advertisers are reportedly grilling Musk over his plans to address the rampant misinformation being spread on the platform, a trend that Musk himself has been actively contributing to since the acquisition.

And if he's succeeding in ameliorating advertisers in private, he's antagonizing them publicly. On Wednesday, Musk posted a poll asking users whether advertisers should support either "freedom of speech," or "political 'correctness'" — a type of false dichotomy that echoes the rhetoric of far-right conspiracy theorists and conservative pundits.

"Those type of provocations are not helping to calm the waters," an unnamed media buyer told Reuters.

Some are going public with the same sentiment.

"Unless Elon hires new leaders committed to keeping this 'free' platform safe from hate speech, it's not a platform brands can/should advertise on," Allie Wassum, global media director for the Nike-owned shoe brand Jordan, wrote in a LinkedIn post.

So far, Musk's plans for the social media platform remain strikingly muddy. In addition to the behind-the-scenes advertising plays, he's also announced that users will have to pay to retain their verification badge, though he's engaged in a comically public negotiation as to what the cost might be.

He's also hinted that previously banned users — former US president Donald Trump chief among them — might eventually get a chance to return, but only once "we have a clear process for doing so, which will take at least a few more weeks."

The move was seen by many as a way to wait out the impending midterm elections. After all, Twitter has played a huge role in disseminating misinformation and swaying elections in the past.

While advertisers are running for the hills, to Musk advertising is clearly only a small part of the picture — even though historically, social giants like Twitter have struggled to diversify their revenue sources much beyond display ads.

Musk nodded to that reality in a vague open letter posted last week.

"Low relevancy ads are spam, but highly relevant ads are actually content!" he wrote in the note, addressed to "Twitter advertisers."

Big picture, Twitter's operations are in free fall right now and Musk has yet to provide advertisers with a cohesive plan to pick up the pieces.

While he's hinted at the creation of a new content moderation council made up of both "people from all viewpoints" and "wildly divergent views," advertisers are clearly going to be thinking twice about continuing their business with Twitter.

With or without advertising, Twitter's finances are reportedly in a very deep hole. The billions of dollars Musk had to borrow to finance his mega acquisition will cost Twitter around $1 billion a year in interest alone.

The company also wasn't anywhere near profitable before Musk took over, losing hundreds of millions of dollars in a single quarter.

Whether that picture will change any time soon is as unclear as ever, especially in the face of a wintry economy.

But, of course, Musk has proved his critics wrong before. So anything's possible.

ALMA is one of the largest and most advanced radio telescopes in the world. And for reasons still unknown to the public, hackers decided to take it down.

The Atacama Large Millimeter Array (ALMA) Observatory in Chile has been hit with a cyberattack that has taken its website offline and forced it to suspend all observations, authorities there said.

Even email services were limited in the aftermath, illustrating the broad impact of the hack.

Nested high up on a plateau in the Chilean Andes at over 16,000 feet above sea level, ALMA is one of the most powerful and advanced radio telescopes in the world. Notably, ALMA helped take the first image of a black hole in 2019, in a collaborative effort that linked radio observatories worldwide into forming the Event Horizon Telescope.

Thankfully, ALMA's impressive arsenal of 66 high-precision antennas, each nearly 40 feet in diameter, was not compromised, the observatory said, nor was any of the scientific data those instruments collected.

In High Places

What makes ALMA so invaluable is its specialty in observing the light of the cooler substances of the cosmos, namely gas and dust. That makes ALMA a prime candidate for documenting the fascinating formations of planets and stars when they first emerge amidst clouds of gas.

Since going fully operational in 2013, it's become the largest ground-based astronomical project in the world, according to the European Southern Observatory, ALMA's primary operators.

So ALMA going offline is a distressing development, especially to the thousands of astronomers worldwide that rely on its observations and the some 300 experts working onsite. Getting it up and running is obviously a top priority, but the observatory said in a followup tweet that "it is not yet possible to estimate a date for a return to regular activities."

As of now, there's no information available on who the hackers were, or exactly how they conducted the attack. Their motivations, too, remain a mystery.

Anarchists have employed certain symbols for their cause, including most prominently the circle-A and the black flag.[1][2] Anarchist cultural symbols have been prevalent in popular culture since around the turn of the 21st century, concurrent with the anti-globalization movement.[3] The punk subculture has also had a close association with anarchist symbolism.[4]

The red flag was one of first anarchist symbols and it was widely used in late 19th century by anarchists worldwide.[6] Peter Kropotkin wrote that he preferred the use of the red flag.[7]

Use of the red flag by anarchists largely disappeared after the October Revolution, when red flags started to be associated only with Bolshevism and communist parties and authoritarian, bureaucratic and reformist social democracy, or authoritarian socialism.[6]

The black flag has been associated with anarchism since the 1880s, when several anarchist organizations and journals adopted the name Black Flag.[1]

The black flag is the negation of all flags. It is a negation of nationhood ... Black is a mood of anger and outrage at all the hideous crimes against humanity perpetrated in the name of allegiance to one state or another ... But black is also beautiful. The origins of the black flag are uncertain.[1] Modern anarchism has a shared ancestry withamongst other ideologiessocialism, a movement strongly associated with the red flag. As anarchism became more and more distinct from socialism in the 1880s, it adopted the black flag in an attempt to differentiate itself.[2]

The French anarchist paper, Le Drapeau Noir (The Black Flag), which existed until 1882, is one of the first published references to use black as an anarchist color. Black International was the name of a London anarchist group founded in July 1881.

One of the first known anarchist uses of the black flag was by Louise Michel, participant in the Paris Commune in 1871.[1][9] Michel flew the black flag during a demonstration of the unemployed which took place in Paris on March 9, 1883. With Michel at the front carrying a black flag and shouting "Bread, work, or lead!," the crowd of 500 protesters soon marched off towards the boulevard Saint-Germain and pillaged three baker's shops before the police arrested them.[9] Michel was arrested and sentenced to six years solitary confinement. Public pressure soon forced the granting of an amnesty.[10] She wrote, "the black flag is the flag of strikes and the flag of those who are hungry".

The black flag soon made its way to the United States. The black flag was displayed in Chicago at an anarchist demonstration in November 1884.[12] According to the English language newspaper of the Chicago anarchists, it was "the fearful symbol of hunger, misery and death". Thousands of anarchists attended Kropotkin's 1921 funeral behind the black flag.[1]

The colors black and red have been used by anarchists since at least the late 1800s when they were used on cockades by Italian anarchists in the 1874 Bologna insurrection and in 1877 when anarchists entered the Italian town Letino carrying red and black flags to promote the First International.[2] Diagonally divided red and black flags were used by anarcho-syndicalists in Spain such as the labor union CNT during the Spanish Civil War.[2] George Woodcock writes that the bisected black-and-red flag symbolized a uniting of "the spirit of later anarchism with the mass appeal of the [First] International".

The symbol composed of the capital letter A surrounded by a circle is universally recognized as a symbol of anarchism[1] and has been established in global youth culture since the 1970s.[15] An interpretation held by anarchists such as Cindy Milstein is that the A represents the Greek anarkhia ('without ruler/authority'), and the circle can be read as the letter O, standing for order or organization, a reference to Pierre-Joseph Proudhon's definition of anarchism from his 1840 book What Is Property?: "as man seeks justice in equality, so society seeks order in anarchy"[16] (French: la socit cherche l'ordre dans l'anarchie).[17][18]

In the 1970s, anarcho-punk and punk rock bands such as Crass began using the circle-A symbol in red,[19] thereby introducing it to non-anarchists. Crass founder Penny Rimbaud would later say that the band probably first saw the symbol while traveling through France.[20]

The origin of the black cat symbol is unclear, but according to one story it came from an Industrial Workers of the World strike that was going badly. Several members had been beaten up and were put in a hospital. At that time a skinny, black cat walked into the striker's camp. The cat was fed by the striking workers and as the cat regained its health the strike took a turn for the better. Eventually the striking workers got some of their demands and they adopted the cat as their mascot.[21]

The name Black Cat has been used for numerous anarchist-affiliated collectives and cooperatives, including a music venue in Austin (which was closed following a July 6, 2002 fire) and a now-defunct "collective kitchen" in the University District of Seattle.

"No gods, no masters" is a phrase associated with Anarchist philosophy. Likely dating back to a 15th-century German proverb, it appeared in an 1870 pamphlet by a disciple of Auguste Blanqui and became the title of Blanqui's 1880 newspaper Ni Dieu ni matre[fr] before it spread throughout the anarchist movement,[22] appearing in Kropotkin's 1885 Words of Rebel and an 1896 Bordeaux anarchist manifesto. Sbastien Faure resuscitated the slogan during World War I, after which Paris's Libertarian Youth adopted the name. It has appeared on tombstones of revolutionaries,[24] as the slogan of birth control activist Margaret Sanger's newspaper The Woman Rebel,[25] and as the title of a 1964 song[fr] against capital punishment by Lo Ferr.[26]

Richard Allen Epstein (born April 17, 1943) is an American legal scholar known for his writings on torts, contracts, property rights, law and economics, classical liberalism, and libertarianism. He is the Laurence A. Tisch Professor of Law at at New York University and the director of the university's Classical Liberal Institute. He also serves the Peter and Kirsten Bedford Senior Fellow at the Hoover Institution and the James Parker Hall Distinguished Service Professor of Law emeritus and a senior lecturer at the University of Chicago.

Epstein's writings have extensively influenced American legal thought. In 2000, a study published in The Journal of Legal Studies identified Epstein as the 12th-most cited legal scholar of the 20th century. In 2008, he was chosen in a poll by Legal Affairs as one of the most influential legal thinkers of modern times. A study of legal publications between 2009 and 2013 found Epstein to be the third-most frequently cited American legal scholar during that period (behind only Cass Sunstein and Erwin Chemerinsky). He has been a member of the American Academy of Arts and Sciences since 1985.

Epstein was born on April 17, 1943, in Brooklyn, New York. His grandparents were Ashkenazi Jews who immigrated to the United States from Russia and Austria in the early 20th century. Epstein's father, Bernard Epstein (19081978), was a radiologist, and his mother, Catherine Epstein (ne Reiser; 19082004), managed his father's medical office.[2] He has two sisters. He attended elementary school at P.S.161, a school that is now one of the Success Academy Charter Schools.[3] Epstein and his family lived in Brooklyn until 1954, when his father began working at the Long Island Jewish Medical Center and their family moved to Great Neck, Long Island.[3]

Epstein attended Columbia University as an undergraduate in the early 1960s. He had wide-ranging academic interests and did not wish to select a single major, and he obtained special permission from the university to pursue a self-selected program of study across sociology, philosophy, and mathematics. He graduated with a B.A., summa cum laude, in 1964.[4]

Epstein's undergraduate performance earned him a Kellett Fellowship, an award at Columbia that pays for two of each year's top graduates to spend two years in England studying at either Cambridge University or Oxford University. Epstein chose Oxford, where he studied jurisprudence at Oriel College. He received a B.A. with first-class honours in 1966. He then returned to the United States to attend Yale Law School. Because he had an English law degree, Epstein entered Yale Law as a transfer student with second-year standing.[5] He graduated in 1968 with an LL.B., cum laude.

After graduating from law school, Epstein became an assistant professor at the University of Southern California's (USC) Gould School of Law. He taught at USC for four years before moving to the University of Chicago Law School in 1972. Epstein taught at Chicago for 38 years, eventually holding the title of James Parker Hall Distinguished Service Professor of Law. Epstein formally retired from Chicago in 2010, but quickly came out of retirement to join the faculty of the New York University School of Law as its inaugural Laurence A. Tisch Professor of Law. He remains a professor emeritus and senior lecturer at Chicago, occasionally teaching courses there. In 2013, NYU Law established a new academic research center, the Classical Liberal Institute, and named Epstein its inaugural director.[6]

Since 2001, Epstein has served as the Peter and Kirsten Bedford Senior Fellow at the Hoover Institution, a prominent American public policy think tank at Stanford University. He has served in many academic and public organizations and has received a number of awards. In 1983, he was made a senior fellow at the Center for Clinical Medical Ethics at the University of Chicago Medical School, and in 1985 he was inducted into the American Academy of Arts and Sciences.[7] He was editor of the Journal of Legal Studies from 1981 to 1991, and of the Journal of Law and Economics from 1991 to 2001. In 2003, Epstein received an honorary LL.D. degree from the University of Ghent, and in 2018 he received an honorary doctorate in law from the University of Siegen.[8] In 2005 the College of William & Mary awarded him the Brigham-Kanner Property Rights Prize for his contributions to the field of property rights.[9] In 2011, he was awarded a Bradley Prize by the Bradley Foundation.[10]

Epstein became famous in the American legal community in 1985 with Harvard University Press's publication of his book Takings: Private Property and the Power of Eminent Domain. In it, Epstein argued that the "takings clause" of the Fifth Amendment to the U.S. Constitutionwhich reads, "nor shall private property be taken for public use, without just compensation", and is traditionally viewed as a limit on the governmental power of eminent domaingives constitutional protection to citizens' economic rights, and so requires the government to be regarded the same as any other private entity in a property dispute. The argument was controversial and sparked a great deal of debate on the interpretation of the takings clause after the book's publication. During Clarence Thomas's Supreme Court Justice confirmation hearings in 1991, Senator Joe Biden "in a dramatic movement" held the book up and "repeatedly interrogated" Thomas about his position on the book's thesis. The book served as a focal point in the argument about the government's ability to control private property.[11] It has also influenced how some courts view property rights[12] and been cited by the U.S. Supreme Court four times, including in the 1992 case Lucas v. South Carolina Coastal Council.[11]

At the height of the HIV pandemic in 1988, Epstein argued that companies ought to be able to discriminate against "AIDS carriers" and that anti-discrimination laws were unfair to employers. In place of such laws, Epstein argued that "AIDS carriers" ought to have their health insurance premiums subsidized via taxation so as to "discipline the behavior of government and interests groups, here by requiring citizens to make choices about how much they individually are prepared to pay to subsidize AIDS carriers." Furthermore, he argued that "[t]here is no reason to suppose that any public benefit obtained from having employers and their insurers care for AIDS victims will be at some level that matches the additional costs that are imposed." Instead, Epstein proposed that employers have the right to refuse to hire suspected "AIDS carriers".[13]

Epstein is an advocate of minimal legal regulation. In his 1995 book Simple Rules for a Complex World, he consolidates much of his previous work and argues that simple rules work best because complexities create excessive costs. Complexity comes from attempting to do justice in individual cases. Complex rules are justifiable, however, if they can be opted out of. Drawing on Gary Becker, he argues that the Civil Rights Act and other anti-discrimination legislation ought to be repealed. Consistent with the principles of classical liberalism, he believes that the federal regulation on same-sex marriage, the Defense of Marriage Act, should be repealed,[14] stating:

Epstein has criticized the Supreme Court ruling in Obergefell v. Hodges.[15][16] In 2007, he defended the intellectual property rights of pharmaceutical companies against the cheaper, generic production of AIDS drugs, writing that "disregarding property rights in the name of human rights reduces human welfare around the globe".[17]

In 2014, Epstein argued against reparations for African Americans in a piece published on the Hoover Institution's website.[18]

Contributing to the anthology Our American Story (2019), Epstein addressed the possibility of a shared American narrative. Taking a decidedly skeptical approach, Epstein concluded that no new national narrative can be achieved "unless we engage in what I call American minimalisma conscious reduction of the issues that we think are truly best handled as a nation and not better address by smaller subnational groups: states, local governments, and, most importantly, all sorts of small private organizations that are free to choose as they please in setting their own membership and mission."[19]

In March and April 2020, Epstein wrote several essays published by the Hoover Institution giving a contrarian account of the COVID-19 pandemic and warning against extensive containment and mitigative United States responses to the COVID-19 pandemic, which he called an "overreaction".[20] In a piece published on March 16, he argued that the word "pandemic" is not to be used lightly and that the virus should be allowed to run its course, predicting there would be 500 U.S. deaths. In early June, the U.S. death total surpassed 100,000.[21] On March 24, when U.S. deaths had already exceeded 500, Epstein added a "Correction & Addendum", in which he changed his forecast to 5,000 deaths[22][23][24] without changing the underlying model that had led him to his first estimate.[25] On April 6, when the death toll had already far surpassed his earlier predictions, he again revised that figure, with the "Correction & Addendum" section declaring under the inaccurate date stamp "March 24, 2020" that the "original erroneous estimate of 5,000 dead in the US [was] a number 10 times smaller than [he had] intended to state", implying that both "500" and "5,000" had been misprints for "50,000".[26] After several news reports about Epstein's ever-increasing estimates, on April 21 an editor's note appeared on the website that explained the latest changes as an "editing error" and clarified that Epstein's original prediction had been 500 deaths.[27] In December 2020, when the death toll from COVID-19 in the U.S. was over 333,000, Politico named Epstein's predictions among "the most audacious, confident and spectacularly incorrect prognostications about the year".[28]

Epstein compared COVID-19 to the 2009 H1N1 pandemic and suggested that public health measures "are done better at the level of plants, hotels, restaurants, and schools than remotely by political leaders." He argued that "the response of the state governors to the coronavirus outbreak has become far more dangerous than the disease itself", writing that the number of deaths had been exaggerated.[29] His essays, containing a number of factual errors and misconceptions about the SARS-CoV-2 virus, circulated in conservative circles and in the Trump administration upon their publication.[30][31] In an article published on June 6, Epstein praised Republican-governed states like Florida for their crisis management, linking the then greater deaths in Democratic-governed states to their "interventionist policies".[32]

In 2006, the American scholar James W. Ely Jr. wrote: "It is a widely accepted premise that Professor Richard A. Epstein has exercised a pervasive influence on American legal thought." In early 2015, Epstein commented on his relationship to the modern American political landscape, stating: "I'm in this very strange position: I'm not a conservative when it comes to religious values and so forth, but I do believe, in effect, in a strong foreign policy and a relatively small domestic government, but that's not the same thing as saying I believe in no government at all."[42] He has also been characterized as a libertarian conservative.[43][44] During a debate with Chris Preble in December 2016, Epstein identified himself as being a "libertarian hawk".[45]

Epstein's wife, Eileen W. Epstein, is a fundraiser and educator who serves on the board of trustees for the philanthropic organization American Jewish World Service. They have three children: two sons, Benjamin M. and Elliot, and a daughter, Melissa. Epstein is a first cousin of the comedian and actor Paul Reiser.[46]

Libertarians seek to maximize autonomy and political freedom, and minimize the state's encroachment on and violations of individual liberties; emphasizing pluralism, cosmopolitanism, cooperation, civil and political rights, bodily autonomy, free association, free trade, freedom of expression, freedom of choice, freedom of movement, individualism and voluntary association. Libertarians are often skeptical of or opposed to authority, state power, warfare, militarism and nationalism, but some libertarians diverge on the scope of their opposition to existing economic and political systems. Various schools of Libertarian thought offer a range of views regarding the legitimate functions of state and private power, often calling for the restriction or dissolution of coercive social institutions. Different categorizations have been used to distinguish various forms of Libertarianism. Scholars distinguish libertarian views on the nature of property and capital, usually along leftright or socialistcapitalist lines. Libertarians of various schools were influenced by liberal ideas.

Prohibition was repealed in 1933 when I was 21 years old, so was a teenager during most of Prohibition. Alcohol was readily available. Bootlegging was common. Any idea that alcohol prohibition was keeping people from drinking was absurd. There were speakeasies all over the place. But more than that. We had this spectacle of Al Capone, of the hijackings, of the gang wars...

Anybody with two eyes could see that this was a bad deal, that you were doing more harm than good. In addition, I became an economist. And as an economist, I came to recognize the importance of markets and of free choice and of consumer sovereignty and came to discover the harm that was done when you interfered with them. The laws against drugs were passed in 1914, but there was no very great enforcement of it.

Murray Bookchin (January 14, 1921 July 30, 2006) was an American social theorist, author, orator, historian, and political philosopher. A pioneer in the environmental movement, Bookchin formulated and developed the theory of social ecology and urban planning within anarchist, libertarian socialist, and ecological thought. He was the author of two dozen books covering topics in politics, philosophy, history, urban affairs, and social ecology. Among the most important were Our Synthetic Environment (1962), Post-Scarcity Anarchism (1971), The Ecology of Freedom (1982) and Urbanization Without Cities (1987). In the late 1990s, he became disenchanted with what he saw as an increasingly apolitical "lifestylism" of the contemporary anarchist movement, stopped referring to himself as an anarchist, and founded his own libertarian socialist ideology called "communalism", which seeks to reconcile and expand Marxist, syndicalist, and anarchist thought.

Private police in the United States are law enforcement bodies that are owned and or controlled by non-governmental entities such as security agencies or private corporations. There is a strong overlap between the work of police and security, given that they share the same goals, perform the same activities and cooperate with one another, and often the same individuals work in both fields simultaneously, with police moonlighting as security officers.[1] The overlap is even more pronounced when the police are private. Thus, it can be hard to draw a line between what is a private policeman and what is a public police officer. Private investigation is extensively used to investigate workplace crime.[2]

Perhaps the easiest distinction to draw between public and private police is by sponsorship (i.e. by government or by private entities).[3] Thus, private companies to whom police work is contracted out by the government would still be considered public police, since they are funded by government, and private security officers would be considered private police. There is also sometimes a distinction made between voluntary policing supported by the state and vigilante forms of policing that do not have the support of the state.[4]

Private security firms patrol industrial facilities, commercial establishments, office buildings, transportation facilities, recreational complexes, shopping districts, residential neighborhoods, military complexes, power plants, and prisons.[5]

Depending on one's definition of private police, it can include firms to which the government contracts out police work (e.g. the 19751977 Oro Valley, Arizona-Rural/Metro contract, the 1980 Reminderville, Ohio-Corporate Security contract, the 1976 Indian Springs, Florida-Guardsmark contract, and the 1976 Buffalo Creek, West Virginia-Guardsmark contract). Or, they can be officers who contract with various firms to patrol the area, as in the case of the San Francisco Patrol Specials, which at one time had arrest powers. Private police services are sometimes called "Subscription-Based Patrol."[6]

A specific type of private police is company police, such as the specialized railroad police. In some cases, private police are sworn in as government employees in order to ensure compliance with the law, as in the Kalamazoo, Michigan-Charles Services contract, which lasted 312 years. Private security firms in the U.S. employ more guards, patrol personnel and detectives than the U.S. federal, state and local governments combined, fulfilling many of the beat-patrol functions once thought central to the mission of public police. It has been argued that the private police market furnishes tangible evidence about what people want but are not receiving from public police.[7]

In Michigan some Security officers and store detectives have merchant police arrest powers and a limited peace officer status.[8]

In South Carolina, all Security Officers have the same authority and power as Sheriff Deputies.[9] Spring Valley HOA in Columbia, SC is a good example of this. Private Officers respond to calls for service, make arrests and use blue lights[10] and traffic radar. They are Law Enforcement under state law, case law and AG's opinion, and are authorized by the state to issue Uniform Traffic Tickets to violators.[11] Security Officers in some cases are also considered Police Officers.[12]

In Boston, Massachusetts, more than 100 housing projects and low-income apartment buildings are patrolled by private security. Almost all of the privately operated housing projects contract companies that employ Special Police Officers that are licensed through the City of Boston. These Special Police Officers are trained through a Boston Police approved academy and have full arrest powers while on property. Boston Special Officers also are given the authority to issue Civil Citations through BPD issued citation books.[13]

In Utah, if privately owned colleges or universities are certified by the commissioner of public safety, they are allowed to have a law enforcement agency with officers being granted the same law enforcement authority as any other public law enforcement agency (police department).[14]

In Arizona, privately owned colleges that offer bachelor's degrees, and have at least one dormitory, may employ a security police force. These officers have full police powers on the property of the University and must meet all certification and training requirements as established by the state. The law also indemnifies the state of any liability associated with 'acting or failing to act', and instead, places the financial responsibility on the respective college or university.[15]

In North Bend, Oregon, Pembina Pipeline, the Canadian fossil fuel company that owns the Jordan Cove Energy Project, is the sole source of funding for a unit of the police department, which has been trained to suppress protests.[16]

In Cass County, Minnesota, Enbridge, a Canadian owner of the Line 3 Pipeline has paid for thousands of hours of police patrol time and for equipment.[17]

By the late 1960s, the private security industry was growing at a recession-resistant rate of 10-15% annually. Estimates of the number of private guards, investigators, and so on ranged from 350,000 to 800,000.[18] From 1976 to 1981, there was a 20% increase in calls for police service. Demand existed for nonroutine services, such as police checks of vacationers' homes, escorts for merchants making bank deposits, extra patrols at business closing times, and so on. Around that same time, many police departments were facing budget freezes or cuts, and the number of police employees per 1,000 population dropped 10 percent between 1975 and 1985. Police adopted differential responses to requests for services, deprioritizing investigation of "cold" burglaries and larcenies. Private firms were employed to fill the gap.[19] Private police and their clients have compiled extensive records on certain crimes, such as department store pilferage.[20] By 1990, private police comprised three-quarters of all police officers in the United States.[21] It has been suggested that the private sector of policing in the future may increasingly assume the role of the public guardian of society, leaving public policing to a more narrow role that focuses on personal violence.[22]

There is evidence that private police can provide services more cheaply than public police. As of 2017, the cost of San Francisco's private patrol specials ranges from $5060/hour,[23] compared to $58/hour for an off-duty police officer.[24] In Reminderville, Corporate Security outbid the Summit County Sheriff Department's offer to charge the community $180,000 per year for 45-minute response time emergency response service by offering a $90,000 contract for twice as many patrol cars and a 6-minute response time.[25]

Another advantage that has been cited is that private police have a contractual responsibility to protect their customers.[26] In Warren v. District of Columbia, the court found that public police have no such responsibility.[27] Thus, they cannot be sued if they fail to respond to calls for help, for instance.

James F. Pastor addresses such disadvantages by analyzing a number of substantive legal and public policy issues which directly or indirectly relate to the provision of security services. These can be demonstrated by the logic of alternative or supplemental service providers. This is illustrated by the concept of "para-police." Para-police is another name for private police officers. Many public safety agencies use auxiliary police officers, who are part-time sworn police officers. Some also use reserve police officers, who are hired on an "as needed" basis, with limited police powers. These officers are typically called to duty for special details or events. In contrast to auxiliary and reserve officers, private policing is a relatively new and growing phenomenon.

There are several key distinctions between these options. Briefly, the distinctions relate to the level of police powers associated with the officer, the training levels required for each officer, the funding sources for the service provision, and the contractual and liability exposures related to each supplemental arrangement. Each alternative or supplemental service has its own strengths and weaknesses. The use of private police, however, has particular appeal because property or business owners can directly contract for public safety services, thereby providing welcome relief for municipal budgets. Finally, private police functions can be flexible, depending upon the financial, organizational, political, and situational circumstances of the client.[28]

Murray Rothbard notes, "police service is not 'free'; it is paid for by the taxpayer, and the taxpayer is very often the poor person himself. He may very well be paying more in taxes for police now than he would in fees to private, and far more efficient, police companies. Furthermore, the police companies would be tapping a mass market; with the economies of such a larger-scale market, police protection would undoubtedly be much cheaper."[29]

Patrick Tinsley also notes that some consumers might benefit from free police service:[30]

There are products for which the bother of charging money outweighs the prospects for profit; these products are thus offered free of charge to the individual user, more or less in affiliation with the sale of coadunate goods. Examples of this phenomenon abound: book matches are given away with and without the sale of tobacco products; bathrooms, whether in restaurants or department stores or gas stations, are often open to customers and the general public alike. Police protection could operate likewise.

Ultimately, some people see the potential for a "dual system" of policingone for the wealthy and one for the poorand others see the provision of private security as the primary protective resource in contemporary America.[31] Other issues that arise in private policing include those arising from searching private property, electronic eavesdropping, and private police access to public police records. Abuse of authority, false arrest, improper search and interrogation, and operating without a license have been cited as potential dangers.[32]

Introduction

Voluntaryism is the doctrine that relations among people should be by mutual consent, or not at all. It represents a means, an end, and an insight. Voluntaryism does not argue for the specific form that voluntary arrangements will take; only that force be abandoned so that individuals in society may flourish. As it is the means which determine the end, the goal of an all voluntary society must be sought voluntarily. People cannot be coerced into freedom. Hence, the use of the free market, education, persuasion, and non-violent resistance as the primary ways to change people's ideas about the State. The voluntaryist insight, that all tyranny and government are grounded upon popular acceptance, explains why voluntary means are sufficient to attain that end.

Violence is never a means to knowledge. As Isabel Paterson, explained in her book, The God of the Machine, "No edict of law can impart to an individual a faculty denied him by nature. A government order cannot mend a broken leg, but it can command the mutilation of a sound body. It cannot bestow intelligence, but it can forbid the use of intelligence." Or, as Baldy Harper used to put it, "You cannot shoot a truth!" The advocate of any form of invasive violence is in a logically precarious situation. Coercion does not convince, nor is it any kind of argument. William Godwin pointed out that force "is contrary to the nature of the intellect, which cannot but be improved by conviction and persuasion," and "if he who employs coercion against me could mold me to his purposes by argument, no doubt, he would.. He pretends to punish me because his argument is strong; but he really punishes me because he is weak." Violence contains none of the energies that enhance a civilized human society. At best, it is only capable of expanding the material existence of a few individuals, while narrowing the opportunities of most others.

People engage in voluntary exchanges because they anticipate improving their lot; the only individuals capable of judging the merits of an exchange are the parties to it. Voluntaryism follows naturally if no one does anything to stop it. The interplay of natural property and exchanges results in a free market price system, which conveys the necessary information needed to make intelligent economic decisions. Interventionism and collectivism make economic calculation impossible because they disrupt the free market price system. Even the smallest government intervention leads to problems which justify the call for more and more intervention. Also, "controlled" economies leave no room for new inventions, new ways of doing things, or for the "unforeseeable and unpredictable." Free market competition is a learning process which brings about results which no one can know in advance. There is no way to tell how much harm has been done and will continue to be done by political restrictions.

The voluntary principle assures us that while we may have the possibility of choosing the worst, we also have the possibility of choosing the best. It provides us the opportunity to make things better, though it doesn't guarantee results. While it dictates that we do not force our idea of "better" on someone else, it protects us from having someone else's idea of "better" imposed on us by force. The use of coercion to compel virtue eliminates its possibility, for to be moral, an act must be uncoerced. If a person is compelled to act in a certain way (or threatened with government sanctions), there is nothing virtuous about his or her behavior. Freedom of choice is a necessary ingredient for the achievement of virtue. Whenever there is a chance for the good life, the risk of a bad one must also be accepted.

Common sense and reason tell us that nothing can be right by legislative enactment if it is not already right by nature. Epictetus, the Stoic, urged men to defy tyrants in such a way as to cast doubt on the necessity of government itself. "If the government directed them to do something that their reason opposed, they were to defy the government. If it told them to do what their reason would have told them to do anyway, they did not need a government." Just as we do not require a State to dictate what is right or wrong in growing food, manufacturing textiles, or in steel-making, we do not need a government to dictate standards and procedures in any field of endeavor. "In spite of the legislature, the snow will fall when the sun is in Capricorn, and the flowers will bloom when it is in Cancer."

Although certain services and goods are necessary to our survival, it is not essential that they be provided by the government. Voluntaryists oppose the State because it uses coercive means. The means are the seeds which bud into flower and come into fruition. It is impossible to plant the seed of coercion and then reap the flower of voluntaryism. The coercionist always proposes to compel people to do some-thing, usually by passing laws or electing politicians to office. These laws and officials depend upon physical violence to enforce their wills. Voluntary means, such as non-violent resistance, for example, violate no one's rights. They only serve to nullify laws and politicians by ignoring them. Voluntaryism does not require of people that they violently overthrow their government, or use the electoral process to change it; merely that they shall cease to support their government, whereupon it will fall of its own dead weight. If one takes care of the means, the end will take care of itself.

It is a commonplace observation that the means one uses must be consistent with the goal one seeks. It is impossible to "wage a war for peace" or "fight politics by becoming political." Freedom and private property are total, indivisible concepts that are compromised wherever and whenever the State exists. Since all things are related to one another in our complicated social world, if one man's freedom or private property may be violated (regardless of the justification), then every man's freedom and property are insecure. The superior man can only be sure of his freedom if the inferior man is secure in his rights. We often forget that we can secure our liberty only by preserving it for the most despicable and obnoxious among us, lest we set precedents that can reach us.

It is a fact of human nature that the only person who can think with your brain is you. Neither can a person be compelled to do anything against his or her will, for each person is ultimately responsible for his or her own actions. Governments try to terrorize individuals into submitting to tyranny by grabbing their bodies as hostages and trying to destroy their spirits. This strategy is not successful against the person who harbors the Stoic attitude toward life, and who refuses to allow pain to disturb the equanimity of his or her mind, and the exercise of reason. A government might destroy one's body or property, but it cannot injure one's philosophy of life. - Furthermore, the voluntaryist rejects the use of political power because it can only be exercised by implicitly endorsing or using violence to accomplish one's ends. The power to do good to others is also the power to do them harm. Power to compel people, to control other people's lives, is what political power is all about. It violates all the basic principles of voluntaryism: might does not make right; the end never justifies the means; nor may one person coercively interfere in the life of another. Even the smallest amount of political power is dangerous. First, it reduces the capacity of at least some people to lead their own lives in their own way. Second, and more important from the voluntaryist point of view, is what it does to the person wielding the power: it corrupts that person's character.
